What is it?

Eversheds Nicea has set up a unit that specialises in pharmaceutical law to support to in-house legal departments manage exceptional increases in volume of work for various reasons, for instance the absence of a team member, major acquisition projects, year-ends etc.

Our lawyers have worked in-house in the legal departments of major pharmaceutical companies and are able to offer a wide range of services including:

– drafting and negotiation of all types of contracts specifically related to the pharmaceutical industry of a routine or frequent nature (advisory boards, donations, sponsorships, speakers, etc.)

– drafting and negotiation of contracts concerning

projects or initiatives promoted by pharmaceutical companies within the framework of their activity (projects aimed at improving patients’ lives, publication of guides about a given pathology, implementation of innovative diagnostic technology, etc.)

– drafting and negotiation of complex contracts

specifically related to the pharmaceutical industry (licence agreements, sales force agreements, etc.)

– provision of support for clinical trials (clinical trial contracts, informed consent, licence agreements for the use of data obtained from the trials, laboratory contracts, pharmacy contracts, contracts with CROs, confidentiality agreements, equipment loan agreements, etc.), observational studies, Investigator Initiated Trials (IIT) agreements and contracts with lead researchers, both at the local level and at EMEA and APAC level

– provision of support to the different divisions in companies (healthcare, pharma, vaccines, oncology, medical affairs etc.)

– global management of the affairs of affiliate pharmaceutical companies, acting as Geographic Assigned Lawyer to the affiliate, providing advice to the management team committee and attending to their meetings

How do we provide our services?

Eversheds Nicea is aware of the need for companies’ legal departments to have a close relationship with their clients (the business). However, in this technological age in which telecommunications have made it easy to access clients and to communicate with them we consider that, using both in-person and technological techniques, the client can be provided with an excellent global service.

Our proposal is as follows:

– understanding your needs: after an initial meeting with you to get a deeper understanding of your requirements, our Unit Manager will give her opinion and set out the possible ways forward. The parties will then agree on the conditions under which the service will be provided

– provision of the service: this stage involves providing

continuous support to you and your business regarding those matters which the members of the pharmaceutical company’s in-house legal team delegate to us

– the service will have the following features:

- initial presence, defined and adjusted to your requirements, of one of the our members in your legal department. This will allow both the business and the lawyer in question to get to know one another. The duration of the service and the period of the initial presence of the lawyer from the Unit will be agreed by both parties according to the length of the support period requested by you

- regardless of which member of the Unit is assigned to provide the service, matters will be coordinated, reviewed and approved by the Management of the Unit

- it is recommended that you assign the lawyer from the Unit an email address, facilitating contact

between him/her and the business

– occasional meetings at your request when required

Marta is a Senior Lawyer in Eversheds Nicea’s Life Science Department. She mainly works in litigation, advising and representing clients in court.

In particular, her professional practice focuses on advising companies in the pharmaceutical sector as regards their main areas of activity, with an emphasis on representing them before the court on patent infringements, product liability and unfair competition claims.

In addition, Marta has supplemented her experience in the sector by working as an in-house lawyer in the legal departments of pharmaceutical companies such as Glaxosmithkline, S.A. (Spain) and Celgene International Sarl (Switzerland).

Education

– graduate in Law from the Complutense University, Madrid

– preparation of public examinations to enter the Judiciary and the Public Prosecutor’s Office

– author of articles for specialist publications in the pharmaceutical sector (CEFI) and in general law (Lexogology)
