CAFTA Short Supply:

A Reference Guide to Short Supply Items November 3, 2011

The U.S. Central America and Dominican Republic Free Trade Agreement (CAFTA) entered into force on March 1, 2006. Among the duty-free benefits for U.S. imports of apparel is the Agreement’s Short Supply provision, which permits the use of non-CAFTA originating materials in the production of duty-free garments. This is one of the exceptions to the Agreement’s yarn-forward Rule of Origin for apparel. The following table includes all fabrics, fibers, and yarns approved by the Committee for the Implementation of Textile Agreements (CITA) for the CAFTA Short Supply List. Introduction Under CAFTA’s Short Supply provision, products made from inputs sourced from outside of the CAFTA countries – which are determined to be not commercially available in the region in a timely manner – are eligible for duty-free treatment provided that the goods are cut and sewn in a CAFTA Party. For apparel production, this means yarns and fabrics may be of any origin. The short supply list is included in Annex 3.25 of the DR-CAFTA text (attached). The Annex includes all 43 items contained on the Caribbean Basin Trade Partnership Act short supply list, in addition to items added through the course of CAFTA negotiations in 2003, and subsequently through the Agreement’s procedure for amending the list. This report is intended as a companion to, not a replacement for, the Annex. The IDS Report, CAFTA Short Supply: A Reference Guide to Short Supply Items, is a reference tool for searching the CAFTA short supply list by HTS number.

CAFTA Short Supply Rule of Origin CAFTA Rule of Origin provides the following definition for apparel goods potentially eligible for duty-free status using the Short Supply benefits:

An apparel good of chapter 61 or 62 of the tariff schedule…shall be considered originating if it is cut or knit to shape, or both, and sewn or otherwise assembled in the territory of one or more of the parties to the Agreement, and if the fabric of the outer shell, exclusive of collars and cuffs where applicable, is wholly of –

(1) one or more fabrics [on the short supply list] (2) one or more fabrics formed in the territory of one or more of the parties to the Agreement from one or more of the yarns [on

the short supply list] (3) any combination of the fabrics referred to [above] or one or more fabrics originating [from a CAFTA party].

Additionally, CAFTA restrictions on the origin of sewing thread, visible lining, and elastic bands do not apply to garments which meet the rule above. How to Use This Report The report presents the following elements:

The column titled “HTS Number” gives the Harmonized Tariff Schedule number for each item;

The column titled “Item #” shows the item number assigned by the Department of Commerce’s Office of Textiles and Apparel (OTEXA). This corresponds to the attached OTEXA Annex, where fibers, yarns, and fabrics on the Short Supply list are arranged in chronological order according to when the item was added to the list;

The column titled “Description” gives the description of each item as it appears on the Short Supply list;

The fourth column indicates whether the product is a fiber, yarn, or fabric;

The fifth column lists the date each item entered the Short Supply list. Locating the HTS number of the fiber, yarn or fabric on the IDS CAFTA Short Supply Report will quickly and easily provide the corresponding item number for the OTEXA Annex. The OTEXA Annex provides the definitive definition and other characteristics required to meet CAFTA Short Supply rules. Acting as an index for the OTEXA Annex, the IDS report is intended to make CAFTA’s short supply provisions easier to understand. In some cases, the same HTS classification applies to more than one Short Supply item. For example, one fabric may have a variety of yarn numbers or finishes.

A fiber, yarn or fabric must meet all specifications on the OTEXA Annex in order for the end product to qualify for duty-free treatment through CAFTA short supply benefits. The OTEXA Annex lists detailed specifications for each item; all specifications must match exactly. The items currently on the DR-CAFTA short supply list sorted by HTS number are:
