CITY OF SURREY BYLAW N0.1876o A Bylaw to authorize the Termination of Land Use Contract Number 493· WHEREAS on the 5th day of January 1979, this City entered into a Land Use Contract with Barrow Holdings Ltd., Bathurst Holdings Ltd., Browning Holdings Ltd., Baron Holdings Ltd., Harman Investments Ltd., Elgon Investments Ltd., and Nkokonjeru Developments Ltd., for the use and development of the lands therein described; AND WHEREAS the Council deems it expedient that the rights and obligations created and to be performed under the said Land Use Contract should terminate and be no longer of force or effect; AND WHEREAS Section 548.2 and 464.1 (c) of the Local Government Act, R.S.B.C. 2015, c.1 provides that a Land Use Contract may only be terminated by bylaw and only after a Public Hearing. NOW, THEREFORE, the Council of the City of Surrey enacts as follows: 1. BYLAW N0.1876o

A Bylaw to authorize the Termination of Land Use Contract Number 493·

WHEREAS on the 5th day of January 1979, this City entered into a Land Use Contract with Barrow

Holdings Ltd., Bathurst Holdings Ltd., Browning Holdings Ltd., Baron Holdings Ltd., Harman

Investments Ltd., Elgon Investments Ltd., and Nkokonjeru Developments Ltd., for the use and

development of the lands therein described;

AND WHEREAS the Council deems it expedient that the rights and obligations created and to be

performed under the said Land Use Contract should terminate and be no longer of force or effect;

AND WHEREAS Section 548.2 and 464.1 (c) of the Local Government Act, R.S.B.C. 2015, c.1

terminated.

2. THAT the Mayor and City Clerk are hereby authorized to sign and affix the seal of the

Corporation to such instrument as will effectually extinguish all rights and obligations

created by the Land Use Contract and will release and terminate the Land Use Contract

from the records of title to aforesaid lands in the New Westminster Land Title Office.

3· This Bylaw shall come into effect one year after the date of final adoption.

4· This Bylaw may be cited for all purposes as "Surrey Land Use Contract No. 493,

Termination Bylaw, 2016, No. 1876o"

PUBLIC HEARING HELD thereon on the nth day of July, 2016.
