Iwas hoping that by the time this issue of the Code 3 cameout, we would have some progress on the FRS lawsuit.

Specifically, the 3% of our salaries, that the Republicans (andour Governor) “forced down our throats.” We’ll continue tomonitor what our legislators have in store for us this year withmore pension changes. Will they listen to the special interestgroups, TAB or the Tea Party? We will keep you informed.

Likely, at this point, most of us have seen the results of theelection in Ohio on Tuesday, November 8th. Democrats andunions are ecstatic over the repeal of the Ohio law curbing col-lective bargaining protections. Watch out Republicans andGovernor Scott. 2012 is an election year and police, firefightersand teachers are not going to forget this election or how wewere treated in the past. Stay tuned. If the legislators weresmart, they would concentrate on redistricting and leave thepensions alone.

In addition, chalk one up for the good guys. The PBA wasvictorious recently in a lawsuit against the State, when the StateLegislators and Governor Scott attempted to privatize 19 stateprisons. Even a blind person could see exactly how that dealwent down: It was payback to the contributors in the 2010election and an effort to punish the PBA for not supportingthem and their agenda.

I want to congratulate the civilian unit at the Palm BeachSheriff’s Office for ratifying its first contract. The electedRepresentatives did a great job communicating to the membersthe proposed contract. Keep up the good work. Also, many ofour cities, towns and counties have reached agreements withthe PBA in order to settle a lot of our contract disputes. Goodjob to all our Representatives.

Ann “Annie” TartaglioneAugust 6, 1957 – September 3, 2011

In Memory of CaptainDaniel Sargent

Captain Daniel Patrick Sargent, 50, lost his battle with ALSon Saturday, November 5, 2011. He grew up in West PalmBeach and graduated from Forest Hill High School. He went onto Florida State University, where he became a die-hardSeminole fan. After graduation, he was hired by The City ofWest Palm Beach Police Department. He earned the ranks ofSergeant, Lieutenant, and retired as a Captain. Throughout his27 years with the department, he was assigned to several tacti-cal units, road patrol and Special Investigations. He obtained acommercial helicopter pilot license and was part of the aviationunit. His proudest accomplishment was being the ExecutiveOfficer/Team Commander of the SWAT team. He is a graduateof the Southern Police Institute at the University of Louisvilleand the F.B.I. National Academy.

Although ALS took his arms, legs, speech and finally theability to breathe, it did not take his spirit, courage or sense ofhumor. He fought this battle until the end. We will love and misshim forever. We would like to thank everyone who came togeth-er to form “Team Sargent.”

Officer of the Month - January 2011MCSO Lt. Ken Pickering and D/S David ClendeninNominated by: MCSO D/S William Weiss

While working uniform patrol, Martin Co. Lt. KenPickering and Deputy David Clendenin heard an armed bankrobbery call. As a couple on a crime spree were leaving thebank, a customer was able to note the license plate and vehi-cle description. A high speed chase ensued as the suspectsapproached Lt. Pickering’s position, police deployed stopsticks hitting the vehicle’s tires. The vehicle crashed into Lt.Pickering’s vehicle. The male suspect raised a handgun andpointed it towards the officers. Both Lt. Pickering and DeputyClendenin pulled their firearms and fired at the male suspect.The suspects were involved in at least seven (7) bank rob-beries across the United States and considered themselves amodern day “Bonnie & Clyde.” Thanks to the quick reactionsof both Lt. Pickering and Deputy Clendenin their crimesprees were put to an end.

Officer of the Month - February 2011WPB Sgt. Matt Bessette and Boynton Officer Scott SpruillNominated by: WPB Ofc. Terry Golden and Boynton BeachLt. Kelly Harris

On February 22, 2011, there was an incident on the I-95overpass of Okeechobee Boulevard. West Palm Beach Ser-geant Bessette arrived on the scene with off-duty OfficerSpruill. Officer Spruill advised that a female at the scene wasangry with her parents because they had ruined her life andwanted them to tell them good-bye. Sgt. Bessette and OfficerSpruill established a dialogue with the female and slowlymoved towards her as she prepared to jump from the guard-rail over I-95. “Attempting to introduce himself” to thefemale, Sgt. Bessette grabbed hold of her hand while OfficerSpruill grabbed her from the other side and removed her from

the guard-rail. She was transported to Columbia Hospital.Both Sgt. Bessette and Officer Spruill acted beyond the call ofduty and saved this young girl’s life.

On March 4, 2011, Martin County Sheriff ’s OfficeDetective Janice Waltersdorf was assigned in a case in whichan armed masked man entered a victim’s house and threat-ened the victims (a mother and daughter) that if they failedto comply with his demands, he’d kill them. While on thescene, Det. Waltersdorf obtained information from the vic-tims such that she was able to cultivate a suspect and followup on leads. In the morning hours of March 5, 2011, the sus-pect was located by Det. Waltersdorf, and then an arrest wasmade. The interview by Det. Waltersdorf of the suspect’s girl-friend yielded incriminating evidence against the suspect.Due to the direct efforts of Det. Waltersdorf, the suspect iscurrently in Martin County jail facing a life sentence.

Officer of the Month - April 2011Boynton Officer Connor Haugh and PBSO D/S MichaelMustoNominated by: Boynton Officer Brian Goldfuss

On March 29, 2011, officers responded to the area of 500West Gateway Boulevard in reference to a PBSO Deputy beingdragged by a motorcycle. Deputy Musto was attempting tostop a motorcycle on the off-ramp of Northbound I-95 atGateway Boulevard when the driver grabbed onto the motor-cycle and dragged D/S Musto from the south side of the inter-section to the north side where he was thrown off and almosthit by westbound traffic. D/S Musto was taken to BethesdaHospital for treatment of scrapes. Officer Haugh, who wasoff-duty, advised that he had located a motorcycle matchingthe description given out. Both Boynton Beach and PBSOunits arrived and located the suspect inside of a business. Thesuspect was arrested with D/S Musto’s clothing and helmetlocated at the suspect’s work station.

On March 1, 2011, Deputy Timothy Garcia responded toa domestic disturbance as backup. Although D/S Garcia couldnot see the suspect inside the window, he realized the suspectwas detaining the victim inside the residence’s bedroom andwas able to initiate dialogue with the suspect. As the suspectbecame enraged, he punched the glass of the window, shatter-ing it. D/S Garcia was able to pull the vertical blinds out of thewindow and create an opening to see inside the residence.Seeing the victim lying on the floor, D/S Garcia was able todeploy his DFSG through the window and neutralize the sus-pect, thereby allowing the victim to escape. D/S Garcia’s quickand effective decision making successfully ended this violenthostage situation.

Officer of the Month - June 2011Delray TFO Mark LucasNominated by: Delray Lt. John Palermo

In June, 2009, TFO Mark Lucas initiated an investigationof a member of the Spanish Cobras involving an individualselling multi-ounce quantities of Heroine in Palm BeachCounty. TFO Lucas worked with the Columbian NationalPolice and DEA Agents stationed in Columbia as he contin-ued the investigation. In November 2010, TFO Lucas wroteand executed five (5) Federal Search and Arrest Warrants andcoordinate the execution of these warrants with the DelrayBeach Police and West Palm Beach Police Department SwatTeams. From June 2009 through January 2011, twenty-four(24) Federal Indictments were issued, over three (3) kilo-grams of Heroine has been seized, cocaine, crack, thirteen

(13) handguns and an Uzi firearm were all seized as a resultof TFO Lucas’ excellent work.

Officer of the Month - July 2011MCSO Sgt. Doug Pierce, Det. Todd Schimelfanick, D/S William Weiss and Sgt. Dan FooteNominated by: Palm Beach County PBA

On July 13, 2011, Martin County Sheriff’s Deputies weredispatched to a bank robbery at the Seacoast National Bankin Hobe Sound. The suspect handed the teller a note sayinghe had a gun and wanted cash. Within minutes deputies con-verged on the area creating a narrow perimeter. The bankteller was able to give dispatch a brief description of the get-away vehicle. Although Sgt. Pierce attempted to initiate atraffic stop, the suspect refused and pursuit ensued.Ultimately, Det. Schimelfanick and D/S William Weiss wereable to pursue with Sgt. Pierce who was directly behind thesuspect. Sgt. Pierce pulled to the side of the suspect and con-ducted a pit maneuver disabling the suspect’s car. Within sec-onds the suspect was immobilized. All the deputies are to becommended for their excellent work in the pursuit, takedown, and arrest of this bank robber.

Throughout your careers, there are certain “immovable”time deadlines that simply must be met. Deadlines apply

to dates by which, for example, a promotional exam must begiven/taken, dates when supplemental reports must be submit-ted, dates by which Grievances (pursuant to our CollectiveBargaining Agreement) must be submitted, etc. Missing a dead-line by even one (1) day can forever change the course of yourcareers, your rank, your reputations, your pay checks and ourcollective ability to protect your rights.

Therefore, as members, it is crucial to get paperwork for-warded to us the same day it is received (or within a reasonableamount of time thereafter) by you and to let us know immedi-ately if you even suspect that you may have a bona-fideGrievance under your particular Collective BargainingAgreement. Remember: Each Collective BargainingAgreement’s Grievance Procedure contains time deadlines ateach Step of the Grievance Process. Some of these deadlines weneed to address at our office, but your abilities to comply withthe 1st Step in the process goes a long way.

Next, all “disciplinary notices” you may receive, i.e., datesby which Pre-disciplinary Hearings must be scheduled, paper-work received that requires you to elect between either aCareer Service Board or Arbitration on a disciplinary issue, oran Internal Affairs notice that you are the subject of an investi-gation and so on, must be expeditiously sent to us so that wemay timely preserve your rights. For years, we’ve heard thesame types of responses regarding lagging or absent paper-work:

“I wasn’t really worried about it so I just held on to it.”or“It’s something I just handled/can handle myself.”“Holding on to it” is a sure-fire way to potentially make an

issue a worry, which we may have been able to timely addressto alleviate that worry for you down the road.

A part of your on-going routines should now incorporateinto them the task of going to your mailboxes and, if a docu-ment is contained therein with a deadline, a due date, a deci-

sion and so on, from your agency (or other agency concerningyour law enforcement/corrections status) call / fax / e-mail usin your very next motion. It needs to become habit. As soon asyou know – we need to know.

Treat the dates on all of the paperwork you receive as“drop”-deadlines.

School District Police NewsHello to all. We have started the negotiations for the

new contract along with all the other happenings within ourDepartment.

NEW TOURS: 4 to 12 shift, 12 to 8 shift. Somethingthis Dept. was neither set up for or ready for, but here weare in the middle of it. Hopefully, by the time this article isprinted, the powers to be will meet and rectify this problemfor the safety of all.

Equipment has been promised, but has yet to be deliv-ered. It is extremely important that equipment be issued to thenight officers to help them do a professional job—these offi-cers have taken on a task as road officers and not school based.

As you all are aware, the 2012 budget is in the books.Let’s look back for a second—we have no raises in countlessyears. Any extra monies handed out have been in the form ofa stipend. So now let’s look at what has been changed. We areworking more and more overtime. We are spending less andless time with our families and more and more money on con-sumer products. Special units have been dissolved or reducedto a point that they are really not functioning. Health insur-ance is increasing again, paying into your retirement lessmonies than are being paid by the district into your pension.

This School District has enjoyed a wonderful quality oflife with the School District Police as their primary protec-tor. However, we cannot maintain our level of service towhich these people have become accustomed because oflack of funding by the District. With every cut, we get clos-er and closer to the difficulties of not protecting the stu-dents. No one can predict when crime will happen and whowill decide which school is more important to cover. Thetime is coming that no matter how much overtime youwork, there just won’t be enough hours in the day.

School District Police NewsNegotiations: The PBA and the School District are cur-

rently in negotiations for the entire Collective BargainingAgreement. We are attempting to rewrite the whole contractline by line. We are reviewing every article, adding moreprotection for our members and deleting obsolete ones. Weremain optimistic and hope to see major changes in thisnew contract. Wish us luck...

Grievances: As you are aware, the Night Shift has beenpatrolling the Bell Glade Area since its inception. Therefore,the argument was that these officers and sergeants should beentitled to the Bell Glade Supplement. After numerousrequests for the supplement went unanswered, your PBAReps were forced to file a grievance against the Departmentin reference to this issue. Eight days later, the PBA was noti-fied that the Department had a change of mind and thegrievance (Glades Supplement) was GRANTED with retroto all. Currently, all the Night Shift Officers and Sergeantsare receiving the supplement.

General Information: Welcome aboard to the newhires—hope your stay here is a pleasant one. Goodbye toour old friend David Rosenthal. Keep your chin up. Youwere an excellent cop and a good friend. You will alwayshave friends in this Department.

Palm Beach Shores NewsI am pleased to announce that contract negotiations

have ended with a positive outcome. As of October 1st,2011, we entered into a new contract that rectified a fiveyear pay disparity/salary compression issue affecting six (6)officers. Our negotiations with the Town went smoothly andboth sides came away from the table feeling good about theprocess.

I would like to thank the Town of Palm Beach Shores andtheir officials for understanding the needs of their officersand approving the increases necessary to bring our salaries inline with other agencies within Palm Beach County.

In a climate where cities and counties are taking awaymore than they are giving, the bargaining unit would like toacknowledge the Town’s cooperation and generosity duringthis crucial negotiation.

West Palm Beach NewsAs a PBA Rep, I am constantly hearing complaints

regarding how police officers may have been treated unfair-ly. Mostly it comes from citizens’ complaints at which timewe assist the officers to make sure that they are treated fair-ly and correctly. Lately, and more consistently, I have beenhearing complaints coming not from citizens, but fromsome of our own. Yes, you heard it right. For whatever rea-son, I am hearing from various police officers throughoutthe county about how they are being treated by FloridaHighway Patrol Officers. Now don’t get me wrong, if apolice officer is breaking a law then he / she should be treat-ed like everyone else. What I have an issue with are FHPofficers who are constantly pulling over fellow police offi-cers for minor traffic violations and offering no profession-al courtesy.

Just the other day, one of my officers approached meand stated that his fiancée had been pulled over by FHPTrooper Clifford Jones. Upon informing Trooper Jones thather fiancée was a West Palm Beach Police Officer, he notonly wrote her for unlawful speed and no proof of insur-ance, but also gave a written warning for having a PBAbadge covering a portion of her tag. I’m sorry, but are youtelling me that you cannot offer a fiancée of a fellow policeofficer a break on a lousy speeding ticket and no proof ofinsurance and then give her a hard time for having a PBAbadge on their tag? Some will say that I am wrong in thistype of thinking, but I can bet, more often than not, almostevery police officer out there would agree with me. Whatmakes this whole situation even worse is that 30 minutesafter finding out his fiancée had received the tickets, dis-patch informed him and his partner that “FHP was request-ing backup in reference to a traffic stop in our city.” But,although he was upset over the tickets, he did the rightthing. He backed up the FHP Trooper and did his job!

Unfortunately, if this Trooper doesn’t have the trainingor the knowledge to find “criminals,” then I invite him tocome out and ride with my unit. As a police officer of over22 years, I have never (nor will I ever) write a fellow officeror their family members a minor traffic ticket. It is a basicprofessional courtesy to the men and women who risk theirlives on a daily basis to keep us safe. West Palm Beach NewsThree Year West Palm Beach

Contract RatifiedAfter lengthy negotiations, we finally ratified a three

year Contract. Although we are finally getting the Step Planreinstated, some severe concessions were made. Giving theCity two years of Chapter 185 money was a tough pill toswallow, but it did preserve the majority of compensablebenefits including longevity, holiday pay and incentivemonies.

Several senior members were resistant to the Agree-ment, citing the basic concern of “what’s in it for me?” Afterexplaining to the membership that this move would pre-serve their current benefits, all but a small handful of mem-bers realized that this was the best deal we could achieveand voted “yes” for the contract. I would like to thank allthe Reps who worked on this contract and all the memberswho took the time to attend the meeting and listen to thefacts in order to make an informed decision on what wasbest for everyone. For the members who voted uninformedand without attending the meeting, let’s just say I’m gladyou are very few. I’m hoping that by October 1, 2014 we areeconomically and politically in a better position to recoupsome of the concessions that have been made over the pastthree years. I expect that the very few “no” voters will worktogether with us for the next couple of years to ensure weare in a better position politically, even though that’s goingto mean attending meetings and participating in politicalactivities.Submitted by: Louis Penque, WPBPBA

Driving safely is a primary concern to everyone. But, infew areas is it more important than in the law enforce-

ment community.Most accidents are preventable. It is normally just about

using a little extra caution and paying a little extra attention.But when you’re in the middle of a hot call, your adrena-

line is pumping, and it is absolutely critical that you get thereto back up your fellow LEO’s. Your lights are flashing, yoursiren is on—why aren’t people paying attention? You mightthink that this is the most likely scenario for the majority ofdepartmental crashes.

Guess again. According to data from PBSO, the #1 causefor crashes from January-June 2011 is backing. Backing intoanything: other vehicles, mailboxes, dumpsters, buildings,etc.—although it may seem a bit preposterous, backing intosomething that is likely large and noticeable. But remember, itwas the #1 cause for PBSO vehicle crashes for the first sixmonths of 2011.

How can this type of accident be prevented? One way is toalways be aware of your surroundings. Objects that are notquite as obvious are those that are closer to the ground, such asa low pipe, or curb. Get a 180° view of every angle from yourvehicle. Those buildings/vehicles/mailboxes will show upsomewhere. Use your mirrors. That extra second you take to dothat might make the difference.

Regardless of how care-ful we might be, crashesmay still occur. But mostaccidents are avoidable, andby taking just a few precau-tions, we can reduce thoseodds substantially.

The holidays are a time of celebration, love and family. But,along with your loved ones, there are frequently some

uninvited and very unwelcome guests. There ARE ways to keepyour stress level at a minimum. And, while yours might not bethat “Rockwellian Christmas” in the movies, you CAN comethrough it all relatively unscathed.

1. Acknowledge your feelings. If, for some reason, you can’tbe with loved ones, realize that it’s normal to feel sadnessand loneliness. It’s OK to take time to cry or express yourfeelings. You can’t force yourself to be happy just becauseit’s the holiday season.

2. Be realistic. The holidays don’t have to be perfect or justlike last year. As families change and grow, traditions andrituals often change as well. Be open to creating new ones.

3. Set aside differences. Try to accept family members andfriends as they are, even if they don’t live up to all of yourexpectations. Set aside grievances until a more appropriatetime for discussion. Be understanding! Remember, othersare probably feeling the effects of holiday stress, too.

4. Stick to a budget. Before you go gift and food shopping,decide how much money you can afford to spend. Thenstick to your budget. Don’t try to buy happiness with anavalanche of gifts.

5. Plan ahead. Set aside specific days for shopping, baking,

visiting friends and other activities. Plan your menus, makeyour shopping list and stick to it.

6. Learn to say no. Saying “yes” when you should say “no”can leave you feeling resentful and overwhelmed. Friendsand colleagues will (should!) understand if you can’t par-ticipate in every project or activity.

7. Don’t abandon healthy habits. Don’t let the holidaysbecome a free-for-all. Overindulgence only adds to yourstress and guilt. Have a healthy snack before holiday partiesso that you don’t go overboard on sweets, cheese or drinks.

8. Take a breather. Make some time for yourself. You’d besurprised. Spending just 15 minutes alone, without distrac-tions, may refresh you enough to handle everything youneed to do. Find something that reduces stress by clearingyour mind.

9. Seek professional help if you need it. Despite your bestefforts, you may find yourself feeling persistently sad oranxious, plagued by physical complaints, unable to sleep,irritable and hopeless, and unable to face routine chores. Ifthese feelings last for a while, talk to your doctor or contactyour agency’s Employee Assistance Program (EAP).

Remember that the pressure for perfection likely comesfrom YOU! So, relax and enjoy yourself. It’s your Christmas too!

While reading a public “Sound Off” section in ournewspaper, my wife and I came across the complaint

below from “Del.” After responding to this poster, we actuallyhad someone (Leo) show appreciation for all that we do! I thinkthis speaks for itself:

Del Says: ((July 12th, 2011 at 12:23 pm) I see more police cars at the stores with off-duty officers

shopping. Of course, this is a perk that tax pays for. I am sorryguys, use your own cars while off-duty, gas, repairs, insurance,etc. isn’t cheap.

This is not the 1st time I’ve seen these comments here. Ijust love when people are so bold in this column when they’reanonymous!

First off, I am the WIFE of a Deputy sounding off here! Myhusband PAYS for gas in his patrol car! There IS an automaticdeduction for gas from his paycheck for off-duty travel. By theway, we ALSO pay ADDITIONAL auto insurance privately, tocover his off-duty use!

In case you still don’t see why the need to use the cars off-duty, let me remind you of how many times he has been some-where on his day off and it was lucky for the public and storeowners that he WAS there because he was needed at thatmoment! Do you know how many times he was off-duty and hehad to pull over because he saw an accident just occur, peoplewith a flat tire, or broken down in a dangerous area? Just thinkif he wasn’t there in his patrol car, or if that was YOUR familymember. Remember, he’s not getting paid for this when he’s off-duty, but because he has the car, he is able to help people.

How many times have you been enjoying your dinner orjust gone to sleep and someone rings the bell because their dadis beating up their mom, or their small child is missing becauseGrandma took him for a walk without telling the parents, or aneighbor needs advice about an accident or ticket? This HAS

happened to us many times because of the patrol car in ourdriveway OFF-DUTY!

We also have been told by neighbors that they feel muchbetter knowing that the car is there, as I’m sure many of youhave in your area too.

So when you’re OFF-duty, do you still work 24/7 as myhusband does? Are you home every holiday and weekend toenjoy with your family? My husband isn’t! Every day I wonderif it’s the last kiss goodbye I gave him! So sleep tight and don’tworry, he IS paying for the gas!!

When most of us enter the career of law enforcement,we do so with the intent of completing a 20 plus year

career and retiring to spend quality time with our family. Thatbeing said, most of us pledge our loyalty to our agency andcareer to get us through the “long haul” to retirement.

Some, however, have a different set of standards. Somehave only their personnel goals in mind no matter who theyadversely affect. These persons will sacrifice anything to reachtheir own personal goals, leaving their employees and familyfloundering and at a major loss. Their loyalty is only to them-selves, and their boss.

In law enforcement, we are held to a higher standard thanother professions. This applies to ALL. You cannot earn the loy-alty of your subordinates or your superiors by superficial“cheap shots” at those who are trying to improve conditionswithin an agency. If you have to gain favor that way, you arelost.

If you are a CEO of an organization, the employees shouldbe the number one priority, not your boss and self-servinggoals. Loyalty is a two way street and I will end this article witha well known quote from General George Patton. I was intro-duced to this quote by a co-worker. I would implore you toprint and post this quote in obvious places or attach it to youre-mails as a constant reminder to ALL.

“There’s a great deal of talk about loyalty from the bottomto the top. Loyalty from the top down is even more necessaryand is much less prevalent. One of the most frequently notedcharacteristics of great men who have remained great is loyaltyto their subordinates.” ~ General George S. Patton, Jr.
