Peggy:  As I mentioned to you on the phone, I have some family health issues that are requiring more of my time and as such, I must resign my position on the Butte County Forest Advisory Committee. It has been a pleasure to serve on the committee during this start up period and work with my fellow dedicated Butte County citizens, Supervisor Teeter, Director Crump and especially you. Your continual leadership and guidance has been the key in bringing the interests of each of the FAC members together to assist the BC Coordination Committee in their social, economic and environmental dealings relative to the management of the Plumas and Lassen National Forest lands and Bureau of Land Management lands that fall within Butte County. This is especially  important to the citizens and businesses in Butte County as we move through this current drought and catastrophic fire period and commence in the urgently needed revision of the Land Management Plans for the National Forests throughout the Sierra Nevada’s and especially Butte County.  Again, thank you for the opportunity to have served on this important committee.  Frank Stewart

COMMITTEE VACANCY NOTICE BUTTE COUNTY BOARD OF SUPERVISORS The Butte County Board of Supervisors is hereby giving notice of a vacancy on Forest Advisory Committee (FAC) for the Agriculture/Timber Management regular member. This vacancy is the result of a resignation. The Board of Supervisors may consider making an appointment to fill this vacancy on or after June 17, 2015. The term of this appointment will end December 31, 2019. The Board of Supervisors established the FAC to facilitate public involvement and assist the County in its quest to meet these guiding principles of the Butte General Plan 2030 as it pertains to use of public lands. The Committee serves to gather information and opinions from interested parties, to present pertinent recommendations to the Butte County Board of Supervisors through the Coordinating Committee, and to serve as a resource in Coordination efforts. The FAC is comprised of 5 public members and alternates representing the following areas of expertise/interest: Agriculture/Timber Management; Recreation-Motorized; Recreation-Non-motorized; Environmental and Watershed Management; and Economic/Tourism. The FAC meetings are held on the 4th Monday of each month. The location of the meetings alternate between cities of Chico, Paradise and Oroville. Butte County Forest Advisory Committee 

Bylaws 

 

ARTICLE I ‐ BACKGROUND  Butte County's General Plan 2030 addresses Butte County's commitment to protection, enhancement, utilization and management of natural resources; the importance of agricultural enterprises; and the need for parks and recreation opportunities. Specifically, the Public Facilities and Services Element, section VI, Parks and Recreation discusses the importance of access to public lands, to include Plumas and Lassen National Forests (USFS), State Recreation Areas (SRA), and local Recreation and Park Districts (RPD).  Goal PUB‐6 supports a comprehensive and high‐quality system of recreational open space and facilities. Goal PUB‐7 encourages local, regional and State parks providers to engage in coordinated and cooperative planning efforts. Goal PU‐8 encompasses coordination with local jurisdictions, Lassen and Plumas National Forests, the Department of Water Resources and the Department of Fish and Game to designate additional shared use trails along unpaved County roads, access roads and fire roads including abandoned railroad rights‐of‐way, levee tops, utility easements and waterways.  Further, it promotes shared uses to include equestrian, hiking, biking, off‐road vehicles, etc.    To facilitate public involvement and assist the County in its quest to meet the guiding principles of the Butte General Plan 2030 as it pertains to utilization and management of public lands, the Board of Supervisors has directed that an Advisory Committee be formed to gather information and opinions from interested parties, to present pertinent recommendations to the Butte County Board of Supervisors through the Butte County Federal/State Land Use Coordinating Committee (“Coordinating Committee”), and to serve as a resource in Coordination efforts.  ARTICLE II ‐ NAME  The name of this committee shall be Butte County Forest Advisory Committee, “Forest Advisory Committee” or “FAC”.  ARTICLE III ‐ PURPOSE  The purpose and duties of the Forest Advisory Committee shall be to serve as a stakeholder and informational resource on the following issues in Butte County.    

1. Review Schedule of Proposed Actions (SOPAs) issued quarterly by the US Forest Service (USFS) as they pertain to Butte County. 

2. Work with USFS prior to issuing of SOPAs to influence USFS decisions. 3. Review impacts of USFS, Bureau of Land Management (BLM), State Recreation Area (SRA) and 

Recreation & Park Districts (RPD) actions on Butte County as they pertain to agriculture, recreation, environmental, water quality, and economy (including tourism).  

4. Review Butte County General Plan and other land use issues pertaining to public land. 5. Build comment histories on USFS, SRA and other public land projects. 6. Seek participation and comment from members of the public.

7. Through the Coordinating Committee, make recommendations to the Board of Supervisors for projects or policies that serve the interests of Butte County’s citizens in their pursuit of enjoyment and protection of public lands. 

 ARTICLE IV ‐ MEMBERSHIP  Section 1 ‐ Five members and five alternates from the public ‐ Each appointed by the Butte County Board of Supervisors after the application process in the following areas of expertise/interest. One member from the Coordinating Committee (a County department head) appointed by the Board will serve as a non‐voting ex officio member of FAC.   Section 2 – Membership of FAC 

1. Agriculture/Timber Management  a. Timber Harvesting b. Fuel Reduction/Fire Management c. Grazing Leases 

2. Recreation – Motorized  a. Public Access/campgrounds/picnic areas b. Road use classifications/regulations c. OHV and Single Track Trails 

3. Recreation – Non‐Motorized  a. Equestrian b. Mountain Bikes  c. Hiking/Backpacking 

4. Environmental & Watershed Management  a. Lakes/streams/erosion control/preservation 

5. Economic/Tourism  a. Private Enterprise Operations/Events/Fishing & Hunting 

6. Butte County Coordination Committee Representative (ex officio a. Agendas, Minutes, Timekeeper, Brown Act compliance 

 Section 3 ‐ Public members of FAC will serve four‐year terms. Terms shall be staggered by lot for two years at the onset (two members will serve an initial term of 2 full years and the portion of the calendar year ending December 31, and three members will serve an initial term of 4 full years and the portion of the 5th year ending December 31). The term of appointment for FAC members shall coincide with the calendar year and shall expire on December 31. All public FAC members and alternates shall be open to re‐appointment for consecutive terms.  In order to preserve continuity, alternates for each category will serve initial terms that are the opposite of the member for the area of expertise for which they were appointed.  Section 4 – If a member is unable to attend a scheduled meeting, the alternate for the category to which he/she was appointed is authorized to vote at that meeting.  Section 5 ‐ The Board of Supervisors may, at the request of FAC, appoint a new member to the FAC to replace a member whose FAC term has not yet expired, when the member is no longer able to represent the areas of expertise/interest as shown above.

Section 6 ‐ FAC members serve at the pleasure of the Board of Supervisors and can be removed at any time without cause. A FAC member who misses three consecutive regular meetings without good cause may be removed from the FAC by the Board of Supervisors.  Section 7 ‐ The term of ex officio member of FAC does not expire. The Board of Supervisors may change the ex officio member at any time.  ARTICLE V ‐ OFFICERS AND TERMS OF OFFICE  Section 1 ‐ The FAC shall elect a Chair and Vice Chair at its first meeting of each calendar year.  Officers shall assume office immediately upon election and serve until the following election.  Section 2 ‐ If the office of the Chair becomes vacant, the position shall be filled by the Vice Chair for the remainder of the Chair’s term and shall vacate the office of the Vice‐Chair. If the office of the Vice Chair becomes vacant, the office shall be filled by a majority vote of the FAC, and the Electee shall serve the remainder of the term. If both offices become vacant, both will be filled by a majority vote of the FAC for the remainder of the term.  ARTICLE VI ‐ OFFICER DUTIES  Section 1 ‐ The Chair shall preside at all regular and special meetings of the FAC and shall appoint all committees.  The Vice Chair shall assume the duties of the Chair in his or her absence.  ARTICLE VII ‐ MEETINGS  Section 1 ‐ Regular meetings shall be held monthly, or as necessary, as determined by a majority vote of the FAC. The regular location of meetings may be held in any suitable location of adequate size.   Section 2 ‐ Special meetings may be called by the Chair and shall be called by the Chair on petition of a majority of the Board.  Section 3 ‐ Meetings shall be public and minutes shall be maintained of all meetings. Minutes of the previous FAC meeting shall be distributed by email or other electronic form as an attachment to the agenda for the next regular FAC meeting. Hard copies of the minutes and agenda shall be made available upon request.  Members of the y Coordinating Committee shall be copied on the minutes of the FAC meetings.  Section 4 ‐ Meetings and the conduct of FAC members shall be governed by the Ralph M. Brown Act as per Government Code section 54950, et seq.  Section 5 ‐ Agendas for regular meetings shall be distributed to FAC members and posted for public information no later than 72 hours prior to each regular meeting. Agendas for special meetings shall be distributed to FAC members and posted for public information no later than24 hours prior to each special meeting. Proposed Agendas will be circulated to the Coordinating Committee for comment prior to finalization and posting.

Section 6 ‐ Agendas shall be posted in a location that is freely accessible to members of the public near the entrance to the facility where the meeting is to be held. Agendas shall also be sent to the interested local media and to individuals who ask to be placed on the FAC’s mailing list.  Section 7 ‐ A simple majority of authorized positions with current appointments (three public members) shall constitute a quorum for meetings of the FAC.     Section 8 ‐ Members or Alternate Members of the Forest Advisory Committee may be eligible for 

reimbursement for transportation related expenses to attend authorized, out of area meetings.  An out 

of area meeting is defined as one requiring more than 50 miles of travel from the residence of the FAC 

attendee (one way).  Mileage will be paid at the rate per mile authorized to county employees and 

officials.  In order to receive such reimbursement, a FAC member attending an out of area meeting 

subject to reimbursement will be attending upon the request of the Coordinating Committee.  In cases 

when a FAC member requests to attend an out of area meeting and will seek transportation 

reimbursement, prior authorization must be granted by the Ex‐Officio FAC Member and at least one 

additional member of the Coordinating Committee.   Only one FAC representative will be authorized to 

receive reimbursement for attending the same out of area meeting, and the meeting should be 

determined necessary to the purpose of the Committee.   A Butte County claim form, containing the 

claimant’s signature and an approving signature obtained from the Department Head member of the 

Coordinating Committee who authorized the travel, must be submitted to the Auditor‐Controller for 

processing and payment.  The person authorized for reimbursement will need to provide proof of valid 

insurance coverage and complete a W‐9 according to county standards.  

ARTICLE VIII ‐ AMENDMENTS  Section 1 ‐ These bylaws may be amended by the Board of Supervisors with a recommendation by the FAC after a proposal has been submitted in writing to the Chair who shall notify each member of the proposed amendments not less than five days before the date of the meeting at which time the amendment will be voted upon.  ARTICLE IX ‐ RULES OF ORDER  Section 1 ‐ No specific rules of order are adopted. The FAC shall operate by consensus. If consensus cannot be achieved, reference may be made to Roberts Rules of Order for assistance in resolution of procedural issues.    By:  _________________________________   Doug Teeter, Chair   Board of Supervisors  ATTEST:  Paul Hahn, Chief Administrative Officer and Clerk of the Board of Supervisors

The House Natural Resources Committee marked up and approved the Resilient Federal Forests Act of 2015 (H.R. 2647) on June 11, by a vote of 22-15. Introduced by Rep. Bruce Westerman (R-Ark.), the measure aims to improve the health and well-being of forest lands and forest communities by promoting collaboration, streamlining regulations for forest health projects and protecting communities through wildfire risk reduction. The legislation, which was supported by NACo, also includes language important to counties that would improve flexibility and fairness in forest revenue sharing through the Secure Rural Schools (SRS) program.

Approval by the House Natural Resources Committee is only the first step in the legislative process for this measure. The legislation is still subject to amendment and debate when it reaches the House floor and will have to pass both the House and Senate before being sent to the president’s desk.

NACo’s letter in support of H.R. 2647 commended Rep. Westerman for his leadership in introducing legislation that would promote the active management of our nation’s federal lands and forests, reduce the risk of catastrophic wildfire and promote collaborative approaches to address natural resource management challenges. The letter specifically called attention to provisions in the legislation that authorize limited categorical exclusions for projects that improve forest health and have been developed through consensus based collaborative processes. Collaborative processes have been utilized by forest counties across the United States to address natural resource management challenges by convening broad stakeholder groups to develop workable solutions without litigation.

NACo also expressed thanks for provisions of the legislation that providing flexibility and equitable sharing of forest revenues. NACo worked with House staff to include language within the legislation that shares forest revenues from stewardship contracting projects with forest counties. Traditionally, the federal government has shared 25 percent of all forest revenues with forest counties. However, in recent years revenues derived from stewardship contracting projects have been excluded. Provisions within H.R. 2647 would ensure stewardship contracting revenues are shared equitably.

NACo also supported provisions that would reform Title III of SRS to provide much needed flexibility for counties to use a portion of SRS funding to support law enforcement patrols and ensure county first-responders have the equipment and training they need to provide high-quality emergency services to county residents on forest service land and the millions of public lands visitors each year.

The Forest Service is evaluating its existing management of OSV use on the Lassen National Forest (LNF). The goal of this proposed project is to designate LNF system roads, trails, and areas where OSV use will be allowed, restricted or prohibited.

Approximately 0.51 miles of fence will be constructed in two portions across Childs Meadow pasture to tie in with an existing fence on adjacent private land.

The project is intended to re-establish a safe, sustainable trail crossing over Chips Creek along the Pacific Crest National Scenic Trail for hikers and stock users.

Thin areas around proven rust resistant sugar pine (RRSP) trees to increase sustainability by reducing direct vegetative competition, wildfire risk, over-wintering habitat for cone boring insects, and squirrel access to crowns.

To control livestock there is a need to construct a fence along the west side of Forest Road 32N02 from the railroad tracks to the north to separate Pine Creek Valley from the Feather Lake area.

Proposed activities include: salvage, treatment of non-merchantable trees, removing hazard trees along roads andtrails, treatment of activity slash, site preparation, and planting, maintaining existing roads, and constructing temporary roads.
