PursuanttotherequirementsofAB2398,themanufacturersofcarpetsoldintheState ofCalifornia(CarpetMills)submitthiscarpetstewardshipPlan toCalRecycle,perPublicResourceCode(PRC),Section42972.CARE,asthedesignatedstewardshiporganizationoftheCarpetMillsselling carpetinto California,respectfullyrequestsCalRecyclesapprovalofthisPlan.PursuanttoSection42973,CalRecyclemayapprovethisPlanonlyifCalRecyclemakesbothofthe followingfindings:(A)Theplan willnothavetheeffectofreducingthe levelofdiversionandrecyclingofpostconsumercarpetthathasbeenachievedpursuanttothischapteratthetimethedepartmentreviewstheplan.(B)Theamountoftheassessmentintheplan willnotcreateanunfairadvantagein themarketplaceforoneormoreofthecompanies intheorganization.
CAREhasresponded strategically,aggressively,andrepeatedly inanefforttoinfluencegrowthofthecarpetrecyclingindustry.Theglobal polymersupplychainiscomplex,sophisticated,unregulated,and intensely competitive.Therearemultiplecompetitivesourcesofthesematerialsincluding virgin,postindustrial,preconsumer,andpostconsumerpolymerfromdozensofindustriesrepresentinghundredsofproducts.
Anoutlineofthesefactorsmaybefoundinthe2015CAREAnnualReporttoCalRecycle and isincorporated byreference.ItistheintentofCAREto pointoutthefactualelementsthatgovernourabilityasasmallenterprisetoinfluencethemarketsforrecycledpolymericmaterials.TheState hasseenfirsthandthesesame headwindsmanifested asadropinitsstatewiderecyclingrateto 47%in2015.Wefacethis challengetogether, anditmakesgreatsensetocontinuetocollaborateonourpathforwardtosuccessaswe workto evolveandenhancethisPlan.
AsthisPlandemonstratesthatcurrentlevelsofdiversionandrecycling willincreaseinthe next5yearsandwillnot,atthe currentlevelofassessment,createanunfairadvantageinthemarketplace,itmeetstwoofthekeyrequirementsestablished bythelawforapprovalofthisPlanbyCalRecycle.

CarpetAmericaRecoveryEffort(CARE)isthedesignatedstewardshiporganizationoftheCarpetMills andisresponsibleforsubmittingthisPlan.CAREisa501(c)(3)nonprofitorganization.CAREbeganin 2002asaresultofaMemorandumofUnderstanding(MOU)forCarpetStewardshipsignedbystakeholdersincludingmembersofthecarpetindustry,governmentrepresentatives,nongovernmentalorganizations,andentrepreneurs.CaliforniaAssemblyBill2398required CAREtoserveasthecarpetstewardshiporganizationuntilApril1,2015,andCAREiscontinuinginthatrolewiththesupportofall qualifiedCarpetMills.
CAREis the facilitatorandnetworkerforthe marketbasedsystemforpostconsumercarpet recycling acrosstheUnitedStates.CAREactivelysupportsitsmembersincludingentrepreneurs,thecarpetindustry,governmententities,andnongovernmentalorganizationstoachieveitsmission.CAREsmissionistoadvancemarketbasedsolutionsthatincreaselandfilldiversionandrecyclingofpostconsumercarpet,encouragedesignforrecyclability,andmeetmeaningfulgoalsasapprovedby the CAREBoardofDirectors.CAREsvisionisthatpostconsumercarpetdiversionandrecyclingareeconomically,socially,andenvironmentallysustainableforallstakeholders.
