The 173rd
Meeting of the Eastern Regional Committee (ERC), National Council for Teacher
Education (NCTE) was convened on 26th
June, 2014 at Conference Hall, ERC, NCTE,
15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below
were present at the time of the 173rd
ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them
about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the
permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the
Committee for its due consideration and appropriate decision.

Inspection conducted by the NCTE Hqrs. U/S 13 on the basis of direction
given by the Hon’ble High Court of Jharkhand.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs
- Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the
High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section
13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency
letter No.93-30/2014/NCTE/Insp/A86677 dated 01.05.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide
letter dated 13.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the
NCTE Hqrs as well as reply dated 13.06.2014 submitted by the institution, the matter was discussed in
detail and observed as under:
1. The following deficiencies are still exist :
(i) The B.Ed. Department is located in a part of the building with a covered area of 443 sq.ft.
which is less than the required 1500 sq,m.
(ii) Laboratories like Psychology, ICT, Art & Craft Resource Centre etc are not available.
(iii) No separate provision has been made for Health and Physical Education.
(iv) The Library has a stock of 800 books which is less than the required 3000 books as per
norms.

(v) The University has recruited eight lecturers on contractual basis for 11 months for the
year 2013-14 and posted them in this college on 03.09.2013. The services of the staff are
terminated after 11 months and fresh appointments are made in the beginning of a
session. As per norms the teaching faculty must be appointed on regular basis.
In view of the above, the committee decided as under:
Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn
on the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE
Act 1993 to the institution to submit its reply within 30 days from the issue of the letter before the
Committee takes final decision.
A copy may also be sent to the Registrar of the concerned university and State Govt.

A complaint dated 21.10.2013 forwarded by NCTE Hqrs on 27.12.2013 received from Mrinmoy Mandal
stating that Dr. Sarepalli Radha Teacher Training College, Daultabad, Dist- Murshidabad and Daulatabad
Primary Teachers Training College, Daultabad, Murshidabad are running in the same campus and same
land.
The committee considered the complaint and decided as under:
1. The institution be asked to submit the certified copy of land documents of both the institutions
along with building plan duly approved by any Government Engineer.
2. A copy of the complaint may be forwarded to the District Magistrate of the concerned District
with a request to direct the concerned officers to make an inquiry whether both the institution are
running in the same campus or has separate land and building and submit the report within 30
days.

against the institution of RTC B.Ed College regarding removal from the teaching faculty by the
management of the institution.
The committee considered the complaint and decided as under:

college for comments.

Magadh Teacher’s Training College, West Church Road, Near D.M.

A complaint dated 19/02/2014 received from Anant Kumar and another complaint dated 03.02.2014
received from Bipin Kumar, Gaya against the institution.
The committee considered the complaint and observed as under:
Mr. Brij Mohan Singh, Mr. Vijay Kumar Pandey and Mr. Ishwar Singh who were shown as lecturers in
the approved faculty of Magadh Teacher Training College, Gaya also shown as lecturers in A.M. College,
B.Ed Course, Kotari Hill Road. Gaya.
In view of the above, the committee decided as under:
A clarification letter be issued to the both the institutions to submit its reply within 30 days from the issue
of the letter before the Committee takes final decision.
11. 173.12(i).4 S.M. Zaheer Alam Teacher Training College, Bahera, Darbhanga, Bihar-
847201 (B.Ed.) (Private) (L.N. Mithila University) (Code No.APE00506)
The complaints dated 21.05.2014, 20.05.20114, 18.05.2014, 22.04.2014, 31.03.2014, 03,03,2014,
11.12.2013, 28.10.2013 and 18.07.2013 received from the different complainants regarding illegal
admission made by the S.M. Zaheer Alam Teacher Training college and collecting huge amount from the
students.
The Registrar of the Lalit Narayan Mithila University has also sought a clarification vide its letter No.
6372/14 dated 03.06.14 regarding total intake of 200 students, which was granted by the ERC in two
installments i.e vide order No. BR-S/E-9/96/6268 dated 22.06.1998 granted recognition with intake of 150
and vide order No. ERC/BR-S/E-9/96/14533 dated 03.12.2008 granted additional intake of 50 for making
the total intake of 200 students.
As per NCTE Regulation 2009, the institution has to accredited by NAAC with a Grade “B”certificate on
or before 1st April 2010 failing which the additional intake granted shall stand withdrawn with effect from
the academic session 2010-11. The institution has failed to accredited by NAAC till date.
Hence, committee decided to withdraw the additional intake of 50 granted vide order No. ERC/BR-S/E-
9/96/14533 dated 03.12.2008 with effect from the session 2014-15. The institution henceforth will make
admission for intake of 150 only order No. BR-S/E-9/96/6268 dated 22.06.1998.

Sova Rani College Of Education, Vill-Gobindapur, Tehsil/Taluka-Birahimpur,
City-Malda, P.O-Birampur, Dist-Malda, West Bengal-732207 (D.El.Ed.)

A complaint dated 10.02.2014, 28.02.2014, 20.06.2014 received from Sukdeb Biswas, Bijon Poddar and
other local people of Najarpur, Malda stating that the Malpractice and fraudulent activities is being done
by the President of Sova Rani College of Education (D.El.Ed.). The institution building is not constructed
in the same land and plot No. 143 & 145 which was submitted in the ERC office. Moreover, the said trust
authority in order to commit malpractice laid down the signboard and have changed the colour of Sova
Rani College of Education (D.El.Ed) to show that the name of college as Janardan College of Education
(B.Ed).
In view of the above, the committee decided as under:
1. A copy of the complaint may be forwarded to the District Magistrate, Malda, West Bengal with a
request to direct the concerned officers to inquire the matter and submit the report to RD, ERC,
NCTE, Bhubaneswar within 30 days.
2. The institution be asked to submit the certified copy of land documents from both of the
institutions along with building plan.

ER-172.12(ii) Misc. Cases - (II)
13. 173.12(ii).1 Central University of Bihar, BIT Campus, Po-B.V. College, Patna-800014,
Bihar (Govt.) (Course: 4 year Integrated B.A. B.Ed. and B.Sc.Ed.)
The Registrar, Central University of Bihar had submitted an application for grant of recognition for
innovative course viz. four 4-year Integrated B.A.B.Ed and B.Sc.B.Ed on 23.01.2014 and same was
forwarded to the NCTE Hqrs for examination if its innovativeness.
The NCTE Hqrs vide letter No. 61-1/2013/NCTE/Acad/A85909 dated 16.04.2014 has advised to the
Registrar of the Central University, Bihar as follows:
“… to stop admitting students in the said teacher education courses not recognized by NCTE and also
inform that the degrees of the students already passed/admitted in the said teacher education courses shall
be treated as invalid for employment purposes as per section 17(4) of the NCTE Act.”
The committee noted the decision of the Appeal Committee.

Central University of Jharkhand, Vill- Cheri/Manatu, Po- Bukru, Tehsil-Kanke
(Gonda), Town/City-Ranchi, Dist.-Ranchi, Jharkhand-834006(Govt.)
(Course: 4 year Integrated B.A. B.Ed. and B.Sc. B.Ed.)
Previously the Central University of Jharkhand had submitted an application for grant of recognition for
innovative course viz. four 4-year Integrated B.A.B.Ed and B.Sc.B.Ed on 28.10.2014 and same was
forwarded to the NCTE Hqrs for examination if its innovativeness. The said application had already been
refused/dropped by the NCTE Hqrs vide letter No. 61-1/2013/NCTE/Acad/A83093 dated 19.02.2014.
Further the Central University of Jharkhand has submitted a proposal of 4-year B.A. B.Ed and B.Sc.B.Ed.
programme vide letter No. CUJ/CE/3/808/2014 dated 28.02.2014 to the Member Secretary, NCTE, New
Delhi.
In view of the above, the committee decided as under:
A copy of the proposal of Central University of Jharkhand may be forwarded to the Member Secretary,
NCTE, New Delhi for further necessary action in the matter.

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High
Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of
the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter
No.93-62/2014/NCTE/Insp/A86383 dated 30.04.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide
letter dated 09.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the

NCTE Hqrs as well as reply dated 09.06.2014 submitted by the institution, the matter was discussed in
detail and observed as under:
The following deficiencies are still exist :
(i) The land and building is not demarcated for the B.Ed. programme.
(ii) Multipurpose hall is not available in the institution.
(iii) There are no Psychology lab, Language learning lab. Art & work experience room, play-
ground and the staff room, Principal room and common room, play ground and staff
room for B.Ed course.
(iv) Books in the Library are only 1006 which is less than the required 3000 books. Seating
arrangement in the library is not available.
(v) Computers in the ET room are not available.
(vi) The HOD is not appointed for B.Ed. programme.
(vii) The institution is required to submit a fresh faculty list appointing the faculty on regular
basis and duly approved by the Registrar of the concerned university alongwith their
educational/professional certificates.
(viii) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh are not submitted towards endowment
fund and reserve fund respectively into joint account in the name of institution and RD,
ERC, NCTE, Bhubaneswar.
In view of the above, the committee decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs
- Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the
High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section
13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency
letter No.93-67/2014/NCTE/Insp/A86412 dated 30.04.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide
letter dated 10.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the
NCTE Hqrs as well as reply dated 10.06.2014 submitted by the institution, the matter was discussed in
detail and observed as under:
(i) The institution is required to submit a fresh faculty list duly approved by the Registrar of the
concerned university alongwith their educational/professional certificates.
In view of the above, the committee decided as under:
A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the
letter before the Committee takes final decision.
A copy may be sent to the Registrar of the concerned university for information.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda - Vs -
Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High
Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of
the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter
No.93-65/2014/NCTE/Insp/A86417 dated 30.04.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide
letter dated 14.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the
NCTE Hqrs as well as reply dated 14.06.2014 submitted by the institution, the matter was discussed in
detail and observed as under:
(i) During granting recognition, the institution vide letter dated 21.02.2005 committed that the
college has earmarked a separate complete building for the Department of Education of the
College of B.Ed and separate psychology, Science lab, lecturers room and Library would be
constructed in due course of time.
(ii) As per recognition order, the B.Ed deptt shall be shift to its own building having separate
campus within a period of 3 years.
(iii) As per VT report, the new building for the Department of education is under construction and
the B.Ed college is still functioning in the existing building of General college whereas the 08
years have already been elapsed.
(iv) Laboratories and Library is not available in the B.Ed department.
(v) All teaching faculty have been appointed on contractual basis for a period of less than one
year.
(vi) No regular HOD has been appointed to supervise the work of the faculty.
(vii) Separate supporting staff for the B.Ed department has not been appointed.
(viii) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh are not submitted towards endowment fund
and reserve fund respectively into joint account in the name of institution and RD, ERC,
NCTE, Bhubaneswar.
In view of the above, the committee decided as under:

The committee in its 171st meeting decided as under:
As per the court order, the committee authorized the Regional Director to call the petitioner for hearing
their case and thereafter a reasoned order communicate to the petitioner.
Accordingly, a letter to the institution informing the date & time u.e. 07.07.2014 at 10.00 A.M. at ERC,
NCTE, Bhubaneswar for hearing was issued on 17.06.2014.

In view of the above, the committee decided as under:
1. A copy of the complaint may be forwarded to the District Magistrate, Malda, West Bengal with a
request to direct the concerned officer to inquire the matter and submit the report to RD, ERC,
NCTE, Bhubaneswar within 30 days.
2. The institution be asked to submit the certified copy of land documents both of the institutions
along with building plan.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs
- Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the
High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section
13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency
letter No.93-72/2014/NCTE/Insp/A86391 dated 30.04.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide
letter dated 16.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the
NCTE Hqrs as well as reply dated 16.06.2014 submitted by the institution, the matter was discussed in
detail and observed as under:
(i) As per VT report, the salary to the teaching faculty and staff is paid on consolidated bases
and other benefits like EPF, Medical facilities are not provided.
In view of the above, the committee decided as under:
A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the
letter before the Committee takes final decision.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs
- Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the
High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section
13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency
letter No.93-67/2014/NCTE/Insp/A86412 dated 30.04.2014.
In response to the deficiency letter issued by the NCTE Hqrs, the institution has not submitted any reply in
response to the deficiency letter. The committee considered the report of the NCTE Hqrs as well as
deficiency letter issued on 30.04.2014 observed as under:
(i) The institution is required to submit a fresh faculty list duly approved by the Registrar of
the concerned university.
(ii) Salary statement of staff last 3 months and EPF deduction to be submitted.
In view of the above, the committee decided as under:
A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the
letter before the Committee takes final decision.

The complaints dated 29.01.2014 & 05.02.2014 submitted by the SK Saiful Alam and another complaint
dated 03.05.2014 submitted by Md. Sabir Mahmood have already been forwarded to the Secretary, West
Bengal Board of Primary Education vide letter No. 26294 dated 18.06.2014 with a request to inquire the
matter by conducting an inspection and submit the report within 30 days. Reply from the Secretary, West

increase of intake capacity in the existing teacher training institutions in the

The NCTE Hqrs. vide letter No.A78554, dated 3.12.2013 granted relaxation for increase of intake capacity
in the existing teacher training institutions in the State of Odisha. Accordingly, the recognition was
granted to all the 69 institutions subject to condition that the deficiencies pointed out by the VT would be
completed upto December 2014. However, VT letter to all the institutions were issued as per the decision
of the ERC, NCTE.
The Director, Directorate of Teacher Education and SCERT, Odisha, Bhubaneswar vide letter dated
24.06.2014 received in this office on 26.06.2014 informed that the visiting team of NCTE has visited all

The Govt of Odisha, School and Mass Education Department submitted a order No. 12970/SME dated
16.06.2014 stating that “the State Government has decided that no objection certificate to any private
institution can not be issued for B.Ed and D.El.Ed course and as such the case of the appellant is rejected.
The committee noted the order of the Hon’ble Supreme Court as well as the decision of the Government of
Odisha.
