The Colorado Health Care Connections (CHCC) consortium is sponsored by and housed at the Colorado Hospital Association. The Project Coordinator is Steve Ward. The Colorado Hospital Association is a 501(c)(6) not-for-profit organization with a wholly owned subsidiary, the Colorado Center for the Advancement of Patient Safety, a 501(c)(3) not-for-profit organization. Colorado Hospital Association is a membership organization that represents over 80 hospitals in Colorado,. All nonprofit and public hospitals, except for selected federal hospitals, are members. Colorado Hospital Association was founded in 1921 and has been in existence eighty-six years, providing Colorado hospitals services related to advocacy, education, data, communications, and quality and patient safety.

CHCC is sharing the services of a FCC Pilot Program Associate Project Coordinator with a sister Pilot Program participant, the Rocky Mountain HealthNet (RMHN). No federal USAC funds will be used for this purpose. Program coordination staffing and activities will be carried out using internal CHC resources.

Program coordination will include the leadership, fund-raising, and implementation needed to develop healthcare applications enabled by the proposed network.

2. Identify all health care facilities included in the network. See attached Addendum A (spreadsheet which addresses items a. and b. below) with information on all health care facilities that were included on our 465 attachment posted on September 15, 2008. HCPs listed in Addendum A have indicated a strong interest in participating in the program but reserve the right for final commitment based on the results of the competitive bidding process and identification of true costs to be incurred both during the RHCPP and after. a. Provide address (including county), zip code, Rural Urban Commuting Area (RUCA) code (including primary and secondary), six-digit census tract, and phone number for each health care facility participating in the network. b. For each participating institution, indicate whether it is: i. Public or non-public; ii. Not-for-profit or for-profit; iii. An eligible health care provider or ineligible health-care provider with an explanation of why the health care facility is eligible under section 254 of the 1996 Act and the Commission’s rules or a description of the type of ineligible health care provider entity. 3. Network Narrative: In the first quarterly report following the completion of the competitive bidding process and the selection of vendors, the selected participant must submit an updated technical description of the communications network that it intends to implement, which takes into account the results its network design studies and negotiations with its vendors. This technical description should provide, where applicable: The competitive bidding process was initiated on September 15, 2008 with the posting of Form 465, 465 Attachment and RFP. Bid proposals were officially opened on October 15, 2008. A proposal evaluation meeting was held on October 22, 2008. CHCC followed documented Competitive Procurement Policies and Procedures. Committee members completed detailed, quantitative proposal evaluations keyed to the RFP evaluation criteria. CHCC selected the bid proposal submitted by Qwest Communications as it most nearly conformed to the specifications set forth in the RFP, will best serve the needs of CHCC and its members, and will provide the most cost-effective means for producing results defined in the RFP. CHCC and Qwest Communications completed negotiations and signed a contract on June 29, 2009. a. Brief description of the backbone network of the dedicated health care network, e.g., MPLS network,

carrier-provided VPN, a SONET ring;

The Colorado Health Care Connection (CHCC) is a carrier-provided VPN. CHCC has contracted with Qwest to provide a reliable, secure, managed broadband network (the Network) that links participating health care providers (HCPs) to one another with both Layer 2 and 3 transport including Asynchronous Transfer Mode (ATM) and Metropolitan Optical Ethernet (MOE). Qwest has subcontracted with major ILECs and CLECs in Colorado to provide ubiquitous transport statewide.

b. Explanation of how health care provider sites will connect to (or access) the network, including the access technologies/services and transmission speeds;

The Network provides Ethernet handoff to each participating HCP terminated on a Qwest-managed router (CPE) placed on the HCP customer premises. Transmission speed categories and transport (in parentheses) are 4.5/5.0 Mbps, 7.5 Mbps, 40 Mbps and 100 Mbps. Qwest and CHCC will jointly determine the IP addresses needed to meet CHCC’s business requirements and Qwest will provide the public IP addresses to be used by the HCPs for network address translation (NAT) and port address translation (PAT) services on individual HCP CPEs. If required by an HCP, Qwest will provide NAT and PAT services on that HCP’s CPE device to translate LAN RFC1918 IP addressing into pre-determined unique, publicly routable IP addresses. Qwest will address the Ethernet handoff with IP addresses determined by the HCP. Qwest will provide Dynamic Host Configuration Protocol (DHCP) services on the CPE if required by the HCP.

c. Explanation of how and where the network will connect to a national backbone such as NLR or Internet2;

The Network will obtain access to Internet2 at the Front Range GigaPoP (FRGP), a national research network node operated by the University Center for Atmospheric Research. CHCC will subscribe to Internet2 for this access.

d. Number of miles of fiber construction, and whether the fiber is buried or aerial;

Qwest will spend approximately $17M to build out more than 25 miles of new fiber construction to support this project. These builds will be from central offices to specific HCP sites, in particular those subscribing to 40 and 100 Mbps service.

e. Special systems or services for network management or maintenance (if applicable) and where such systems reside or are based.

CHCC has contracted with Qwest for a managed services solution. These services include: IP addressing and routing; 7 X 24 network monitoring; architectural support for private subnetworks emulating hub-and-spoke topologies; Quality of Service traffic management; a single gateway firewall between the Network and access to both the Internet and the FRGP; read-only SNMP and Sflow access to designated CPE routers; and, multicast capability. All systems reside or are based in Qwest facilities.

4. List of Connected Health Care Providers: Provide information below for all eligible and noneligible health care provider sites that, as of the close of the most recent reporting period, are connected to the network and operational. i. Identify source of financial support and anticipated revenues that is paying for costs not covered by the fund and by Pilot Program participants. ii. Identify the respective amounts and remaining time for such assistance. d. Explain how the selected participant’s minimum 15 percent contribution is helping to achieve both the selected participant’s identified goals and objectives and the overarching goals of the Pilot Program. 7. Identify any technical or non-technical requirements or procedures necessary for ineligible entities to connect to the participant’s network. Non-eligible and for-profit entities will pay their full share of network costs, including non recurring costs (NRC) and monthly recurring costs (MRC).

If non-eligible entities join the network, they will be invoiced separately for each service item for their fair share of the network costs without USAC subsidy. These invoices will be provided directly to the non-eligible participant. USAC will receive invoice documentation that reflects eligible rural health care providers only.

8. Provide an update on the project management plan, detailing: a.The project’s current leadership and management structure and any changes to the management structure since the last data report; and The CHCC consortium project is managed by Steve Ward, the Project Coordinator. The Associate Project Coordinator is Debby Farreau. b. In the first quarterly report, the selected applicant should provide a detailed project plan and schedule. The schedule must provide a list of key project deliverables or tasks, and their anticipated completion dates. Among the deliverables, participants must indicate the dates when each health care provider site is expected to be connected to the network and operational. Subsequent quarterly reports should identify which project deliverables, scheduled for the previous quarter, were met, and which were not met. In the event a project deliverable is not achieved, or the work and deliverables deviate from the work plan, the selected participant must provide an explanation. CHCC will follow the prescribed process in the FCC Orders. Namely, we will obtain Letters of Agency from each of our participants, complete and file Form 465, select a service provider, file Form 466, obtain funding authorization, file Form 467 as services contracts are established, file the quarterly reports required by Order 07-198, maintain all audit records as required and cooperate with all audit requests.

Initial Target Schedule missed some of the original targeted dates the Target Schedule has been updated to reflect new target dates. CHCC posted Form 465, 465 Attachment, and RFP on September 15, 2008. Allowable contract date: October 13, 2008. Form 466-A and signed contract was posted June 30, 2009. Target dates have been updated to reflect the actual posting date of the Form 465, 465 Attachment, the RFP and Form 466-A. Updated target schedule is an estimate only based on current knowledge of time required to complete tasks.

We will fully complete network build-out within the 5-year period required by Order 07-198.

9. Provide detail on whether network is or will become self sustaining. Selected participants should provide an explanation of how network is self sustaining. a. Status of obtaining minimum fifteen percent match for the project:

CHCC has approximately 129 health care providers (HPCs) signed-up to participate in its network, 125 as eligible for USAC support, and 4 as non-eligible. The sign-up period is scheduled to complete in November 2009 (see Data Item 8 - Target Schedule). Of the 125 eligible participants, each will pay at a minimum 15 percent of its contracted rate for the service. In the aggregate, the 125 eligible HCPs are paying 40% of total costs, 30% of non-recurring costs, and 40% of monthly recurring costs. HCPs have committed to a 36-month term of service.

b. Projected sustainability period:

CHCC projects a 10 year sustainability period.

c. Principal factors that were considered by the participant to demonstrate

sustainability: 1. We have decided to keep the rates for our eligible members steady once the

RCHPP support is expended. Thus, as cited above, eligible members will continue to pay approximately 40% of monthly recurring costs. The remaining 60% will be the responsibility of CHCC and will be raised as described below.

2. We have determined how much revenue will be needed to pay the monthly recurring operating expense of the network once the USAC subsidy is expended—$147,362 per month commencing at 27 months from initial network deployment.

3. We have decided to pursue a business services model rather than a subscription fee model to cover these costs. That is, revenue from the delivery of business services over the network will be used to cover the cost of operating the network. We do not anticipate charging HCPs a membership fee to cover these management costs, while, however, we do reserve this option.

4. Sources of revenue under consideration include: VPN access to the CHCC network for private practice physicians (12,505 licensed in Colorado); dedicated access to health insurance providers; and marketing agreements with health care information technology product vendors.

d. Terms of membership in the network:

CHCC membership is open to all health care service providers, including: physicians; clinics; hospitals; applications service providers that support our institutions with electronic medical records, server space, medical record exchange, billing and similar services; health insurance companies; educational institutions providing CME; etc.

• Agreements. Each Participating Health Care Provider (PHCP) signs a Participating

HCP Agreement with Qwest which binds them to the terms and conditions of CHCC’s Master Contract with Qwest and specifies the terms and conditions of membership as a PHCP. The form of the PHCP Agreement is cited by the Master Contract and included therein as an exhibit.

• Financial and/or time commitments. The Master Contract contains the pricing information for all PHCPs as an exhibit, plus the procedures for making final modifications to this pricing before service begins. By signing the PCHP Agreement,

the PHCP agrees to the final pricing, detailed as total, match, and USAC support for both non-recurring and monthly recurring charges. No time commitments or in-kind contributions are asked of the PHCPs.

• Financing of excess bandwidth for growth. Since our Master Contract with Qwest is for leased, managed services, we are free to add additional user bandwidth on demand without the need to finance this in advance. The network consumes exactly the amount of bandwidth subscribed.

• Membership fees for non-eligible health care providers/Fair Share. Non-eligible HPPs pay 100% of the network service rates including non-recurring costs, recurring costs and construction costs. New members beyond the initial eligible RHCPP participating HCPs, whether they are eligible or non-eligible HCPs, will also pay 100% of the service rates. The service rates and procedures for modifying them are established in CHCC’s Master Contract with Qwest. These are flat rates based on bandwidth (that is, they are “postalized” or location-independent, such that all members using a given bandwidth pay the same rates. (Data Item 3 of this report lists the bandwidth categories.)

e. Excess capacity:

CHCC has no excess capacity at the network level. All capacity is managed, leased services. The capacity of these services is driven by HCP subscription with Qwest, our telecommunications service provider, under the terms of our Master Contract with Qwest. The Acceptable Use Policy for the network requires that all capacity leased under the master contract be used to support the primary and ancillary mission of the HCP (consistent with the guidance of the RCHPP order, Para. 76). Non-health care delivery use of the CHCC network is not permitted. Un-related business revenue from use of the CHCC network is not permitted. Incidental use of the network is permitted if it is integral with the HCP’s health care delivery system, its providers and its users, and would be difficult for the HPC to quantify or segregate.

f. Ownership structure:

CHCC owns no assets and operates as a facilitator and aggregator of telecommunications services for its HCP members. CHCC enjoys the full organizational support of its founding organization, the Colorado Hospital Association (CHA) and subsidiary 501(c)(3), the Colorado Center for the Advancement of Patient Safety (CCAPS). The project director is Steve Ward, FACHE, Vice President for Rural Health and Hospitals, Colorado Hospital Association. CCAPS is doing business as CHCC, thus providing 501(c)(3) corporate entity status.

g. Sources of future support:

• Internal. CHCC will, by month 27 of operations, generate $147,362 per month to

replace existing USAC support (see item ‘c’ above). • Private. CHCC has received a $399,500 12-month grant from the Colorado Health

Foundation to defray administrative expenses through June 2010. • Federal. CHCC submitted an application to the first round of the NTIA BTOP

Sustainable Broadband Adoption program. The BTOP application requested support to add video and voice services to the CTN and provide quality improvement coaching services for our HCPs in how to effectively use communications and information technology to employ clinical guidelines for continuous process improvement.

• Assumption of Continued RHC Funding. CHCC strongly advocates that the RHC subsidy mechanism be continued in the future; either in its original form, or, preferably, in a revised form resulting from the successful experiments of the RHCPP.

h. Management costs:

We estimate management costs to be approximately $35,000 per month. These costs are currently covered by the Colorado Hospital Foundation grant. These costs include: part-time support of the Project Coordinator, full-time support of the Associate Project Coordinator, and support for contracted technical and legal services. CHCC will include these management costs in its overall sustainability plan revenue goal.

10. Provide detail on how the supported network has advanced telemedicine benefits: No Health Care Providers are connected; therefore this is not applicable at this time. a. Explain how the supported network has achieved the goals and objectives outlined in selected participant’s Pilot Program application; b. Explain how the supported network has brought the benefits of innovative telehealth and, in particular, telemedicine services to those areas of the country where the need for those benefits is most acute; c. Explain how the supported network has allowed patients access to critically needed medical specialists in a variety of practices without leaving their homes or communities; d. Explain how the supported network has allowed health care providers access to government research institutions, and/or academic, public, and private health care institutions that are repositories of medical expertise and information; e. Explain how the supported network has allowed health care professional to monitor critically ill patients at multiple locations around the clock, provide access to advanced applications in continuing education and research, and/or enhanced the health care community’s ability to provide a rapid and coordinated response in the event of a national crisis.

11. Provide detail on how the supported network has complied with HHS health IT initiatives: No Health Care Providers are connected; therefore this is not applicable at this time. a. Explain how the supported network has used health IT systems and products that meet interoperability standards recognized by the HHS Secretary; b. Explain how the supported network has used health IT products certified by the Certification Commission for Healthcare Information Technology; c. Explain how the supported network has supported the Nationwide Health Information Network (NHIN) architecture by coordinating activities with organizations performing NHIN trial implementations; d. Explain how the supported network has used resources available at HHS’s Agency for Healthcare Research and Quality (AHRQ) National Resource Center for Health Information Technology; e. Explain how the selected participant has educated themselves concerning the Pandemic and All Hazards Preparedness Act and coordinated with the HHS Assistant Secretary for Public Response as a resource for telehealth inventory and for the implementation of other preparedness and response initiatives; and f. Explain how the supported network has used resources available through HHS’s Centers for Disease Control and Prevention (CDC) Public Health Information Network (PHIN) to facilitate interoperability with public health and emergency organizations. 12. Explain how the selected participants coordinated in the use of their health care networks with the Department of Health and Human Services (HHS) and, in particular, with its Centers for Disease Control and Prevention (CDC) in instances of national, regional, or local public health emergencies (e.g., pandemics, bioterrorism).
