This office represents defendants-appellees Thomas J. Spargo, Joseph L. Bruno, the State Senate, Sheldon Silver, the State Assembly, George E. Pataki, Randy A. Daniels, Eliot Spitzer and all members of the New York State Senate and Assembly named as defendants (the "State Defendants") in these proceedings. We write in response to plaintiff-appellant William Van Allen's motion, dated June 17, 2010, for permission for himself and plaintiff John-Joseph Forjone to join the brief submitted by plaintiff-appellant Christopher Strunk.

Background

Mr. Van Allen's June 17 motion seeks permission for himself and appellant John-Joseph Forjone to join the brief filed in this appeal by appellant Christopher Strunk. Attached to the motion was the notice of appeal filed in the district court by Mr. Forjone (Doc. # 125).1 Mr. Forjone's notice of appeal was filed on September 29,2008 - more than 30 days after the judgment appealed from (Doc. # 110), which was filed on August 1, 2008. Mr. Forjone did not file any motion that might have stayed his time to appeal from the judgment. Thus, as explained in the letter brief filed by the State Defendants, Mr. Forjone's notice of appeal was untimely. (See Letter from Andrew B. Ayers to the Court, May 6,2010, at 2 & n.4.)

1 Mr. Forjone's notice of appeal (Doc. # 125) was styled an "amended notice of appeal" because it was an amended version of an earlier notice of appeal (Doc. # 118) that had been filed solely by Mr. Van Allen.

In a conversation with the Office of the Clerk of Court on June 23, I was advised that Mr. Van Allen's June 17 motion has not been docketed as a motion. However, the amended notices of appeal that Mr. Forjone and Mr. Strunk filed in the district court in 2008 (Docs. # 123, 125) were accepted for filing by the Office of the Clerk and added to this Court's docket on June 21, 2010. The caption was apparently amended on the same day to indicate that Mr. Strunk and Mr. Forjone are appellants in this matter. We have not received a copy of the amended caption, but if my understanding is correct, Mr. Forjone is now listed as an appellant when in fact he did not timely appeal.

Discussion

We take no position on Mr. Van Allen's motion insofar as he himself seeks to join in Mr. Strunk's brief, although we note that Mr. Van Allen failed to file or join a briefby the date set in this Court's scheduling order dated December 4, 2009. See Local Rule 31.2.

We do oppose Mr. Van Allen's motion insofar as it seeks leave for Mr. Forjone to join the brief. Mr. Van Allen is not an attorney and cannot represent Mr. Forjone. Moreover, as discussed above and in our letter brief of May 6,2010, Mr. Forjone did not file a timely notice of appeal in this matter. Thus, Mr. Forjone is not an appellant and is not entitled to join Strunk's brief.

Finally, if the caption has indeed been amended to add Mr. Forjone as an appellant, we ask that the Court correct the caption to indicate that he is not.
