"BIRMINGHAM" marking to bold Damascus pattern on barrel which shows

much original colour & pattern. Scroll engraved lock & hammer with

"BENTLEY & PLAYFAIR" marking to lockplate. Scroll engraving to trigger-

guard & tang. Double-set trigger, German silver nosecap to fore-end. Silver

escutcheon to butt. Chequering to wrist of butt. A scarce big-bore sporting

rifle in good original condition.

Round 10-bore full-stock 41,75" "LONDON" marked "Sterloop" barrel.

Engraved lock marked to "LACY & Co." . Steel triggerguard to double-set

trigger. Brass buttplate. Some light longitudinal age-related cracking to butt.

Cheek-piece to butt. Single blade, period rear sight has been fitted to barrel.

Light surface pitting to bore of smoothbore barrel. Fair to good overall.

B9 Botha Flintlock Sporting Rifle R 17500.00

Full-stock, octagon to round 44" 8ga. barrel marked to "P.J.BOTHA". Scroll

engraved lock, cock & tang with lockplate marked to "P.J. BOTHA".

Engraved brass triggerguard & buttplate, double-set trigger. Semi-

Bobbejaanboud type butt with fore-end cap missing. A good example of the

typical Voortrekker/Settler Bobbejaanboud rifle in good original condition but

for missing nosecap which can readily be replaced.

B10 J. Hayton S/S Percussion Rifle R 29500.00

Damascus 29,5" rifled barrels for .62cal. winged bullet. Broad top-rib

marked "JOHN HAYTON GRAHAMS TOWN 7306" with side-grooves for

goalpost sight and 1" to 20" graduations on rib. Scroll engraved ornate

hammers, lock-plates, triggerguard and tang. Lion amidst scroll engraving

to patchbox. Chequered wrist & fore-end. Ebony ramrod with brass tip.

Small chips to either side of fore-end at barrel juncture. Bold Damascus

pattern to barrels. Good original condition overall.

B11 12ga Theophilus Richards S/S Percussion Shotgun R 7500.00

Damascus 29,25" barrels with relatively good bores. Small patch to

underside of RH barrel 4" from muzzle. Replacement nipple to LH barrel.

Ornate scroll engraved hammers, lockplates, triggerguard & tang.

"THEOPHILUS RICHARDS & Co." to lockplates. Well-figured walnut stock

with chequering worn on wrist. The firm was established in 1747 and

continued in operation until after 1886. The last Theophilus Richards was

the brother of William Westley Richards. Overall good condition.

B12 16ga Austrian S/S Percussion Shotgun R 12500.00

Fine Damascus pattern to 30,75" barrels. Back-action side-locks. Typically

Germanic styled, one-piece integral wooden trigger-guard, extended grip

and butt of walnut which includes cheekpiece. Overall very good plus

condition.

B13 Mortimer S/S Flintlock Sporting Gun R 12500.00

Damascus, 30" 10ga. smoothbore barrels with "London" marking and fixed

rear sight to top-rib. Engraved tang, cocks, lockplates and triggerguard.

Lockplates marked "MORTIMER" . Walnut stock with chequering worn at

wrist. Silver escutcheon plate to wrist. Good to good plus original condition.

B14 .50 Mkonto In-line Muzzle-loading Rifle R 4750.00

Modern repro of the J. Pauley patent mechanism. Round 23" (584mm)

barrel with ramrod underneath. Light coloured beech stock. Bushnell

"Trophy" scope fitted, no iron sights. Excellent condition.

Half-stock sporter with 27" barrel. Under-rib to barrel with German silver

nosecap to 5,75" fore-end. Typical crescent steel buttplate. Serial number

29XX. Flat-top topstrap with two-line lettering reading: "COLT Pat. 1855

ADRESS COL. COLT HARTFORD CT. USA" with customary gas port

hole to topstrap. Adjustable hinged rear sight is missing locking screw.

Sharp rifling to bore with some light corrosion to grooves. Stock has broken

across hand and displays a period repair of wood spliced into either side of

grip. Replacement clearing rod. Finish has faded to an overall grey/brown

patina. Good working order.

B16 North .54cal. Flintlock Pistol R 3500.00

Heavy octagonal Damascus barrel of about 13mm diameter, 5" (128mm)

long. "North" to lockplate. Chequered wooden grip, engraving to lock &

cock. Ramrod missing, rest good condition with some mottling to finish on

barrel. Worthy of a do-over.

B17 .40cal British Pepper Box Pistol R 1800.00

Action and frame of German silver, engraved with scrollwork. Walnut grips

with tiny square chequering. Trigger cocking faulty.

B18 .58cal. Austrian Percussion Service Pistol R 2500.00

Large, heavy percussion single shot pistol. Unusual nosecap/barrel band to

10,5" (267mm) barrel. Interesting safety mechanism which prevents

hammer from contacting nipple when engaged Steel reinforcing tang

through to steel buttcap with lanyard ring. Stock cracked through pistol grip.

Fair condition, should clean-up well.

B19 EIC Flintlock Pistol-Reproduction R 2750.00

A real horse pistol. .69cal with 9" (228mm) round barrel. Lock marked with

a lion rampant. Brass nosecap, triggerguard and butt cap. Excellent

condition.

98" date stamps to ricasso. Scabbard of leather with steel mouthpiece and

chape. Hindi? markings to crossguard & mouthpiece of scabbard. Very

good condition.

C20 Martini Bayonet Patt. 1887 Mk3. Bayonet R 4500.00

The 18,5" plain blade, single edged with dagger point. Crown V.R cypher

over "88" date & Broad Arrow over "WD" to ricasso. The knurled leather

grips held with 2 rivets. Scabbard with metal mouthpiece & chape, leather

good. Good to good plus condition overall.

Short Rifle Yataghan Sword Bayonet, bushed for Martini-Henry rifle. A

22,75" blade with 3/4 length wide shallow fuller. "Reeves" , Broad Arrow,

"59" date plus various inspectors marks to ricasso. Broad arrow disposal

mark to hilt. Knurled leather grips. Leather scabbard with mottled

mouthpiece and chape. Good to good plus.

Length overall of 28,5", blade =23" with long rib groove. Knurled leather

grips, 20,5" muzzle ring diameter. No markings to "Yataghan" type blade

which is in exceptionally good condition. Leather scabbard with steel

mouthpiece & chape. Very good plus to excellent condition overall.

For Martini rifle. Triangular 22" blade, 3" socket. Brass mouthpiece and

chape on brown leather scabbard. Well marked with ordnance & disposal

stamps. Possible replacement of leather to scabbard. Good plus condition.

A 21,5" triangular blade in excellent condition. Various ordnance acceptance

& disposal marks. The scabbard with brass mouthpiece and chape, black

leather. Very good plus condition.

Mk1 2nd type made "6-92". Two rivet handgrips with oil hole to wooden grip

some scattered light pitting. Rifling well-defined. Pistol has approx 95%

original finish to it with some very light scuff marks to bottom of barrel &

front of magazine. Correct nitre bluing to extractor, sight slide, firing pin

retainer & safety. Unusual integral oil bottle to matching numbered stock,

which is in good condition. Feedback is that Mauser only produced 100

pistols with integral oil bottles? Sights marked "1 to 10" in large type rather

than later "100 to 1000m" markings. A scarce pistol in good plus original

condition.

D68 7,63mm Broomhandle Mauser. Pre-1898 R 10500.00

Replacement stock, mismatched numbers. Lower frame, hammer, firing pin

and firing pin retainer marked "48xx", whilst 4" barrel is marked "408xx".

The barrel marking could be a later addition as the type size does not match

the rest of the numbers and the marking is not typical of Mauser's style.

Grips have been altered to make provision for finger grooves and ribbed

lines have been recut. Good to good plus bore, high % finish with some

holster wear to high spots. Good to good plus overall condition.

Serial no. 1016xx. Standard small-ring model complete with matching

number shoulder-stock holster. Matching numbers to all parts. Rifling is still

relatively well-defined but displays light pitting to grooves. High % original

edge of magazine and high spots of frame. Correct nitre bluing to extractor

and sight slide. Stock has a crack which has been repaired/strengthened

with woven brass & silver wire which is a typical period repair. Good working

and extractor still as-new. Wooden holster/stock is in original Mauser stock

with matching number and Mauser banner stamped on the wood.

rubbing in holster/stock. Blueing on frame turned slightly brown. Wooden

holster/stock is an original Mauser stock with non-matching number and

stock. Modified rear sight blade, probably done by Westley Richards?

Original Astra model "F" Broomhandle pistol in 9mm Largo caliber. Serial

no. 301xx. Developed in 1934 and the model F is a very rare pistol as only

1126 were ever made. It was regarded as the best and the most

controllable of all the Broomhandle pistols as its features a unique cyclic

rate retarder. Pistol is in excellent condition with original finish and matching

numbers on all parts, fully functional and complete. No wooden

holster/stock. Two original detachable magazines, a 10-round and a 20-

round. Magazine numbers do not match that of pistol.

Original Astra model "E" Broomhandle pistol in 7,63mm caliber. Developed

after the model "F". The model "E" was the last in the M900 series of pistols

from Astra and was produced in 1949. Serial no.340xx. It is an extremely

rare pistol as only 548 were ever made. Pistol is in excellent condition with

original finish and matching numbers on all parts, fully functional and

complete. Wooden holster/stock has no number. Original 20-round and 10-

round detachable magazines. Both magazines have matching numbers to

that of pistol.

Original Royal "Super Azul" Broomhandle pistol in 7,63mm caliber.

Manufactured by "Beistegui Hermanos" in Eibar, Spain. The Super Azul

was a close copy of the Mauser Schnellfeuer pistol but internally differs

quite a bit. Introduced in 1931 it was very well made and used the magazine

from the Mauser pistol. This particular pistol was made in 1935. It is an

extremely rare pistol as only 1000 were ever made. Pistol is in excellent

condition with original finish and matching numbers on all parts, fully

functional and complete. Wooden holster/stock has no number. Original 20-

round Mauser detachable magazine (not numbered).

Early small-ring hammer model, serial No. 506XX. Rear sight graduated

from 50 to 1000M. A "Jan Smuts" serial number has been added to the side

of the upper receiver. Matching serial numbers to pistol & shoulder stock.

Approx 95% original blue throughout with finish marred only by some light

pitting back of hammer assembly. Crisp markings, unblemished box.

Excellent overall finish. Crisp lines to grips. Very good to good plus

condition.

Original and very rare Bergmann model 1896 pistol in 6,5mm caliber.

Complete with original wooden grips (not cracked or chipped). Excellent

original condition, fully functional, original finish on all parts, bluing 95%

plus. This pistol is serial number 2688 of only about 4000 built. Designed by

Louis Schmeisser and built by Theodor Bergmann. Marked with a circled

emblem and the words "GUGGENAU V.C.S. SUHL" on the right hand side

of the frame. Additional rack number "Z5312" stamped on side of frame.

12000 of these pistols were made. Matching numbers on all parts. Marked

shape. Finish faded to silver-grey overall with good original colour to

and figure, flat-top chequering to 18 LPI to pistol grip and forearm. LOP to

front trigger 14,25", to the rear 13,25". Excellent condition.

Boer War service weapon. Originally ordered by the Portuguese

Government, the Guedes order was cancelled in favour of the newly

introduced Kropatchech rifle. The unissued Guedes rifles were ordered by

the Boers after the Jameson raid when it was clear that war would be

imminent. Fore-end has been shortened, silver-grey finish to metalwork with

some light surface pitting. Fair to good original condition.

First ordered by Turkey in February 1887, the rifle was chambered for the

black-powder 9,5X60R cartridge. Action bears the manufacturer's marking

"Toughra" marking. Tubular magazine to 29,97" barrel. Good bore, rifle is

complete with cleaning rod and in good original condition.

with a gold inlaid "2", indicating no.2 of a pair. The 30" (762mm) barrels

have clean bores but for some light pitting in the RH barrel. The action and

locks covered with light floral scrollwork. The stock of a high grade walnut of

pleasing figure. Gold finial inlet to stock, plain. Reblued metalwork. Good

plus condition, the gun would benefit from a professional refinish to wood &

metalwork.

has a good bore with an extra-full choke. Repair to the plain walnut stock at

the rear of the action. Collectable. Mechanically sound.

F110 12ga Winchester 1911 S.L. Shotgun R 2750.00

S.L. stands for Self Loading. Stymied by Browning's patent on the cocking

lever of the Model 5, Winchester's answer was on this, their first S/Auto

shotgun, to knurl a section of the barrel so that to cock the gun you pushed

the whole barrel downwards whilst the butt was up against something solid.

To keep the action open a push button above the safety catch must be

pressed home.The gun's nickname of "the widowmaker" was well earned!

This gun is in very good condition with some slight loss of finish on the

action and barrel. The ribless 28" (712mm) barrel has a clean bore and is

choked a tight 3/4. The Mod 1911 was manufactured 1911 to 1921.The

plain wood is in good condition. Good plus overall.

quick-release push button. The stock of good straight-grained walnut with a

bit of contrast. A single recoil cross-bolt fitted under the breech. Wrap

around chequering to 18LPI on the forearm with separate panels at the

pistol grip. British sporting style butt with a ventilated brown recoil pad, LOP

is 14 5/8". Conversion to .460 done by Bill Ritchie. An excellent big bore

Another Japanese import. This one in pristine condition. The 28" (712mm)

barrel sports a ventilated top rib and multichoke. The M for Modified is fitted,

unfortunately no other chokes accompany the gun. The bore is excellent.

The butt with some figure, contrasting rosewood pistol grip cap with a white

22LPI chequering to the wrap-around forearm pattern and the pistol grip

panels. LOP is 14,75" to a thick red rubber ventilated recoil pad. Another

gun that is seemingly barely used.

The 27" (686mm) browned barrels are Cylinder bored on the bottom and

Skeet 1 on the top. The bores are excellent. Two small rust pits on the LHS

of the black finished action spoil an otherwise clean picture. The single

trigger is non-selective. The nicely coloured walnut is chequered to 22LPI to

the wrap-around forearm pattern and the pistol grip panels. The forearm

exhibits a restrained schnabel. LOP to the black polymer butt pad is 14 1/8".

Good plus condition.

No model number for this Spaniard. The 28" (712mm) barrels have solid

pistol grip panels well executed. Silvered action with locking cross-bolt and

safety catch is frozen, no barrel selector switch is fitted. The nicely dark

straight-grained walnut is chequered to 22LPI on both forearm and pistol

grip. LOP to a solid red rubber recoil pad is 14 3/8". Excellent condition.

"Game bird" model with double triggers. The 30" (762mm) barrels have

ventilated side and top rib. Bores are pristine, bottom barrel is 1/4 choke

and top is 3/4. Non-auto safety and extractors. The silvered action is very

bright, the engraving a bit off. The wood is acceptably dark walnut, the

chequering hand-cut to 20 LPI. LOP to front trigger is 14,25" and to the rear

13 3/8". New condition.

G51 12ga Baikal O/U Shotgun R 3750.00

Reputedly built from the steel of recycled T34 tanks and able to take as

much punishment! This one an ejector model with non-selective single

trigger plus auto safety. The 28,5" (724mm) barrels with ventilated top rib.

Bores are excellent and choked 1/4 bottom and 3/4 top. The bulky action

with some minimalistic engraving on the sides. Hardwood stock and

forearm have small panels of hand-cut chequering. This gun appears to be

barely used.

G52 12ga Beretta S56E O/U Shotgun R 10500.00

A S56E model. The 28" (710mm) barrels with ventilated top rib are stamped

F over IM and indeed the top barrel is choked Full whilst the bottom barrel is

3/4. The bores are pristine. The barrel selector/safety catch is an auto-

safety model. The silvered action is engraved with "P.BERETTA

GARDONE" surrounded by light floral scrolls on both sides. The light

coloured walnut is nicely hand chequered to 20LPI. The LOP is 14,25" to

the polymer black butt plate. Whilst the S56 and S58 models have been out

of production for many years, this example is in mint condition.

LHS of the action, next to the maker's name and address. Serial No.

SAV/54xx.The 30inch (762mm) barrels have clean bores, chokes are 1/2

left and 3/4 right barrels. The milled top rib sports a mid-rib bead. Much loss

of finish to the action, not quite as much to the barrels. Extractor auto safety

model. The action/barrels are off the face as shown by the cocking lever

being well to the right of the center line. The dark walnut has small poorly

executed hand-cut chequering panels at forearm and pistol grip. LOPs are

14 1/8" front and 13 1/4" rear trigger to the polymer butt plate.

Boxlock action with side clips and a Greener style cross bol. Non-ejector

Heavy 28" barrelled target rifle built by Sportco on .310 Martini Cadet rifle

action. All markings removed from sides of action, Kangaroo insignia intact

on the top of action. Sportco details plus "CLUBMASTER .22L.R." marking

to top of barrel. Action is fitted with a Parker-Hale 17 target peep sight whilst

foresight is a standard FS22 tunnel sight with provision for interchangeable

elements. Wide fore-end with adjustable palm-stop similar to BSA 12/15

series target rifles. Excellent condition.

Full-stocked DWM M1893 standard military Mauser fitted with a Weaver K4-

C3 scope. Bolt handle bent and profiled to avoid scope. The bore of the 29"

(740mm) barrel is fair. The wood in pretty good shape. Good overall.

G63 .338 Lapua Snipers Rifle R 55000.00

A full-on sniper's weapon, military finish. The 30" barrel fitted with a

substantial muzzle brake, the bore is excellent. Massive bolt action with 5

shot box magazine. Carbon fibre shroud to protect the user's cheek. Fully

adjustable stock. Bipod fitted plus third point at bottom of the butt. Mint

condition.

G64 .303"Long Lee" L.E.1. Sporterised Rifle R 450.00

Forearm cut down ahead of barrel band. Butt socket marked "BSA Co" .

Bore of the 30" (762mm) barrel is rough. Magazine cut down to take 5

cartridges. Remaining woodwork left plain.

G65 .303 "Sporterised" BSA Rifles x2 R 800.00

No. 250XX retains the top cover behind the rear sight and forearm cut off at

7,5" from the muzzle. Otherwise everything standard, though wood is

refinished to a high standard. 10 shot magazine retained. Leather sling

fitted. No. M98XX has the forearm cut off at 12.5" from the muzzle, a barrel

band added and an attempt at making a schnabel tip to the forearm. Both

guns have reasonable bores with 250XX's a bit better.

G66 .303 "Sporterised" Lee-Enfield Rifle R 750.00

Forearm cut down by 12". The beech stock is clean and patched where

necessary. The 25" (636mm) barrel has a good bore, military sights. Ten

shot magazine retained. Good to Good Plus condition.

G67 .303 "Sporterized" Lee Enfield Rifle R 700.00

An Ishapore Sht.L.E.III with the forearm cut down by 13,75". A slight

schnabel formed and 16LPI flat-top chequering on the side panels of the

forearm, which is beech. The walnut butt cleaned up but not chequered.

Military sights retained on the 25"(636mm) barrel which has a fair bore.

Good condition.

G68 .303 "Sporterised" Lee Enfield Rifle R 2250.00

No. 4 Mk2 action, recoil pad fitted to butt, fore-end & barrel shortened.

Nikko Stirling 4x32 scope on Lynx mounts. Good bore, good plus condition.

G69 .303 "Sporterized" No.4d Rifle R 950.00

The beech forearm cut off 15" (381mm) from the muzzle. The 25" (636mm)

barrel has a front sight. Bridge scope mount across the action. Bore is good.

Walnut butt cleaned up and a ventilated brown rubber recoil pad added to

make the LOP 13". Very good condition.

G70 .303 BSA Rifle and .303 Lee Enfield Rifle R 1000.00

The BSA has the forearm cut down by 12". Military sights retained, 25"

(636mm) barrel has a reasonably good bore. Top cap retained behind rear

sight. Otherwise stock-standard. The Lee Enfield also chopped off 12" from

the muzzle. Everything else remains standard except the stock given a

clean-up. The 25" (636mm) barrel is also pretty good. Good condition for

both.

G71 .308/303 NM Musgrave R 1650.00

Heavy round tapered 7,62mmr barrel of just over 25" (642mm) chambered

for .303 cartridge. Bore is excellent. P-14 action much machined and scope

bases fitted, no iron sights. Cut-down military walnut stock with inletted

repairs. Recoil cross bolt under the breech. Very good condition.

G72 .22lr. Unique S/Auto Rifle R 3750.00

Push rod at forearm tip for loading. 5 and 10 shot box magazines. 60cm

(23,5") barrel with muzzle threaded for a silencer, bore good. Ramp front

sight, tangent rear. Plain forearm and butt. LOP 13 7/8" to the black polymer

buttplate with a white line spacer. Receiver grooved for scope bases. Take-

down model. Excellent condition.

Conditions of Sale

The following Terms and Conditions as amended by any postal notice or verbal announcement during the sale, constitutes the entire terms and conditions under which the property listed in this catalogue, is offered for sale by Classic Arms and any consignor for the said property that we act for. 1). As used herein, the “bid price” shall mean the price at which a lot is knocked down by the auctioneer, to a purchaser and the term “purchase price” shall mean the aggregate of: a). The bid price, b). A PREMIUM PAYABLE BY THE PURCHASER OF 12,5% OF THE BID PRICE, + VAT at 14% thereon (i.e. a total premium of 14.25%) c). And where specifically stated by the auctioneer VAT at 14% of the bid price. It is recorded that the consignor has authorised Classic Arms to retain the premium payable on each lot as part of our remuneration and that the VAT payable on such premium is in addition to such premium. 2. On the fall of the Hammer the highest bidder will have been deemed to have purchased the lot being offered and to have: a). assumed full responsibility and liability for the ownership of that lot in accordance with the terms and conditions contained herein b). to undertake to settle the aggregate purchase price within a maximum of seven calendar days from the date of sale. In the case of all firearms it is specifically recorded that the purchaser is deemed to have assumed full liability for ownership and payment in accordance with the terms and conditions contained herein irrespective of the granting or not of a South African Police Services licence or permit for possession of the said lot. All lots requiring licences shall be retained by Classic Arms pending proof of issuance of said licences. Should a licence for any lot, for any reason whatsoever, be declined, then the purchaser may require Classic Arms or a registered arms and ammunition dealer of the purchasers choice to resell such lot on the purchasers behalf. Such sale shall be conducted against the prevailing terms and conditions of the chosen dealer at time of resale and, irrespective of the Auction purchase price, at the price determined in agreement with the auction purchaser and the dealer.

It is specifically noted that Classic Arms may in no way be held liable for a shortfall if any, between the auction purchase price and the resale price. Under no circumstances shall any lot requiring SAPS licensing be released to any person or body not duly authorised to be in legal possession of said lot, and unless all monies due have been settled in full and in accordance with the terms and conditions contained herein. No lots shall be deemed to have been paid for until all monies due have been delivered in cash or in Bank Cleared funds. All purchases may be paid for in cash, by Master Card or VISA, American Express or Diners Club International, or by cashiers. or Bank Guaranteed Cheque. A further premium of 5% of the aggregate purchase price including VAT thereon will be levied for all Credit or Charge Card settlements. No cashier’s cheque will be deemed to constitute payment until the effects thereof have been cleared into the Classic Arms Trust Account. If the foregoing or any other conditions contained herein are not complied with by the purchaser, in addition to any other remedies available to us and the consignor by law, including but without limitation to, the right to hold the purchaser liable for the purchase price, then we at our sole discretion may: a). cancel the sale, retaining as liquidation costs any amounts paid by the purchaser, b). resell the property.

3. All payments to be made within 7 days. Property sold at auction and not paid for in full or collected, within 4 (Four) elapsed Months from the date of the auction, shall be deemed to be abandoned UNLESS OTHERWISE NOTIFIED. The auctioneer reserves the right to dispose of the property in any manner he sees fit and recover reasonable administration and/or storage costs from the disposal of said property and/or the purchaser. No subsequent claim arising from such a disposal shall be entertained and the auctioneer may not be held liable for any losses incurred by either the consignor or purchaser, or any other party, in this regard either publicly or privately and in such event to hold the purchaser liable for all costs including our commission and expenses for both sales, all other charges due hereunder, our attorneys fees and incidental charges. All fees commissions, bid prices and duties not settled promptly by the purchaser in terms of this clause 2 shall bear interest at South African Bankers prime lending rate plus 3 percent from the seventh day following the sale until settlement is received in full.

In the event that a purchaser does not effect collection within four months of the sale date, of any item purchased, Classic Arms reserves the right to charge a storage fee of ZAR 50-00 per calendar month or part thereof. Such fee being payable monthly in advance from the first day of the month within which the four month period shall expire. In the event that the purchaser fails in his obligation to Classic Arms to pay such fee, Classic Arms, may at its own discretion, resell such item to recover such fee. 4. We reserve the right to withdraw any property at any time prior to the actual sale of such property. Unless actually stated by the auctioneer, all lots shall be offered against their catalogued number and no lot shall be divided for sale.

5. We reserve the right to reject any bid. The highest bid acknowledged by the auctioneer shall be deemed to be the final bid price. In the event of any dispute between bidders or, if in the sole opinion of the auctioneer he doubts the validity of a bid, the auctioneer shall have the sole right to determine the successful bid or to re-offer the property in dispute for sale. Our sale records shall be conclusive in any dispute during or after conclusion of the sale.

6. If for any reason beyond our control, including but not limited to, fire, theft, acts of God, or insurrection, we are prevented from delivering the property to the purchaser, then we will be liable only for the sum actually paid therefore by the purchaser and shall in no event include payment for consequential or incidental damages. Classic Arms accepts no liability for any losses of whatsoever nature caused by any legislative changes in regard to the possession, by individuals or bodies, of firearms or ammunition.

7. If a lot is offered subject to a reserve (this being the confidential minimum price required by the consignor) then Classic Arms reserves the right to open the bidding or to bid on the consignor’s behalf in order to protect such reserve. Classic Arms shall not bid on the consignor’s behalf above such reserve. IN NO EVENT MAY A CONSIGNOR BID ON ANY PROPERTY OFFERED FOR SALE BY SAID CONSIGNOR. 8. All lots are sold “Voetstoets”. ALL STATEMENTS CONTAINED IN THE CATALOG OR IN ANY SALE DOCUMENTATION AS TO THE AUTHENTICITY, VALIDITY, AUTHORSHIP, PERIOD CULTURE, SOURCE, PROVENANCE, RARITY, CONDITION, IMPORTANCE OR HISTORICAL VALUE, ARE STATEMENTS OF OPINION AND ARE NOT REPRESENTATIONS OR WARRANTIES. NOT WARRANTY IS GIVEN AS TO ACCURACY OF RIFLES OR CLARITY OF OPTICS. No employee of Classic Arms is authorised to make any written or verbal warranty or statement on behalf of Classic Arms or our consignors.

9. If we undertake packaging or handling of any lots on the purchaser’s behalf it is done so entirely at the purchasers risk. We are not liable for any acts or omissions of carriers or packers including those recommended by us. Such carriers or packers may carry there own insurance and any claims for loss or damage should be addressed directly to them.

10. These Conditions of Sale and the respective rights of the purchaser and Classic Arms, are governed by the laws of South Africa. By bidding at an auction in person, or by agent, order-bid or telephone or other means, the buyer or bidder agrees to be bound by these Conditions of Sale. Any dispute controversy or claim arising out of or relating to this Agreement, or the breach, termination or validity thereof, brought by or against Classic Arms (but not including claims brought against the consignor by the purchaser of the lots consigned hereunder) shall be resolved by the parties in 10. These Conditions of Sale, shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of successors and assigns. No waiver amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing signed by us.

11. Absentee Bids. As a service to those bidders that are unable to attend the actual auction, we may at our sole discretion accept bids in advance of sale by telephone, or in writing on the bidding forms provided in the back of the sale catalogue. Please note that we cannot accept “buy” bids and all bids must clearly state the maximum (excluding buyers premium and any applicable taxes) bid that the bidder is willing to pay. In the event that identical absentee bids are received then the first bid received shall take preference. In the event that the maximum absentee bid is equalled by any bid from the auction floor, then the auction floor bid shall take preference. We accept no responsibility for not executing an absentee bid for any reason whatsoever.

12. Estimate prices. As a service to our clients, we furnish presale estimates for all lots. These estimates are intended as a guide to current market value and represent no warranty to bidder or seller as to the actual price.
