• SB7requiresthatemploymentapplicationsincludeadditionallanguagetoseekrelevantinformationregardinginappropriaterelationshipswithstudents.

• SB7becameeffectiveonSeptember1,2017.However,TEAhasnotissuedaformaffidavitpursuanttoSB7

• Wewould not encouragedistrictstoattempttocreateahomegrownaffidavit.Thestatutespecificallysaystheaffidavitwillbeaform“adoptedby”TEA.Alocallyadoptedformwouldnotsuffice.Consequently,districtsmaydecidetotakenoactionatthistime.

• Ifyourdistrictusesthe modelTASBHRServicesapplicationform,italreadyinquiresastoadjudicatedoffensesandincludesaverificationthattheinformationistrueandaccurateandastatementthatdeliberatefalsifications,misrepresentations,oromissionsoffactmaybegroundsforrejectionordismissalfromemployment.

• IfyourdistrictisamemberofRegionOneESC’sOneApp,youareincompliancesincewefollowasimilarmodeltoTASB.Inaddition,assoonasTEAissuestheformaffidavit,wewilladoptitinOneApp.

Sec. 21.009. PRE-EMPLOYMENTAFFIDAVIT.(a) An applicant for a position described by Section 21.003(a) or (b) with aschool district, district of innovation, open-enrollment charter school,regional education service center, or shared services arrangement mustsubmit, using a formadoptedby theagency, a pre-employment affidavitdisclosing whether the applicant has ever been charged with, adjudicatedfor, or convicted of having an inappropriate relationship with a minor.(b) An applicant who answers affirmatively concerning an inappropriaterelationship with a minor must disclose in the affidavit all relevant factspertaining to the charge, adjudication, or conviction, including, for acharge, whether the charge was determined to be true or false.
