FORT MADISON - A Fort Madison City Council-man, who’s supportive of term-limits, wants a review of the Civil Service Commission terms and scope.

First ward City Councilman Chris Greenwald balked at approving a renewal of Duane Denning to a 6-year appointment to the commission. The agenda item was part of the consent agenda, which includes groups of

regular items including paying bills, approving previous minutes, etc, that typically don’t require a debate at the meetings.

OBITUARIES

JOHN S. MIKOLAJAZYKJohn S. Mikolajazyk, 61, of Montrose

passed away on Friday, July 21, 2017 at 5:30 AM at his home.

He was born on March 29, 1956 in Chicago, IL to Stanley and Elizabeth Fox Mikolajazyk. On Septem-ber 7, 1994 he married Carla Rezab in Kahoka, MO. John worked for

BNSF and retired in March of 2016 after over forty years of service. He loved restoring old cars and trout fishing.

Survivors include his wife, Carla Mi-kolajazyk of Montrose and her children,

Tanya Frank of Ft. Madison and Joey Frank of Montrose; his mother, Bet-te Smith of Sun City West, AZ; seven grandchildren, Adrian, Julian, Brook-lynn, Carter and Emma Frank, Josie and Henry Worley; two brothers, Paul and Jim Mikolajazyk of Chicago; one sister, April Stonis of Hazelhurst, WI; several nieces and nephews. He was preceded in death by his father and a sister, Joyce.

Per his wishes, cremation has been entrusted to King-Lynk Funeral Home & Crematory and there will be no formal services at this time. Online condolenc-es may be left at www.kinglynk.com.

each other as well. On a larger scale, a company like Verizon could limit a competing company’s app from getting access through its customers Verizon devices. U.S. Cel-lular could do the same thing. You would literally be seeing what they chose for you to see first. A former Verizon attorney, Ajit Pae, the chairman of the FCC is leading the charge at the direction of President Trump.

How scary is that. The anti-competitive nature in itself is scary enoung, but what it really is..and

the really creepy part...is a tug at that one string that begins to unravel the fabric on which this coun-try was woven - The First Amendment. If a compa-ny slows your message in favor of their own, they have curtailed your ability to get your message across the Internet and that’s an infringement on free speech.

Pai says the tougher classification has impeded corporate investment in upgrades including broad-band networks. I say that just means their holding progress hostage until

they get their way.Let’s see if we can make

this a little simpler to understand.

We have a huge river that runs right down the side of our town. It runs right by us and we have natural rights to use that river within legal param-eters anyway we choose. We can fish it, we can boat on it, we can clean it and improve it...we can even contain it. But now a big corporation comes in and requires more of the river so they settle up north and put in dams and channels and move the river off our

shores and leave us with tributary.

These net neutrality rules would work like that. Company’s would deter-mine what information would flow to your devic-es. They’ll tell you they’re just putting the rules on”different legal footing” and no major changes will occur.

For example, prior to the FCC incorporating stronger net neutrality guidelines during the Obama presidency com-pany’s such as AT&T, Ver-izon and Sprint were all caught violating net neu-trality guidelines, but they were just that - guidelines. Verizon sued in court and the courts said FCC need-ed to tighten up the rules, which they did.

According to a website run by FreePress Action Fund www.freepress.net/blog/2017/04/25/net-neutrality-vio-lations-brief-history - “From 2011–2013, AT&T, Sprint and Verizon blocked Google Wallet, a mobile-payment system that competed with a similar service called Isis, which all three companies

had a stake in developing.”Also according to

FreePress - “In 2005, the nation’s largest (Internet Service Provider) ISP, Comcast, began secretly blocking peer-to-peer technologies that its cus-tomers were using over its network. Users of ser-vices like BitTorrent and Gnutella were unable to connect to these services. 2007 investigations from the Associated Press, the Electronic Frontier Foundation and others confirmed that Comcast was indeed blocking or slowing file-sharing appli-cations without disclosing this fact to its customers.”

We sent letters support-ing net neutrality to the offices of U.S. Sen. Charles Grassley and U.S. Rep. Dave Loebsack.

“As a member of the House Energy and Commerce Committee, which has jurisdiction over telecommunications policy, I will continue to closely monitor any FCC rulemaking related to net neutrality, and will keep your thoughts in mind when considering any legislation related to

this important issue. My primary goal is to ensure that constituents in my district have continued open access to internet content while also foster-ing an environment that allows our rural service providers the ability to compete and grow in an ever changing telecom-munications landscape,” Loebsack wrote in his reply.

Seriously, anything else is giving these company’s a knob to control the speed of information to your phone, computer or tablet. They will tell you what you get and when you get it. This is no small change. It can be com-pared to an invasion of privacy by limiting where you shop, how you book a flight or hotel and, yeah, what news outlets you read.

$1,000 Grants Available for New Students

Holy Trinity Catholic Schools is pleased to announce that beginning with the 2017-2018 school year, $1,000 grants will be available to incoming students transferring from another school. These are one-time grants, which will be awarded to students for the first year that they attend HTC. A new student discount is already built into HTC’s kindergarten tuition costs so these grants do not apply to them.

There are a limited number of spots available in each grade for next year so acceptance will be based on a first come first served basis.

The New Student Grant is a stackable award that can be used in conjunction with all other forms of tuition assistance including STO Grants, Foundation Grants and scholarships.

spend money to use a consultant to find a new police chief.

Mayor Brad Randolph said the com-mission was in favor of hiring a consul-tant and then reversed their position and recommended using in-house resources.

“I think if you search your memory, you will find you were lobbied,” Green-wald told Andrews.

“Actually then, they also lobbied Council members on that and I guess I don’t think that’s the function of the Civil Service board and at that time they really gave me the impression of being anti-city. Whereas I think their function is to be neutral and serve as a bridge between the city and public safety.”

Greenwald said he was not in favor of renewing Denning’s appointment.

Randolph asked if the boards are dic-tated by higher governance. Varley said the city code and section 400 of the Iowa Code dictates the function of the Civil Service Commission.

Randolph asked Varley to look into something that would outline the roles and expectations of volunteers who sit on recommending boards and commissions.

“I think that’s a good idea and we can do something like that for those boards,” Varley said.

Title 2, Chapter 11, Paragraph 2 of the Fort Madison City Code indicates Fort Madison Civil Service Commission terms are six years. Section 400 of the Iowa Code shows the terms are for four years.

Greenwald said he’s in favor of term limits and wasn’t going to run for his current City Council term.

“I was talked into this last term and I’m a term limits person. The Civil

Service board is one of those, that when it is needed it’s serious...it’s big stuff,” Greenwald said. “It’s almost like they’re supreme court justices and they end up being on there for life. We should turn it over every once in a while. We should strive to do that. You know, 10 years is too long. I’m a term limits guy because you get too comfortable. You become overbearing and I think that’s perhaps what’s happened to this board. I’m very uncomfortable that they were led by the police department.”

Councilman Chad Cangas asked if it was specifically Mr. Denning or the com-mission in general that Greenwald had a problem with.

“I think it’s the commission in general, but Denning was highly involved in that decision, Greenwald said. This side of my brain says God bless the guy for all the time he’s put in, and part of my brain says I don’t appreciate it because we need to try and keep it fresher. This is painful.”

The council moved to table the is-sue and remove the appointment from the consent agenda, which Greenwald opposed, but it passed 4-1. Councilmen Kevin Rink and Travis Seidel were absent from the meeting.

In other action, the council:• approved 5-0 to authorize a loan

agreement in an amount not to exceed $2.7 million for the Blackhawk sewer construction.

• approved, 5-0, an agreement with the Iowa Dept. of Transportation to use TAP Funds for the Rodeo Park Trail Rehabil-itation.

• approved 5-0 to purchase property at 1801-1805 Avenue L for $18,000. Varley said the property will be needed when the Hwy 61 reconstruction gets under-way.

Mayor Pro Tem Green-wald opened the public hear-ing at 5:33 P.M. concerning the proposal to enter into a Development Agreement with Boulders Inn Fort Mad-ison, L.L.C. There being nor oral or written comments, on motion, Council closed the public hearing. On motion, Council approved Resolu-tion No. 2017-47, approving and authorizing execution of a Development Agreement

by and between the City of Fort Madison and Boulders Inn Fort Madison, L.L.C.

On motion, Council adopted Resolution No. 2017-48, fixing date for a meeting on the proposition to authorize a Loan and Dis-bursement Agreement and the issuance of not to exceed $2,700,000 Sewer Revenue Capital Loan Notes of the City of Fort Madison, and providing for publication of notice thereof.

On motion, Council authorized the Mayor’s signature on an Engagement Agreement with Ahlers & Cooney, P.C., of Des Moines, Iowa, for their services as Bond Coun-sel in connection with the issuance of not to exceed $2,700,000 Sewer Revenue Capital Loan Notes. On motion, Council approved the purchase of a replace-ment fire engine from Alexis Fire Equipment of Alexis, Illinois, for $568,865.

At 5.41 P.M., on motion, Council adjourned until Tuesday, July 18, 2017 at 5:30 P.M.
