May 16, 2017- 6:15 P.M.

The Regular meeting of the Utilities Commission of the City of Rialto was held in the Civic Center Council Chambers located at 150 S. Palm Avenue, Rialto, California 92376, on Tuesday, May 16, 2017.

This meeting was in accordance with the provision of the Government Code §54956 of the State of California.

CALL TO ORDER Vice-Chairperson Hayes called the meeting to order at 6:20 P.M.

ROLL CALL The roll was called by the Commission Clerk, Dayan Malfavon. Present: Vice-Chairperson June Hayes Commissioner Richard “Kim” Chitwood Commissioner Kevin C. Kobbe Commissioner James M. Shields Student commissioner Alex L. Rowe Absent: Chairperson Barbara Zrelak-Rickman City staff present: Tom Crowley, Katie Nickel, Susanne Wilcox, and Dayan Malfavon. Also present: Rolf Ohlemutz, Clarence Mansell, Aaron Kraft, and Chandrasekar Venkatraman (CV), Lynn Merrill, David Terry, Robert Lee, Alejandro Juarez, Bob Tincher.

APPROVAL OF MINUTES – Regular Meeting April 18, 2017

Vice-Chairperson Hayes provided a brief description of the history of Student Commissioners and introduced Student Commissioner Alex L. Row.

Student Commissioner Row introduced himself to the Commission.

Commissioner Kobbe moved to approve the minutes of the Regular Meeting of April 18, 2017.

Commissioner Shields seconded the motion.

Motion carried.

VOTE: 4 to 0 in favor of approval of the minutes as written.

ORAL COMMUNICATIONS Vice-Chairperson Hayes asked if there were any oral communications from the audience of items not on the agenda. There was none.

Item 1- Request the Rialto Utility Commission to conduct a Public Hearing on the Public Health Goals (PHG) pursuant to the Calderon-Sher Drinking Water Act of 1996. (ACTION)

Vice-Chairperson Hayes formally opened the Public Hearing on the Public Health Goals (PHG) for public comment.

Crowley reviewed the staff report.

Vice-Chairperson Hayes asked if there were any violations.

Commissioner Shields made a motion to close the Public Hearing.

Commissioner Kobbe seconded.

Motion carried.

VOTE: 4-0 in favor.

Item 2- Receive the 2016 Consumer Confidence Report. (RECEIVE AND FILE)

Tom Crowley reviewed the 2016 Consumer Confidence Report.

Clarence Mansell informed the Commission the report will be presented to Council first, then posted.

Commissioner Chitwood commented he enjoys receiving the Consumer Confidence Report.

Mansell reminded the Commission that the Consumer Confidence Report will not be mailed to residents unless requested.

The Commission received and accepted the report.

Item 3- Waste Management Report (RECEIVE AND FILE- NO ACTION)

Katie Nickel briefly presented the monthly Waste Management Report.

Nickel provided the Commission with a spreadsheet of financial information for water and wastewater revenues and expenditures.

Nickel informed the Commission an update to the report will be presented quarterly.

Commissioner Chitwood inquired about the exact location of the community garden at Bub Bender Park.

Vice-Chairperson Hayes informed the Commission that during the monthly Burrtec meeting, there was a discussion of Rialto schools not having recycling bins and commented that there was consideration of the City purchasing recycling bins and training teachers and janitors.

Vice-Chairperson Hayes stated she did not agree with the proposal that the City should pay for the receptacles and asked to have a report presented at the next meeting.

The Commission received and accepted the reports.

Item 4- Proposed Street Sweeping Parking Enforcement Program (ACTION)

Lynn Merrill introduced himself to the Commission and presented a PowerPoint presentation on the Proposed Street Sweeping Parking Enforcement Program.

Commissioner Chitwood commented that the previous street sweeping parking enforcement program did not alleviate residents parking on street sweeping days and suggested cars be towed if there is record of previous citation.

Vice-Chairperson Hayes asked Merrill to explain why alternate-side street sweeping will not be proposed throughout all of Rialto.

Vice-Chairperson Hayes asked if Data Ticket would be the citation-processing service used.

Vice-Chairperson Hayes commented that Data Ticket only allows 21 days to appeal a ticket and stated that it is not enough days to appeal a citation.

Vice-Chairperson Hayes recommended that money collected from fines be used on pavement maintenance.

Commissioner Chitwood made a motion to recommend the Proposed Street Sweeping Parking Enforcement Program to Council, and that money collected from fines be used on pavement maintenance.

Commissioner Kobbe seconded.

Motion carried.

VOTE: 4 to 0 in favor of the recommendation.

Item 5- Recommend the City Council/Rialto Utility Authority Approve the Final Construction Work Authorization for $2,178,270.51 to Rialto Water Services for the Water Facility Improvement Project W6 - City Wells 1 & 2 Improvements; (ACTION)

Crowley briefly reviewed the staff report for the Final Construction Work Authorization (FCWA) for the Water Facility Improvement Project W6 - City Wells 1 & 2 Improvements.

CV provided a description of the project to the Commission.

Commissioner Shields made a motion to recommend the approval of the Final Construction Work Authorization for $2,178,270.51 to Rialto Water Services for the Water Facility Improvement Project W6 - City Wells 1 & 2 Improvements.

Commissioner Chitwood seconded the motion

Motion carried.

VOTE: 4 to 0 in favor of the recommendation.

Item 6- Recommend the Purchase of 2,000 Acre Feet of State Water Project Water, at the Rate of $118.40 per Acre Foot, in the Amount of $236,800 for Recharge of the San Bernardino Basin Area. (ACTION)

Crowley briefly reviewed the staff report and introduced Bob Tincher with San Bernardino Valley Municipal Water District.

Tincher introduced himself to the Commission and reviewed a PowerPoint presentation on the status of the state water project availability.

Tincher provided answers to questions from the Commission in regard to the following:

Vice-Chairperson Hayes asked what the safe yield is.

Commissioner Chitwood asked how much 2,000 acres will recharge the San Bernardino Basin Area.

Vice-Chairperson Hayes asked what an acre-foot is in relation to water.

A discussion ensued regarding the amount of water staff requested to purchase.

Commissioner Chitwood made a motion to recommend approval of the purchase of 2,000 acre-feet of State Water Project Water.

Commissioner Kobbe seconded the motion.

Motion carried.

VOTE: 4 to 0 in favor of the recommendation.

Item 7- Monthly Santa Ana Watershed Project Authority (SAWPA) Grant Update (RECEIVE AND FILE)

Susanne Wilcox presented the Monthly Santa Ana Watershed Project Authority (SAWPA) Grant Update.

Vice-Chairperson Hayes asked Wilcox to explain what the SAWPA grant is for the new Student Commissioner.

The Commission received and accepted the report.

Item 8- Veolia Operations and Maintenance Report (RECEIVE AND FILE)

Crowley reviewed the Veolia Operations and Maintenance Reports.

Robert Lee presented the Customer Service report and introduced Nancy Jackson, the new Customer Service Supervisor.

Jackson introduced herself to the Commission and provided a brief summary of her professional background.

Crowley provided answers and updates to the Commission in regard to the following:

Commissioner Chitwood inquired about the fluctuations on Fats, Oils, and Grease (FOG) collection.

Vice-Chairperson Hayes asked for an update on the Advanced Metering Infrastructure (AMI) and Advanced Metering Analytics (AMA) meters.

Vice-Chairperson Hayes inquired about any grants available to replace old meters to smart meters.

Commissioner Kobbe asked if residents are aware that the new meters are 60% efficient and proceeded to suggest that customers be informed.

Clarence Mansell provided answers to the Commission in regard to the following:

Vice-Chairperson Hayes asked what causes wastewater backups when performing maintenance on the sewer mainline.

Commissioner Chitwood asked who covers the cost of repairs and clean up to private property after a backup caused by maintenance of the main sewer line.

Commissioner Kobbe asked if staff notate a backup at the address for future reference.

Concerning the wastewater back up that occurred on April 11, 2017, Vice-Chairperson Hayes asked if the resident was satisfied with Rialto Water Services’ efforts to correct the issue.

Vice-Chairperson Hayes asked if the open positions have been filled.

Vice-Chairperson Hayes inquired about the valve exercise program and asked when the program will restart.

David Terry provided a copy of Senate Bill No. 555 to the Commission and gave a brief summary of the bill.

Commissioner Shields asked if there has been any progress to resolving the emergency switch issue at the wastewater treatment plant.

A discussion ensued regarding the progress made to resolve the automatic switchgear.

The Commission received and accepted the reports

Vice-Chairperson Hayes provided an update to the Commission regarding the consolidation of water and wastewater resolutions and recommended arranging a workshop between the Utilities Commission and Council to review and discuss the final consolidated resolution.

Commissioner’s Report Vice-Chairperson Hayes provided a brief summary of a discussion held at the Association of Clean Water Administrators (ACWA) she attended, where other water agencies were sharing their intend to develop methods of helping low income families, disabled, and senior citizens with billing rates.

Minutes for the meeting of May 16, 2017 were tabled until the next regular meeting.

ORAL COMMUNICATIONS Chairperson Zrelak-Rickman asked if there were any oral communications from the audience of items not on the agenda.

Dennis Barton spoke to the Commission concerning a notice he received from Burrtec informing him that trash and recycling services will be added to the annual property tax bill.

Barton asked the Commission what the thought process was behind adding the trash and recycling services to the property taxes.

Chairperson Zrelak-Rickman stated the Commission did not see any disadvantages with rolling the charges onto the property taxes and informed Barton the proposition was determined to be more cost-effective and environmentally responsible.

Barton informed the Commission he will opt out of the tax roll off, and expressed he would have preferred that the letter he received would have been clearer.

Chairperson Zrelak-Rickman thanked Barton for addressing the Commission.

Item 1- Monthly Activity Report for City of Rialto Waste Management Services (RECEIVE AND FILE)

Amy Crow presented the monthly Waste Management Report.

Crow reviewed the tonnage, special collection, and scavenger reports.

Crow provided a brief update to the Commission in regards to the Southern California Edison (SCE) street light acquisition and informed the Commission that Siemen’s will start verifying the pole inventory.

Crow provided answers to questions from the Commission concerning the following topics:

Chairperson Zrelak-Rickman asked who would be performing the maintenance of the streetlights once acquired.

Commissioner Chitwood asked if there is another way of reporting streetlights to SCE as opposed to the SCE mobile app,

Crow informed the Commission that not all streetlights will be acquired from SCE.

A discussion ensued regarding the types of poles that will still belong to SCE.

The Commission received and accepted the report.

Item 2- Monthly Santa Ana Watershed Project Authority (SAWPA) Grant Update (RECEIVE AND FILE)

Susanne Wilcox presented the Monthly Santa Ana Watershed Project Authority (SAWPA) Grant Update.

Chairperson Zrelak-Rickman inquired about other agencies considering budget based rates.

The Commission received and accepted the report.

Item 3- Utilities Commissioner Assignments (ACTION)

Tom Crowley informed the Commission that Vice-Chairperson Hayes will no longer be available to serve as an alternate to Chairperson Zrelak-Rickman in the event she is unable to attend the monthly City of Rialto Waste Management Oversight meeting.

Commissioner Shields volunteered to serve as an alternate to Chairperson Zrelak-Rickman.

Commissioner Chitwood made a motion to appoint Commissioner Shields as an alternate.

Commissioner Kobbe seconded.

Motion carried.

VOTE: 4 to 0 in favor of the recommendation.

Crowley presented the Veolia Operations and Maintenance Report.

Aaron Kraft introduced Rich Perna, Veolia’s new Wastewater Project Manager.

Perna introduced himself to the Commission and spoke about upcoming tasks and capital projects.

Crowley provided a current update to the WA- Water Meter Replacement Project.

Crowley provided a current update to the S1- Wastewater Treatment Plant Upgrade Project.

Crowley provided an update on the emergency switchgear at the wastewater treatment plant.

Crowley informed the Commission there is proposal to implement a cogeneration project and provided a brief summary of what cogeneration is.

Crowley provided answers to questions from the Commission in regard to the following:

Chairperson Zrelak-Rickman inquired about how often the City receives a payment from the County for trash liens.

Chairperson Zrelak-Rickman inquired about the number of USA Dig Alert markings performed and asked if they were new markings.

Chairperson Zrelak-Rickman inquired about the rags that were pulled out of the sewer lateral at 330 W Foothill and asked if the rags came from the resident or the main line.

A discussion ensued concerning the property owner’s responsibility in regard to the sewer lateral.

The Commission received and accepted the report.

BACKGROUND:The City of Rialto Municipal Code Chapter 2.24 establishes and defines the Rialto UtilitiesCommission. The responsibilities assigned to the Commission include acting “as an advisor to theCity Council and City Administration regarding solid waste policies, recycling, source reduction, andother related state mandates.” This report provides general information to the Commission on theactivities and events for the Public Works Department’s Waste Management Division.

BACKGROUND:Pursuant to Article VI “Wastewater Facility Improvements and Capital Projects” of the ConcessionAgreement (CA), certain priority capital projects were identified by the CA for implementation byRWS. Some of these projects relate to specific capital improvement projects associated with thewastewater system, including Project S1 - Wastewater Treatment Plant Improvements.

The Wastewater Treatment Plant (WWTP) was constructed in 1955. The WWTP was expanded inlater years; however it is now in need of repairs and upgrades in order to continue to provide reliableservice to the community and customers.

There are five plants that make up the overall WWTP; Plant 1 is currently abandoned and Plants 2, 3,4 and 5 are in operation.

ANALYSIS/DISCUSSION:Based on studies conducted by AECOM and W.M. Lyles, a total of five options were evaluated foroverall value, and impacts on capital and operational costs.

The five options were referred to as Options: 1A, 1B, 1C, 2A and 2B.

· Options 1A, 1B and 1C focused on the rehabilitation of existing plants 2, 3 and 4 with norepairs/upgrades to Plant 5.

· Options 2A and 2B focus on upgrades to plants 2, 3, 4 and 5, with greatest focus on the mostrecently installed Plant 5, the most modern and the largest of the treatment plants.

It was determined that upgrades are needed for existing Plant 5 which was not addressed by Options1A, 1B and 1C. So ultimately, Option 2B was selected which proposed upgrades to portions ofPlants 3 and 4, abandoning plant 2 and constructing a new aeration basin, due to anticipated benefitsgained and in comparison of costs.

Over the last several weeks, the project team consisting of participants from the City/Rialto UtilityAuthority, Rialto Water Services (RWS), West Yost, Veolia, AECOM and WM Lyles have beenworking hard to finalize a project description that would be documented in the Task 3 TechnicalMemorandum, Basis of Design Report (BODR).

Since the decision was made in September 2016 Council meeting to proceed with Option 2B, thefollowing design milestones have been met:

· Over 10 progress conference calls and review sessions completed to update team and trackdesign progress,

· Four full-day sessions with City/Rialto Utility Authority (RUA), Rialto Water Services, Veolia,AECOM, W.M. Lyles and West Yost to review design and progress updates,

· All day plant visits to Palmdale and Lancaster wastewater treatment facilities to observe diskfilters in operation and get feedback from plant operators and engineering team,

· Multiple conference calls with staff from neighboring cities and treatment plants to incorporatebest industry practices and provide value engineering input to the project, and

· Electrical shutdowns and inspections underway to evaluate additional value engineering inputfor electrical design of Option 2B.

There are some key differences between projects in the specific scope of work planned which staffbelieves will result in a more efficient and better operating WWTP. Specifically, there are differencesbetween the Original Option 2B and Updated Option 2B in the following categories of work:

· Electrical & Controls Rehabilitation,

· Filter Upgrade portion of the project, and

· Re-using Secondary Clarifiers of Plants 3 & 4.

The currently designed Updated Option 2B addresses plant capacity requirements and alsoaddresses the urgent electrical and instrumentation/controls needs in Plant 5 in the most costeffective manner. This design has been rigorously vetted during multiple review sessions by theCity/RUA, its consultants, RWS/Veolia and AECOM/W.M. Lyles.

It should be noted that the added cost of the updated project remains well below the cost torehabilitate the existing plant to achieve the same result.

As staff continues to work with the project team to bring the S1 Wastewater Treatment PlantImprovements project to completion, the next steps planned are:

· Applicable comments, concerns or recommendations will be incorporated into the basis ofdesign report.

· Request City of Rialto Water Subcommittee to affirm project direction and recommend it bepresented to the Utilities Commission and the City Council thereafter.

· Staff will be proceeding with Task 4 for the updated 2B design. Task 4 will conclude with a50% design package and a guaranteed maximum price.

FINANCIAL IMPACT:The area of most concern is the cost of the project and the sources of funding for the neededimprovements. The current costs estimates are as follows:

RECOMMENDATION:Staff recommends that the Rialto Utilities Commission receive and file the update on the S1 Project -Wastewater Treatment Plant Improvements.

Electrical & Controls Rehabilitation:

Option 2B included a percentage of construction to estimate electrical. This percentage considered re‐using existing electrical equipment, wiring and controls for plant 3, 4, and 5

Field evaluations have revealed that there are multiple weaknesses in the electrical systems of plants 3, 4 and 5, such as grounding problems, obsolescence of equipment, wear and tear of equipment, and lack of technical support and spare parts for critical components of equipment

Further, there are multiple stand‐alone control systems for plants 3, 4, and 5, which do not mutually communicate

Updated Option 2B includes an initial contractor’s estimate for electrical and controls, which results in a higher level of cost outlay to rehabilitate existing electrical equipment, provide all new plant controls and integrate the plant into SCADA system for remote monitoring and control.

Option 2B added 3 new disk filters, and considered modest renovation of the existing deep bed gravity filters

The updated Option 2B project includes four new disk filters with a 6 mgd capacity, to provide firm filtration capacity of 18 mgd

There was very high uncertainty regarding the repair costs for the gravity filter with estimates ranging from $0.5M to over $1M. Hence, it was decided to eliminate the unknown cost potential impact to the project 

The disk filters have a better operational performance, and lower operational costs than the current gravity and DynaSand filters. The working of these filters was observed during all‐day site visit to Palmdale and Lancaster WWTP facilities

Option 2B considered repurposing existing secondary clarifiers of plants 3 and 4 to serve as new primary clarifiers for Option 2B

During engineering and design development, hydraulic limitations and increased costs related to aging underground piping were identified

Hence, the updated Option 2B project includes construction of a new primary clarifier in lieu of repurposing the existing clarifiers. The new clarifier nominally increases construction costs while significantly improving reliability and lowering O&M costs

The currently designed updated option 2B addresses plant capacity requirements and also addresses urgent electrical and instrumentation/controls needs in Plant 5 in the most cost effective manner. This design has been rigorously vetted during multiple review sessions by the City, its consultants, Veolia and AECOM/W.M. Lyles

The added cost remains well below the cost to rehabilitate the existing plant to achieve the same result

Staff recommends proceeding with Task 4 for the updated 2B design. Task 4 will conclude with a 50% design package and a guaranteed maximum price

Staff is seeking funding in the amount of $28,279,605 in order to proceed with the project as described in the BODR.

Collection System OverviewCompliance Statement: In June the Wastewater Collections Systems remained 100% compliant with the requirements specified in regulatory permits.

1. A total of 70,191 ft. of sanitary sewer lines were cleaned in June. The cleaning schedule for the reporting period can be drivenby “Hot Spot” or problem areas where previous issues have been observed and documented. “Hot Spot” cleaning accounted forapproximately 10,171 ft. of the total cleaned. 2. The target for calendar year 2017, is to complete 25 miles of CCTV inspections. A total of 1.63 miles were inspected in June2017. A total of 15 miles has been inspected for 2017.3. There were zero manhole inspections completed for the month of June. 4. Veolia performed 92 USA Dig Alert markings this month.

Customer Service LogThere were six (6) citizen complaints/sewer call-outs this month and zero (0) sanitary sewer overflow.

Treatment Plant Overview

Compliance Statement: In June the Rialto Wastewater Plant remained 100% compliant with the discharge requirements specified in Order No. R-8-2014-0010, NPDES No. CA-105295

The weather was dry and warm again this month. With the warmer weather problems continued with supplying enough oxygen to the Plants #2 and #3 aeration systems. Two blowers ran above 95% output on moderately warm days. This indicates there will be a severe problem supplying enough air when the hotter summer days arrive. Plant staff has been researching corrective measures that can be taken to keep the plant in compliance with the NPDES Permit ammonia-nitrogen and TIN limits when the hotter weather arrives. Those measures include but are not limited to: repairing the deteriorated underground air supply line or replacing it with an above ground line; overhauling or replacing the worn and failing blowers; and, replacing the air diffusers and piping in the aeration tanks. Contractors are preparing quotes so that a project budget can be developed by July 28th. Flows to Plants #2, 3 & 4 are being moved to plant #5 to relieve stress as much as possible with out over stressing plant #5. On 05/30/17, flow was completley stopped to plant #4 so that it can be taken out of service for assessment to determine rehabilitation needs and costs.On June 16, 2017, Rialto Utility Commissioners Rickman, Sheilds, and Hayes were escorted by Tom Crowley, Utility Manager, to the wastewater treatment plant to review the status of the assessment work for Plant 2 air piping and Plant 4 aeroation piping and defusers.Biosolids production information for June was not available from Synagro at the time of this report. Biosolids production in May was 1,155.04 wet tons hauled.

Major Equipment and/or Machinery OutagesThe Ethernet cables arrived and will be installed in the first week of June. This job is now completed.

Multiple Field Logic Units (FLU) failures still occurring at the front end of the plant due to excessive heat. FLU failures are continuing to be addressed as an OR&R project. The Ethernet cables arrived and will be installed in the first week of June. Two have been completed and we are still waiting for fiber cable ends to complete the last seven. Plant 4 aeration basin has been taken out of service to facilitate repairs of the air system.Plant 5 Anoxic Mixer #5 was returned and will be installed the week of July 10th, 2017. Still waiting for the return of Mixer #1.

FOG Information (Fats, Oils & Grease)There were 161,751 gallons of FOG delivered this month. A total of 1,031,166 gallons has been received for 2017.

**TDS: High levels near or above the effluent limitation of 490 mg/l continue. The WWTP does not treat TDS. The high levels are from the water supplied to the City and contributions added by the community using the water. Veolia uses wells with low TDS and avoids imported water as much as possible. Other purveyors of water in the city are being asked to do the same.

Free Cyanide: The effluent Cyanide has been in compliance since contracting with IEUA in November 2016 to perform the test locally using a true Free Cyanide method approved by the EPA.

TIN: The plant continues to operate close to the limit and is at risk of violation. The problem will be resolved by FIP Project S1 . It will install new blowers, air piping, air diffusers, and a belt filter press flow management system that will help control the treatment of ammonia.

o Service level (calls answered within 30 seconds) has increased 3.1% to 66.1% for June 2017 compared to

previous month. (2016 service level average was 32%) o Number of calls decreased 3.9% from previous month, but service level did not improved due to billing system

outage for full one week. o 99 calls were abandoned by the caller, which is 3.9% of total calls received. (2016 average was 14.7%)

o Average wait time to speak with an agent has increased by four seconds to one minute and nine seconds
