New York State’s Pedestrian Safety Action Plan also known as the PSAP is a 5-year initiative that was announced by the Governor of NY in June of 2016. It includes $110M of federal Highway Safety Improvement Program funds as well as other state and federal funding for Engineering Improvements, Educational Programs and Enforcement activities that improve pedestrian safety in Long Island and Upstate NY. A copy of the PSAP report and other pedestrian safety material can be found on the governors webpage shown on this slide.

Our Highway Safety Improvement Program is data driven so when we started developing the PSAP we started by looking at the crash data. The purpose of mentioning the statistics on this slide and the next is that they drove some of the requirements of the program we are going to discuss today. About 300 pedestrians are killed in NY every year which is comparable to the number of people killed in alcohol related motor vehicle crashes. In addition to the number of people killed, over 15,000 pedestrians are injured, many of them seriously. That’s 15,000 people injured in a car crash that weren’t even in a car. Over 25% of the motor vehicle related fatalities in the state are pedestrians. And finally the economic cost over a 5 year period between 2009-2013 for pedestrian crashes outside NYC is estimated at $5.82 billion And as you can see from the graph on the right, the number of pedestrian fatalities hasn’t gone down much since 2009.

The darker shaded blue areas on this map are the more densely populated areas in the state. As you can see, most pedestrian crashes, which are represented as red dots, occur in the more densely populated areas in the state; In fact, 88% of the pedestrian crashes in a 5 year period between 2009-2013 occurred within the 2010 federal adjusted urban area boundaries. This statistic drove the urban requirement of the PSAP program which will be discussed in later slides. 50% of the urban crashes occurred in 20 communities so much of the education and enforcement efforts completed thus far have been focused in those 20 communities. We saw that the location of pedestrian crashes is often random and not necessarily concentrated at one particular site. Many crashes are occurring at intersections, at mid block locations, on state roads and on locally owned roads as well. Pedestrian crashes were often more severe on state roads probably due to higher speeds, and were over represented on State Roads relative to center line miles. The data also showed that 70% of the pedestrian crashes between 2009-2013 occurred on local roads. We also saw that most pedestrian crashes occurred when pedestrians were crossing the road as opposed to walking along the side of the road.

The variability in motor vehicle crashes and pedestrian crashes in particular really requires a 3 pronged approach (the 3 E’s) to achieve the greatest success. From an engineering perspective, the plan calls for NYSDOT to continue to treat locations with a history of pedestrian crashes (aka a potential hot spot). In addition to treating locations with a known crash history, NYSDOT has plans to treat 2,400 signalized intersections and 1,350 uncontrolled/midblock crosswalks on the state system with low cost systemic improvements. Implementing low cost treatments means that improvements can be made systemically at many locations throughout the roadway network instead of just a few sites with a known crash history. The chosen sites may or may not have a pedestrian crash history but they all have risk factors associated with pedestrian crashes, namely the locations are at a signalized intersection or an uncontrolled crosswalk and in an urban location. The PSAP plan also includes $40M in HSIP funding for systemic improvements on local and county roads which will be presented today. There is also Education efforts being coordinated by the Department of Health and Enforcement activities being coordinated by the Governors Traffic Safety Committee. I won’t go into the particulars of the Education and Enforcement efforts today since we have a lot of material to cover on the local call but you can read more about those efforts in the PSAP Report which is available on the PSAP Local Call Webpage as well as the governors webpage.

All locations in a project must be in a 2010 Federal Adjusted Urban Area. For those of you who don’t know what the adjusted urban areas are… They are based on the 2010 census and then they get adjusted for transportation purposes. FHWA urban area definitions by population range are shown on this slide. Generally, FHWA adjusted urban areas have a population of 5,000 or more. The lower limit that the census bureau and FHWA uses in their definition of urban clusters is different and that has been generating some confusion. The census bureau uses a lower limit of 2,500 while the lower limit that FHWA uses is 5,000 as shown in this chart. What you need to know is that the PSAP program uses the FHWA definition. So the answer to the question that many have been asking about whether or not urban clusters are eligible is “urbanized areas as well as urban clusters with a population >= 5,000 meet the urban eligibility requirement of the PSAP program”

There is a minimum and maximum dollar value that can be funded. The minimum is $250,000; the maximum is $5M. The minimum (and maximum) includes all costs for which the applicant is seeking funding. One sponsor must be responsible for delivery of all locations and components of the project but Counties and/or municipalities can bundle locations together to meet the minimum. And we are looking for the systemic implementation of the low cost countermeasures that are identified in the guidance and in the PSAP report. All locations funded with HSIP funds must be on a public road as per 23 CFR 924.3 which basically says that a Public road is any highway, road, or street under the jurisdiction of and maintained by a public authority and open to public travel. So roads through private universities or multi-use paths would not not eligible under this program. We already mentioned that all locations have to be in an adjusted urban area. And all locations have to be owned or maintained by a county or municipality. Locally owned signalized locations in an urban area on a state touring route are also eligible for funding. The guidance says that local touring route locations are not eligible which is an error. They are eligible and we will get the document corrected and posted to the PSAP Local Call Webpage shortly.

Just to give you an idea, these are the systemic goals we have for the state system: Treat 100% of the urban uncontrolled crosswalks with a basic treatment package as defined in the PSAP report and 20% of the uncontrolled crosswalks with an enhanced treatment as defined in the PSAP report. We are also looking to treat 50% of the urban signalized intersections with one or more of the signalized treatments identified in the PSAP report. Your application does not have to mirror the goals we have for the state system but eligible projects do have to widely treat uncontrolled crosswalks and/or signalized intersections with one or more of the countermeasures identified in the PSAP. We don’t prescribe exactly what widely means in your municipality; there is some flexibility there. It could be all; it could be several corridors with a lot of pedestrian exposure and/or a crash history; it could be a neighborhood for example. You could also choose to address only signalized intersections or only uncontrolled crosswalks. You do not have to address both. The key is broad implementation of the countermeasures defined in the guidance at eligible locations.

The Local Call PSAP Guidance includes a list of low cost fundable treatments at signalized intersections. Due to the complexity and variability of signalized intersections, the PSAP does not include a basic package for signalized intersections like it does for the uncontrolled sites. As mentioned previously there is $40M of HSIP funds available for this program. This is a federal aid fund source so the rules that govern the use of Federal Aid funds apply here. The funds can be used for Design, Construction, Construction Inspection. We don’t expect that these improvements will required ROW acquisition but if they do the funds can be used for small amounts of ROW in isolated cases. The costs associated with the development of the application cannot be funded as they will occur before federal authorization.

The applicability of the ADA to the PSAP is explained in the Traffic Safety Mobility Instruction (TSMI) 17-02 which is available at the link on this slide. The TSMI includes a table like the one shown here with a list of the PSAP countermeasures in the first column and whether ADA improvements are required by law as a direct result of the installation of the associated countermeasure in the second column. Generally speaking under the HSIP, ADA requirements that occur by law as a direct result of the implemented safety work are reimbursable with HSIP funds. ADA work beyond that requires a separate funding source.
