Update on National Land Code
(Amendment of First and Fifth Schedules) Order 2017
(1) We refer to Bar Council Circular No 192/2017 dated 30 Aug 2017, entitled “National
Land Code (Amendment of First and Fifth Schedules) Order 2017”, which included a
copy of the National Land Code (Amendment of First and Fifth Schedules) Order 2017
(“P.U. (A) 247”) and a copy of Sample Form 13B. The Bar Council Conveyancing
Practice Committee (“CPC”) has since received further information from the relevant
authorities.
(2) By an email dated 7 Sept 2017, Bahagian Pendaftaran, Pejabat Pengarah Tanah dan
Galian, Wilayah Persekutuan Kuala Lumpur (“PPTG KL”) informed the CPC as
follows:
Adalah dimaklumkan bahawa Perintah Kanun Tanah Negara (Pindaan Jadual
Pertama dan Kelima) 2017 telah mula berkuatkuasa pada 30 Ogos 2017. Oleh
itu, semua penyempurnaan borang mulai tarikh 30 Ogos 2017 hendaklah
mematuhi pindaan sepertimana Warta Kerajaan Persekutuan P.U. (A) 247
tersebut.
Selaras pindaan ini, pelanggan juga dikehendaki menggunapakai Borang
Kaveat Persendirian (Borang 19B) versi Bahasa Inggeris sehingga borang di
dalam versi Bahasa Malaysia diluluskan. Bersama ini disertakan Borang 19B
versi Bahasa Inggeris untuk tujuan edaran.
Untuk makluman tuan/puan juga, pengisian maklumat dalam Bahasa
Malaysia atau Bahasa Inggeris adalah diterima.
(3) The CPC has subsequently confirmed with the Jabatan Ketua Pengarah Tanah dan
Galian, Putrajaya (“JKPTG”) that the contents of the abovementioned email from
PPTG KL in respect of the preparation of Form 19B shall similarly apply to all land
registries or land offices in Peninsular Malaysia, until the Bahasa Malaysia version has
been approved.
(4) By an email dated 12 Sept 2017, JKPTG furnished to the CPC the following new First
Schedule Forms in Bahasa Malaysia that have been approved:
(i) Form 7D;
(ii) Form 13B;

(iii) Form 19B;
(iv) Form 19D; and
(v) Form 28A.
Members are to note that these First Schedule Forms in Bahasa Malaysia, which are
attached, are to have immediate effect.
(5) Following Bar Council Circular No 192/2017, the Conveyancing Practice Department
of the Bar Council Secretariat has been inundated with telephone calls and emails from
Members of the Bar regarding the amendments effected by P.U. (A) 247.
(6) The CPC regrets to note that most of the enquiries could have been resolved if the
Member had made an effort to read P.U. (A) 247 in detail, so as to enable the Member
to comply with the amendments made therein, to the best of the Member’s abilities.
(7) In particular, Members are advised to read paragraph 4 of P.U. (A) 247, which states
very clearly as follows (emphasis added):
(1) The amendment made to Form 19B in the First Schedule shall have
no effect to the documents executed before the commencement of this Order
and shall be continued to be presented as if the First Schedule had not been
amended by this Order.
(2) The amendment made to the Fifth Schedule by inserting paragraph 2A
shall have no effect to the documents executed before the commencement of
this Order and shall be continued to be presented as if the Fifth Schedule
had not been amended by this Order.
(8) Any Member who wishes to make any enquiry relating to conveyancing practice is
required to complete and submit the attached Conveyancing Practice Query Form by
email to [email protected].
(9) Nevertheless, for the guidance of Members, the CPC has prepared its views on the most
common enquiries received, in a set of Frequently-Asked-Questions (“FAQs”) that is
attached.

Frequently-Asked-Questions on National Land Code
(Amendment of First and Fifth Schedules) Order 2017 [P.U. (A) 247]
Since P.U. (A) 247 came into force on 30 Aug 2017, the Bar Council has received numerous
enquiries from Members of the Bar in connection with some of its provisions.
Below is a summary of the views of the Bar Council Conveyancing Practice Committee
(“CPC”).
(1) New First Schedule Forms amended by P.U. (A) 247
FAQ 1
Can we have the new First Schedule Forms in Bahasa Malaysia?
The CPC has been informed that new First Schedule Forms in Bahasa Malaysia
(amended by P.U. (A) 247) have just been approved by the relevant authorities. The
forms are contained in pages 3 to 13 of Bar Council Circular 200/2017, to which this
set of FAQs is attached.
(2) New paragraph 2A of the Fifth Schedule
(a) FAQ 2
If an advocate and solicitor makes the Statutory Declaration (“SD”) in respect of
the claim under Form 19B, is the advocate and solicitor required to indicate that
he or she holds a Practising Certificate that is in force at the date of making the
SD?
The CPC is of the view that:
(i) Paragraph 2A of the Fifth Schedule applies to an advocate and solicitor, in
attesting any execution.
(ii) If an advocate and solicitor makes the SD to verify the claim, as required
under paragraph 3(b) of Form 19B, the advocate and solicitor is not
attesting any execution as envisaged by the aforesaid paragraph 2A.
(iii) Nevertheless, in making the SD, the advocate and solicitor may, if he or she
wishes to do so, indicate in the SD that he or she holds a Practising
Certificate which is in force at the date of making the SD.

(b) FAQ 3
Is the advocate and solicitor required to attach a copy of his or her Practising
Certificate at the time of presentation of the instrument that was attested by him
or her, for registration?
The CPC is of the view that paragraph 2A of the Fifth Schedule inserted by P.U. (A)
247, does not require a copy of the Practising Certificate to be attached to the
instrument attested by the advocate and solicitor.
(3) Sample Form 13B (attached to Bar Council Circular No 192/2017)
(a) FAQ 4
Whether to use the description “peguamcara dan peguambela” as stated in the
sample Form 13B or “Peguambela dan Peguamcara”, which is normally used as
a description of an advocate and solicitor?
The CPC is of the view that:
(i) The sample Form 13B was provided by the appropriate authority as an
example and guidance only, in respect of the attestation clause to be used
by an advocate and solicitor when he or she is attesting the execution of any
instrument of dealing under the National Land Code 1965.
(ii) An advocate and solicitor may describe himself or herself in the attestation
clause as a “peguambela dan peguamcara”. The CPC has already informed
the Department of Director General of Lands and Mines (Jabatan Ketua
Pengarah Tanah dan Galian, “JKPTG”) that practising lawyers are known
as “advocates and solicitors” in English and they should therefore be known
as “peguambela dan peguamcara” in Bahasa Malaysia.
(iii) An advocate and solicitor may also describe himself or herself in the
attestation clause as a “peguam bela dan peguam cara”, which are the words
used in the Bahasa Malaysia version of the Legal Profession Act 1976.
(b) FAQ 5
Whether the rubber stamp of an advocate and solicitor may continue to be used,
and if so, whether the words used in the rubber stamp should be the same words
used in the sample Form 13B?
The CPC is of the view that:
(i) For the time being, Members of the Bar should follow the sample Form
13B as closely as possible, subject to FAQ 4 in section (3)(a) of this set of
FAQs.

(ii) The sample Form 13B requires, as an example, the following words to be
typewritten below the signature of the advocate and solicitor:

(iii) The above words should be typewritten below the signature of the advocate
and solicitor who is attesting the signature.
(iv) The rubber stamp of the advocate and solicitor, which was used at all
material times, may continue to be affixed next to the signature of the
advocate and solicitor, for example on the left-hand side of his or her
signature.
(c) FAQ 6
The Form 14A is dated 12 July 2017 with the old attestation clause and is now
ready to be presented for registration at the relevant land office. Are we
required to add the new attestation clause to the Form 14A before presentation
for registration?
The answer to this question is found in paragraph 7 on page 2 of Bar Council Circular
200/2017, to which this set of FAQs is attached.
(4) New Form 19B
(a) FAQ 7
On the new paragraphs 4 and 5 of Form 19B, under what circumstances should
either paragraph be deleted or remain?
The CPC is of the view that:
(i) Since the new paragraph 4 is with a double asterisk (**), it may be deleted
if it is not applicable in the case of a caveat binding a particular interest
only. See paragraph 2(c)(ii) of P.U. (A) 247.
(ii) Since the new paragraph 5 is with a single asterisk (*), it may be deleted as
appropriate.

(b) FAQ 8
If the Form 19B was executed on 29 Aug 2017 but was dated 30 Aug 2017, should
we use the old Form 19B, or the Form 19B must be dated 29 Aug 2017?
The CPC is of the view that:
(i) Since the Form 19B is dated 30 Aug 2017, the instrument ought to have
been executed and attested by the advocate and solicitor on the same day.
(ii) Since P.U. (A) 247 came into force on 30 Aug 2017 and the Form 19B is to
be dated 30 Aug 2017, the new Form 19B ought to be used.
