A. Absent knowledge as to who, i f anyone, supports t h i s application, a meaningf u l t r a f f i c exhibit cannot be presented. However, i t i s obvious that the bulk of protestant's operations, under i t s proposed service would be subject to diversion resulting i n an adverse impact on protestant and approval of th i s application would be contrary to the public i n t e r e s t .
5. This protest w i l l be withdrawn i f the application i s amended so as to eliminate authority to transport passengers to or from the Harrisburg International Airport *
6. Pursuant to §333(c) of the Public U t i l i t y Code, demand i s made on applicant to furnish protestant's counsel with a l i s t of the names and addresses of the witnesses intended to be called, including a b r i e f summary of t h e i r proposed testimony.
7. Applicant presently holds no authority from t h i s Commission and i t s fitness and a b i l i t y to operate the proposed service i s challenged by protestant.
8. Absent such amendment, protestant prays that the application may be dismissed.

property and persons as a common c a r r i e r , and due to the nature of the business
of Lancaster Limousine Service, Ltd., the approval of the above application
would cause undue economic deprivation to Lancaster Limousine Service, Ltd.
Lancaster Limousine Service, Ltd. does considerable business between points
in the City of Harrisburg, Dauphin County, Pennsylvania, and with an a i r l i n e
distance of si x t y (60) statute miles of the l i m i t s thereof and has found that
i t i s not overburdened i n t h i s area. Lancaster Limousine Service, Ltd. sees
no need for additional c a r r i e r service i n this area, and the granting of an
approval of the application to the above applicant would only take away from
the business of Lancaster Limousine Service, Ltd.

would cause undue economic deprivation to Lancaster Limousine Service, Ltd.
Lancaster Limousine Service, Ltd. does considerable business between points
in the City of Harrisburg, Dauphin County, Pennsylvania, and with an a i r l i n e
distance of si x t y (60) statute miles of the l i m i t s thereof and has found that
i t i s not overburdened i n t h i s area. Lancaster Limousine Service, Ltd. sees
no need for additional c a r r i e r service i n this area, and the granting of an
approval of the application to the above applicant would only take away from
the business of Lancaster Limousine Service, Ltd.
2. The Commission docket numbers under which the Protestant operates
are PUC A-99235, Folders 1, 2, 3, 4, 5, 6, & 7; and PUC A-96629, Folder 2;
copies of which are attached hereto as "Exhibit A" and made a part hereof.
3. Lancaster Limousine Service, Ltc. believes, and therefore avers,
that the Applicant w i l l not be able to demonstrate a public need for the
proposed service or any inadequacy of the existing service now offered by
your Protestant.
4. There are no r e s t r i c t i o n s to the application which would protect
the Protestant's interests i n t h i s matter. There i s no amendment which

p r e v i o u s l y c h a r a c t e r i z e d as a i r p o r t t r a n s f e r s e r v i c e . On t h e
o t h e r hand, t h e s e r v i c e t o be p r o v i d e d by A p p l i c a n t , w h i l e n o t
e x t e n d i n g as f a r as t h a t c ontemplated by Aero C o r p o r a t i o n , i s
n o t p h y s i c a l l y l i m i t e d t o o p e r a t i o n s t o and from t h e a i r p o r t .
Thus, t h e s e r v i c e t o be rendered by t h e A p p l i c a n t h e r e i n i s
o f a d i f f e r e n t c h a r a c t e r than t h a t proposed by t h e P r o t e s t a n t .

We have received the Restrictive Amendment submitted by Mr. Doll i n the above case.
I believe there has been an inadvertent omission i n the f i r s t paragraph which I believe should read:
"To transport persons i n limousine service between points i n the counties of Dauphin and Cumberland and from points i n said counties to points within an a i r l i n e distance of 60 statute miles of the l i m i t s thereof and vice versa."
The amendment does, however, sa t i s f y the interest of Aero Corporation and i t s protest may now be'considered withdrawn and i t w i l l not be represented at the hearing before Judge Banzhoff on July 3, 1984.

4 ) . The v e h i c l e s are t o be housed i n a b u i l d i n g , c u r r e n t l y
under c o n s t r u c t i o n , c o n s i s t i n g o f o f f i c e space and approx
i m a t e l y 2750 square f e e t f o r s e r v i c e on up t o s i x l i m o u s i n e s
(N.T. 11-12; A p p l i c a n t ' s E x h i b i t 5 ) . These f a c i l i t i e s w i l l
be used f o r d a i l y v e h i c l e s a f e t y i n s p e c t i o n s and f o r minor
r e p a i r s (N.T. 12-13), w h i l e major r e p a i r s and w a r r a n t y work
w i l l be performed by t h e s e l l i n g d e a l e r s h i p (N.T. 12).
Upon r e c e i p t o f i t s c e r t i f i c a t e , A p p l i c a n t w i l l i n s t i t u t e
a d r i v e r t r a i n i n g program w i t h t h e a s s i s t a n c e o f Aetna
Insurance Company (N.T. 13, 38-39).
I n o r d e r t o b e t t e r serve t h e c l i e n t e l e who would u t i l i z e
t h e t y p e o f l u x u r y s e r v i c e proposed, t h e A p p l i c a n t i s prepared
t o e s t a b l i s h a d e t a i l e d r e c o r d keeping system which s h a l l serve
as a c h e c k l i s t e n s u r i n g p r o p e r care o f t h e v e h i c l e and t h e
passenger (N.T. 6 ) . A l t h o u g h A p p l i c a n t has n o t p r i n t e d the
forms t o be u t i l i z e d pending t h e outcome o f t h i s p r o c e e d i n g ,
Mr. L i l l e y t e s t i f i e d t h a t forms s i m i l a r t o those found i n
A p p l i c a n t ' s E x h i b i t No. 2 w i l l be used.
Mr. L i l l e y i n c l u d e d , w i t h i n t h e c o n t e x t o f h i s t e s t i m o n y ,
examples o f r e q u e s t s r e c e i v e d f o r t h e proposed s e r v i c e ,
i n c l u d i n g those from f i v e Supreme Court J u s t i c e s and v a r i o u s
c e l e b r i t i e s , which have n o t been honored due t o t h e l a c k o f
a c e r t i f i c a t e from t h e Commission (N.T. 7; A p p l i c a n t ' s
E x h i b i t 3 ) . S e r v i c e has been f u r n i s h e d on two occasions
w i t h o u t compensation (N.T. 2 3 ) .
F i n a l l y , d e s p i t e u t i l i z a t i o n o f the l i m o u s i n e s e r v i c e

t h a t t h i s use would account f o r no more t h a n t h r e e p e r c e n t
( 3 % ) o f A p p l i c a n t ' s a n t i c i p a t e d b u s i n e s s (N.T. 3 8 ) , t h e
r e m a i n i n g b u s i n e s s coming from e x e c u t i v e s , c o r p o r a t i o n s and
from i n d i v i d u a l s who w i s h t o u t i l i z e t h e s e r v i c e f o r s p e c i a l
o ccasions (N.T. 36; 3 8 ) .
Timothy Buchanan ( H a r r i s b u r g )
Mr. Timothy Buchanan, manager o f t h e Pennsylvania S o c i e t y
o f A s s o c i a t i o n E x e c u t i v e s , who i s r e s p o n s i b l e f o r p r o v i d i n g
management s e r v i c e s t o t h e A s s o c i a t i o n o f A s s o c i a t i o n Execu-
t i v e s , t e s t i f i e d on b e h a l f o f A p p l i c a n t . Mr. Buchanan
t e s t i f i e d t h a t t h e A s s o c i a t i o n c u r r e n t l y p r o v i d e s t r a n s p o r
t a t i o n s e r v i c e s t o speakers and o t h e r VIP's t h r o u g h t h e use
o f employees' p e r s o n a l v e h i c l e s (N.T. 4 1 ) , b u t would u t i l i z e
t h e s e r v i c e s proposed by t h e A p p l i c a n t i f t h e y were t o become
a v a i l a b l e (N.T. 4 2 ) .
Wayne B. T i t u s I I (Swatara Township)
Mr. T i t u s , owner o f T i t u s C a d i l l a c - - 0 1 d s m o b i l e , I n c o r
p o r a t e d , t e s t i f i e d as t o the need f o r t h e proposed s e r v i c e .
He has p e r s o n a l l y u t i l i z e d t h e s e r v i c e o f Lancaster Limousine
(N.T. 54) and found t h a t s e r v i c e t o be. inadequate (N.T. 5 5 ) .
He f u r t h e r t e s t i f i e d t h a t he would u t i l i z e t h e a p p l i c a n t ' s
proposed s e r v i c e t o p r o v i d e h i s customers w i t h a q u a l i t y

I l l . ARGUMENT
A. INTRODUCTION AND PERTINENT BACKGROUND LEGAL PRINCIPLES
The g e n e r a l t e s t g o v e r n i n g common c a r r i e r a p p l i c a t i o n s
i s found i n S e c t i o n 1103 o f t h e P u b l i c U t i l i t y Code, 66 Pa.
C.S. 51103(a), which p r o v i d e s i n p e r t i n e n t p a r t , t h a t " [ a ]
c e r t i f i c a t e o f p u b l i c convenience s h a l l be g r a n t e d by o r d e r
o f t h e commission, o n l y i f t h e commission s h a l l f i n d o r
determine t h a t t h e g r a n t i n g o f such c e r t i f i c a t e i s necessary
or p r o p e r f o r t h e s e r v i c e , accommodation, convenience o r s a f e t y
o f t h e p u b l i c . " (Emphasis added). I n a p p l y i n g g e n e r a l
s t a t u t o r y s t a n d a r d , t h e Commission i s n o t r e q u i r e d t o f i n d
t h a t a proposed s e r v i c e i s an a b s o l u t e n e c e s s i t y ; r a t h e r , t h e
Commission i s charged by law t o c o n s i d e r b o t h t h e accommodation
and convenience o f t h e p u b l i c , and t o determine s i m p l y whether
a proposed s e r v i c e i s reasonably necessary. P h i l b o r o Coach
Corp. v. Pa. P.U.C., 67 Pa. Commonwealth Ct. 176, 446 A.2d
725 (1982); McNaughton v. Pa. P.U.C, 2 Pa. Commonwealth Ct.
319, 270 A.2d 186 (1971).
I n c a r r y i n g o ut t h i s L e g i s l a t i v e charge, t h e Commission
has promulgated v a r i o u s r e g u l a t i o n s . T h i s p r o c e e d i n g commenced
a f t e r t h e p r o m u l g a t i o n and e f f e c t i v e n e s s o f t h e Commission's
new r u l e s r e g a r d i n g e v i d e n t i a r y c r i t e r i a t o be used i n motor
c a r r i e r a p p l i c a t i o n s (52 Pa. Code §41.14). Under c u r r e n t
Commission r e g u l a t i o n s , t h e r e i s no l o n g e r a n e c e s s i t y t o prove
inadequacy o f e x i s t i n g s e r v i c e . S e c t i o n 41.14 p r o v i d e s as
f o l l o w s :
(a) An a p p l i c a n t s e e k i n g motor common c a r r i e r a u t h o r i t y has a burden o f d e m o n s t r a t i n g t h a t t h e a p p r o v a l o f t h e

a p p l i c a t i o n w i l l serve a u s e f u l p u b l i c purpose, r e s p o n s i v e t o a p u b l i c demand or need.
(b) An a p p l i c a n t s e e k i n g motor common c a r r i e r a u t h o r i t y has t h e burden o f d e m o n s t r a t i n g t h a t i t possesses t h e t e c h n i c a l and f i n a n c i a l a b i l i t y t o p r o v i d e t h e proposed s e r v i c e , and, i n a d d i t i o n , a u t h o r i t y may be w i t h h e l d i f t h e r e c o r d demonstrates t h a t t h e a p p l i c a n t l a c k s a p r o p e n s i t y t o o p e r a t e s a f e l y and l e g a l l y .
(c) The Commission w i l l g r a n t motor common c a r r i e r a u t h o r i t y commensurate w i t h t h e demonstrated p u b l i c need u n l e s s i t i s e s t a b l i s h e d t h a t t h e e n t r y o f a new c a r r i e r i n t o t h e f i e l d would endanger o r i m p a i r t h e o p e r a t i o n s o f e x i s t i n g common c a r r i e r s t o such an e x t e n t t h a t , on balance, t h e g r a n t i n g o f a u t h o r i t y would be c o n t r a r y t o th e p u b l i c i n t e r e s t .
Where an a p p l i c a n t proposes t o p r o v i d e a s e r v i c e which
d i f f e r s from t h a t o f e x i s t i n g c a r r i e r s , p u b l i c n e c e s s i t y f o r
t h e s e r v i c e alone s u p p o r t s t h e g r a n t i n g o f a c e r t i f i c a t e o f
p u b l i c convenience. M o b i l f o n e o f N o r t h e a s t e r n Pennsylvania,

I t must be note d t h a t t h e n a t u r e o f t h e l e g a l " d i f f e r e n c e "
i n s e r v i c e which r e s u l t s i n a f f o r d i n g an a p p l i c a n t t h e l e s s e r
burden o f p r o o f i s c l e a r l y i l l u s t r a t e d i n t h e G e t t y s b u r g Tours
case. I n t h a t case, b o t h t h e a p p l i c a n t and t h e p r o t e s t a n t
p r o v i d e d a s i m i l a r t o u r s e r v i c e o f t h e G e t t y s b u r g b a t t l e f i e l d .
However, a p p l i c a n t ' s s e r v i c e was found t o be l e g a l l y
" d i f f e r e n t " f o r purposes o f d e t e r m i n i n g burden o f p r o o f , based
upon two simp l e c o n s i d e r a t i o n s :
1. The a p p l i c a n t ' s r o u t e and h i s t o r i c a l emphasis d i f f e r e d f r o m t h a t o f p r o t e s t a n t , and
2. The a p p l i c a n t ' s v e h i c l e s were a i r c o n d i t i o n e d .

i s w i l l i n g t o commit whatever a d d i t i o n a l funds which may be

The p r o p e n s i t y f o r o p e r a t i n g l e g a l l y i s b e s t e x e m p l i f i e d
by A p p l i c a n t ' s r e f u s a l t o render compensated s e r v i c e s d e s p i t e
s e v e r a l r e q u e s t s t o do so (N.T. 7, 23; A p p l i c a n t ' s E x h i b i t 3 ) .
I t i s a b u n d a n t l y c l e a r t h a t A p p l i c a n t i s aware o f t h e
Commission's concern over t h e safe and proper o p e r a t i o n o f
a l i m o u s i n e s e r v i c e and, upon the g r a n t i n g o f i t s c e r t i f i c a t e
o f p u b l i c convenience, w i l l t a k e any and a l l steps necessary
t o o p e r a t e i n a safe and l e g a l manner.

C. APPLICANT HAS ESTABLISHED A NEED FOR THE PROPOSED SERVICE
As s t a t e d p r e v i o u s l y , i n d e t e r m i n i n g whether a p u b l i c
need f o r t h e proposed s e r v i c e has been shown, t h e Commission
i s n o t r e q u i r e d t o f i n d t h a t a proposed s e r v i c e i s an a b s o l u t e
n e c e s s i t y , b u t merely whether a proposed s e r v i c e i s reasonably
necessary. P h i l b o r o Coach; McNaughton. Recognizing these
p r e c e d e n t s , t h e Commission has r e v i s e d i t s e n t r y standards
f o r motor c a r r i e r a p p l i c a t i o n s . Under 52 Pa. Code §41.14 i t
i s no l o n g e r necessary t o prove t h a t e x i s t i n g s e r v i c e i s
inadequate. I n s t e a d , an a p p l i c a n t must merely demonstrate
" t h a t t h e a p p r o v a l o f t h e a p p l i c a t i o n w i l l serve a u s e f u l

FACTS OF THE CASE
The Applicant f i l e d an application with the Pennsylvania Public U t i l i t y
Commission for the r i g h t to transport, persons, i n limousine service between
points i n the City of Harrisburg, Dauphin County, and within an a i r l i n e distance
of s i x t y statute miles of the l i m i t s thereof. This application was la t e r
amended by Restrictive Amendment, which reads as follows:
To transport persons i n limousine service between points i n the counties of Dauphin and Cumberland and from points i n said counties to points within an a i r l i n e distance of sixty statute miles of the l i m i t s thereof and vice versa.
PROVIDED that no r i g h t , power or privilege i s granted to perform transportation from points i n the county of Cumberland to or from Harrisburg International Airport i n the Township of Lower Swatara, Dauphin County.
FURTHER PROVIDED that no r i g h t , power or pr i v i l e g e i s granted to perform transportation from points i n the County of Dauphin with the exception of points i n the City of Harrisburg and the Township of Derry, Dauphin County, to or from the Harrisburg International A i r port i n the Township of Lower Swatara, Dauphin County.
Lancaster Limousine Service, Ltd., protested the application and a
hearing was held on June 20, 1984, before Administrative Law Judge Harry G.
Banzhoff.
The primary testimony given by the Applicant was that of Robert D. L i l l e y ,
President of the Applicant. He stated that he wished to provide a luxury-
class type of service with luxury-stretch limousines, equipped with stereo and
AM-FM radio, video recorder, a bar, ice chest, intercom system and telephones.
(N.T.#4). He stated that the creation of the corporation and the application
came out of a need for i t s use by other companies owned by himself. (N.T.#5).
He states that one of his ether businesses would possibly use t h i s service
twenty-five times per year.(N.T.#8)
Further testimony by Mr. L i l l e y made i t clear that i t was another one of
his businesses known as "Liberty Productions, Inc." which would be using t h i s
limousine service approximately twenty-five times per year. (N.T.#19). The
applicant further introduced an exhibit which was market "Exhibit 3" which
was a small l i s t of requests that he had had for service. He t e s t i f i e d that
some of the service had been provided by the Protestant but did not know i f
the Protestant had provided service to a l l of the requests i n Exhibit 3.
On cross-examination, the Applicant stated that his major need connected
with Liberty Productions, Inc. and i t s usage of the limousine would be i n the
months of January, February and March. (N.T.#37). He also t e s t i f i e d that there
was only one occasion when he contacted the Protestant and was not able to use
the Protestant's vehicle. (N.T.#38). He further stated that the use of the
vehicle by Liberty Productions, Inc. would be approximately three percent (3%)
of the vehicle's use. (N.T.#38).

In support of i t s application, the Applicant had several witnesses
t e s t i f y . The f i r s t was Timothy Buchanan, who i s the manager of the Pennsyl
vania Society of Association Executives. He stated that he could possibly use
the service several times a year. (N.T.#42). He further stated that the only
time he used this service i n two years was when he chartered a bus, (N.T.#43).
and that he was not aware of the existence of Lancaster Limousine Service, Ltd.
(N.T.#42). He further t e s t i f i e d that the vehicle which could possibly be used
by his group would not have to have a bar or a television i n i t , (N.T.#49).
and that he would use Lancaster Limousine.Service, Ltd. i f a need would arise.
(N.T.#50),
Applicant's next witness was Wayne B. Titus, I I . He i s a car dealer
who sold a limousine to the Applicant. He also stated that he has not used a
limousine on more that one occasion but that he has customers that may want to
use i t . Howevever, these customers were not present to t e s t i f y . He further
t e s t i f i e d that he would anticipate that i f the Applicant's application were
granted, that the Applicant would buy the vehicles from him. (N.T.#59).
Applicant next questioned was Kenneth L i n t , who was t e s t i f y i n g on behalf
of "Total :Exposition Concepts," which i s a business .conducted1.to set up
trade shows, conventions, and the. l i k e . (N.T.#60). He t e s t i f i e d that he
could possibly use t h i s service six or twelve times per year, (N.T. #62), that
he was aware of the existence of the Protestant (N.T.#63), but that he had no
occasion to have used a limousine service for luxury-type service as has been
applied f o r .

Applicant's next witness was Leslie Taylor, who stated that he might want
to entertain a c l i e n t and might use t h i s service i n this manner, (N.T.#70). He
further t e s t i f i e d that he has never used a limousine to entertain a c l i e n t or
for any other purpose within the past three years. (N.T.#71).
Applicant's las t witness was Annett Scholl, who i s o f f i c e manager for
"Mesmer Associates, Inc." She attempted to t e s t i f y that her company would use
a limousine service for her to go to other businesses to t r a i n that business to
use the services of her business; but that she has never looked into the
p o s s i b i l i t y of using a limousine service.
QUESTIONS INVOLVED
1. IS THERE A NEED FOR THE PROPOSED SERVICE OF THE APPLICANT?
2. HAS THE APPLICANT PROVED THAT THE EXISTING SERVICE DOES NOT SATISFY THE PUBLIC NEED?
3. WOULD THE PROPOSED SERVICE OF THE APPLICANT CORRECT OR SUBSTANTIALLY IMPROVE THE CONDITION ASSUMING THAT THE EXISTING SERVICE DOES NOT SATISFY THE PUBLIC NEED?
SUMMARY OF ARGUMENT
Is the position of Lancaster Limousine Service, Ltd. that a need does
not exist for the service proposed by the Applicant, other than the need
connected with another business owned by the Applicant. For reasons which w i l l
be detailed hereinafter, the Protestant feels that the Applicant, has not met
i t s burden to show that a need exists. Further, the Protestant submits that
the Applicant'has not shown that the existing service does not sa t i s f y the

public need and, therefore, the question of whether the proposed service would
correct or substantially improve the condition i s a moot point.
ARGUMENT
The Applicant has not met i t s burden of proof, has not displayed a need
for the proposed service. A need for a proposed service i s established by
showing that such service i s reasonably necessary for the accommodation or'
convenience of the public, or by establishing thatt the existing service does
not s a t i s f y the public need and that the proposed service would tend to correct
or substantially improve that condition. Zurcher vs. Pennsylvania Public
U t i l i t y Commission, 173 Pa.Super.343(1953). Proper matters for the Public
U t i l i t y Commission to consider are: Accommodation and convenience of the
public: Ruetteger vs. Pennsylvania Public U t i l i t y Commission, 164 Pa.Super.388
(1949), Requests for service: Reutteger vs. Pennsylvania Public U t i l i t y
Commission, 164 Pa.Super.388(1949), and Ecomony of operation: Alko Express
Lines vs. Pennsylvania Public U t i l i t y Commission, 152 Pa.Super.27(1943). The
testimony indicates that the major user of the proposed service would be anothei
corporation owned by the owner of the Applicant. That same corporation.
Liberty Productions, Inc., has used the services of Lancaster Limousine
Service, Ltd., and there has only -been one occasion when the service could
not be provided. Certainly, i f Liberty Productions wants to use a luxury,
stretch-type vehicle equipped with a bar, a television, etc., one i s now
available to i t since the Applicant has already purchased a vehicle. Since

a l l of the corporations t e s t i f i e d to by Mr. L i l l e y have a common ownership,
the use of this vehicle could certainly be feasible. However, there' seems to
be no need to grant a public u t i l i t y commission license for the use of this
vehicle since i t could be done on a "no charge basis."
I t i s submitted that the witnesses t e s t i f y i n g on behalf of the Applicant
have not shown a need for the type of service proposed. The f i r s t witness,
Mr. Buchanan, t e s t i f i e d that he would not need a limousine equipped as the
Applicant intends to equip his vehicles. His needs could certainly be met
by the regular cadillac-type service i n existence. The second witness, Mr.
Titus, gave nebulous testimony regarding customers requesting the "limousine
service but he did not state what type. He fur t h e r , obviously, has a vested
interest i n whether or not this application should be granted.
The t h i r d witness, Mr. L i n t , has never used a limousine service i n three
years. He also t e s t i f i e d that he knew of the existance of the Protestant.
This does not show any need for the service. The fourth witness, Mr. Taylor,
only indicated that he may use such a vehicle for his own personal entertaining
However, he also t e s t i f i e d that he never made any investigation into the
a v a i l a b i l i t y of such service. The f i n a l witness, Ms. Scholl, t e s t i f i e d i n such
a manner that her testimony should be disregarded as i t was obvious" that there
i s no need at her place of employment for a luxury limousine service.

I t i s therefore submitted that the need does not exist i n the public
sector for the granting of t h i s application. I t i s submitted that there i s
not a need for one vehicle, l e t alone the f i v e or ten as proposed by the
Applicant. There i s also no testimony been presented showing that the
existing service does not s a t i s f y the public need.
The Protestant further submits that there i s no need to consider the
question of whether the proposed service would tend to correct or substantially
improve the existing condition, since the existing condition i s that there i s l
no'need for the Applicant's service and that the existing service s a t i s f i e s
the public need. The only possible need shown by the testimony i s the need of
a subsidiary corporation of the Applicant. As stated before, the limousine
already purchased can certainly be used by this subsidiary corporation without
the need to have rights granted to the Applicant by the Public U t i l i t y
Commission. The existing condition i n regard to need i s a satisfactory one
and no correction i s neccessary regarding the existing service because of a
lack of need. The witnesses for the Applicant certainly did not show that
a need exists. The Applicant further did not show that the existing condition
could be improved since there was no discussion regarding rates or a v a i l a b i l i t y
of service.
CONCLUSION
The testimony presented by the Applicant i s i n s u f f i c i e n t to meet the
Applicant's burden of proof. The testimony does not show that there is

s u f f i c i e n t need, for the proposed service. The testimonyin no way shows that
the existing service does not s a t i s f y the public need. The application of
A Touch of Class Limousine Service, Inc. should be denied.
