By Diane Ryder A sharply divided board of trustees tangled during a lengthy discussion Thursday over how to use an 80-acre parcel on the northern edge of the Chester Township. One trustee accused the other two of shutting him out of the planning process. Calling the board “dysfunc- tional,” Trustee Ken Radtke accused Trustee Chairman Mike Joyce of meeting privately with local Kiwanis Club members to ask them to come up with ideas for the township-owned property at 11255 Chillicothe Road. Radtke also questioned whether Joyce went behind his back to ask the township’s Zoning Commission to conduct a community survey to find out what residents would like to do with the parcel, much of it wet- lands. Radtke also voted against hir- ing locally based Marino Surveying for $3,700 to survey the parcel. “At the last township trustees meeting, some emotion was involved,” Radtke said. “Why did Mr. Joyce schedule a Dec. 2 meeting (with Kiwanis Club members) at such short notice?” Addressing Joyce, Radtke added, “One comment you made at that Dec. 2 meeting was if the board’s not on the same page, it sends a bad message; well, this board’s not on the same page. In a Nov. 29 email, you said you’d be talking to Chesterland Kiwanis and I think you brought up some valid questions. But on Nov. 28, you rushed an invitation out for a Dec. 2 meeting.” Radtke said he sees “what is happening here” and doesn’t think it’s a positive reflection on the board, adding the audiotape of that meeting showed Joyce told Kiwanis members he was not concerned about their com- plaints about all terrain vehicles using the property. “Are you aware we have a contract with the Western Reserve Conservancy about that?” he asked Joyce. Radtke said that Joyce’s meeting should have been a pub- lic one with other board mem- bers present and that Joyce should not have represented the board at the meeting. Joyce said he called the meet- ing as a single citizen and told the club that. “I respectfully request the board let the rest of the board know what’s going on,” Radtke said. “Just let me know.” He added, “One campaign promise I made when I ran was that we would hold a public meeting about the parcel. I would like to request it after the first of the year. This is going to impact our permanent appropri- ations. This board’s unwilling to have a public meeting.” Joyce shot back, “I didn’t say that,” adding he thought the board should have a meeting on the issue later. “You went and had a private meeting instead,” Radtke said. “If you don’t set a public meeting for this, I will go ahead and set one.” Radtke, visibly angry, said he has been consistently left out of the communications loop and told Joyce that on Friday, Dec. 7, he learned from a newspaper reporter that Fairmount Minerals was moving its corporate head- quarters to Chester Township. “I told her I hadn’t heard that and asked her how she knew,” Radtke said. “She said that you, Mr. Joyce, had told her.” Radtke asked Caputo when she had heard about the move and Caputo said she had heard it at a recent Opticon meeting from Munson Township Trustee Irene McMullen. Radtke said it was another example of lack of communica- tion. “I don’t like the direction you are going,” Joyce said. By Ann Wishart Munson Township Zoning Inspector Tim Kearns just wants it to end. “Moving Ohio Forward — the saga continues,” he told Munson Township Trustees on Dec. 11. “That house comes down in January.” Kearns was talking about Kristopher Klingmann’s aban- doned nursing home on Rock- haven Road that township, county and state officials have declared unsafe and unsalvageable over the last three years. Yet, it is still standing. Klingmann, who has sought funding twice to help him dis- pose of the once famous struc- ture, was not present last Tuesday to object to Kearns’ pronouncement, but he knows the score, the zoning inspector said. Receiving the Moving Ohio Forward grant is still uncertain, Kearns said, adding it doesn’t matter. The building can be torn down and the grant could be awarded later, with the township being reimbursed at that time, he said. If the grant does not materi- alizes, the cost would be collect- ed from Klingmann on his prop- erty taxes, trustees have said. Meanwhile, legal counsel has advised the township to start — again — from the beginning, get- ting quotes for the work. In case the grant becomes reality, a search for liens against the property going back several years also has to be made. In addition, Klingmann needs to sign a waiver of liability, Kearns said. “He doesn’t like Munson not being responsible for every- thing,” Kearns said, adding, how- ever, the paperwork won’t hold the project up. “I told him we’re doing this in January,” he said. The next step will be to go to the Geauga County Treasurer’s Office and find out if the taxes are paid up to date, Kearns said. When the township went through this before, Klingmann had taxes due, but Kearns added he believes those have been paid off. Geauga County Commis-sioners have approved extend-ing a sewer line along stateRoute 306 in Russell Township.

Radtke shot back, “I don’tlike that you don’t tell us(trustees), but you tell a newspa-per. It shows lack of respect foryour fellow board members.”

He said he believes there isan obvious attempt to preventhim from conducting townshipbusiness for which he was elect-ed.

Radtke added, “Earlier thisyear, you both said you wereopposed to liaisons (with the

departments) so I am making amotion to rescind Mike Joyce asliaison to the zoning inspector.I’d just like to be consistent.”

Caputo seconded it.All three trustees, Joyce

included, voted yes.“I also move to require the

zoning inspector to issue a bi-weekly written report,” Radtkesaid.

Caputo said she was notgoing to second that motion “atthis point.”

Radtke then reiterated heresented hearing about theFairmount plans from a reporter

and called the board dysfunc-tional.

The audience of about 20buzzed and murmured in appar-ent agreement.

“Excuse me? Really?”Caputo said to the audience.

Caputo denied leavingRadtke out of the loop andpointed out instances when shediscussed financial matters withhim.

“It works both ways; it’s atwo way street,” Caputo toldRadtke.

The arguing continued dur-ing the public comment periodat the end of the meeting.

Cathy Cotman asked Joycewhy he wanted to hold off call-ing a meeting in January to dis-cuss the 80-acre parcel.

“I don’t have a crystal ballwith me,” Joyce said, adding hewanted to meet with the mem-bers of the zoning commissionfirst to discuss their definition ofa park.

“Once I get comments fromthem, I will call a meeting,”Joyce said.

Radtke said that conversa-tion should “start at the boardlevel.”

“I disagree,” Joyce said. “Letthe Kiwanis decide what theywant to do rather than handthem a homework assignment.”

After several other com-ments from the audience, Joycesaid, “We’ve discussed this 80acres to death now. Nothingmore can be accomplished bycontinuing this discussion now.”

After a few more commentson related topics, trustees wentinto executive session to discusscontract negotiations.

Radtke repeatedly asked theother two trustees whether theyhad researched the issueenough to pass it after receivingthe proposal Wednesday.

“Mr. Welty asked me to putthis on as a discussion item,”Trustee Judy Caputo said, refer-ring to Fred Welty, a Democratwho ran unsuccessfully againstGeauga County CommissionerTracy Jemison in November.

“I feel that the townshipshould have some controls,”Caputo said. “He asked me toput it on, so I asked it be put onthe agenda.”

Radtke asked both trusteeswhether they had enough

knowledge of the issue to makea decision about a proposed res-olution they had just heardabout the day before.

“I served as zoning inspectorin Chester Township for 12years and two years in Bain-bridge, and I’ve talked beforethe House of Representatives inColumbus on this,” TrusteeMike Joyce said. “And I knowof people who have beeninjured with gas wells.”

Joyce said that, to his knowl-edge, Chester is the only town-ship in Ohio with drilling regu-lations “still on the books,” and,although they are not enforceableunder current state law, the reg-ulations remain there so thetownship will be prepared if thelegislature decides to grant thetownships authority again.

Under persistent question-ing from Radtke, Joyce said heknew of at least one injurylocally from a leaking well.

“And there were at leastthree fires I know of while wellswere being drilled,” Joyceadded.

Caputo said she has attend-ed meetings and seminars onthe subject.

“I think our infrastructure asfar as water goes is important,”Caputo said.

“It is,” Radtke agreed, butasked both trustees whetherthey were familiar with HouseBill 315, which regulates hori-zontal well drilling, brinehaulers and gives the OhioDepartment of Natural Resou-rces sweeping authority overthe drilling process.

“It’s one of the nation’stoughest regulatory docu-ments,” Radtke said. “We gotthis request yesterday, which isan inadequate amount of time. Ithink it’s very important thatthe board does research beforeconsidering something like thisthat is overly broad and lackingspecifics.”

According to Radtke, 16,000horizontal wells have beendrilled in Texas and one so farin Ohio, since 2008, with nogroundwater contaminationreported.

Caputo and Joyce toldRadtke that the ODNR hasnever conducted tests on hori-zontal wells, which Radtkequestioned.

Caputo said that an injectionwell in Hambden Township hasreceived a large amount oftruck traffic as trucks haul brinefrom horizontal wells inPennsylvania.

“I think it’s a shame there isno kind of local control orenforcement of this,” Caputosaid. “ODNR has only 26employees for the State ofOhio, although they are addingmore. Their funding comes frompermit fees.”

Caputo said because of that,the agency has an incentive togrant permits across the state.

“I don’t have faith in a groupthat is funded through permit(fees),” Caputo said. “They haveto do the permits in order togain their revenue.”

Joyce added, “ODNR knowsif the drilling doesn’t continue,they don’t have jobs.”

Radtke said he believes thathorizontal drilling can result inenergy independence, a goalpushed by Republicans in the2012 presidential campaign.

When Joyce called for a vote,Radtke said, “You’re voting on

something you haven’t had achance to reference the resou-rces.”

“I still feel confident withwhat is printed on this paper,”Caputo said. “I guess it’s okayfor you to disagree with me. Ididn’t think it was that big of anissue, but this is my decision.”

Joyce said he was voting yes,because he would “rather err onthe side of safety.”

“I don’t know how thiswould accomplish that,” Radtkesaid.

“I don’t either,” Joyce admit-ted, as the audience erupted inderisive laughter.

Environmental ProtectionAgency representative said itwould be OK to use the asbestosreport from the previous roundof studies to determine howmuch of the building must bespecially handled because of thecarcinogenic material.

“Every piece of flooring isbad,” Kearns said, according tothe report.

The Moving Ohio Forwardgrant requires numerous pic-tures documenting destructionof the building, so Kearns saidhe would be there with his cam-era throughout the demolitionprocess.

A contractor’s report is thelast thing trustees and legalcounsel need, he added.

Kearns said he would like tomeet with each bidder separatelyto make sure they understand

what the township wants done. Judging from the previous

bids, Kearns said he doesn’texpect the cost to exceed$50,000, so advertising won’t berequired.

“This is going to go. Krisknows it, he’s just holding it up,”Kearns said, adding he is hopefulthe township would receive thegrant — eventually.

“We’re number one on theMoving Ohio Forward list,” hesaid.

Once the structure is torndown and the rubble is removed,the basement will be filled inwith clay, which must be broughtin from another location, sincethere isn’t any on the property.

“This takes it to a seeded fin-ish,” with grass growing over thesite come spring,” Trustee ToddRay said.“You won’t even know(the building) was ever there.”

Kearns added, “The prosecu-tor is 100 percent behind us.”

He added, “The treatmentplant was built in the 1970s andthis will bring it up to capacity.”

Property owners will beassessed for the project based ontheir road frontage and their taxbills will be charged for the next10 years to pay for tying into thesystem, explained Morgan.

Morgan told the GeaugaCounty Maple Leaf on Fridaythe project is estimated to cost$270,000, including all engineer-ing and construction work.

The estimated per foot costis $131, excluding tap-in fees,which Morgan said depend onthe use of each business prop-erty.

“So trustees are all in favorof this?” Commissioner MarySamide asked.

Morgan said they are andthat the commissioners’ greenlight is the first step in theprocess.

He said notices would besent out to the affected prop-erty owners on Dec. 27, inform-ing them about a Jan. 30 publichearing on the issue.

Commissioner Tracy Jemi-son said property owners wouldhave the option of beingassessed to tie in or to pay for itoutright.

“It will be on the tax bill orthey can pay cash,” he added.

The West Geauga Wolver-ines have been steadfast ondefense this season, proving itagain last week in a ChagrinValley Conference matchupagainst visiting Chagrin Falls.

The Tigers committed 16turnovers and shot just 29 per-cent from the floor, as WestGeauga won the neighborhoodrivalry, 40-37.

Through four games, WestGeauga has allowed 45 pointsper game and has a 3-1 record.The team’s only loss came tostate-qualifier Lake Catholic.

The Tigers dropped to 2-2 onthe young season.

West Geauga coach JohnCardiero commended histeam’s defensive effort on a off-shooting night.

“Our defense really set thetone for us tonight,” he said.

West Geauga shot 34 per-cent from the field (16 of 47)baskets and 53 percent from thefoul line (eight of 15), includingjust two in seven tries in thefinal minute of the game.

A bright spot for WestGeauga was how they took careof the ball with only 11turnovers.

Senior Noah Bidar, the sea-son’s leading scorer through the

first four games, led the

Wolverines offensively. Heimpressed again, scoring 12points, grabbing eight reboundsand dishing out six assists in thewin.

Chagrin Falls started fastand scored the first seven pointsof the game.

The Wolverines used youth-ful resilience and went on theirown 8-0 run, led by juniorCooper Stafford. Chagrin Fallsresponded with a 7-0 run of itsown to take a 14-8 lead early inthe second quarter.

The Wolverines then wenton a 9-0 run and never lookedback, leading 22-19 at halftime.

West Geauga outscored theTigers, 10-9, in the third quarterand held its biggest lead of thegame late in period at 32-25.

But Tigers senior JackThome hit a 3-pointer to cut theWest Geauga lead to 32-28heading into the final 12 min-utes of play.

That is when things gotinteresting.

The Wolverines extendedtheir advantage to 38-33 whenAaron Rabe completed a three-point play.

The Tigers continued to clawaway at the deficit and pulled towithin one point, 38-37, with2:02 remaining in the game.

The game came down to thefinal 11 seconds when NoahBidar split a pair of free throwsand pushed the Wolverines’winning margin to 40-37.

Chagrin Falls coach DaveBargar called a timeout inhopes of designing a final playto tie the game.

West Geauga had secondthoughts about the Tigersattempting a game 3-pointerand decided to foul AdamShoemaker and put him on thefree throw line.

The Tigers senior missed thefront end of a 1-and-1, but sen-ior forward Liam Sullivangrabbed the offensive rebound.His put back missed as timeexpired.

One of the most intriguingbattles of the night was waged

in the paint between two of thetop post players in the county— Mario Formichelli of WestGeauga and Thome.

Thome led the way statisti-cally scoring 11 points and grab-bing 10 rebounds along withthree blocks, but Formichellicame away with the victorywhile chipping in eight points.

“Thome was limited inside

by Formichelli and forced out-side, which he is good at, but heis better when he gets insideand we give him the ball, andwe play inside-out basketball,”Bargar said.

“It’s funny,” he added. “Atthe start of our scrimmages, wewere shooting 60 percent fromthe 3-point line. We were crush-ing teams offensively. The lasttwo games, we haven’t shot wellat all.”

Bargar summed up thedefeat best. “When you hold ateam to 40 points of offense, it’svery frustrating no doubt.”

The Tigers also received asolid game from senior guardNick Berry, who scored 11points off the bench. Sullivanfinished the game with sixpoints.

The Wolverines continuedtheir winning ways with a winover Painesville Harvey, 72-48,on Saturday night. They are offuntil the Gilmour HolidayTournament on Dec. 28-29.

The Tigers fell to KenstonSaturday night in an overtimethriller. They will host Wickliffeon Dec. 19.

Metzenbaum ReceivesFive-Year Accreditation

The Geauga County Boardof Developmental Disabilities,also known as the BessieBenner Metzenbaum Center,was awarded a Five-YearAccreditation, the highest certi-fication a county board canreceive.

This is the second timeMetzenbaum has received thisaward and must establish

“Areas of Excellence” in orderto earn it.

The process included inter-viewing several departments aswell as consumers and parents/guardians.

Members also looked atrecord keeping and consumerplans.

Positive initiatives with theEarly Intervention program, themove to natural-environmenttherapy as well as relationships

with CareStar and GeaugaCounty Department of Job andFamily Services were highlight-ed.

The review board felt thecenter finds meaningful workopportunities.

The Metzenbaum Centerdid this using the areas theyexcel in, such as leadership andorganizational management,promoting employment andbusiness, and promoting com-munity participation.

Some of the emphasizedareas were the partnershipswith other local organizationsincluding the school districts,Geauga County Department onAging and Kiwanis Club.

The center was also acknow-ledged for the Help Me Growprogram with the EarlyIntervention Program.

They have formed partner-ships with several businessesand organizations aroundGeauga County to place indi-viduals in employment.

Cat Sanctuary in Need ofItems

The Happy Tails CatSanctuary is into its 30th year(although it didn’t officially getits current name until 2005,when it became a non-profit501-c-3 charitable organization).

The sanctuary’s founder anddirector, Jeanne Bones, beganrescuing and caring for neglect-ed, abused and abandoned catsin September 1982.

With winter just around the

No one at Happy Tailsreceives a salary, and volunteersand foster families are greatlyappreciated.

DOMESTIC DISPUTEOfficers were dispatched to a

residence for a possible domesticdispute. Upon arrival, it is discov-ered that no physical violenceoccurred between either parties.Male left the residence and offi-cers cleared without further inci-dent.

SUSPENDED LICENSEOfficers conducted a traffic

stop on Sperry Road and discov-ered the driver had a suspendedlicense. The vehicle was towedfrom the scene and the driver wasissued a citation and a court datethrough Chardon MunicipalCourt. Officers cleared withoutfurther incident.

INVALID LICENSEOfficers conducted a traffic

stop on Mayfield Road and dis-covered the driver of the vehicledid not have a valid driver’slicense. The driver was cited andgiven a court date through theChardon Municipal Court.

Officers conducted a trafficstop on a vehicle that went left ofcenter on Caves Road. Uponspeaking with the driver, it wasfound that his driver’s license wasexpired. The passenger had avalid license and was able to takepossession of the vehicle. Thedriver was cited and given a courtdate through Chardon MunicipalCourt. Officers cleared withoutincident.

CAR ACCIDENTOfficers responded to a two

car injury accident on WilsonMills Road. One driver was takenby Chester EMS to HillcrestHospital and both vehicles weretowed from the scene. The driverwho struck the other car wasissued a citation.

Officers responded to a twocar damage accident on Mayfieldand Chillicothe roads. No injurieswere reported and neither car hadto be towed from the scene. Thedriver that struck the other carfrom behind was issued a citationfor failure to maintain assuredcleared distance.

Family and friends of Patand Gary Kreuz surprised thecouple with a 50th anniversary

part this summer at OrchardHills Park.

Pat and Gary were marriedon June 23, 1962 at theCommunity Church of Chester-land.

Patricia (nee Whitlock) andGary were high school sweet-hearts - graduating from WestGeauga in 1961.

They raised three childrenand ran the family business inChester Township (formerlyCaves Road 5ohio, now CavesRoad Sunoco, owned by theirson, Todd.)

They now continue individ-ual activities of Sweet Adelinesand bowling for Pat, and basket-ball, softball and volleyball forGary.

Together they love to travel,explore nature, the outdoorsand spend time with family.

They enjoy their 10 grand-children and attend as manyactivities and events as possible.

Laurie (Scott) and Todd(Debbie) remain in town withchildren Melissa, Kevin andNicole Lee; Ktherine, T.J.,Joseph and new baby WilliamKreuz. Valierie lives inMansfield with Jacob, Dannyand Megan Supron.

The coalition members alsocollected food basket donations,voted on a HUD funding grantrenewal opportunity and dis-
