SmartcitiesThiscasestudyhasfocusedonthecreationofvaluefrompotentiallymassiveamountsofurbandatathatemergesthroughthedigitalisedinteractionofacity’susers,i.e.ofcitizensandbusinesses,withtheurbaninfrastructure.Theeconomiesofdigital,especiallybigdata,favourmonopolisticstructures,whichmayposeathreattothemanySMEsincities.However,opensourceandopenplatforms,opendata,andevenopenalgorithmscrystalliseasashortcutand“technology-drivenformofliberalisation”accompanyingthebigdatamovementincities,whichhasthepotentialtoleveltheplayingfieldandevenspurmorecreativityandinnovation.Nonetheless,monetisationofbigdataremainsamovingtarget.Investmentsbytheprivatesectorneedtobesecuredbyreductionorcompensationoffutureuncertainties,otherwisethecurrentstateoflackofinvestmentswillremain.Similarly,withtheincreasingpotentialofmachinesthatlearn,oldjobsconsistingofsimpletasks arealsoatrisk.Newskillsarerequiredandwillcreatenewjobs,butnumbersaremostlikelynotequal.

Asforthesocialandethicalexternalities,thepotentialofbigdatatobeusedforsocialgoodisimmense,especiallyinthedigitalisingcity.However,therelianceondata-drivenservicesneedsadebateonhowwecanassureenoughequalitywhentherearesomanydifferentreasonswhynotallcitizenswillreapvaluefromdatainequalamounts.Thismaybeduetothedigitaldividewehavebeenawareofforawhilenow,ortoentirelynewchallengesthroughrecenttechnologicalbreakthroughssuchasdeeplearning,whichenablemachinestolearnandtakeoversimpletasks,suchascountingcarsorrecognisingletters.Moreover,trustincomputingmethodsforbigdatamaybehardertoestablishiftheirrationalecannotbeeasilyexplained.Furthermore,businesses,criticalinfrastructures,andlivesmayrelyonbigdataalgorithms.

Sincenewsourcesofdatacreatenewwaysthatdatacanbemisused(includingsensitivepersonaldata),thiscasestudyquestionsthesuitabilityofthecurrentlegalframeworkbasedondataownership.Indeed,theshifttowardsbigdatamayimplythatdataaswellasalgorithmstominethedataarerequiredcommoditiestocreatevaluethroughuserexperienceandservices.

Finally,politicalexternalitiesincludelosingcontroltobigdataactorsoutsideEurope.Indeed,bigdatabusinessescanimprovetheEuropeaneconomy,butrequireaunifiedEuropeandataeconomywithaccordinglyunifiedpolicies.

HealthThiscasestudyhasfocusedontheuseofgeneticdatabyapublichealthdatadrivenresearchorganisation.Overall,thiscasestudyhighlightsanumberofpositivesocietalexternalitiesthatflowfromgeneticresearchandraregeneidentification,whichisfacilitatedthroughtheutilisationofbighealthdata.Concerningeconomicalexternalities,oneimportantresultiscostsavingforhealthcareorganisationsthataregainedthrough moreaccurateandtimelydiagnosesandefficienttreatments.Thisisparticularlyimportantwhendealingwithraregeneticdisordersthatmaynototherwiseattracttheattentionthatdisordersandhealthissuesaffectingthewiderpopulationdo.Inaddition,theutilisationofbigdatainhealthcareproducesanothereconomicexternalityinthatitpotentiallygeneratesrevenueespeciallythroughthedevelopmentofmarketabletreatmentsandtherapies,andtheinnovationofhealthdatatechnologiesandtools.Nevertheless,researchinitiatives,suchastheinstituteofthecasestudy,arenaturallysubjectto financialrestrictionsandcostsavingsmeasuresimplementedbygovernments.

Onthesocietalandethicalside,theidentificationofraregeneticdisordersprovidestreatmentopportunitiesforthepatient, as wellasmoreeffectivediagnostictestingforfuturepatientsandagreaterunderstandingofraregeneticdisordersgenerally.Inaddition,analyses of geneticdataenablestreatingclinicianstoprovidearangeofotherhealthcareservicesforfamilymembers,includinggeneticcounselling.Beyondtheinitial purposeforthedatacollection,thereislimitedornoreuseofgeneticdataduetolegalandethicalissues.However,datareusemaybecomeastrongerfocus in thefutureforthepurposeofproducingadditionalbenefitsforpatientsandsociety.Therewilllikelybeanincreaseinfocusonresearchforthepurpose of developingpersonalisedmedicinetreatments,whichfocusesonimprovedtreatmentbasedonpatientdrugmetabolism.Whilstthepositivesocialimpacts of reusinggeneticdataareobvious,ethicalconsiderationswillremainattheforefrontofanypoliciessupportingtherepurposingofgeneticdata,especiallyasitissensitivepersonaldata.Therearepotentialnegativeimpactslinkedtotheutilisationofbigdatainhealthcaresuchasover-medicalisationofan otherwisehealthypopulation;discriminationbasedonthestratificationongenotypeorinrelationtohealthinsurancepolicies;andincidentalfindingsdiscoveredwhendataisanalysed.Forexample,cancergenesmaybediscoveredalongsidetheidentificationofraregenesorothergeneticmutations.

Sincehealthdataisbyitsverynaturesensitivedata,thiscasestudyhighlightslegalrisksassociatedwithdataprotectionanddatasecurity.Inparticular,anonymisation isalegalrequirementthatischallengingtoachievewithgeneticdata.Theissueofdataprotectionandinformationprivacy callsforthedevelopmentofadequateprotectionsthatbalancetherighttopersonaldataprotectionwhilstfosteringinnovationinthedigitaleconomy.Althoughdatasecuritypreservationmeasuresensurecompliancewithstandarddataprotectionrequirements,theycanalsohinderfurtherresearch,whichinturn,couldleadtonewdevelopmentsandtreatments.Lastly,threatstointellectualpropertyrightscanariseinrelationtosubsequentusesofbighealthdata,suchasinrelationgenepatenting(andlicensing)ofnewdrugtherapies,orifitweretobeincludedinworksprotectedbycopyright.

Concerningpoliticalexternalities,theavailabilityofbigamountsofdatawillenablepoliticianstohavemoreinformationaboutdifferentsituationsinthehealthsectorandthusabetterunderstandingthatmayleadtoimprovetheirdecision-makingandincreasestheinvestmentsinhealthcare.

EnvironmentThiscasestudyhasbeenconductedinthecontextofanearthobservationdataportal(GEOSS),aglobal-scaleinitiativeforbetterunderstandingandcontrollingtheenvironment,tobenefitSocietythroughbetter-informeddecision-making.Onthepositiveside,theuseofbigdataiscreditedwithhavingstrongimplicationsontheeconomicgrowth,e.g.seadataforfishingnationsandweatherdatafortourism,forthemeredirecteffectsontheITsectorsuchasopportunitiesforinfrastructure/hardware/datacentres,andrent-sharingpossibilitiesforcomputing.However,bigdatacouldaswellbeseenasathreatbytraditionalservices,forexampleintheweatherforecastingsector.

Ouranalysisofsocialandethicalexternalitiesshowstheeffectivenessofdata-intensiveapproachesinimprovingthegovernanceofenvironmentalchallenges,supportingsafeandenvironment-friendlyoperations.Thishasimplicationsontherobustnessoftheenvironmenttorecoverafterstressingevents(resilience),especiallyinurbancontext,aswellasontheactualqualityoflifeandhumanhealth.Ontheotherhand,big-brother-effectandmanipulation,realorperceived,canbeproblematic.Infact,ashumansocietyisanintegralpartoftheenvironment,especiallyinurbancontext,thefearofdataabuse,privacyviolationandthelike,mayhamperparticipationandengagement.Moresubtly,alsoexcessivetrustindata-intensiveapplicationshasbeenhighlightedasapossiblenegativeimplication,inthatitwouldencouragethefalsebelievethatthedynamicsoftheenvironmentcanbecapturedquantitatively,overlookingqualitativeaspectsthat,instead,remainfundamentaltocomprehendit.

Withrespecttolegalexternalities,thegrowingrelianceondataintheenvironmentsectoriscertainlyhighlightingmanyshortcomingsofthecurrentlegalframeworks,e.g.onIPR,privacy,andauthorisationtousethedata.Potentialproblemsare moreprominentwhenconsideringdifferentlegislationssuchastheprincipleoffullandopenexchangeofdatathatissimplyinconsistentwithsomeofthecurrentnationalpolicies.Legalsupportforcitizensindata-relatedissuesisarguablygoingtobecomeapublicservice,inthefuture.Besides,incompatibilitiesinthelegalframeworksindifferentcountriesareseenasinhibitorsthatneedtobeadapted,inordertoremovelegalbarriers.

Finally,politicalexternalitiesincludeincreasedtransparencyandaccountability,sincechoiceswillhavetobebasedonmeasurableandobservableindicators.However,thereisariskofdependingonexternalsources,particularlyprovidedbybigplayers.Inthisregard,theenvironmentcommunityisconcernedabouttheimpositionofcommercialproductsasdefactostandards,causinganimplicitvendorlock-infortheirmaintenanceandevolution.TheuseofGEOSSmapdataisapotentialsourceofpoliticaltensions,e.g.withregardstodisputedorotherwisesensitiveareas.AsEuropeleadstheinnovationinthespatialsector,theshifttoamoreintensiveuseofdataintheenvironmentsectormayputEuropeinaprimaryroleonthepoliticalscene.
