1. Introduction

The purpose of this report is to provide background document for the workshop with Member States on Reporting under the Bathing Water Directive(s) in Brussels, 15.October 2009. The following items from agenda are covered: Item 2: Review of BWD for 2008 season Item 4: BWD reporting for 2009 season – PROPOSAL for Data Dictionary update Item 5: Reporting for 2010 season - “before start of the season”

Item 2: Report on timing and issues dealt with by ETCW in the process of preparation of 27 national bathing water reports for 2008 season. Problems identified during QA/QC phase are identified for discussion with MS. It is a purpose of this discussion to improve 2009 season reporting. Item 4 includes the main findings identified during checking of lists of bathing waters for 2009 season and proposals for improvement of Data Dictionary. It includes the comments from Member States given on the workshop. Item 5 includes proposal for a reporting for 2010 season before the season. It is based on the main findings under “before the season” reporting for 2009.

2. Review of BW quality assessment - 2008 season (Item 2)2.1. Report on timing and general issues

The first version assessment was sent on 20.2.2009. Issues:

1. Meaning of “ParnoDi” (number of samples that not comply with mandatory values for each parameter) and “ParnoDg” (number of samples that not comply with guide values for each parameter): “ParnoDi < ParnoDg” correct. Clarification needed. Bulgaria and Slovenia misinterpreted the parameters meaning, therefore they sent updated data. Beside, Austria made a point that “ParnoDi < ParnoDg” rule should be valid only for Total coliforms and Faecal coliforms (having both, mandatory and guide values) and not for all parameters that are reported under Directive 76/160/EEC. ETWC upgraded the rule as Austria has recommended.

2. Status of BWs that have been reported in the “Inventory of identified BW” table, but not in “Monitoring results of BWs” table was clarified as “de-listed or “not sampled” (Denmark, Hungary, Latvia, Spain).

3. Rules for assessment under “transitional period” deficient (Closed BWs classified as poor quality, since class “closed” did not exist in the methodology proposed)

4. Interpretation of Art. 5 (The percentage of samples for mandatory standards for parameters 8, 9, 10 (physico-chemical parameters) under Directive 76/170/EEC was set to 50%)

The second version assessment (March 2009) issues: 1. The Czech Republic, Germany, Hungary, Finland, France, Italy, Lithuania, Latvia, the

Netherlands, Slovakia, Spain and the United Kingdom: comments and updated data included2. For Cyprus and Sweden the assessment procedure has been changed from Directive

76/160/EEC to assessment under “transitional period”.3. Interpretation of Art. 5 (The percentage of samples for mandatory standards for parameters 8,

9, 10 (physico-chemical parameters) under Directive 76/170/EEC has been set to 95% for mandatory standards and 90 % for guide standards).

4. New category “banned (temporarily closed) or closed throughout the season” added.

The second version draft assessment was sent to the majority of Member States on 19.3-20.3.2009, Austria on 17.3.2009, Bulgaria on 23.3.3009 and Sweden on 30.3.2009. We sent a second version to

Portugal on 4.3.2009. Greece did not receive the second version assessment until 27.3.2009 due to problems with e-mail address of the reporter.

We got answers from Cyprus, the Czech Republic, Denmark, Finland, Germany, Italy, Latvia, Lithuania, Malta, the Netherlands, Portugal and the United Kingdom: Cyprus, the Czech Republic, Finland, Lithuania and Malta confirmed the results. Other MS have remarks or corrections.

Additional questions were sent to MS to clarify the following issues:- “BW groups” for Hungary (BW group with closed BW as representative BW),- “insufficiently sampled” BWs for Poland,- clarification in regard to “temporary banned” BWs for the Czech Republic and Latvia.

The reasons for “de-listing” has been specifically communicated with MS (March 2009) that have not previously informed EC or put information on CDR. In addition, some MS were also asked for the reasons for the opening of some BWs.

The final assessment was sent on 31.3.2009. We included additional remarks or/and some corrections in regard to “de-listed” BWs from Cyprus, Denmark, Estonia, Germany, Ireland, Portugal, Slovenia, Slovakia, Spain and the United Kingdom. In the final QA/QC the water type change (coastal - freshwaters) of some BWs in Denmark, Finland, Germany and Lithuania was found (question send to MS on 7.5.2009; all MS replied).

National bathing water reports were published on EEA: State of bathing water website (http://www.eea.europa.eu/themes/water/status-and-monitoring/state-of-bathing-water-1/) and EC DG Environment: Bathing water quality: Annual report, 2008 bathing season website (http://ec.europa.eu/environment/water/water-bathing/report_2009.html) in June 2009.

2.2. Issue of Coordinates

There were missing, wrong or duplicated coordinates detected in 13 MSs. In QA/QC period ETC/W used data from 2007 bathing season and corrected some coordinates (AT and ES). Problems connected with coordinates were solved for 8 MSs, for 2 MSs were partially solved and in 3 MSs problems stay unsolved. Bathing waters with missing coordinates are not included in statistics by geographic regions.

2.3. Specific problems identified during assessment (2008 season)

2.3.1 Reporting templates and CDR:

12 MS reported under Directive 2006/7/EC (Cyprus, Denmark, Estonia, Finland, Germany, Hungary, Latvia, Lithuania, Luxembourg, Slovakia, Spain and Sweden). All MS, except Estonia, uploaded files on CDR under folder “Bathing Water Directive 76/160/EEC Report”.

Cyprus and Sweden that reported under Directive 2006/7/EC used templates prepared for reporting under Directive 76/160/EEC. Cyprus has resent files (used correct templates). Sweden used only one correct template (“Monitoring results of BWs”). ETCW transformed the other data into “Inventory of identified BW” and “Seasonal information on BWs” files (to do assessment under “transitional period”.)

Not all attributes have been filled (e.g. RBDs and WFD water bodies).

2.3.2 De-listed, banned/closed, not sampled BWs:

Italy: the new category “deleted” was introduced (besides “de-listed” and “banned” BWs). They were classified as “banned”. Message: please use available list of categories

The UK: Three BWs were reported as temporally closed because they have not been accessible due to construction (and therefore not sampled). They were classified as “not sampled” (NS). Message: If BW is not accessible due to construction or other reasons, please, put “not sampled”. As directed by EC, banned BWs should be sampled.

Portugal: One BW was included in “general data” file, but not in “geographic data” file, therefore it has been classified as “de-listed”. Hungary: closed BWs were classified in attr. “BWType” as “3” (means “deleted”) and attr. “Closed” was “Y”.Message 1: reporting under Directive 76/160/EEC: BW that is not de-listed, but a) banned, should be included in all files (with data in ‘parameter data’ table; attr. “Banned” should be “B”), or b) not sampled, BW should be included in all files with attr. “ParNoB” equals “0”. Message 2: reporting under Directive 2006/7/EC: BW that is not de-listed, but a) closed should be included in all files (with data in ‘Monitoring results’ table; attr. “Closed” should be “Y”; attr. “BWType” should be “1), or b) not sampled attr. “Closed” should have “N” and “BWType” should be “1”; not reported in ‘Monitoring results’ table.

Latvia (Directive 2006/7/EC): Monitoring data for “temporarily banned” BWs were reported. Only in “updated” version they informed us, that those BWs are “temporarily banned”. Message: Attr. “Closed” for BWs that are “temporarily closed” or “closed throughout the season” should be “Y”.

Denmark, Hungary and Germany: Some BWs being on the list of 2007 report were not in the list of 2008 according to NUMIND (they were automatically classified as “de-listed”). Hungary approved all, Denmark partly. Germany clarified that some NUMID from 2008 are not the same as were 2007 and send code list NUMID from 2007 - BWID 2008. One BW has been de-listed. Message: NUMID should not be changed from year to year. If changed, code list should be supplied.

2.3.3 Change of attributes:

Attr. NUMIND change due to changes of NUTS if the community structure changed. Information on NUMIND is used in first QA/QC for search of “new” and “de-listed” BWs. There were problems with changed NUMID in Belgium, Germany, Greece and Latvia. Message: NUMIND should not be changed from year to year. If changed, code list should be supplied.

Attr. “Codeau” (Directive 76/160/EEC) or “BWaterCat” (Directive 2006/7/EC): change of water type/category from coastal to freshwater or opposite due to the consistency with WFD classification of water bodies (Germany) or a mistake. We have to know, that is such cases, the statistics by coastal and freshwater bathing waters are not consistent when two subsequent seasons are compared.

2.3.4 Sampling frequency:

France, the Netherlands and Portugal: As detected from number of samples some BWs were insufficiently sampled and the attr “Frequency” was “N” (meaning the frequency is less than fortnightly- not sufficient). BWs have been classified as “insufficiently sampled”. MS send information, that these BWs have reduced frequency due to good water quality according to Directive 76/160/EEC (Annex).

For Poland, BWater programme gives different results in regard to “insufficiently sampled” bathing waters compared to status calculation by ETCW. ETCW applied the rule: “If one of two parameters Total coliforms and Faecal coliforms under Directive 76/160/EEC is missing, the BW is classified as insufficiently sampled (NF)”.

Germany (reporting under Directive 2006/7/EC): Several samples for one bathing water for one date. Explanation given: “For some bathing waters at the coast that cover a long beach area e.g. 500 m, two sampling sites have been laid down by the authorities responsible for the monitoring. Therefore, two samples are often taken at the same date for these bathing waters”. Later, Germany sent data on averages from monitoring results for one date.

3.2.5 Groups of BWs:

Hungary (reported under Directive 2006/7/EC): attr. “GroupID” for one group taken from one BW in the group. Monitoring results data available for some BWs in the group. Consequently: BWs in the group with no monitoring data have been classified as “not sampled”. Only when bathing profile is established and one representative BW is defined for a group, other BWs may have the same status as the representative BW.

3.2.6 Parameters reported under Directive 76/160/EEC:

Some MS under Directive 76/160/EEC mixed parameters ParnoDi, ParnoDvln and ParnoDg.

3.2.7 Data Dictionary:

Code lists for attributes are available in Data Dictionary (DD). In templates, values are given without definition. Some codes were not used correctly (code for river or lake at attr. “Codeau”). We recommend that DD is used for support.

3.2.8 Coordinates:

Some MS reported BWs with missing, wrong or duplicated coordinates. Some MS sent coordinates in their national coordinate systems (Spain, Italy, Germany, France) Spain and Greece: same coordinates for different BWs (duplicates); ETCW thinks that this is a

consequence of vicinity (different bathing waters located very close to each other), but no explanations given so far. In the WISE Map/Data Viewer they are overlapping.

Greece and Sweden: unsolved problems (missing, wrong, duplicated coordinates) Spain has technical problems with coordinate conversion from national coordinate system into

ETRS89. They promised to send coordinates in WGS84.

3.2.9 Short bathing water names:

Bathing water names are usually too long for visualisation of bathing water names on maps (and unreadable). The recommendation for SHORT name should be followed (attr. “ShortBWName”).

3.2.10 Late/no replies by MS:

comments received on the last day or even after the deadline additional data after the report deadline no comments on assessments.

3.2.11 E-mail addresses of reporters:

3.2.12 General information as provided by MS authorities (information to public and measures to improve bathing water quality, other issues):

In Data Dictionary under Directive 2006/7/EC, no reporting table for general information as provided by MS authorities is available, but only one attribute (“ManMeas”) in “Seasonal information on BWs” template. MS under Directive 2006/7/EC provide no such information, except for four MS (Cyprus, Hungary, Sweden, Slovakia). Therefore, information for 2007 bathing season were considered in the final draft assessment. Denmark, Estonia, Germany and Spain provided updated general information given for 2007 season report.

ETCW had some difficulties with some translations from national (more time needed for clarification of translated text).

3

3. BWD reporting for 2009 season (Item 4)

3.1. List of bathing waters for 2009 season

Member States shall notify EC of all waters identified as bathing waters, including the reason for any change compared to the preceding year according to Directive 2006/7/EC (Art.13) (reporting obligation “New Bathing Water Directive 2006/7/EC Report - Identification of bathing areas”). Denmark, Latvia and Sweden have not reported the list of BWs. MS under Directive 76/160/EEC also provided a list of BWs before the start of bathing season, except for Bulgaria, France and Poland. They reported in different ways.

3.1.1. Directive 2006/7/EC

MS, that reported under Directive 2006/7/EC in 2008 uploaded lists of BWs under folder for reporting obligation “Bathing Water Directive 76/160/EEC Report” (Reportnet - CDR). Estonia delivered the list of BWs under the folder for reporting obligation “New Bathing Water Directive 2006/7/EC Report - Identification of bathing areas”.

The Netherlands monitors under Directive 2006/7/EC in 2009 season for the first time. They provided two files: a codelist of BWs and additional information. The first includes two attributes of ‘Inventory of identified BW’ (BWID and BWName). The second (‘Geographic data’ template under Directive 76/160/EEC) included changes of BWs and reasons for de-listing (in ‘remark’ attribute).

Romania reported selected attributes in file ‘Geographic data’ (prelev, administrative units) and ‘Inventory of identified BW’ files (BWID, status: identical to BWType). It also provided monitoring calendar and start date and end date of the bathing season for each BW. It is not clear under which Directive they report in 2009 season. On the workshop, Romania clarified that they continue reporting under Directive 76/160/EEC.

Ireland filled in ‘Inventory of identified BW’ template completely. This may indicate that they monitor (and will report) under Directive 2006/7/EC?

Some MS filled in only selected attribute fields in template ‘Inventory of Identified BW’ (e.g. Spain: BWName, administrative units, status (new and de-listed BWs) and reasons for these changes (e.g. Slovakia: BW Name, BWID, Access Key and coordinates).

Hungary, Luxembourg, Slovakia and Spain that report under Directive 2006/7/EC added start date and end date of the bathing season for each BW (attributes of ‘Seasonal information on BWs’ template) into ‘Inventory of identified BW’ template. Ireland noted that the start date and end date of the bathing season is the same for all bathing waters.

MS provided no information if public participation (Art. 11) was included in establishing of BW list and its changes, except Cyprus (de-listed BWs, change of BWName or BWID) and the Netherlands (de-listed BWs).

3.1.2. Directive 76/160/EEC

Austria, Belgium-Flemish Region (reporting under Directive 76/160/EEC in 2008) reported that the start date and end date of the bathing season in 2009 is the same for all bathing waters.

Greece, Italy, Malta (reporting under Directive 76/160/EEC in 2008) already uploaded files ‘Geographic data’.

The United Kingdom for 2009 season uploaded ‘Inventory of identified BW’ file with limited number of fill-in attribute fields (BWID, BWName, comments, Short BW name, lat, long).

Some MS reported selected attributes of ‘Geographic data’ table in Word document (Austria: including changes of BW list and reasons) or PDF document (Belgium-Flemish Region, Portugal, Slovenia). Belgium-Flemish Region and Portugal did not report NUMIND of BWs.

The Czech Republic reported selected attributes of ‘Geographic data’ table adding its own attributes and changes of BW list (de-listed BW) including reasons for de-listing. Slovenia reported selected attributes of ‘Geographic data’ table in PDF document adding text report on changes of BW list (new and de-listed BWs) and reasons for de-listing. They both noted that a list of BWs is reported according to Directive 2006/7/EC.

Slovenia also provided information on public participation in establishing of BW list and its changes (new and de-listed BWs) in a text report.

3.3. Proposals for improvement of Data Dictionary

Proposals for improvement of Data Dictionary include improved definitions of attributes and values of codelists. These updates will reduce communication with MS (e.g. problem with de-listed BWs due to change of NUMIND). Significant management measures are needed for a chapter on information as provided by MS authorities in national bathing water reports. It should be specified which management measures according to Art.2 of Directive 2006/7/EC are significant.

3.3.1. Directive 76/160/EEC

All de-listed BWs compared to preceding year should be included in “Inventory of identified BW” template, even if they have no BWID, but NUMIND only.

Re-opened bathing waters are new in regard to the preceding season, but they once existed (being closed in previous season(s)). They are defined as existing bathing waters (BWType is “1”) with a remark “re-opened bathing water” under attribute “Change”.

comparing coastal and freshwater bathing waters between seasons. Administrative units (region, province and commune) are not needed

to be reported anymore. They were replaced by RBD attributes. For visualisation in WISE Data Viewer, the information on the change of administrative units is welcome since bathing waters are aggregated on region and province level.

Even if bathing waters are closed, they should be monitored, except if they are de-listed (BWType is “3”). This is especially true for bathing waters being closed only for a part of the season (temporarily).

De-listed bathing waters are closed throughout the season. If closed bathing waters are not monitored, but defined as existing

(BWType is “1”), MS should clarify the reasons for not being monitored. Closed under Directive 2006/7/EC has the same meaning as banned

under Directive 76/160/EEC (closed due to bad water quality or other reasons).

Causes of pollution Identifying and assessing causes of different types of pollution. There are several types of pollution according to Directive 2006/7/EC: abnormal situations, short term pollution, proliferation of cyanobacteria, proliferation of macro-algae and/or phytoplankton, bathing waters of poor quality (non-compliance during “transition period”).

Significant management measures (Art.13) are defined with this attribute. In the Directive 2006/7/EC, the description of management measures is given (Art.2).

To support information on management measures, also information on BW profile has to be established. In the Directive 2006/7/EC, the deadline for this is set: 24.3.2011 (Art. 6). For group of BWs, a bathing waters profile has to be established as soon as possible.

It is recommended to report “significant management measures” in a reporting template for individual BW or a group of BWs. They can be also given separately in a Word document. The name of file “Annex to ManMeas” is recommended. If necessary, MS include a list of BWs in the document.

MS decide on significant measures to be reported. Information, such as: -public participation procedure in regard to the lists of BWs, -information to public (as reported under Directive 76/160/EC with consideration of requirements of Directive 2006/7/EC),-actions and long-term measuresare included into national bathing water reports.

These causes are weather conditions (e.g. storms, droughts), floods (abnormal situations) or accidental discharges, dumping of waste, sewage overflows, etc.

4. Proposals for reporting for 2010 season: “before the start of the season” (Item 5)4.1. Directive 76/160/EEC

If reporting a list of BWs before the start of the bathing season, it should be as follows: A list of BWs should be uploaded on Reportnet - Central Data Repository. It is recommended to report using templates. MS should not mix the attributes of templates under both Directives. If MS report under the Directive 76/160/EEC, they should use the following templates:

- ‘Geographic data’ (possible to be used also for the “before the start of the season” reporting)- ‘General data’- ‘Parameter data’- ‘Supplementary data’

If MS report under the Directive 2006/7/EC for the first time, they should use the following templates: - ‘Inventory of identified BW’ (“before the start of the season” reporting)- ‘Seasonal information on BWs’- ‘Monitoring results of BWs’- ‘Abnormal situations’- ‘Short term pollution’

4.2. Directive 2006/7/EC

A list of BWs (reported before the season) should be uploaded on Reportnet - Central Data Repository.

MS should create a new folder on CDR and link it with reporting obligation “New Bathing Water Directive 2006/7/EC Report - Identification of bathing areas”. The same should be done for reporting obligation “New Bathing Water Directive 2006/7/EC Report - Monitoring and classification”.

It is optional to report “StartDate” and “EndDate” attributes of ‘Seasonal information on BWs’ template as additional attributes in ‘Inventory of identified BW’ template before the start of the bathing season.

If changes of BWs (list) happen during the bathing season (e.g. temporal closure due to pollution…) MS should fill ‘Inventory of identified BW’ template again at the end of the year.

If MS do not completely fill ‘Inventory of identified BW’ template before the start of the bathing season, they should do this at the end of the year.
