ACTIVE (MUNICIPAL SOLID WASTE, INDUSTRIAL, OR ASH) LANDFILL
A landfill is a solid waste management facility where solid waste is disposed. This form applies to municipal solid waste, industrial, and ash monofill landfills. Further information and a listing of the landfills are available online at http://www.dec.ny.gov/chemical/23681.html. Note: If you operate a construction and demolition debris, land clearing debris landfill, or a Long Island landfill, DO NOT use this form. Forms for all solid waste management facilities, sample completed reports, and a brief description of each can be found at http://www.dec.ny.gov/chemical/52706.html.
Annual/Quarterly Report
Submit the Annual Report no later than March 4, 2013. For use of this form as an Annual Report, complete line A and complete Sections 1 through 13 and 19 through 21. The Annual Report form is to be used to meet annual reporting requirements (excluding results from annual sampling events which require the use of the Quarterly Report form as noted in the following paragraph). For use of this form as a Quarterly Report, complete line B and complete Sections 1 and 14 through 21. The Quarterly Report form is to be used for reporting of quarterly, semiannual, or annual results from each sampling event without regard for whether the sampling event is required on a quarterly, semiannual, or annual basis. Submit the Quarterly Report no later than 60 days after the last day of each calendar quarter or within 90 days of the conclusion of sample collection if Site Analytical Plan requirements must be met. Reporting of the information indicated on this Active Landfill Annual/Quarterly Report form is required pursuant to 6 NYCRR 360-1.4(c); 360-1.8(e)(1)(ii); 360-1.14(e)(2), (i)(1); 360-2.9(j)(3); 360-2.11(c)(5)(iv), (d)(5), (d)(6); 360-2.14(a)(2)(vi); 360-2.17(a), (t); 360-2.19(b)(1)(ii), (c)(1)(ii), (d)(1)(i); 360-6.5(d); and 360-8.1. Failure to provide the required information requested is a violation of Environmental Conservation Law. Timely submission of a properly completed form to the Department’s Regional Office that has jurisdiction over your facility and to the Department's Central Office is required to meet the Annual/Quarterly Report requirements of 6 NYCRR Part 360. Where the Annual/Quarterly Report requirements have been modified, appropriate Sections (as necessary to reflect the modification) must be completed and submitted with a copy of the Department's written notification which allows the modification. Entries on the report forms should be either typewritten or neatly printed in black ink. Attach additional sheets if space on the pages is insufficient or supplementary information is required or appropriate. Please note that where reference is made to a "Quarter" such as in line B, Quarter 1 is from January 1st to March 31st, Quarter 2 is from April 1st to June 30th, Quarter 3 is from July 1st to September 30th and Quarter 4 is from October 1st to December 31st.

SECTION 20
Operations and Maintenance Manual - Section 19.2.1 Quarterly Reports
Each quarterly monitoring report will provide information on activities occurring during the quarter in question (January 1 to March 31, April 1 to June 30, July 1 to September 30, October 1 to December 31) and will be submitted no later than 60 days after the last day of the quarter in question. All quarterly reports will be submitted on the forms provided by the NYSDEC or electronically as specified by the NYSDEC and shall also contain the following;
1. Report on funding levels of closure and post-closure funds and evidence that proper financial assurance mechanisms are in place.
2. Amounts of leachate collected by each primary and secondary leachate collection systems on a daily basis.
3. Amount of leachate removed from the leachate tanks on a daily basis and the disposal location.
4. Amounts and dates of fluid removed from the leak detection monitoring risers (double contained tanks and double contained leachate lines).
5. Amounts of waste (mixed municipal, water and wastewater sludges, industrial waste & sludges, ash, C&D debris, asbestos, compost, yard wastes, contaminated soils) received from each New York State County, from each State and from outside of the Country.
6. Amounts of landfill gas condensate generated at the flare knockout tank, the disposal location, and the number of landfill gas collection wells in operation.
7. Groundwater and surface water quality results.
8. The amount and types of waste utilized as alternate daily cover.
9. The results of the methane gas migration monitoring program required by 6 NYCRR Part 360-2.17(f)(2).
10. The results of the monitoring of the landfill surface in accordance with 6 NYCRR 360-2.21(f)(3). Any remediation or required modifications shall be reported as well.
11. Odor Complaint records as applicable.

Quarterly Gas System Report
Quarterly Gas System Report Fourth Quarter 2012 The C.I.D. Gas Facility has three condensate knockouts on the Existing landfill, a knockout on the main header running from the landfill to the flare, and a knockout on the 18 inch header located in the northwest corner of the Western Expansion. The three knockouts on the landfill remove condensate from the landfill gas and drain into existing leachate collection tanks. Due to this configuration, quantities of condensate passing through these knockouts are unavailable. The main header, however, employs a condensate knockout that drains to its own condensate storage tank. The condensate levels are read each week by stick measurement and emptied as needed. The knockout in the northwest corner of the Western Expansion drains into a vertical sump and is pumped through into the leachate force main and ultimately into the leachate storage tanks. Flows are tracked via flow meter and flows are recorded daily. All condensate is pumped into a tanker truck and taken to either Buffalo Sewer Authority or Niagara Falls Wastewater Treatment plant for disposal. Total Condensate generated for this Quarter: 28,739 gallons Total gallons treated at Buffalo Sewer Authority 0 Total gallons treated at Niagara Falls W.W.T.P. 28,739 gallons Currently there are 50 active gas wells on the existing site and 10 active wells in the Western Expansion. All of these wells are at the surface and monitored on a monthly basis. The entire collection system is also monitored monthly.

Mr. Thomas Lewis District Manager WMNY – CHAFFEE LANDFILL 10860 Olean Road Chaffee, NY 14030 Dear Mr. Lewis: Re: Fourth Quarter Surface Monitoring at Chaffee Landfill NYSDEC Permit ID No.: 9-1642-00001/00013 On October 19, 2012, Conestoga-Rovers & Associates, Inc. (CRA) conducted the fourth quarter surface monitoring at the Waste Management of New York, LLC - Chaffee Landfill facility located in Sardinia, New York. The monitoring was conducted in accordance with Code of Federal Regulations (CFR) Title 40, Part 60, Appendix A, Method 21. Mr. Michael Casullo of CRA performed the calibration evaluation and monitoring using a Thermo Environmental Instruments Toxic Vapor Analyzer (TVA) 1000 flame ionization detector (FID) to determine surface methane levels. Attachment 1 contains the monitoring instrument performance evaluation and calibration documentation. The monitoring followed a serpentine pattern at 30-meter intervals, as required in 40 CFR Part 60 Subpart 60.753, and generally followed the pattern described in the Surface Monitoring Plan for the facility. In addition, all ground penetrations were monitored when encountered, which resulted in frequent diversions from the general surface-monitoring path. The fourth quarter of 2011 marked the third consecutive quarterly monitoring period with no recorded exceedances of the 500 ppm limit for the Closed Landfill. Therefore, surface monitoring for this area is now conducted annually as stated under 40 CFR 60.756 (f): Each owner or operator seeking to demonstrate compliance with §60.755(c), shall monitor surface concentrations of methane according to the instrument specifications and procedures provided in §60.755(d). Any closed landfill that has no monitored exceedances of the operational standard in three consecutive quarterly monitoring periods may skip to annual monitoring. Any methane reading of 500 ppm or more above background detected during the annual monitoring returns the frequency for that landfill to quarterly monitoring. CRA elected to perform the 2012 annual surface monitoring of the Closed Landfill during the fourth quarter. During the fourth quarter surface scan, the Closed Landfill did not exhibit any exceedances of the 500 ppm above background limit and no further action is required for this area. Since there were no exceedances, the Closed Landfill will continue to be monitored annually going forward.

CRA also monitored Cell 5 of the Western Expansion Landfill during the fourth quarter surface scan since this area will become subject to quarterly surface monitoring under New Source Performance Standards (NSPS) in November 2012 (Cell 5 area first received waste in November 2007). During the fourth quarter surface scan, the Western Expansion Cell 5 Area did not exhibit any exceedances of the 500 ppm above background limit and no further action is required for this area. The Western Expansion Cell 5 Area will continue to be monitored quarterly going forward. The Chaffee Landfill facility is in compliance with the requirement of 40 CFR 60.753(d) for Municipal Solid Waste (MSW) Landfills. Jim, We received an email regarding odor concern on December 9, 2012 from resident John Petersen who is located West of our site. The average temperature that day was 34.7 degrees with SE winds. During the investigation on Monday morning I drove Hand Road and did not note odor. The lead operator at the site also drove Hand Road and did not note odor. We checked the landfill surface for cover integrity issues and did not note defects. The odor control system was operational over the weekend and functioning properly. I spoke with our gas technician who lives nearby and traveled Hand Road several times this past weekend. He said when he passes the landfill he always checks for odor. He did not notice odor this past weekend. To help resolve the matter, we increased the flow of odor control agent (Evane Scent). We are also considering the option to extend the hours of operation for the odor control system. Please note that over 100 acres of adjacent farmland was recently fertilized. This past weekend they were spreading liquid manure both Saturday and Sunday.
