June 2013 </p><p>"Seniority Date" referred to in this agreement shall mean the first day hired into a regu( position and adjusted to include hours worked prior to achieving regular status. June 2013 </p><p>"Employees" as used in this Agreement shall mean all employees employed in those classifications listed in Schedules "A", "S" and "C" ofthis Agreement. </p><p>"Employee Status" </p><p>Regular Full-Time Employee </p><p>A regular full-time employee is one who works regularly scheduled full-time shifts. Any employee who accumulates 70 or more hours in a two week pay period shall be considered a regular full-time employee. These employees accumulate seniority and are entitled to all benefits outlined in this Agreement. </p><p>Regular Part-Time </p><p>A regular part-time employee is one who works regularly scheduled shifts but does not work the scheduled hours of a full-time employee. These employees accumulate seniority and are entitled to all benefits outlined in the Agreement, except as otherwise stated herein. </p><p>Casual Employees </p><p>Casual employees shall mean any employee hired on an intermittent basis. </p><p>Temporarv Employees </p><p>( </p><p>Revised 2013 </p><p>Temporary employees shall mean any employee employees hired on an intermittent basis. They are hired only for positions temporarily vacant (replacing an employee on leave) or temporarily existing (for specific projects). Revised 2013 </p><p>Student Employees </p><p>Student Employees shall mean employees hired for a specific period of time not to exceed five (5) consecutive months between April 15th and September 15th. It is understood that student employees shall mean those who are continuing their education at a post secondary institution. They shall not accumulate seniority or be entitled to any benefits or posting privileges and will be paid the negotiated Student Rate. No regular employee will suffer a reduction of their hours or lay-off as a result of work performed by students. The Union will agree to the number of students to be hired prior to March 15th of each year. The number of students will be negotiated in a fair and reasonable manner. Revised 2013 </p><p>~~~---------------------------( Collective Agreement 1 between City of Nelson and CUPE Local 339 </p><p>January 1, 2013 - December 31, 2015 </p></li><li><p>"Day" shall mean a 24 hour consecutive period, normally beginning at 12.01 a.m. and shall mean a calendar day unless otherwise specified in the Agreement. </p><p>"Week" shall mean the regular working week constituting forty (40) hours, eight (8) hours per day, or thirty-five (35) hours, seven (7) hours per day. </p><p>"Work Week" in this Agreement shall mean a regular work week from Sunday to Saturday for purposes of calculating payment of wages under this Collective Agreement. March 1999 </p><p>"Month" shall mean a period of thirty (30) or thirty-one (31) days except the month of February which shall be twenty-eight (28) days or twenty-nine (29) days each leap year. </p><p>"Year" shall mean a period of twelve (12) months from one given date to another. </p><p>"Lay-off' shall be defined as a reduction in the work force or a reduction in the regular hours of work of an employee as defined in this agreement. March 1996 </p><p>"Probationary period" Employees will be considered probationary for a period of five hundred (500) working hours. June 2013 </p><p>"Qualifying period" Employees are considered to be in the qualifying period for the first sixty (60) calendar days when posting into a new position. June 2013 </p><p>"Catastrophic Illness" shall mean an acute or prolonged illness usually considered to be life threatening or with the threat of serious residual disability. June 2013 </p><p>Collective Agreement between City of Nelson and CUPE Local 339 </p><p>January 1, 2013 - December 31, 2015 </p><p>2 </p></li><li><p>ARTICLE 1 - RECOGNITION OF THE UNION </p><p>Section 1 - Sole Bargaining Agency . </p><p>1.01 The City recognizes the Union as the sole bargaining agency on behalf of the employees (. whom the Union has been certified as bargaining agent with respect to any and all matters affecting the relationship between the Parties to this Agreement, looking forward to a peaceful and amicable settlement of any difference that may arise between them. </p><p>Section 2 - Union Security </p><p>1.02 Employees who are brought within the jurisdiction of the Union's Certificate of Bargaining Authority, including newly hired employees, shall become members of the Union within thirty (30) days of the start of employment. Each employee shall, as a condition of continued employment, be a member in good standing in the Union according to the Constitution and By-laws of the Union. </p><p>Section 3 - No Discrimination or Harassment </p><p>1.03 The City and the Union jointly affirm that every employee in the City's service shall be entitled to a respectful workplace. The environment must be free of discrimination and harassment. </p><p>The principle of fair treatment is a fundamental one and both the City and the Union do not and will not condone any improper behaviour on the part of any person which would r jeopardize an employee's dignity and well-being and/or undermine work relationships an~' productivity. </p><p>Through this Collective Agreement, the parties agree that there shall be no discrimination based on: </p><p>Race Physical o...</p></li></ul>
