In reply to your letter of June 2© regarding the above captioned matter, the location is contrary to existing orders of the Coaaission adopted by the Coaaission sitting in ita quasi judicial capacity. Any location contrary to existing orders ean only be authorized by a proceeding before the Com­mission sitting in its judicial capacity. Jfou should there­fore file your court application before the Commission. When the Commission considers your application, i t may call a hearing upon same, naming the date, place and purpose of such hearing.

The waivers of which you &<>eak Ki l l materially help the Commission in arriving at its decision. The waivers, however, should be introduced in evidence at the hearing. A copy of them, however, should be attached as exhibits to your court application.

The waivers will be held pending your instructions to return them to you; or, i f you prefer, you aay leave them in the files of this matter and introduce theis into evidence at the tine of the hearing. It is assumed that you have retained copies thereof in ease you wish to attach them as exhibits in your court application*

Dear Mr. Livingston:

Mr. W. C. Davis of the Land Department of Shell O i l Company has referred to us the above matter f o r handling, and i n the f i l e we f i n d your l e t t e r to Shell f o r the at t e n t i o n of Mr. Davis, dated July 6, 1939. There are a number of questions which we should l i k e to ask you re­garding t h i s s i t u a t i o n and there i s certain material which we should l i k e t o secure.

In the f i r s t instance, we are f a m i l i a r w i t h the fact that the courts of your State do not permit non-resident attorneys to practice except i n isolated cases and then, apparently, at the di s c r e t i o n of the p a r t i c u l a r court. Your reference to the Conservation Commission s i t t i n g as a court causes us to wonder about the poli c y of the Commission w i t h reference to non-resident attorneys p r a c t i c i n g before i t . Shell w i l l expect us to handle t h i s matter before the Commission and we are wondering whether i t w i l l be necessary that we associate ourselves w i t h a New Mexico attorney.

I f the Conservation Commission issues copies of i t s rules and regulations and ex i s t i n g orders w i t h reference to spacing, we would appreciate being furnished w i t h a copy of such rules and regulations; i f there i s no publication of these matters we should l i k e t o have copies of the ex i s t i n g spacing order a f f e c t i n g the area where the above location i s requested. We understand from your l e t t e r that the Commission w i l l s i t as a court upon t h i s application, and we wonder i f i t s procedure i s exactly l i k e that of one of your d i s t r i c t courts since the statutes applicable to the Conservation Commission do not f u l l y reveal t o us everything we should l i k e t o know about the procedure before the Commission s i t t i n g i n i t s j u d i c i a l capacity.
