Both lawsuits were filed by the Paper, Allied Industrial, Chemical & Energy Workers International trade union (PACE), which originally notified its intention to take legal action at the beginning of this year. (See ‘Focus on Pigments’, Feb 2002, 5). In respect of the Sunray plant in Moore county (Texas), the case was filed on 21 Jun. PACE claims that Continental Carbon failed to obtain a hazardous waste permit, accepted hazardous waste material without the necessary authorisations, failed to make hazardous waste determinations, failed to investigate releases of hazardous wastes, failed to maintain and report the required records and failed to follow shipping requirements. In particular, the company is alleged to have failed to treat carbon black oil as a hazardous material. The company is also charged with failing to monitor the disposal and removal of sludge from the Sunray site, with the result that local aquifers and water-wells may be contaminated. In respect of the Ponca City plant in Kay county (Western Oklahoma), the case was filed on 23 Jul and the list of charges is similar to the Texas case. Moreover, the PACE union is fighting for the cause of 85 workers who have been “locked out” of the Ponca City site since May 2001 for failing to ratify new wages and employment terms proposed by Continental Carbon. On 31 May 2002, PACE filed a formal complaint of “unfair labour practices” with the Fort Worth regional office of the National Labor Relations Board (NLRB). The hearings of all these cases should be completed before the end of this year. In the meantime, the Sunray and Ponca City plants have continued to operate more or less as normal and there has been no interruption to deliveries of carbon black. However, according to PACE, Goodyear has ceased taking carbon black from Continental Carbon under pressure from its own workforce. Goodyear normally buys 37,500 stons/y of carbon black from Continental Carbon. The patent granted in 1902 to Meister Lucius & Bruning (one of the predecessor companies of Hoechst AG) referred to “a process for making a mono-azo colorant from o-chloro-m-toluidine-p- sulfonic acid and beta-naphthol that is particularly suited for the manufacturing of color lakes.” Hoechst (and its predecessors and successors) have been making Pigment Red 53:1 ever since. The Pigments & Additives Division of Clariant took over the manufacture of Pigment Red 53:1 as part of the acquisition of Hoechst’s pigments and masterbatch businesses in mid-1997. Subsequently, it closed the manufacturing unit at Frankfurt- Hoechst and transferred production to its new plant at Tianjin (China). Clariant states that world production of Pigment Red 53:1 is nowadays of the order of “several thousand tonnes annually” and further states that Clariant is the world’s largest producer. For the past 50 years, this pigment has been responsible for the distinctive red colour splashed throughout the popular tabloid newspaper “Bild.” The pigment is also widely used in the plastics industry. Although the pigment has a long history, research on it has not yet been exhausted. The arrangement of the molecules in the pigment, for example, has still not been identified. Moreover, there is still room for further development. Last year, Clariant was granted three patents for an orange- coloured variant of the basic Pigment Red 53:1. In addition to commercial products which have been successful for a long time, such as Graphtol Red LC and LG for plastics, or Permanent Lake Red LCLL and LCY for printing inks, Clariant recently introduced a new product – Permanent Lake Red LCYT – which was especially developed for package printing and gives many products a shiny look.
