Since September 7, 2018, Canon Inc.

has issued a multitude of press releases

announcing that it had filed infringement

reports with Amazon seeking and

obtaining the removal of certain Amazon

sellers’ toner cartridge listings. As of

March 31, 2019, Canon has reported on

Amazon takedowns in five countries and

has had Amazon remove a range of

aftermarket toner cartridges used in HP

LaserJet printers and MFPs, which

Canon manufactures for HP Inc.

Typically, infringement reports with

Amazon are filed quietly behind the

scenes, but Canon is breaking with

tradition and publicizing its petitions to

Amazon. We see the move as part of a

more comprehensive effort by Canon

to rid the Internet of aftermarket toner

cartridges that violate its intellectual

property. For the past several years,

Canon has aggressively defended its

toner cartridge patents by filing

lawsuits against aftermarket toner

cartridge manufacturers and

distributors in Asia, Europe, and the

United States. The Amazon filings are

part of this larger effort.

Canon’s Amazon Crackdown

Intellectual property (IP) rights holders

have long complained that counterfeit and

infringing products are widespread on

online marketplaces like Amazon while

Amazon itself is shielded from liability over

what the millions of different sellers on its

platform peddle. Amazon has been taking

steps to make it easier for IP holders to

get infringing or counterfeit listings taken

down. Amazon offers a “Report

Infringement” form that enables IP holders

to notify Amazon about sellers that are

violating IP. Amazon also created a

free Brand Registry service that helps

trademark owners to “proactively remove

suspected infringing or inaccurate

content.” Amazon reports that more than

130,000 brands are registered and that it

has “created a global team of

investigators that is available 24 hours a

day, 7 days a week to respond to and take

action on notices of potential

infringement.” Just this March, Amazon

announced its Project Zero program that

uses artificial intelligence to scour stores

and remove suspected counterfeits and

includes a self-service counterfeit removal

tool for brand owners.

Canon is clearly taking full advantage of

these tools, specifically Amazon’s

“Report Infringement” forms. We

presume Canon is part of Amazon’s

Brand Registry and thus gets Amazon to

act quickly when infringement is

reported. While Canon undoubtedly has

long used Amazon’s tools to take down

infringing and counterfeit products, on

September 7, 2018, Canon began talking

about the infringement reports it filed with

Amazon over third-party toner cartridges

sold on the marketplace.

Between September 7, 2018, and March

31, 2019, Canon issued 55 press releases

about infringement reports filed with

Amazon over third-party toner cartridges

designed to replace HP cartridges. While

the first announcements focused on

Amazon.com in the United States, Canon

quickly turned its attention to Europe as

well. Eighteen of Canon’s announcements

have focused on the UK, 16 on Spain, 10

on Italy, 10 on the United States, and one

on Germany. These press releases cover

the removal of 137 Amazon Standard

Identification Numbers (ASINs): 59 in the

U.S., 31 in the UK, 24 in Italy, 19 in Spain,

and 4 in Germany.

Initially, Canon focused on asserting its

“dongle gear” toner cartridge patents on

Amazon. In the United States, it asserted

U.S. patent numbers 8,280,278,

8,630,564, 8,682,215, 8,688,008, and

8,676,090, while in Europe Canon

asserted European Patent (EP) 2 087

407. These patents are employed in HP

toner cartridge models including the HP

CF280A/CF280X, CE505A/CE505X,

CE310A, CE255A, CF226A, and

CE311A/CE312X/CE313A.

However, starting in February 2019,

Canon began asserting a different

patent in Europe, European Patent EP 1

977 289 . Among other things, this

patent claims a movable “force-

receiving device” that moves between

the developer roller and the drum.

Canon has asserted this patent to take

down infringing HP

CB450A/CB541A/CB542A/ CB543A and

CE320A toner cartridges sold on

Amazon sites in Europe. This European

patent is part of a broader family that

includes a number of counterpart

patents in the United States and

pending patents in Europe.

Canon’s Amazon Takedowns

Result in Lawsuits

Canon is always careful to note in its

press releases about Amazon toner

cartridge takedowns that “Filing a

Report Infringement Form with Amazon

is a service offered by Amazon and

does not comprise any official finding of

validity or infringement of a patent.”

While Amazon pulling a listing is not the

same thing as a judgment of

infringement, we have heard that these

takedowns are posing real challenges

for aftermarket cartridge sellers,

especially smaller ones in Europe.

The detective work Canon does to effect

Amazon takedowns, such as purchasing

sample cartridges, is leading to the filing

of patent-infringement litigation in some

instances. For example, Canon has

announced one Amazon toner cartridge

takedown in Germany to date. On

October 17, 2018, Canon announced

that it got new-build compatibles

designed to replace the HP CE505A,

CE505X, CF280A, and CF280X sold by

Nixim Europe Limited, also known as

Top Cartridge Limited, removed from

Amazon.de after claiming they infringed

Canon’s EP 2 087 407. On February 7,

2019, Canon revealed that it had filed a

patent-infringement lawsuit in Germany

against Nixim Europe Limited over these

same products and asserting the same

patent. The District Court Düsseldorf has

awarded Canon a preliminary injunction

against Nixim.

In an even more recent example, on

February 12, 2019, Canon announced that

Amazon.it took down an HP CB540A

compatible sold by LD Products after the

OEM complained that the cartridge

infringed EP 1 977 289. This seems to

have sparked Canon’s broader interest in

what LD Products was selling because on

March 20, 2019, Canon filed a patent-

infringement lawsuit against LD Products in

the United States in which it claims several

cartridge models sold by LD infringe U.S.

patent number 8,588,646, one of the U.S.

counterparts to EP 1 977 289.

One interesting thing to note is that

Canon is reporting on relatively few toner

cartridge takedowns on Amazon.de in

Germany: so far just the one press

release about Nixim Europe Limited.

That, however, does not mean that

Canon is taking a lax approach to

protecting its IP in the German

marketplace. In fact, the opposite is true.

In the first quarter of 2019 alone, Canon

announced nine new patent-infringement

lawsuits filed in Germany against

aftermarket toner cartridge sellers.

Canon obtained preliminary injunctions

against all nine.

In the German market, it appears that

Canon goes straight to the courts when it

finds infringement rather than working

with Amazon. Germany is perceived as a

good venue for patent holders due to the

speed with which German courts handle

patent-infringement disputes, as well as

the fact that judges with deep experience

in patent law decide cases. Patent

holders like Canon can often get

preliminary injunctions awarded within

days of filing suit. And a preliminary

injunction offers far more protection in

the German marketplace than getting

Amazon to pull a cartridge model,

effectively shutting down sales via other

avenues as well.

The slew of patent-infringement cases

filed by Canon in Germany will likely

continue. We also think it is likely we will

see Canon’s Amazon patent-

enforcement efforts lead to litigation in

countries outside Germany, such as the

new LD Products lawsuit.

Part of a Comprehensive Plan

Canon’s Amazon initiative can be viewed

as an effective strategy for battling what

is now one of the world’s major channels

for infringing toner cartridges—the

Internet. Ecommerce sites are popular

outlets for digital imaging consumables

especially among home users and small

businesses. However, bigger companies

are also increasingly turning to the

Internet to purchase consumables.

Eliminating infringing products from

Amazon will help Canon protect its

investment in its IP. It is faster—and

much cheaper—than relying on the

courts. Moving forward, it will be

interesting to see if Canon expands its

Amazon campaign to other countries

where it has patent protection.

It would seem to be in Canon’s interest to

continue to use the courts to apply

pressure on vendors marketing infringing

products online. In 2018, Canon filed

scores of lawsuits around the world,

including in the United States, Europe,

and Asia. The company kept up the

momentum in the first quarter of 2019,

filing several new lawsuits. Regardless of

where it has filed litigation, Canon has

prevailed in many of these cases and

has reached settlements in its favor with

dozens of defendants that have agreed

to stop selling certain products that

infringe Canon’s patents.
