Sir/Madam:

Attached is a variance application and associated submittal package for the above referencedproperty. In order to redevelop the subject property as needed, the property owners requireseveral variances to the Anne Arundel County Code. The requested variances include; Article17, Section 8-201 for redevelopment on slopes 15% or greater in the LDA, to Article 18,Section 2-301 for constructing a deck more than 10-ft into the rear building restriction line, andto Article 18, Section 4-601 to the required front and rear setbacks and to the coverage bystructures.

The subject property is a legal non-conforming building lot located in the community ofSherwood Forest in Annapolis. It is currently improved with a single-family dwelling, a largeopen deck, and associated improvements. The lot is zoned R-2 and is served by communitywater and a private septic system. The property is located entirely within the Chesapeake BayCritical Area with an LDA land use designation. The majority of the site is encumbered withsteep slopes severely limiting and restricting the areas that allow redevelop.

The applicants propose to raze and remove the existing non-conforming single-family dwellingand construct a new single-family dwelling with the associated improvements. Due to theunique physical conditions inherent to the property, the following variances to the Anne ArundelCounty Code are being requested: Article 17, Section 8-201 (a) of 2, 492-sf of disturbance onslopes 15% or greater in the LDA. The slope disturbance is needed to remove existing structures,associated improvements, relocated a community storm drain system and construct new propertyimprovements. A portion of the steep slope disturbance for a new septic system is located onSherwood Forest Club property and the Sherwood Forest Club is a party to the requested slopevariance request. The slope disturbance is also necessary to relocate and improve an existingcommunity drain system and to provide an adequate location of a portion of the subjectproperty's septic system. These improvements are detailed on the variance site plan.

Variances are also necessary to Article 18, Section 2-301(d) of8-ft to allow a deck more than10-ft into the rear setback requirement. The existing deck is located 5 feet from the property lineand the new deck reduces the non-conformance. Article 18, Section 4-601 of 14-ft to therequired 30-ft front yard setback for a principal structure and 30-ft to the required 40-ft front

yard setback for an accessory structure, 1-ft to the required 25' rear yard setback, and 16% to therequired 30% maximum coverage by structures.

Apre-file meeting was held on December 19, 2017 with the property owners, Michael Drum,P.E., Drum Loyka & Associates, and Lori Rhodes, ofAnne Arundel County. In the pre-filecomments from Anne Arundel County it was noted that variances might be eliminated if theredevelopment of the dwelling occurred on the existing footprint. Unfortunately due to the ageand condition of the existing dwelling structure, extent of the steep slopes, the necessity of a newseptic system to replace the old antiquated existing system and the relocation of the communitystorm drain system off the private building parcel variances to the Code cannot be avoided. TheCounty Engineering Division also commented that the proposed stormwater managementcisterns could be placed under the proposed building decks.

The proposed building plans have been amended to reduce the size of the proposedimprovements eliminating the necessity of side set back variances and reducing the quantity ofsteep slope disturbance. The new plan also shifts the proposed cistern under the deck of theproposed dwelling as requested by Anne Arundel County

The subject property is non-conforming to size and heavily encumbered with steep slopes. Anexisting community storm drain pipe located on the subject property immediately adjacent to theexisting dwelling is proposed to be relocated back onto community property. The storm drainsystem is proposed with a new drain inlet and a portion of the conveyance pipe will be replaced.

The need for the requested variances arises from the unique physical conditions of the site,specifically the diminutive size of the lot, the presence and amount of steep slopes, as well as theissue of relocation of a new state of the art septic system on the site. The proposed dwellingimprovements approximate the footprint of the existing dwelling, but not on the footprint of theexisting house. Unfortunately disturbance of the slopes is unavoidable in both removal of theolder dwelling and building a new dwelling. The large portion of the community of SherwoodForest is encumbered with steep slopes and other environmental challenges

The existing dwelling is currently over the allowable coverage by structures by 18% and is non-conforming to zoning setbacks The new dwelling has less coverage and reduces the coverageby structures by 2 %. Denial of the requested variance would constitute an unwarranted hardshipand deny the applicant's rights commonly enjoyed by other property owners. The variancerequest is not based on actions by the applicant, and will not confer upon the applicant anyspecial privilege that would typically be denied by COMAR or the local Critical Area Program.With the implementation ofstormwater management and the nitrogen reducing septic system,

e devel°Pment will not have an adverse effect on water quality or negatively impact fish,wildlife, or plant habitat, and is in conformance with the general purpose and intent of theCritical Area Program. The variance is the minimum necessary to afford relief from the CriticalArea legislation. The granting of the variance will not alter the character of the neighborhood,impair the use and development of adjacent properties, reduce forest cover in the LDA, nor bedetrimental to the public welfare.
