By unanimous vote of the members present, the following City Ordinance was enacted on
third and final reading:

AN ORDINANCE REGULATING THE SALE OR RENTAL OFCOMPUTER GAMES AND SOFTWARE, ESPECIALLY THOSE OF
EXPLICITLY AND OVERTLY VIOLENT NATURE AND THE LIKE,TO MINORS BY COMPUTER SHOPS, COMPUTER SALES AND
RENTAL HOUSES, COMPUTER CAFES AND ALL RELATEDBUSINESSES WITHIN THE CITY OF MAKATI, AND PROVIDING A
PENALTY FOR VIOLATION THEREOF.

WHEREAS, it has been noted that despite the campaign of National and LocalGovernment Offices, Non-Governmental Organizations and Media outfits against the
distribution and rentals of explicitly and overtly violent computer games and software tominors, especially elementary and high school students, these services continue to be
operated by owners of computer sales, rental and other related businesses;
WHEREAS, majority of their patrons who are minors avail of these computer games
thereby contributing to their delinquency;
NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED BY THE
CITY COUNCIL OF MAKATI, BY VIRTUE OF THE POWERS VESTED IN IT
BY LAW, IN SESSION ASSEMBLED, THAT:
SECTION I. The owners, proprietors and operators of computer sales, rentals and other
related businesses are hereby prohibited from selling or renting out computer games andsoftware, especially those of explicitly and overtly violent nature and the like, to minors.
SECTION 2. Exempted from the provision of Section 1 are computer rentals for
purposes of school-related works, researches, assignments, projects and the like.
SECTION 3. Owners, proprietors and operators of computer sales, rentals and otherrelated businesses found in violation of this Ordinance shall be subjected to the following
penalties:
First Offense - Php3,000.00Second Offense - Php4,000.00
Third Offense - Php5,000.00
These penalties shall be applied without prejudice to the cancellation of the offending
partys business permit at the discretion of the City Mayor.
SECTION 4.
ERNESTO S. MERCADO
This Ordinance shall take effect fifteen (15) days after publication in a
newspaper of local circulation.
