The Bihar Land Disputes Resolution Act, 2009

• Scope of the Act

1. The Bihar Land Reforms Act, 1950

2. The Bihar Tenancy Act, 1885

3. The Bihar Privileged Persons Homestead Tenancy Act, 1947

4. The Bihar Bhoodan Yojna Act, 1954

5. The Bihar Land Reforms (Fixation of Ceiling and Acquisition

of Surplus Land) Act, 1961

6. The Bihar Consolidation of Holdings and Prevention of

Fragmentation Act, 1956

This act has overriding effect over above Acts.

Resolution of Disputes of possession

• Action U/S 145 of Cr.P.C. are barred during the

pendency Of proceeding U/S 48E of BT Act, 1885

• Simultaneous proceeding U/S 107 and U/S 145 of

Cr.P.C. is permissible.

• Apprehension of breach of peace and dispute of

immovable property

• Proceeding U/S 145 of Cr.P.C. and U/S 107 of

Cr.P.C. can be converted into one another.

• Crop and other products on the disputed land can

be attached U/S 146 of Cr.P.C., if possession can

not be decided immediately.

Resolution of Disputes of possession

• Pass prohibitory order

• Proceeding U/S 145 of Cr.P.C. may be converted

into U/S 147 of Cr.P.C.

1. There was a way on the private land, commonly used by farmers since last 10-12 years to reach their fields. The owner of the land has erected wall just to prevent farmers to use for their parcels and houses.
