    It was noted that minutes of 119th meeting of Executive Committee held on 29.12.2003 were circulated to all the members of Executive Committee vide this office letter No. 5-1/2003-EC(119th) dated 8.1.2004. It was requested that addition/deletion, if any, may kindly be suggested within 21 days from the date of issue of the same.

    In response to the above, no comments were received from the member.

    Agenda Item No. 2. Consideration of resolution of VaidyaRaghunandan Sharma, Member, EC.

    It was noted that the minutes of 117th meeting of Executive Committee held on 17.6.2003 were circulated to all the members of Executive Committee with the request to suggest addition/deletion if any with in 21 days from the date of issue of the same. In response to the same Vaidya Raghunandan Sharma vide his letter dated 18.7.2003 had submitted his comments as under;-

    The same was placed before the 118th meeting of Executive Committee at its meeting held on 26.9.2003. The comments of Vaidya Raghunandan Sharma were discussed by the Committee and decided that since President of the Council is not present in the meeting, therefore, matter be placed/discussed before the President, CCIM in the next meeting of Executive Committee.

    The Committee deferred the issue for consideration in the next meeting of Executive Committee.

    Accordingly the above issue was placed before 119th meeting of Executive Committee at its meeting held on 29.12.2003, the Committee deferred the same for consideration in the next meeting of Executive Committee.

    Executive Committee considered the same and decided that

    Agenda Item No.3. Ratification of action taken by President, CCIM for appointment of Shri SK Sharma, Advocate as Retainer for the office of CCIM.

    It was noted that in compliance of the decision of 115th meeting of Executive Committee held on 14.2.2003, Shri Sunil Kumar Sharma, Advocate, Supreme Court of India was appointed as retainer for the Central Council for the period from 1.2.2003 to 31.1.2004. His retainer ship was expired on 31.1.2004.

    His work was found satisfactory during 1.2.2003 to 31.1.2004.

    In this connection, it was noted that Shri Sunil Kumar Sharma, Retainer of the Central Council vide his letter dated 6.2.2004 requested that retainership may kindly be extended for a further period of one year and the retainership fee may be increased from 6500/- pm to Rs.9000/- pm. Keeping in view the fact that the he is defending Government of India in many Court cases and is also drafting Counter affidavits etc. on behalf of Government of India in all cases (and even in cases in which CCIM is not a party) though he is Retainer/Advocate of CCIM only and not of Government of India,

    It was also noted that all the Court cases/Counter affidavits are got typed and prepared by him in his office at his expense and huge amount is spent by him on stationery, typing, printing etc. but nothing is charged from CCIM on that account, even though this was not included in the initial terms of retainer ship agreement.

    The issue was submitted before the President, CCIM. He sanctioned the above and directed to place the same before the Executive Committee.

    Executive Committee considered the same and ratified the action taken by the President.

    Agenda Item No.4. Notification regarding use of modern medicine by practitioners of Indian Systems of medicine.

    It was noted that in pursuance of decision of Executive Committtee in its meeting held on 29.12.2003 under Addl .Agenda Item No.2 Vaidya SK Mishra,Chairman, Education Committee(Ay.), Vaidya GL Chanana, Chairman, Finance Committee and Dr. MS Gupta, Chairman, Education Committee (Unani) were requested to prepare draft for notification.

    In view of the Resolution passed by Central Council in its meeting held on 23rd

    March,2003 alongwith the Judgement of Hon’ble Supreme Court of India following draft was prepared for notification.

    “In exercise of the powers conferred by clause (e) of sub-section (1) of section 2 of Indian Medicine Central Council Act,1970 the Central Council of Indian Medicine declare by notification the following namely:-

    The word “Modern Advances” means advances made in the various branches of Modern Scientific medicine in all its branches of Internal Medicine, Surgery, Gynaecology and Obstetrics, Anesthesiology, Diagnostic procedures and other technological Innovation made from time to time and declare that the courses and curriculum conducted and recognized by the Central Council of Indian Medicine are supplemented with such modern advances.

    It is further clarified that the rights of practitioners of Indian Systems of Medicine to practice modern scientific Medicine are protected under Section 17(3) (b) of Indian Medicine Central Council Act, 1970.”

    The matter was discussed with the President,CCIM over phone. He desired to issue the notification on the basis of resolution passed by CCIM in consultation with Dr.S.K.Sharma, Advisor, (Ay.), Govt.of India which reads as under:-

    “In exercise of the power conferred by Section 2(1) (e) of the Indian Medicine Central Council Act, 1970 hereby Central Council of Indian Medicine notify that:-

    The Indian Medicine Central Council Act, 1970 is very clear with regard to definition of Indian Systems of Medicine of which reads as follows:-

    “Indian Medicine” means the system of Indian Medicine commonly known as Ashtang Ayurveda, Siddha or Unani Tibb whether supplemented or not by such modern advances as the Central Council may declare by notification from time to time.

    To clarify the word “Modern Advances” the Council at its meeting held on 23rd March 2003 has passed the resolution and defined Indian Medicine as under:-

    “This meeting of the Central Council hereby unanimously resolved that in clause (e) of Sub-section 2(1) of the IMCC Act, 1970, the word ‘Modern Advances’ be read as advances made in the various branches of Modern Scientific medicine in all its branches of Internal Medicine, Surgery, Gynaecology and Obstetrics, Anesthesiology, Diagnostic procedures and other technological Innovation made from time to time and declare that

    the courses and curriculum conducted and recognized by the Central Council of Indian Medicine are supplemented with such modern advances.”

    It is further clarified that the rights of practitioners of Indian Systems of Medicine are protected under Indian Medicine Central Council Act, 1970 under section 17(3)(B) which states as under:-

    “Nothing contained in Sub-section (2) shall affect privileges (including the right to practise any system of medicine) conferred by or under any law relating to registration of practitioners of Indian Medicine for the time being in force in any State on a practitioners of Indian Medicine enrolled on a State Register of Indian Medicine.”

    The Government of India from time and again have asked the Council to improve the syllabus by including subjects with regard to National Programmes like National Malaria eradication programme, TB, Leprossy, Family Welfare Programme, RCH Programme, Immunisation Programme, Aids, Cancer etc. and accordingly the Council has strengthened the Syllabus of all the system of Medicine.

    The institutionally qualified practitioners of Ayurveda, Siddha, Unani Tibb are eligible to practice respective Systems with modern Scientific medicine including Surgery and Gynaecology Obstetrics, Anesthesiology, ENT, Optholomology etc. based on the training and teaching.

    Such notification was also notified by the Central Council on 30.10.1996.”

    The draft notification was considered by the Executive Committee and decided that

    Agenda Item No.5. Regarding Acharya Gyan Ayurved College, Indore.

    It was noted that after the withdrawal of the case by the Petitioner’s college i.e. Acharya Gyan Ayurved College, Indore, as per decision of the Executive Committee in its meeting held on 26.9.2003, President, CCIM constituted an enquiry Committee consisting of Vaidya Bhrigupati Pandey, Varanasi and Vaidya PK Vashisth, Kurukshetra. They visited the college on 13.2.2004 and have submitted their report. After going through the Enquiry Committee Report, President, CCIM has made following observations:-

    “the report submitted by enquiry committee sent to Indore alongwith report of enquiry committee of Madhya Pradesh Government and fax message received from students of the college have seen and examined. Both these reports are contradictory and report of the CCIM committee appears to be incomplete.

    The entire matter should be placed before the Education Committee (Ayurved) and then Executive Committee of the Council for consideration and decision. We have also received notice from the advocate appropriate reply in consultation with our legal cell be sent to them also. The Director of Indian Medicine & Homoeopathy, MP should also be sent an interim reply.”

    Executive Committee considered the matter deliberately and decided that

    Agenda Item No.6 Consideration of Audit paras pointed out byauditors of DGACR in the inspection report of the CCIM for the year 2002-2003.

    It was noted that Deputy Director (AMG-II) office of the Director General of Audit Central Revenues, New Delhi vide their letter No. AMG-II/SR/CCIM/2003-04/448 dated 11.2.2004 submitted the Local Inspection Report on the accounts of CCIM for the year 2002-2003.

    Executive Committee considered the matter and decided that

    Agenda Item No.7 Ratification of the action taken by thePresident, CCIM for notification of the Regulations namely “Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College, Regulations, 2003.”

    It was noted that Government of India, Ministry of Health & Family Welfare, Department of AYUSH, New Delhi vide letter No.R.12011/01/2003-EP dated 4th

    February, 2004 has approved draft Regulations namely “the Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College, Regulations, 2003” for notification regarding to set up a new college of Indian Systems of Medicine, to increase intake capacity and to start new or additional course.

    The objections/verifications were submitted to Government of India for reconsideration. A meeting on 25.2.2004 was also held with Joint Secretary of AYUSH and other officials

    and President, CCIM, Vaidya SK Mishra, Chairman, Education Committee (Ayurved) and Vaidya Ved Prakash Tyagi, Vice-Chairman, Regulation Committee. The Government of India vide their letter No.R.11011/01/2003-EP dated 26th February 2004 again informed as under:-

    “The draft regulations prepared by CCIM had been duly examined. The regulations have been issued for notification to the CCIM after obtaining approvals of the competent authorities.

    It was requested that the regulations may be notified without further loss of time. The suggestions given by the Council vide their letter under reference are not feasible for inclusion at this stage. You are requested to furnish a copy of the regulations after notifying the same positively by 27.2.2004.”

    Executive Committee considered the matter and decided that

    Agenda Item No.8. Withdrawal of Career Advancement Scheme implemented by the CCIM at its own for the employees of Central Council of Indian Medicine

    It was noted that Assured Career Progression Scheme has been implemented by the Government of India, Ministry of Health & Family Welfare, New Delhi to employees of the Central Council of Indian Medicine to ensure two financial upgradation in entire service career of an employee after completion of 12 and 24 years regular service satisfactorily and subject to fulfillment of other conditions.

    It was further noted that in the Central Council of Indian Medicine considering that there is no promotional avenues for employees working in the Central Council after serving the 20 to 22 years of service in the Council, almost all the employees are same age group therefore, to maintain the efficiency and to avoid the frustration of the employees, Central Council implemented the Career Advancement Scheme to grant the next scale who have completed 15 years of regular service on the same post for the employees of the Group C & D.

    The Career advancement after completion of 15 years was implemented by Central Council without the sanction of Government of India as required under Section 12(d) of IMCC Act, 1970. The same has been objected by Auditors of DGACR also. Total Eight Employees of the Council have been benefited, under the career advancement scheme.

    Since the career advancement after completion of 15 years service was implemented by Central Council of Indian Medicine without sanction of the Government of India and

    there is Audit objection of DGACR. It may also taken into consideration that Government of India has also issued letter to the recovery of Asstt. Registrar (Ayurved), Asstt. Registrar (Unani), Asstt. Secretary (Registration), Asstt. Secretary (Administration). Therefore, the Committee may kindly consider for withdrawal of the decision taken earlier for career advancement of group C & D employees of CCIM to settle the para and implementation of Assured Career Progression Scheme smoothly.

    Executive Committee considered the matter and decided that

    Agenda Item No.9. Irregular upgradation and change ofnomenclature of the posts of Technical Officer (Ayurved/Unani), Assistant Secretary and Assistant Registrar (Registration) – regarding

    It was noted that the issue of upgradation and change of nomenclature of post of technical Technical Officer (Ayurved/Unani), Assistant Secretary and Assistant Registrar (Registration) was submitted to Ministry of Health & Family Welfare, Department of AYUSH, New Delhi to accord the ex-post facto approval of the Government. In response to the same, Government of India, Ministry of Health & Family Welfare, Department of AYUSH, New Delhi vide their letter No.V.27020/2/99-Ay.Desk dated 2nd

    January 2004 stated that representation of Vaidya Shriram Sharma, President, CCIM for grant of ex-post-facto sanction to the irregular upgradation of four posts [Technical Officer (Ayurved/Unani), Assistant Secretary and Assistant Registrar] in contravention of Section 12 (d) of the IMCC Act, 1970 has been considered and has not been agreed to. Immediate action on the Ministry’s letter dated 1.10.2002 and send the status report. The content of letter dated 1.10.2002:-

    A) Restore the posts of Technical Officer (Ayurveda/Unani) Assistant Secretary, Assistant Registrar (Registration) to their normal replacement scale of Rs.6500-10500/-. Recover the excess payment made a result of irregular upgradation, together with 6% penal interest.

    B) Conduct Internal enquiry to fix responsibility for irregular upgradation and its intimation despite two clear objectsions of the CAG and send report to this Ministry within three months.

    The Central Council is advised to intimate action as indicated above.

    C) The Council is however, free to send a fresh proposal with full justification and back ground for upgradation of the posts indicated at para 1, above for sanction of the Ministry, as per provision of the section 12 (d) of Indian Medicine Central Council Act, 1970.

    A--An Office Order to restore the posts has been issued to the concerned.

    B—The Executive Committee may kindly consider and constitute an Internal Enquiry Committee to conduct Internal Enquiry to fix the responsibilities for irregular upgradation.

    C— Fresh proposals have been submitted to the Government of India as required under Section 12(d) of IMCC Act, 1970.

    Executive Committee considered the matter and decided that

    Addl. Agenda Item No.1 To consider the issue of charging fee from closed Ayurved/Unani Colleges

    It was noted that following colleges of Ayurved/Unani have been closed due to reasons mentioned against their names:-

    1. Mohata Ayurved Due to their inability to meet the Mahavidyalaya, Sadulpur shortcomings.

    2. PBN Institute of Indian Medical Closed due to non-availability of Sciences, Madhubani infrastructure.

    3. Maharshi Charak Ayurved & Unani Medical College, Deoband

    4. Shrimal Rikhab Chand Sukhani Closed willingly Ayurved Medical College, Raichur

    5. Lala Lajpat Rai Ayurved College, Closed by the Management. Moga

    6. Indira Gandhi Memorial College, This has not been permitted by the Bhuvaneshwar Central Council since 1996-97

    onwards.

    7. Himalaya Ayurved Medical College, Permission has not been extended Bareilly beyond 1997-98.8. Anuradha Ayurved College, Chikhli College could not be started.

    9. Doon Ayurved Medical College, Permitted only two session Dehradun 1996-97, 1997-98).

    Central Council has requestedto the State Government totransfer the student of Doon Ayurved College, Dehradunin other approved college ofthe State.

    These colleges have not remitted the recognition fee to the CCIM. The total outstanding fee towards these colleges is amounting to Rs2,60,000/-.

    The auditors of DGACR are pressing hard and in their audit report for the year 2002-2003 also observed that fees have been outstanding for periods ranging from one to eight years. Of this, fees aggregating to Rs.2.60 lakh was outstanding against eight colleges which have been closed down.

    It was not clear as to why the Council has not resorted to de-recognition of such colleges, whose fees have been outstanding since long. The recognition fee is a major source of revenue to the Council and suitable action to recover the out standings should be taken in order to avoid loss of revenue under intimation to audit.

    Since these colleges have been closed due to the reasons mentioned against their name and are not exists in the approved list of colleges of CCIM.

    Therefore, the fee amounting to Rs.2,60,000/- may be considered to be bad debts.

    Executive Committee considered the matter and decided that

    It was noted that following colleges have not been permitted by the Council from last 5 years and as per decision of the Central Council, there may not be students for any session.

    Since the Central Council has not permitted these colleges to take admission for the last six years.

    Executive Committee considered the matter and decided that

    Executive Committee considered the matter and decided that

They visited Paikmal & Bolangir Ayurved College, Bolangir. In this matter a resolution was submitted and the president in the meeting of CCIM held in the March 2003, explained that a local member is being with visiting team. But it is not done. It will be helpful to the committee as the local member shall explain the detail of the college and route. Further, it will be economy to the Council.

    We have been observing the manipulations in Private Ayurvedic colleges related to the staff members. Many teachers shown as appointed in one college, are also working in other institutions. This type of corruption can be wipped off by taking the Affidavit on court stamped paper from each and every staff members and the record should be feed with master computer lying in the CCIM head quarters. A number of examples can be put in the House in this record.

    The Central Council of Indian Medicine members deputed to visit the Post-graduate departments must be either the PG teachers or senior persons. Time for visit for a college only one day is not sufficient.

    The visiting Committee should meet separately to the students, teachers and other workers in order to know their grievances and shortcomings.

    The Faculty of Ayurveda of Banaras Hindu university has appointed the teachers almost in every departments except the teachers of Swasthavritta, Agadatantra & Sanskrit. One non-Ayurvedic teacher (possessing MA degree in History of Art & Architecture) in the Department of Basic Principles of the University is still teaching Ayurvedic subject, guiding the MD (Ayurved) & Ph.D. thesis. University does not care of the ordinance of CCIM.

    Post-graduate diplomas in Panchkarma and Drug-Standardisation (run in Kayachikitsa & Dravyaguna Departments) are still exist. They have not stopped.

    The syllabus of BAMS & MD (Ay.)/MS (ay.) is not in accordance with CCIM. Modern & Ayurvedic subjects are separately mentioned.

    Dean of Faculty of Ayurveda is still non-Ayurvedic person. There is a pull & pressure in the Faculty of some persons, by dint of nothing is happening. Our CCIM has become completely eunuch in this regard.

    The Visiting Committee to BHU last year completed its visit within three hours and papers were called and formality was completed. The next day, visit of private college was done devoting whole day. The teachers, included in the list, are practicing, are doing Ph.D. and the studying shishyas of Guruparampara.

It was also decided that State Govt. and concerned University should be informed about this decision without delay.

    The Executive Committee authorized the President to constitute an Enquiry Committee in respect of this college to investigate the complaint.

    It is further submitted that Govt. of Madhya Pradesh has desired to depute a team of the Central Council to enquire the whole matter by Nov. 03. Further a letter of Director addressed to Secretary to the Govt. of Maharashtra has been enclosed stating the

    It is submitted that following colleges of Ayurved/Unani have been closed due to reasons mentioned against their names:-

    1. Mohata Ayurved Due to their inability to meet the Mahavidyalaya, Sadulpur shortcomings.

    2. PBN Institute of Indian Medical Closed due to non-availability of Sciences, Madhubani infrastructure.

    3. Maharshi Charak Ayurved & Unani Closed due to non availability of NOC from Medical College, Deoband State Government and affiliation of the

    University.

    4. Shrimal Rikhab Chand Sukhani Closed willingly Ayurved Medical College, Raichur

    5. Lala Lajpat Rai Ayurved College, Closed by the Management. Moga

    6. Indira Gandhi Memorial College, This has not been permitted by the Bhuvaneshwar Central Council since 1996-97

    onwards.

    7. Himalaya Ayurved Medical College, Permission has not been extended Bareilly beyond 1997-98.

    8. Anuradha Ayurved College, Chikhli College could not be started.9. Doon Ayurved Medical College, Permitted only two session Dehradun 1996-97, 1997-98).

    Central Council has requestedto the State Government totransfer the student of Doon Ayurved College, Dehradunin other approved college ofthe State.

    These colleges have not remitted the recognition fee to the CCIM. The total outstanding fee towards these colleges is amounting to Rs2,60,000/-.

    The auditors of DGACR are pressing hard and in their audit report for the year 2002-2003 also observed that fees have been outstanding for periods ranging from one to eight years. Of this, fees aggregating to Rs.2.60 lakh was outstanding against eight colleges which have been closed down.

    It is not clear as to why the Council has not resorted to de-recognition of such colleges, whose fees have been outstanding since long. The recognition fee is a major source of

    revenue to the Council and suitable action to recover the out standings should be taken in order to avoid loss of revenue under intimation to audit.

    Since these colleges have been closed due to the reasons mentioned against their name and are not exists in the approved list of colleges of CCIM.

    Therefore, the fee amounting to Rs.2,60,000/- may be considered to be bad debts.

    The false information have been submitted by the Principal of Mayurbhanja Ayurved College, Baripada. The college must be visited in the year of 1994. To acertain the truth of the information.

    Resolution 2

    In the visiting team a local member must be kept. But it is not done. The team is being constituted without a local member. Last year a team made with three members of out siders. They visited Paikmal & Bolangir Ayurved College, Bolangir. In this matter a resolution was submitted and the president in the meeting of CCIM held in the March 2003, explained that a local member is being with visiting team. But it is not done. It will be helpful to the committee as the local member shall explain the detail of the college and route. Further, it will be economy to the Council.

    Hence, in the composition of the visiting committee a local member must be taken.

    We have been observing the manipulations in Private Ayurvedic colleges related to the staff members. Many teachers shown as appointed in one college, are also working in other institutions. This type of corruption can be wipped off by taking the Affidavit on court stamped paper from each and every staff members and the record should be feed with master computer lying in the CCIM head quarters. A number of examples can be put in the House in this record.

    Resolution 2

    The annual CCIM visitation to Ayurvedic colleges should be done either in February or March instead of May & June.

    The Central Council of Indian Medicine members deputed to visit the Post-graduate departments must be either the PG teachers or senior persons. Time for visit for a college only one day is not sufficient.

    The visiting Committee should meet separately to the students, teachers and other workers in order to know their grievances and shortcomings.

    Resolution 3

    The Faculty of Ayurveda of Banaras Hindu university has appointed the teachers almost in every departments except the teachers of Swasthavritta, Agadatantra & Sanskrit. One non-Ayurvedic teacher (possessing MA degree in History of Art & Architecture) in the Department of Basic Principles of the University is still teaching Ayurvedic subject, guiding the MD (Ayurved) & Ph.D. thesis. University does not care of the ordinance of CCIM.

    Post-graduate diplomas in Panchkarma and Drug-Standardisation (run in Kayachikitsa & Dravyaguna Departments) are still exist. They have not stopped.

    The syllabus of BAMS & MD (Ay.)/MS (ay.) is not in accordance with CCIM. Modern & Ayurvedic subjects are separately mentioned.

    Dean of Faculty of Ayurveda is still non-Ayurvedic person. There is a pull & pressure in the Faculty of some persons, by dint of nothing is happening. Our CCIM has become completely eunuch in this regard.

    The Visiting Committee to BHU last year completed its visit within three hours and papers were called and formality was completed. The next day, visit of private college was done devoting whole day. The teachers, included in the list, are practicing, are doing Ph.D. and the studying shishyas of Guruparampara.
