tracheids, or both usually together with wood fibers and parenchyma cells, functions chiefly in conduc-

tion of water and dissolved minerals but also in support and food storage, and typically constitutes the

woody element (as of a plant stem)

Xylem is an American company founded in 2005 on the belief that diverse

It will show you the inventory status, shipping cost and delivery schedule. If a correction is needed, you must contact Xylem before the shipping time stated on you acknowledgement or the item will be shipped and charged as acknowledged.

Change to OrdersOrders in the Xylem system that have not been shipped can be altered or cancelled. All changes must be made via fax including any additions or cancellations. Once orders are shipped adjustments may not be made.

SHIPPING / DELIVERYFreight ChargesFreight charges are not included in the price of each item in the Xylem price list. Shipping costs for all ship-ments except those covered by our Full Freight Allowed policy (see price/discount list) will be noted on the order acknowledgement.

Delivery ScheduleYou will receive a delivery schedule on the order acknowledgement. This date will indicate the delivery week and not the exact day of delivery. It is our policy to do everything in our power to ship within 48 hours of receipts of order.

Showroom / Warehouse Delivery PolicyBecause many of our products are large and heavy, we have established guidelines to ensure safe and complete delivery of Xylem products to our customers. Please note that our responsibilities end when we deliver merchandise in original condition to the carrier and that delivery to the carrier constitutes delivery to the customer. Note: • Customer should have staff and equipment capable of handling large and heavy items being shipped and off-loaded from a trailer tailgate. • All vanities are to be checked for damage at time of delivery by a representative of the customer. • Any and all damages must be reported and noted on the delivery paperwork. • All paper work must be signed by both the driver and the representative of the customer. • If any changes or shortages have been found after delivery, claims for damages or shortages should be made to the carrier within seven (7) days of receipt of product. Failure to do so will result in the denial of claims and no credit will be given.

FINISHES AND CHARACTERISTICSWoodXylem bath furniture is made from natural wood products whose visual appeal is attained by surface ab-sorption of stain, varying grains, knots and other characteristics which are inherent in natural products and veneers. Xylem is not in control of each specific attribute and cannot be held accountable if products vary from sample to sample.

StoneAt Xylem, we use both granite and marble for our stone tops and vessels. Due to the natural veining and color variations within the same types of granites and marbles, it is not unusual to have samples of the same product look different from one another. We cannot guarantee that each sample of stone will look identical to another sample of the same type.

GlassMost Xylem glass products are tempered and of the highest quality. Our “art” glass is handmade and no two pieces will be exactly alike. This is the appeal of this type of glass. Please be aware that samples of the same design will not look exactly alike and color variations can occur.

DEFECTS / DAMAGE POLICYDefectsIt is the customer’s responsibility to investigate all end users’ complaints regarding Xylem products. In some cases, after the dealer has made the inspection, a Xylem representative may be asked to examine the defect in question also.

ClaimsIf a claim is made for a defective product, please have a digital photo taken of the defect and send to us. If possible, please have a photo taken of the packaging as well. If claim is supported, please fill out a Return Goods Authorization form and submit to Xylem at fax 866-395-8113.

Damages/ShortagesPlease report damages or shortages as soon as possible, not exceeding seven (7) days from date of deliv-ery. Failure to do so will result in denial of claim.

LaborXylem will not be responsible for any labor costs related to defective or damaged products.

Replacement PartsWhenever possible, Xylem will replace defective parts on a “rush” basis. The replacement parts/products will be invoiced and a credit will be issued after confirmation of defective parts/products.

RETURNSNo merchandise will be accepted without prior written notice. Returned merchandise must be in “as new” resalable condition and shipped prepaid in its original carton. Merchandise approved for return will be sub-ject to a minimum 25% handling and restocking charge. Also, if the original packaging is damaged, a $10.00 carton charge will be applied. Merchandise will only be accepted for return when accompanied by a Xylem Return Goods Authorization Form.

WARRANTY

Bath FurnitureXylem bath furniture is made from natural products whose visual appeal is attained by surface absorption of stain, varying grains, knots and other characteristics which are inherent in natural products and veneers which are not within the control of Xylem nor considered defects under the warranty. Color changes and surface cracks due to direct sunlight, extreme temperature fluctuations, humidity conditions and cleaning agents are not covered by this warranty.

Fixtures and TopsXylem fixtures are formed from natural stone, glass and vitreous china whose visual appeal is attained by nuances in design, shape, textures, surface color and infused color whose characteristics are apparent in natural products and our manufactured products. Surface scratches, surface etching, chips, cracks and color changes due to cleaning agents, chemical spills, improper cleaning techniques, abrasive cleaners or cloths, extreme temperature fluctuations and by abuse or impact are not covered by this warranty.

Faucets and FittingsXylem faucets and plumbing fittings are warranted to be free from manufacturing defects, both mechani-cally and for surface finish, to the original purchaser for a period of one (1) year from date of receipt as long as product is used in a normal residential application. If the faucet or fitting shall develop a leak or drip, Xylem will provide the parts or products necessary to put the product back in good working condition free of charge. Xylem will not be responsible for labor charges or for damage incurred during installation, repair or replacement.

GeneralXylem warrants its products to be free of defects in material and workmanship to the original homeowner for a period of one (1) year under normal use and service from the date of shipment to the dealer or, if shipped direct, from the date of shipment to the consumer. Xylem products which have such defects will be repaired or replaced at Xylem’s option or if repairs and replacement are not possible, alternate remuneration may be paid also at Xylem’s option.

This warranty applies to products that are subject to normal residential use and does not apply to defects or damage caused by or resulting from negligence, misuse, abuse or improper maintenance including cleaning and/ or cleaning products, agents or chemicals, or when products have been used in institutional, commercial or other non-residential use.

This warranty only protects the homeowner when the product is purchased from an authorized Xylem dealer and proof of purchase may be required to substantiate any and all claims. Products purchased as floor samples or in an “as is” condition are not covered by this warranty.

This warranty gives you specific legal rights and you may have other rights which vary from state to state. Xylem warrants this product for one (1) year from the initial purchase. Xylem shall not be held liable for any consequential damages or commercial loss.

Some states do not allow limitations on how long an implied warranty will last or the limitation of incidental or consequential damages so the above limitation or exclusions may not apply to you.
