The proposed bipartisan NICS Improvement Amendments Act of 2007 passed on a voice vote with support from both the NRA and the anti-gun lobby, and then went to the Senate for consideration there. The objective of the measure is to expedite state reporting to NICS of criminals and also persons adjudicated to be a risk to themselves or the community because of mental health problems. The proposal would in- crease federal funds of up to $250 million a year to help states update their record systems, and impose penalties on those states which fail to provide the required information. The bill also would set up a system under which would be gun purchasers who have received mental health treatment can appeal and clear their records. One provision of the bill, noted CCRKBA Chairman Alan M. Gottlieb, supposedly would allow persons whose names are in the NICS database for minor infractions that should not be disqualifiers to petition the states to have those entries removed. “In should be up to the government to remove those persons from the NICS database automatically, at no cost to the affected person,” Gottlieb stated. “Likewise, the Department of Veterans Affairs should be required to remove the names of some 83,000 veterans that it entered into the system seven years ago, for what the media have identified as ‘alleged mental health reasons.’ Soldiers should not have to petition or pay for that. “More importantly, this proposal should fully restore the process through which citizens can get relief from disabilities (RFD) that prevent them from owning and buying firearms. Though the process remains on the books, there has been no implementing funding since 1991. People who have made a mistake in their past, but since have been good citizens cannot get their rights restored. There should be a mechanism in place to allow funding of RFD investigations, even if the petitioner pays the cost himself.” CCRKBA Public Affairs Director John M. Snyder noted that the proposed Act comes at least partially in reaction to the recent massacre at Virginia Tech, which prohibits students and professors from carrying firearms on campus even if they have state-issued permits to carry concealed firearms. He said that in the proposed Act federal funding should be denied colleges and universities that prohibit students and professors from carrying firearms if the students and professors have such state-issued permits.

Reactingtoquestionsfromreport-ersabouthowtopreventfutureout-rageslikethemurdersof32studentsandteachersatVirginiaTechthispastApril,TexasGov.RickPerrydispelledanynotionthatcommonsensehasbeeneradicatedbypoliticalcorrect-nessintheUnitedStates. Perry’ssensiblesolution:Allowle-gallyarmedcitizenstocarrytheirde-fensivefirearmsanywhere–schools,restaurants,churches.Perrycorrectlyasserted thatso longassuchareasare legislated as “gun-free zones,”killerswhodon’tcareaboutthelawwillenjoyrisk-freeopportunitiesinwhichpeoplecannotfightback. Perry’s remarks were in starkcontrasttocommentsmadebyU.S.AttorneyGeneralAlbertoGonzales.He’sagainstgunsoncampuses,yetheadmitsthenannystateapproachisnopanaceatoviolence. “Wecan’tguaranteecompletesecu-rity,”hesaid.“Weneedtoseewhatwecandoasagovernment–onthefederallevel,onthestatelevel–toensurethesafetyofourstudents.” Gonzales is wrong and Perry isright. Governmentshouldgetoutofthewayandletpeopletakecareofthemselves. Perry’s remarksbroughtwailsofanguish from the anti-gun mob, apoliticallobbymoreadeptatdanc-inginthebloodofmurdervictimsto advance its agenda than it is inoffering common-sense solutionsthatwouldhelppeoplekeep frombeingmurdered. Perhapsself-styled“progressives,”especially those inTexas,have for-gotten the lunatic who drove intoLuby’sCafeteriainKilleenonOcto-ber16,1991,andopenedfire,killing23people,allofthemdisarmedby

athen-existingstateprohibitiononconcealedcarry.Survivorshaven’tforgotten.Oneofthem,formerStateRep.SuzannaGratia-Hupp,ransuc-cessfullytochangethelaw,enablingTexanstofightback. Those who lobbied in state afterstateagainstconcealed-carrystatutespredictedthatsuchlawswouldleadtobloodbaths.Inasense,theyguar-anteedsuchmayhembydemandingthatsomeareasbegun-freezones,wherelaw-abidingcitizensmaynotcarrytheirfirearms.Armedcitizenshave gone through backgroundchecksandinmanystateshavetakenmandatorygun-safetycourses.Howmanyanti-gunliberalswouldtoler-atesuchscrutinyandredtapejusttoexerciseaconstitutionalright?Ifthereisbloodonanyone’shands,itisontheirs.Thecommondenomi-nator in all of this country’s massshootingsinrecentmemoryisthattheyhappenedingun-freezones. Don’t blame these monstrouscrimes on firearm rights organiza-tions.Blamethemontheanti-gunlobbyforpushinglimitationsonthepublic’srighttoself-defense. Thiscountryhastriedittheirway– thewayGonzaleswouldhave it–andallwehavetoshowforitisabodycount. It’stimeforadifferentapproach.Perry’sideaissimplyareminderofanearlier,simplertime,wheneveryonethoughtwiththelogicofaBoyScout:Alwaysbeprepared. WhyisiteasyforPerrytounder-standthatcriminalsandmadmendonotmakeappointments tocommitviolentacts,butthisfacteludescol-legepresidents,liberalpoliticians,anattorneygeneralandfar toomanypundits?

Nobody is advocating anarchy.Thisisamatterofpersonalandcom-munitydefensebecause thepolicearenotourshepherds. Weshouldabolishtheconceptofgun-freezones.Criminals don’t obey it, and theyshouldn’tmaketherulesorbenefitfromthem. Nobodycanstopeverydeterminedcriminalormadman,butwemightstopmostofthem,andsaveinnocentlivesintheprocess.

“Thecantankerous,arrogantandobstreperousattitudeandbehaviorofgun-grabbingNewYorkCityMay-orMichaelR.Bloombergtowardslawenforcementpersonnelwhodisagreewithhimregardinghiscampaigntoeliminatethepro-gunTiahrtAmend-ment is driving police officers andorganizationstowardsdefactounitywith law-abiding gun owners andpro-gunorganizationsonthisissue,”JohnM.Snyder,CCRKBAPublicAf-fairsDirector,observedlastmonthinWashington,D.C. Snyder’scommentcameafteranti-gunSen.BarbaraMikulski(D-MD),ChairmanoftheSenateCommerce,Justice,Science(CJS)AppropriationsSubcommittee, said she would re-movetheTiahrtAmendmentfromthisyear’sspendingbill. “CCRKBA,”Snydersaid,“contin-ues to support the Tiahrt Amend-ment,byRep.ToddTiahrtofKansas.WeopposetheBloombergattempttousesecurelawenforcementdatainthird-party harassing civil lawsuitsagainstthefirearmsindustry. “Anti-gunindividualsandorgani-zationshavebeentryingtodriveawedgebetweenthelawenforcementand the law-abiding, law-enforce-ment supporting firearmscommu-nities.Bloombergandhisgangaredemonstratingthatthereisanaturalaffinity between the gun-owningandlawenforcementcommunities.Wehopetoseethiscommonaltyofintereststrengthened.” ChuckCanterbury,NationalPresi-dentoftheFraternalOrderofPolice(FOP), is so upset and angry withBloomberg’sbehaviorthatthisspringhe addressed a memorandum ontheissuetoFOP’sExecutiveBoard,Board of National Trustees, StateLodge Presidents, Secretaries and

Officers. FOP,statedCanterbury,“hasbeenonthereceivingendofnumerouspo-litically-orientedattacksbyNewYorkCityMayorMichaelBloombergandhis‘lawenforcementspokesperson,’JohnFeinblatt,becauseoftheFOP’ssupport of the Bureau of Alcohol,Tobacco, Firearms and Explosives(BATFE) on the issue of disclosureoffirearmstracedata. “MayorBloomberghasassembleda coalition of his colleagues and isengagedinanefforttorepealwhatisknownasthe‘TiahrtAmendment’fromtheannualappropriationsmea-sure tobeconsideredbyCongresslaterthisyear.Theamendmentwasfirst enacted by Congress severalyearsagoat therequestofBATFE,which had been repeatedly forcedtogotocourttoprotectthefirearmsdatawhenitwassoughtbymunicipalgovernmentstouseincivillawsuitsagainstfirearmsmanufacturers.TheFOPsupportedthatlanguagethenand we continue to do so becausethe release of such data to non-law enforcement entities - namelycivil litigants – could compromisethesafetyoflawenforcementofficersandtheintegrityoflawenforcementinvestigations.” Canterburychargedthat“thecam-paigntorepealthe‘TiahrtAmend-ment’hasenlistedpolicechiefsandorganizationswhichrepresentthemandusedthemtocomplainthattheprohibitionsontheuseoffirearmstracedataishamperinglocalandstateeffortstocombatillegalfirearmsandseveralhavegonesofarastosaythatBATFErefusestosharethefirearmstrace data with law enforcementagenciespursuingacriminalinves-tigation.Neither of these claims is true,butchiefshavelittlechoicebut

Responding, James Pasco, FOPExecutive Director, noted that“within the Fraternal Order of Po-lice is far more expertise with theadministrationofjusticethanMayorBloomberg’s limited experience inthatarea.” Inhismemo,Canterburypointedoutthatfirearmstracedatais“lawenforcement sensitive” and is col-lected by BATFE specifically to as-sist in criminal investigations; theprohibitions on the disclosure offirearmstracedatahasbeenpartofevery BATFE appropriations since2003;thereisnothinginthelaw,inregulation, or in BATFE’s internalprocedures which would prohibitdisclosureof firearmstracedata toalawenforcementagencyorpros-ecutorwhichcertifiesthatthedatawill be used to further a criminalinvestigationorprosecution;oncealawenforcementagencyorprosecu-torhasreceivedthisdata,theyarefreetoshareitwithwhomevertheywish;andthelawprohibitstheuseofBATFEdateastestimonyorevidenceinthird-partycivilactions.

InWashington,D.C.,JohnM.Sny-der,CCRKBAPublicAffairsDirector,notedthat,“apparently,someclergy-men,usingthecoverofthecloth,aretryingtofocuspublicconcernwithviolentcrimeonalaw-abidinggunstore,Chuck’sGunShopinRiverdale,aspartofageneralanti-gunagenda.Theyobviouslyignorethefactthatlaw-abidingcitizensoftenlooktogunshopsasa legalsourcefromwhichthey may obtain the firearms theyneed to defend themselves againstviolentcriminalattack. “Such clergymen could spendmore time and energy facilitatingtheabilityoflaw-abidingcitizenstoobtainthearmstheyneedtodefendthemselvesandtheirfamiliesagainstviolentcriminals. about1,000.“Theselawscreateopenseasononinnocentpeople.” Jacksontalkedoutsidethestoreaftermarchingfromanearbyschool.Hisgroup,theRainbow/PUSHCoalition,organizedthemarchandprotest.“Fortoolong,wehavemournedandnotmarched,”hesaid. Hesaidalsothatthestoresoldthe“majorityofgunsconnectedwithre-centshootingdeathsinChicago”butlateradmittedthathedoesnothavestatistics on the store. “The policeknow – everyone knows – they getgunsfromhere,”hesaid. Chuck’sstoremanager,JohnRiggio,saidhestrictlyfollowsstatelawswhenhesellsguns.Healsonotedthatanyfirearmsthatarestolenorresoldontheblackmarketareoutofhiscontrol. MichaelPflegerforessentiallyencouragingacrowdofprotesterstodriveRiggiooutofbusiness.Thegunshophasbeeninbusinessformorethan30years,and

Congresstakesseveralformalrecessesduringthesummerwhentheyreturntothehomedistricttocommunicatewithconstituents.Thesecommunicationstakemanyforms,including“townhall”meetingswheretheyaddressgatheringsofafewdozentoafewhundredcitizens,publicappearanceswheretheciti-zenstheyrepresentcanatleastseethemifnottalkwiththem,andprivatemeetingswithconstituents. Althoughthespecificrecessdatesmaynothavebeenlockedcompletelyintoplace,theytypicallyin-cludealongIndependenceDay(FourthofJuly)recessthismonthandanother,longerrecessnextmonth,plusanextendedLaborDayrecessinearlySeptember. OnematterCCRKBAMembersandotherscouldimpressupontheirfederallegislatorsistheimportanceofretainingtheTiahrtAmendmentduringtheappropriationsprocess.Thisamendmentprohibitsanti-gunmayorslikeMichaelBloombergofNewYorkCityandothersfromacquiringaccesstofirearmstransactioninformationdesignatedspecificallyforcriminalinvestigativeandprosecutionpurposesandthenusingthatinformationinharassinglawsuitsagainstlaw-abidingentitieswithinthefirearmsindustry. CallyourRepresentative’sorSenators’districtoffice,whichmaybefoundinthebluepagesatthefrontofyourtelephonedirectory,andaskwhenheorshewillbeholdingatownhallmeetinginyourarea.Planonattendingthemeetingandlisteningtowhattheseofficialshavetosayaboutfirearms-relatedissuesandourrighttokeepandbeararms.Ifthey’resilentonthegunissue,bringuptheissue,andletthemknowthatongoingterroristthreatsandcontinuingattemptsbyanti-gunpoliticianstoundermineourgunrightsgenerateperpetualinterestinsupportingtheindividualSecondAmendmentcivilrighttokeepandbeararms.Standupandbecounted!

In a recent urgent action alert,CCRKBAhitahandgunmicrostamp-ingbillwendingitswaythroughtheCaliforniastatelegislature. Theproposal,AB1471,byAssem-blyman Mike Feuer of West Hol-lywood,wouldamend thecurrenthandgun “safety” act by requiringthe chambers of all semiautomaticpistols sold inCalifornia tohaveauniqueserialnumberetchedintothepistol’s chamber. Upon firing, thenumberwouldbeimprintedonthecartridgecase,thusallowingpolicetotrackthecasebacktothefirearm’sregisteredowner. In May, the State Assembly ap-proved the bill by a vote of 44-31.Early last month, the State SenatePublicSafetyCommitteescheduledapublichearingonthemeasure.IftheCommitteeweretoapprovethemeasure,theSenatecouldvoteonit.

IftheSenateweretopassthebill,itwouldbeheadedtothedeskofGov.ArnoldSchwarzenegger,whoatthatpointcouldapproveitorvetoit. They are far morelikely to occur in areas that havebeendesignatedasgun-freezones.Worldwide,officebuildings,hospi-tals,conveniencestores,TVstudios,chainrestaurantsandday-carecen-tershaveallbeentargetsofhomicidalmaniacs.Massshootingsoccurlessoften in areas where responsiblecitizensmaycarryweapons.Expect-ing a suicidal individual to honora law prohibiting firearms is sheerutopianfantasy.Declaringgun-freezonesriskleavingpotentialvictimsdefenseless. “In Israel,however, teachersandparents serving as school aids arearmedatalltimesonschoolgroundswithsemiautomaticweapons.Sincethispolicywasadoptedinthe1970s,attacksbygunmenatschoolsinIsraelhaveceased.Governmentofficialsmustbeawarethatiftheycreateagun-freezone,theyareliableforanyharmitcauses.Historyandcommonsenseprovethatgun-freezonesaredangerous.”

H.R.2424hasbeenreferredtotheHouseJudiciary Committee. Congress-manPaul,acandidateforthe2008Republicanpresidentialnomination,isaCCRKBACongressionalAdvisorwhohasreceivedseveralCCRKBAawardsandhasbeenaspeakerattheannualGunRightsPolicyCon-ference,cosponsoredbyCCRKBAandtheSecondAmendmentFoun-dation.
