Subject:- Procedure for Reference to Private empanelled Hospitals by CGHS

dispensaries.

Revered Sir,

It is brought to your kind notice that OPD treatment in Private recognized hospitals

is not permitted except in case of satellite cities of Delhi, viz Noida, Gurgaon, Faridabad and

Ghaziabad where the CMO incharge can directly refer the beneficiaries to recognized hospitals.

But the CMO incharge at other cities have been barred for referring the beneficiaries directly. As

per the existing practice, the CGHS beneficiary is supposed to get recommended from a specialist

based on his finding.

Coordination Committee of Central Association, Chandigarh took up the case with

CGHS Directorate, New Delhi for empowering CMO in charge Chandigarh to refer the CGHS

Beneficiaries direct to the private empaneled hospitals as per the procedure being followed at

Delhi, Faridabad, Gaziabad, Noida and Gurgaon. The case was also discussed in the 22nd and

PENSIONER'S DAY 2014 CELEBRATIONS

Department of Hospitality U.T Chandigarh threw open the gates of Rest House U.T. Chandigarh for Celebration of Pensioner's day 2014 under the ageis of CCCGPA Chandigarh who rolled out red carpet to welcome the Pensioner's

Initiating the proceedings, Sh. M.L. Panghotra Chairman CCCGPA welcomed the members and spoke about the significance of Pensioner's Day. He told that the Day is celebrated annually to commemorate the land mark Supreme Court Judgment pronounced in D.S. Nakra and others Vs Union of India which had an impact on all subsequent policies relating to Pension as the apex Court had ruled that Pension is neighter a bounty nor a matter of grace depending upon the sweet will of the employer and that it creates a vested right.

Thereafter Raj Pal Sharma Secretary General took the stage. At the outset he lambasted the Union Govt. for adopting dilly - dallying tactics in addressing the problems relating to health care & financial benefits accruing to the Pensioners from Judgment pronounced by. Supreme Court of India. He further informed the house that the approach on the part of present day govt. has undergone a sea change as compared to the govt. during nineteen eighties. He substantiated his remark by telling the house that, while the judgment delivered by Supreme Court of India in D.S. Nakara and others V/S Union of Govt. was implemented by the then Govt. without raising Eye brow or dilution, the present govt. continue to install impediments in implementation of court judgments pronounced in favour of Pensioners under one pretext or the other. He further told the house that SCOVA is the only forum where the problems relating to Pensioners are discussed during periodic meetings held under the chairmanship of Hon'ble Minister of Pensioners and Pensioner's Welfare in the presence of representative of the level Deputy Secretary of all the concerned Departments. The decisions arrived at after thread- bare discussion are never implemented due to lackadaisical attitude on the part of concerned Ministrie. No weightage is given to the decisions taken during SCOVA meeting and the same has been gradually reduced to sumptuous tea party. Secretary General gave Clarian call to Govt. to redress the problems of Pensioner's sympathetically, failing which the annoyance of Pensioners will be felt by her even at the rustling before the day of reckoning, approaching fast. Sh. P.S. Bedi Sr. Vice Chairman of CCCGPA read out charter of demands to the house for adaption. All the twenty demands were adapted by the house unanimously for its onward submission to Prime Minister of India for redressal. Dr. Har Simran Singh MS, Mch (Ortho)of FORTIS Hospital Mohali made power point presentation regarding Hip & knee replacement under health awareness programme which was appreciated by the members. Three members, Sh. G.S. Pathania, Sh. O.P. Bhardwaj and Sh. Saranjit Singh of Majestic Press were bestowed awards for rendering excellent service to the Pensioner's Fraternity. The awards were given away by Sh. Anurag Kayshap Marketing head of Fortis Mohali, who also addressed the members and told them the Fortis Hospital holds elderly Pensioners in high esteem and assured them every kind of help as & when needed.

The celebration also included cultural programme the song sung by Mr. Awasthi in a lilting voice and the poetic recitation by Mr. Major Singh R.C. Hastir and Mr. Kochhar regaled the audience who in turn appreciated their rendering with thunderous applanse. In the end secretary General thanked the Director Hospitality U.T. Chandigarh, Fortis Hospital Mohali,Sh. G.S. Bhangoo CCCGPA Patron, Sh. Didar Singh and all affiliated Pensioners associations for all the help given to make the celebrations a great success.

Lunch was served to the members after the conclusion of the programme.

P.S.U. ABSORBEESD.1 What are the terms and conditions of Central Govt, employees who are absorbed in Central Public Sector Undertaking /Central Autonomous Bodies? The terms and conditions of Central Govt, employees who are absorbed in Central Public Sector Undertaking /Central Autonomous Bodies, are regulated as per the DOPT OM No.28016/5/85-Estt.(C) dated 31.1.86 and DOP&PW OM No.4(12)/85- P&PW dated 13.3.87. The Administrative Ministries/Departments have already been delegated powers to deal with such cases of absorption without obtaining prior concurrences of this Department.Those absorbed in Central Public Sector Undertaking are eligible for pension and retirement gratuity as admissible under relevant rules. Those absorbed in the Central Autonomous Bodies having pension scheme are required to exercise an option eitheri) to receive pro-rata retirement benefits orii) to continue to have the benefits of combined service under the Government and in the autonomous body subject to the condition laid down in the D/o Personnel & AR's OM NO.28/10/84-PU dated 29.8.84 and 12.9.85. Such option should be exercised within 6 months from the date of absorption.In case no option is exercised within stipulated period, he will be eligible for pension based on combined service.D.2 How is the restored 1/3rd commuted portion of pension in respect of Government servants

who had drawn lump sum payment on absorption in Central Public Sector Undertakings/Central Autonomous Bodies required to be revised w.e.f. 1.1.2006?The pension of Central Government pensioners has been revised w.e.f. 1.1.2006 vide this Department's OM No.38/37/08-P&PW(A) dated 1.9.2008. Orders for revision of 1/3rd pension of those who had drawn lump-sum payment on absorption were issued vide DOP&PWs OM No.4/30/2008-P&PW(A) dated 15.9.2008 read with OM dated 27.5.2009.Keeping in view the direction of Hon'ble CAT, Hyderabad Bench orders have been issued vide OM dated 11.7.2013 that 1/3rd restored pension of those Government servants who had drawn lump-sum payment on absorption in PSU/AB and whose 1/3rd pension was restored from a date before 1.1.2006, the pre-revised 1/3rd restored pension will be revised w.e.f. 1.1.2006 by multiplying the same by a factor of 2.26, if it is more beneficial than the amount of revised restored 1/3rd pension arrived at in terms of this Department's OM dated 15.9.2008. In the case of those absorbee pensioners in whose case the restoration of 1/3rd pension became due on or after 1.1.2006, the above formulation would apply with reference to notional 1/3rd restorable pension as on 31.12.2005.Payment of DR and additional pension to old pensioners (of the age of 80 years and above) shall continue to be on full pension as per the instructions issued from time to time. The benefit of revision of restored amount of 1/3rd commuted portion of pension shall be admissible w.e.f. 1.1.2006 or from the date the commuted portion of pension is restored, whichever is laterD.3 Is DOP&PWOM No.38/37/08-P&PW(A) dated 28.1.2013 for stepping up of the pension of pre-2006 pensioners w.e.f. 24.9.2012 applicable to Government servants who had drawn lumpsum payment on absorption in Central Public Sector Undertakings/ Central Autonomous Bodies and whose 1/3rd pension has been restored?It has been clarified in the OM dated 3.4.2013 that the notional full pension of the absorbed pensioners would also be stepped up w.e.f 24.9.2012 in accordance with the instructions contained in the aforesaid OM dated 28.1.2013. No arrear of DR and additional pension on notional full pension would be payable for the period prior to 24.9.2012.

Record Note of the meeting held on 24.10.2013 at 3.00 PM to discuss the possible Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM

A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Ulock under the chairmanship of Dr S K Sarkar, Secretary DOP&T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, which is going to be set up by the Government, with the representatives of the Staff Side of JCM.At the outset, Secretary (P) welcomed the Staff side representatives and thanked them for attending this meeting on a short notice. He indicated that since this meeting has been convened to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, he hoped that the discussions would remain so focused.Sh Umraomal Purohit, Secretary, Staff Side, in his opening remarks stated that it would have been preferable that there was a proposal from the official side on this issue to the Staff Side and then the same could have been discussed further in a meeting where the Finance Secretary could also be

thinvited. He then pointed out that the new concept of Pay Bands and Grade Pay structure as per the 6 CPC, which changed the pay structure in Government, had resulted in a new experience which was

thmixed. He stated that though the 6 CPC did not recommend merger of DA with Pay, they could not have anticipated such a high rate of inflation which resulted in such high rate of DA; the rate of Dearness Allowance presently was 90% and due to high inflation there was a need to consider merger of a part of

thDA with Pay. He also raised the question of Interim Relief pending finalisation of 7 CPC recommendations. Shri Purohit further mentioned that anomalies of 6th CPC should be resolved on priority before 7th CPC. He also suggested that there must be some machinery which should resolve anomalies within one year of implementation of CPC report.

M.Raghavaiah, while thanking the Chairman raised the issue of anomalous situations which thhad arisen due to the new concept of Pay Bands and Grade Pay structure as per the 6 CPC. He

suggested that the Finance Ministry should look into this aspect as to how anomalies cropped up due to this and how these can be avoided in future. He was of the view that the anomalies cases which stand referred to the Ministry of Finance need to be cleared. He referred to anomalies relating to MACP scheme vis a vis ACP scheme and resolution pending thereon required to be resolved as already discussed in the Joint Committee meetings on MACPS. He also demanded that there should be merger of DA with Pay as was agreed to in 2004. He also pointed out that the Railway Ministry's proposals on 6th CPC related matters presently pending with Ministry of Finance should be cleared.

The other representatives from Staff Side raised the following issues1) Entry level pay to promotee employees at par with that admissible to Direct Recruits as was

agreed in the National Anomaly Committee;2) One of the ToR should be to set up a special bilateral mechanism to sort out anomalies arising

out of Pay Commission recommendations;3) Professional approach should be adopted in dealing with peculiarities concerning Railways and

Defence civilian employees;4) There should be parity between pre & Post CPC retirees for the purpose of pension etc.;

th5) Cadre review/restructuring proposals should be delinked from the 7 CPC so that these are not delayed;

6) Wage Revision should be effective after every 5 years as in the case of PSUs;7) If there is going to be separate CPC for the Armed Forces as had been reported in media, or if

ththere is a representative of Armed Forces in the 7 CPC then there should be a representative of th Labour in the 7 CPC;

8) CPC should not go by "Central Secretariat" structure to make its recommendations which does not take into account specific complexities in large Government organisations like Railways, Postal Department and Defence establishments.

9) Allowances should be enhanced concurrently with the pay consequent upon Pay commission implementation.

10) Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/4/2007. These judgments should be implemented to all similarly placed employees.

11) The Secretary Staff side in the end requested that a copy of Terms of Reference as proposed by the Ministry of Finance may be circulated and then another meeting with Secretary, Department of Expenditure and Department of Personnel & Training be arranged to discuss & finalise the Terms of Reference of 7th CPC.In his concluding remarks, the Chairman thanked the participants for their views and requested the Staff Side that they may send their suggestions in writing also.

Section 4(1 )(b) of the RTI Act lays down the information which should be disclosed by Public Authorities on a suo motu or proactive basis. Section 4(2) and Section 4(3) prescribe the method of dissemination of this information. The purpose of suo motu disclosure under Section 4 is to place large amount of information in public domain on a proactive basis to make the functioning of the Public Authorities more transparent and also to reduce the need for filing individual RTI applications.1) In order to further improve the proactive disclosure, Government of India constituted a Task Force on Suo motu disclosure in May 2011, which included representatives of civil society organizations active in the field of Right to Information. After considering the recommendations of the Task Force, the Government of India has already issued guidelines to Central Ministries/Departments for Proactive Disclosure under Section 4 of the RTI Act vide OM No. 1/6/2011-IR dated 15/04/2013.2) The Task Force also recommended guidelines for disclosure by State Governments along with templates for disclosure at various levels. Illustrative templates have been recommended for disclosures under Public Distribution System, Panchayats, MGNERGA, and Primary and Secondary Schools. A Copy of the guidelines along with templates is enclosed as Annexure.3) You are requested to consider issuing the above guidelines and templates for better implementation of the suo motu disclosure at State level.

a) whether the Supreme Court has upheld the decision of High Court and CAT for providing the benefit of Sixth Pay Commission to Government employees who retired before 1st January, 2006;b) whether it is a fact that Supreme Court in its judgement has given benefit w.e.f. January, 2006;c) whether the Ministry has implemented the judgement of Supreme Court in totality while giving benefit to those retirees w.e.f. January, 2006; and if so, details thereof and if not, reasons therefor?

The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department's Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department's letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon'ble CAT directed

that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension® 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

Writ Petitions were filed in the Hon'ble High Court of Delhi challenging the above mentioned order.

In its order dated 29.4.2013, the Hon'We Delhi High Court has upheld the order dated 1.11.2011. After considering the order of Hon'ble High Court of Delhi and various representations received in this regard, Special Leave Petition was filed by the Department of Pension and Pensioners' Welfare in the Hon'ble Supreme Court of India.Department of Pension & Pensioners' Welfare filed an SLP in the Hon'ble Supreme Court against this order. This SLP came up for hearing on 29.7.2013 and was dismissed and the Review Petition was also dismissed. Union of India has also filed SLP against the order dated 29.4.2013 in Writ Petitions No.2348/2012, 2349/2012 and 2350/2012 in the Hon'ble Supreme Courtwhich came up for hearing on 19.11.2013. The Hon'ble Supreme Court directed to list the SLP alongwith CA No.8875-8876 of 2011 filed by Ministry of Defence and is now listed for hearing on 4.2.2014. The matter is therefore sub-judice.

QUALIFYING SERVICE

B.1 Does all leave period qualify for pension and gratuity?All leave for which leave salary is payable qualifies for pension and gratuity. Extraordinary leave (EOL) on medical certificate (MC) also qualifies for pension and gratuity. EOL without MC qualifies only on account of inability to join duty on civil commotion or when granted for a higher scientific & technical study qualifies.

B.2 Is the benefit of counting of past service under Rule 19 available to ex- servicemen re-employed to civil service/post?An ex-serviceman re-employed to the Civil Post/service on or before 31.12.2003 is covered under CCS(Pension)Rules, 1972. Therefore the benefit of Rule 19 also becomes automatically available to him. An ex-serviceman re-employed in civil service on or after 1.1.2004 is covered by the New Pension Scheme and is not covered under the CCS(Pension) Rules, 1972. Therefore the benefit of Rule 19 is not available to the ex-serviceman on re-employment on or after 1.1.2004.

B.3 What happens to the past service of a Govt, servant (appointed before 1.1.2004) who resigns to take up, with proper permission, another appointment under the Govt.?Under Rule 26 (2) "A resignation shall not entail forfeiture of past service if it has been submitted to take up, with proper permission, another appointment, whether temporary or permanent, under the Government where service qualifies". This also applies to a Govt, servant who joined Govt, service before 1/1/2004 and takes up another appointment in the Govt., on or after 1.1.2004.

Rejoinder to this by Petitioners Advocate was submitted on 24.7.13.However, Sitting of Court didnot take place on 25.7.13 and next date of hearing was fixed as 17.9.13.. Heard on 19.12.13,when UOI wanted to link the case in SC in case of SLP 118339-341 etc. but on opposing by pet i t ioners advocate, Court declined it. Thereupon, UOI advocte asked for time to submit some papers and Court adjourned the case granting time but with directive that then, there would be a final hearing in the case.

Petitioners are pre 2006 Pensioners belonging All India Service Officers of Govt. of U.P. retired from pre revised pay scale of Rs. 18,400-22,400. The U.P. Govt. implemented SCPC Report with certain modifications and issued G.O. No. Sa/3/1358 /Das-2010 dated 19.07.2010 fixing their revised pension at Rs. 26,500 w.e.f. 1.1.2006. The Pensioners grieance is that thier pension shold have been fixed at Rs. 27,350 w.e.f. 1.1.2006. The Court heard the case last on 1.7.2013, when as asked for by the Court earlier, UOI submitted a copy of the SCPC Report through a detailed affidavit. On 15 07 13 Pentioners filed CA to SA of UOI. Listed for 29.7.13 and 29.8.13 but no hearing took place on those dates.

"We are informed by Mr.Rohit Kr. Hon.le Supreme Couart vide Judgment dated 4.9.12 had directed for refixation of their pay after adding the Rank Pay and arrears paid accordingly. MOD issued orders on 27.12.12 for implementat ion of the said Judgment. CP(C) 328 of 2013 has been preferred in Supreme Court with plea that (1) Judgment should be implemented w.e.f. 1.1.1986 and not as on 1.1.1986,(2) Minimum of Pay in Integrated Pay Scale for each Rank of officers given in SAI 1/S/87 for Amy and equivaalent officers in Navy and AF should also be raised,(3) Maximum of Integratred Pay scale i.e. 5,100 should also be raised and (4) Refixation of revised pay on 1.1.1996 (5th CPC) and 1.1.2006 (6th CPC) should be done again on the basis of law set by the above mentioned Judgment of the Apex Court, now, meaning thereby, that, the revised pay should be refixed by adding into existing pay the admissible component of Rank Pay or MSP, as the case may be and,payment of arrears be made,accordingly. Further, it is learnt that the Attorney General for India, when Govt. sought his advice, has advised, after due consideration of the pleas in the light of Apex Court Judgment to

thPlease refer to your letter dated 7 September, 2013 regarding inadequate facilities at CGHS Wellness Centre of Chandigarh and other difficulties faced by the senior citizensI have had the matter examined and would like to inform you that the CGHS beneficiaries can avail OP' medical consultations from the doctors at CGHS Wellness Centres and the Government hospitals. For inpatient medical treatment, they are referred to empanelled private hospital of their choice. In case of emergency, they can go to any hospital, empanelled or not, get medical treatment and claim reimbursement, to be allowed as per CGHS rates.As per the CGHS guidelines, a CGHS beneficiary is referred to a Government hospital for medical consultation with Specialists, wherever required for further medical treatment / deciding the line of treatment. They can prescribe him a medical procedure to be carried out at a hospital, wherever required and the beneficiary is accordingly advised. Direct consultation with specialists in private empanelled hospitals is not permitted under CGHS in normal circumstances. It has been introduced as a check and balance measure In larger public interest The system is working reasonably well and there is apparently no need to disturb it.I trust, you will appreciate the position.With regards,Yours Sincerely

As per the information from AD CGHS Office, Chandigarh, the Medical Reimbursement Bills of the CGHS pensioner beneficiaries have been cleared up to Sept 2013, and payment is pending due to non- receipt of LOC. MRC bills for Oct 2013 are under process.Performance of Local Chemist:

The CMO l/C informed the members that the e-tender process for the allotment of ALC is finalized and tender has been allotted to the Goya! Medicos !!. Sh Raj Kumar representative of Goyai Medicos was informed that their pending bills are being processed on priority for payment.Availability of Drugs in the WC:

As per records, there are 40 Generic items and 314 Proprietary items are available in the WC. The CMO l/C informed the members that the annual demand Medicines through GSMD is received regularly and that has reduced the local purchase burden from the local chemist.Amenities for the beneficiaries:

The members felt that without opening of a new wellness centre in the tricity the condition of the lone wellness centre in chandigarh will be affected badly due to increased work load. The members again retreated that the higher authorities should take an urgent necessary action in this matter.Staff Punctuality & Behavior:

The conduct and behavior of the staff of the Wellness Center has been good. They are courteous and helpful to the senior & aged CGHS beneficiaries.Cleanliness & Maintenance of Wellness Centre:

The wellness Centre is clean and well maintained.Grievance Redressal:

The suggestion box was opened by Shri S R Bhardwaj and no letter was found in it. As the year is coming to close the members suggested that AD CGHS chandigarh may be requested to give the consolidated list of action taken on the Advisory Committee's suggestions given & griviences addressed during the last one year so as to pass the information to the beneficiaries.The meeting ended with a vote of thanks.Govt Of India

Coping With an Arthritis Flare

Tips for managing episodes of increased pain and other symptoms.Although rheumatoid arthritis (RA) is a chronic disease, you can have acute episodes of pain and inflammation, known as flares. An arthritis flare may occur after an infection, or after a highly stressful situation. Often, however, what triggers a flare is not clear. You may have long periods when your RA is quiet, or in remission. Then, suddenly, the inflammation becomes more active and you have a rheumatoid arthritis flare. Remember that you have a range of weapons in your arsenal to address pain.Discuss a plan of action with your doctor. One approach would be to adjust your medications temporarily while the disease is unusually active. This will not only relieve some of the pain associated with an arthritis flare, but also help minimize any damage that may occur from unchecked inflammation.Be aware that your medications may not control the flare right away, even if your dosages are increased. Or they may only have a limited effect on your flare. Of course you and your doctors should be in agreement about possible increases in your medications, or even additions of new medications during a rheumatoid arthritis flare. Many doctors will suggest a plan that you can use at each flare's onset without having to seek his or her permission each time.The following is a list of some other steps that you may want to incorporate in your plan. Remember, some techniques work better for some people than others. Try a few of these, and if they don't work for you, discard them and try others.• Balance periods of activity with periods of rest. Although more rest can help during an arthritis flare, you probably do not need to abandon your regular activities, work or exercise program. A doctor or physical therapist can help you modify your program when you experience a flare. Spending long periods in bed is counterproductive, usually prolonging your pain. Instead, try to intersperse periods of rest with some light activity. Finally, to keep joints from becoming stiff, move them through the fullest range of motion possible, gradually increasing your range as the flare subsides.• Have a plan to deal with your obligations. Have a contingency plan both for work and family obligations. At work, try to arrange for coverage, work fewer hours per week or bring work home. Discuss your plan with supervisors and co-workers ahead of time, and assure them of your commitment. If you find that heat helps, try these warming techniques.• Practice relaxation or mind-diversion techniques. These techniques work best when you do them on a regular basis.Even though relaxation may not directly reduce your pain, it can minimize stress, which has been shown to make pain worse. Health Care to Citizens

Any self-respecting country has to regard provision of health-care to its citizens a primary responsibility and it's amazing that the Indian government never thought of that, says Amartya Sen, Nobel Laureate and Thomas W. Lamont University Professor, and Prvfessor of Economics and Philosophy at Harvard University. Excerpts from his interview with Raghuvir Srinivasan:After Right to Work and Right to Food, do you think that the time has come for a Right to Healthcare legislation given the poor state of public healthcare infrastructure in this country?Absolutely! Let me just say that it is incredible that we have got to this state. If you take any country in the world with the possible exception of the United States among the richer countries, they have always regarded it as absolutely elementary for people to have a right to healthcare. The fact that you have to do it through a separate Act itself indicates how backward we have been. Consider the history of the world.With the end of the Second World War, European countries gave the right to healthcare to all residents and other countries, including in Asia, went in that direction. Japan already had a very well established medical system but they extended that. Singapore, Hong Kong, South Korea and Taiwan also had it. China had healthcare for all but when it marketised in 1979, they made it necessary like in the U.S., which was affecting their thinking very much at that time, for the citizens to buy their insurance cover themselves. So the coverage of health insurance which was automatic until 1979 moved from 100 per cent to 12 per cent. It took them a quarter of a century from 1979 to 2004 to admit that they made an error. And they moved to cover everyone. Now, 96 per cent of the population is covered.Basically any self-respecting country has regarded this to be a primary responsibility of the government. Therefore it is amazing that the government of India never thought of that. The whole engine of Asian economic development has been the expansion of human capability and the recognition that there is nothing as favourable not only for development but also for economic growth. Since this country is single-mindedly concerned with growth rate, to maintain high growth rate for a long time there is no better recipe than to have a healthy, educated population. So, coming back to your question, if the government won't do it, will it be right to force the government to do it through a Right to Healthcare Act? Yes. But why shouldn't the government do it? Why isn't this a big public issue? Even the Aam Aadmi Party didn't raise it. The media has a role to play here. In general, the Indian media, print and electronic, should pay much more attention on this subject.That brings me to the next question. More than 85 per cent of the revenue of Indian publications comes from advertisements which are aimed at the affluent and middle-class readership. Therefore, its focus is on issues that concern this segment of the population rather than on the poor and the deprived. How do you get over this handicap?I'll say three things on that. One, yes, it is a problem. Two, is India unusual in depending on advertisement revenue? No, it is not. How come this is not a problem in say, South Korea, Hong Kong, Singapore, Thailand, Japan, Brazil or Mexico? We are not uniquely dependent on ads. It is a question of with what imagination and with what level of . independent reasoning can newspapers, acting together, deal with

advertisement revenue. There should be some convention on that. We have a vibrant media which has made many innovations. It can get more innovative on this.

Third, the advertisers are competing with each other and they are playing one newspaper up against another. It should be possible for newspapers to have a code wherein certain types of news are covered and that code is important to seek.This is about the two-way relationship between growth and enhancement of human capabilities. How do you break the chicken and egg situation of which comes first?No, no, there is no chicken and egg situation at all. It is a win-win situation. Every bit of growth generates more revenue that you can spend on health and education. More spending on health and education solidifies the foundation of growth as well as development. You can start anywhere anytime and each of them will work. It's not that you wait until one gets down and start working. Unfortunately I know that some economists talk like that but that's a terrible way of thinking about economics. It is one of the things that Adam Smith said with absolute clarity in 1776.Asked a question why is it that they want to go for a political economy, the answer he gives is that it makes an economy advanced. What is the advantage of that? First, it increases the people's income. A higher income gives people the ability to do things which they value doing. And it increases public revenue which allows the government to do those things which governments alone can do such as education.But you have this anomalous situation in India where the government is practically absent in areas such as education and health care leaving them to the private sector and is present in strength in manufacturing steel and refining oil which are better left to the private sector....That's just unclear thinking. You should clear out unclear thinking. Every time I come here, a lot of people tell me that the government cannot do anything at all and therefore education and healthcare should be left to the private sector. They don't recognize, for example, that governmental share of health care in India as a percentage of total health expenditure that people make is one of the three lowest in the world. We are in the company of Haiti and Sierra Leone. We spend one quarter of what the Chinese government spends on health care. We spend 1.2 per cent of GDP while China spends close to 3 per cent. And there is no evidence for this idea that the private sector can do better.At the level of basic health care it doesn't work like that. Even the intervention schemes that exist don't cover preventive medicine or preventive health care but if you become catastrophically ill then the government will pay the money, often to the private hospital, to treat you. That is no way of running public health care.And this whole idea that the government cannot do anything, you have to look at the examples of Tamil Nadu,Kerala and Himachal Pradesh. When we discussed them a long time ago that they were doing well, I was told that they cannot sustain it because Kerala, for example, is a poor economy. But now it has the highest disposable income per capita in India. The same thing that improves the quality of your life also enhances the economic development. And that story you will not hear. You will hear that [Narendra] Modi has brought such transformation that his State's growth rate is much higher than [that of] the others. We had a hurricane recently which was expected to be in the news for a month. But it ended the first day because the government could move a million people off the coast. And this was a hurricane five times bigger than Katrina. The problem is that we have convinced ourselves that the government cannot do anything and we give it to the private sector, provide additional money and tie ourselves into a knot from which we cannot exit.There are some interesting developments in the recent elections. We have a party formed out of a civil society movement which has captured the imagination of the electorate and we are seeing a resurgence of centre-right politics manifested by the success of the BJP. How do you see these developments?The practice of democracy depends very much on what kinds of issues are brought into the public domain and into the Rebate connected with elections. The Delhi election was the more interesting one because it brought in many issues which people had neglected in the past. It didn't bring in all the issues that we want to emphasise as much. It didn't tali so much about the neglect of education, the lack of public health care and so on. It was concerned more about the delivery of existing services in an efficient and non-corrupt way.That is important too but I would have liked a broader agenda discussed. However, one cannot get everything and certainly not in one go. But I'm happy that the AAP did bring in some public concerns into

the politics of the election. The fact that they could get the people to focus on these issues rather than on issues of religion or caste is also a very positive thing, as also the fact that they won the election in many areas of Delhi without getting into these issues.The rest of the elections were not unpredictable. The results were connected with traditional politics where religion and caste have played a part. The BJP has been able to project the image of a party that led powerfully even though the nature of the leadership raises deep questions in people's mind, including mine. The Congress has looked rudderless. So, there's nothing terribly exciting. Is that an indicator of what's going to happen in the general election? Is it a wake-up call for Congress? Well, it's not clear that Congress can be woken up!

Services told to appeal against verdicts in favour of ex-servicemen Ajay Banerjee

New Delhi, January 14The Ministry of Deffence (MoD) has issued a set of instruction asking the three services to go ahead and automatically file appeals in higher court in six categories of cases where ex-servicemen have got favourable verdicts. There is no need to seek sanction before filling appeals against such verdicts; go ahead and contest the case right up to the Supreme Court, imply the instructions. The Department of Ex-Servicemen under the MoD issued the instruction on January 2 and asked the legal wings of the Army, the Air Force and the Navy to automatically appeal against the verdicts going in favour of soldiers in courts or the Armed Forces Tribunal (AFT). In case a retired soldier wins a case of increase in disability pension in a lower court or the AFT, the Judge Adjutant General (JAG) in the services has been told to file an appeal. The order of the MoD list six- categories of cases and each category has been backed by an example of an important pending case and the advice of the Attorney General's office in that particular case. Using the AG's pre-existing advice in that particular case, the MoD has said that all similar cases should be appealed against automatically. The six categories of cases are: Extending benefit of broad banding of disability meant for “invalidated out” soldiers to personnel who retired/got discharged/or released from the service (both pre-1996 and post-1996 cases); granting disability pension to personnel who have been assessed and graded by a medical board holding that the disability was neither attributable nor aggravated by the military service; granting benefit of trade rationalization to pre-96 retirees from January 1, 1996, irrespective of the government instructions providing for benefits from July 1, 2009; granting parity of pension to personnel below office rank (PBORs) vis-à-vis Viceroy commissioned officers; grant of reservist pension to ineligible personnel who have not rendered required length of nine years of active service plus six years of reserve service. This will mean the soldiers seeking small additional pension benefits will have to contest the case right up to the Supreme Court, resulting in an expenses of lakhs of rupees in legal fees that the retired soldier or his window may not be able to afford.

They felt crest-fallen and wanted to know when this facility is available at Faridabad, Gaziabad, Noida and Gurgaon then why it is being denied at Chandigarh Members demanded that the case be taken up with Hon'ble Minister of MOH & FW for restoring this facility which was in practice in the past.

5. Implementation of Court Judgments Members expressed their anguish at the adamant attitude of the government for not implementing the court judgment even after dismissal of SLP filled by her. Members wanted that the case be pursued at all available forums for immediate implementation of such cases.

6. Enhancement of Subscription to Pensioner Coordinator Due to rise in cost for publication of Pensioner Coordinator, Secretary General sought the approval of the house for enhancement of yearly, five years and life subscription to Rs. 200, Rs. 800 and Rs.1500/- respectively. The same were approved unanimously.

7. Pensioner's Day 2013 celebration.Secretary General informed that Guest House U.T. Chandigarh has been booked for 15-12-2013. Order has been placed on catering wing of U.T hospitality for serving lunch to the participants. He further informed that whole programme will be sponsored by Fortis Mohali. All the members expressed satisfaction over the arrangement made and authorized the secretary general to go ahead for making the pensioner's Day celebrations a memorable one.

8. Publication of Souvenir Secretary general put forth proposal to the house for publication of souvenir in order to improve the financial position of CCCGPA. Members felt that collection of Advertisement and printing require at least six months. As such this factor be kept in mind before the start of this exercise There-upon it was decided that souvenir committee he formed to look after the work involved so as to ensure its release during AGM in the month of July 2014.There being no other item on the Agenda, the house was adjourned with the permission of the Chairman.

Pensioner's day 2013 was celebrated under aegis of coordination committee of central Govt.

Pensioner's Welfare Associations Chandigarh on 15-12-2013. Two hundred delegates of all Central

Govt. Pensioner's Welfare Associations of North India participated. Besides celebrations, the

programme consisted of highlighting the current Problems being faced by the pensioners especially in ththe light of number of anomalies resulting from the implementation of 6 Central Pay Commission

recommendations.

Twenty resolutions were passed by the house unanimously and they are being submitted to your

good self with a copy to all the concerned Ministries/ Departments. It is prayed that PMO may direct the

concerned Ministries for prompt considerations and redressal.

This action on the part of your good-self will go a long-way in boosting the sagging morale of

elderly pensions in the twilight of their life.

CHARTER OF DEMANDS ADOPTED DURING PENSIONERS DAY CELEBRATIONS ON 15 DECEMBER, 2013

th1. A study has established that 6 CPC based increase in pension has not been uniform for all pay thscales as compared to the scales of 5 CPC. It has been observed that at the lower level, the increase in

thpension has been much lower. In respect of PB 1, the increase in pension was 1.86 % over 5 CPC thscales ( 5200 is 1.86 % of 2750 the lowest of corresponding 5 CPC scale), in case of PB2 the situation is

same ( 1.86 %), whereas in the case of PB4, it is 2,6 %, and in higher scales HAG, it ranges minimum 3.00% and more. We seek equivitable and uniform increase in all cases.2. We seek full parity between past and future retirees must be sought. Any improvement in service conditions introduced for serving employees, such as full pension at 10 /20 years service must be extended to past pensioners / retirees also.

st4. Merger of 50% Dearness Relief (DR) with Basic Pension w.e.f 1 January, 2014 must be considered seriously to cater for present inflationary trends. Presently the DR stands at 90% of Basic Pension, and is expected to cross 100% by 01 January,2014.

6. Old age pension to start from the age of 65 years, as is the case in Punjab and some other states.7. The commuted portion of pension must be restored after 12 years instead of 15 years.

3. Pension calculation formula should be simple & uniform. It should be directly related to last pay drawn. On account of present inflationary trends, the pension should be fixed at 60% of last basic pay plus DR and family pension 40% of last basic pay plus DR. For pre 2006 pensioners notional pay fixation should be worked out, common a common multiplication factor for all the pensioners

5. Enhanced family pension should be paid for 10 years even in the case of death after retirement.

8. Leave Travel Concession (LTC) must be granted to the Central Government pensioners once in two years, equivalent to one month's basic pension.9. Minimum basic pension as fixed from 24-9-2012 on the principle of modified parity is payable to pre-2006 pensioners from 1-1-2006 after the dismissal of SLP and subsequently the Review Petition filed by UOI against the judgement of Delhi HC up holding the verdict dated 1-11-2011 of PB of CAT New Delhi for re-fixing pension from 1-1-2006. Pensioners make a strong appeal for issuing orders for the payment of arrears from 1-1-2006 without any further delay.10. Pensioners must be provided with adequate Medical facilities by providing medical facilities at par with IAS cadres, enlarging the coverage of private empanelled hospitals and by appointing medical specialists. If need be retired medical specialists may be appointed in CGHS Dispensaries.

11. OPD facilities for old CGHS pensioner beneficiaries must be provided in private empanelled hospitals at such locations where posts of CGHS specialists do not exist.12. Enhanced of Fixed Medical Allowance (FMA) from present Rs.300 to Rs.2500. No discrimination be allowed between different sets of pensioners (pensioners of Labour Ministry are being Paid Rs 2000/- per month as FMA

13. The OMs dated 01 August, 1996 and 01 September, 1996, issued by Ministry of Health & Family Welfare, debarring the P&T pensioners the facility of CGHS cover must be withdrawn unilaterally by the Ministry, without waiting for the verdict of the court.

14. The existing CGHS dispensary at Chandigarh is over burdened and over crowded with more than 9000 CGHS card holders. There is immediate requirement for additional CGHS dispensaries at Panchkula, mainly to cater for the CGHS pensioner beneficiaries of Haryana, and one at Mohali to cater to the Punjab CGHS beneficiaries in tune with the central government criteria of opening CGHS dispensaries for each state of India.15. The CGHS cover must be extended to BSNL pensioners.16. The merger of 50% 0f IDA up to 78.2% in respect of BSNL pensioners with effect from 01-01-2007 must be implemented, as has been done in the case existing / serving BSNL employees, where it has been implemented w.e.f 10-06-2013.17. The Fixed medical allowance (FMA) in lieu of OPD treatment in respect of BSNL pensioners, which had been withdrawn, needs to be restored. This withdrawal has created acute problems to the pensioners residing in rural/ remote areas, especially the weak and aged BSNL pensioners, who find it cumbersome to prepare their Re-imbursement claims, and submit their bills to appropriate BSNL authority.18. Defence civilian pensioners must be extended CSD canteen facilities which they enjoy during their service tenure. 19. The distinction between organized cadres and others must be done away with. All employees of central govt must be treated equally, and any incentive, such as NFU must be extended to all similarly placed personnel.20. Income tax exemption limit should be raised to Rs.5 lacs for Sr. Citizen Pensioners.

23rd SCOVA meetings. This demand was considered as a genuine one and Ministry of Pensions and

Pensioners Welfare asked the Ministry of Health and Family Welfare for suitable action at their end to

mitigate the hardships being faced by the elderly Pensioners. This demand was not acceded to, even the

SCOVA recommendations were also ignored. After exhausting all avenues, we were left with no

alternative except to make an appeal to the Honorable Minister of Health and Family Welfare through Sh

Pawan Kumar Bansal, Honorable Member of Parliament, Chandigarh. The reply received from

Honorable Minister came as bolt from the blue and sent shock waves among the elderly pensioners. In

his D.O. letter dated 14-11-2013 addressed to Sh. Pawan Kumar Bansal on the subject cited above

intimated that CMO of other cities except mentioned above are barred for referring the beneficiaries

directly. Honorable Minister further asserted that present system is working reasonably well and has

been introduced as a check and balance measures in larger public interest and there is apparently no

need to disturb it. Honorable Minister is known to be endowed by God the quality of Ingenuity. We

expected much better response in solving our problem. But it is painful to find that honorable Minister has

signed on dotted lines of letter documented by the lower ministerial staff against whom we have been

fighting at every step for our rightful claims relating to health care. With due apology and without casting

any aspersion to the Honorable Health Minister, we fail to understand as to how the system which has

been working very well at Delhi and adjoining stations can not be introduced at Chandigarh due to fear

that it would disturb the smooth working of system.

With the march of time, the need for modification of systems for the welfare of masses is

an established practice. But in this case, it seems that Health care to the beneficiaries has been rationed

if not all togather sacrificed at the alter of system protection.

We may also add, with the introduction of online working of CGHS dispensaries, history of

medicines issued to beneficiaries and nature of their ailment are a click away in Personal Computer of

CMO. The availability of this information readily enables CMO to be in a best position as to refer the

patient or not to private empanelled hospitals for further treatment expeditiously as every second matters

for health care.

As per latest instructions, from Ministry of Health and family Welfare, Chandigarh CGHS

beneficiaries are required to get recommendations based on findings from over crowded PGI

/Government Medical College, Sector 32, Chandigarh before they are permitted to avail cashless

treatment in empanelled private hospital.. The whole exercise entails heavy expenditure as Transport

fare and cause great inconvenience due to weak health and fragile financial position in the twilight of their

life. Majority of the Pensioners fail to get requisite treatment as the procedure involved is cumbersome

one which compels them to suffer the agony of awaiting death.

Coordination Committee of Central Government Pensioner's Associations fervently

appeal to your good self to Intervene & direct the Moh & Fw to empower CMO incharge CGHS,

Chandigarh for refering the Pensioners beneficiaries directly to Private empaneled hospitals keeping in

view the unique status of city Chandigarh . It is a capital of two states besides being a Union Territory.

Apart from this, because of its strategic location, elderly pensioners from for flung areas of Himachal

Pradesh, Haryana and Punjab are the beneficiaries of CGHS, Chandigarh. This act on your part will go a

long way as a booster to the sagging moral of the elderly Pensioners.
