Fifth Legislative Assembly oi Goa, D a m and Diu

The Third Session (October) 1980 of the Fifth Legislative Assembly of Coa, Darnan and Diu commenced at the Assembly Hall, Panaji on Monday the 6th October, 1980. 10 meetings were held and the total time taken for the business of the meethg was 33 liours 32 minutes.

&Xotiona for condolence

On 6th October, 1980 motions for condolences were moved (1) pn passing away of the former President of India, Shri V. V. Giri who was a great social worker, veteran Labour Leader and a valiant freedom fighter. (2) for the sad untimely tragic death of Shri Sanjay Gandhi a dynamic youth leader and a promising personality.

Summary of business transacted by the Goa, Damm and Diu Legislative Assembly ' day to day during the 3rd Session, 1980

Monday, +he 6th Ocfober,' 1980

- I. (i) Eleven Starred Questions were answered.

(ii) One Starred Question was postponed.

(iii) Twenty Starred Questions were not reached and were transferred to Unstarred List.

11. (1) S/Shri V. D. Chodankar, A. N. Naik, R. T. Prabhu, V. P. Gaonkar, R. D. Khalap, H. Dourado and Dr. Wilfred de Souza, MLAs moved the following motion for condolence.

"This House expresses its deep sense of sorrow and profound grief in the death ,of former President of India Shri V. V. Giri, who was a great social worker a veteran labour .leader and a valiant freedom fighter and conveys its heartfelt condolences to the bereaved family".

The motion proposed. Seven members took part in the debate. Motion was passed unanimously. The members stood in silence for 2 minutes as a mark of respect to the departed soul.

(2) S/Shri V. D. Chodankar, A. N. Naik, D. G. Narvenkar (Minister for Legislative Affairs), R. T. Prabhu, V. P. Gaonkar, H. Dourado and Dr. Wilfred de Souza, MLAs moved the following motion for condolence: -

"This House expresses its deep sense of sorrow and profound grief in the 'sad untimely tragic death of Shri Sanjay Gandhi, a dynamic youth leader and a promising personality in whom our Nation had high expectation and conveys its heartfelt condolences to the bereaved family."

III. Shri H. Dourado, MLA moved the following motion for congr6tulations: - "This House warmly congratulates the National Hockey team for its gallant

rise to glory by its victory a t the Moscow Olympics and rests in the hope that it shall live upto its traditions".

The Motion proposed. Two members took part in the debate. The motion was put to vote and carried.

IV. Th?? Minister for Law laid on the Table of the House the Audit Report and Accounts of the Housing Board for the year 1977-78.

VI. The Chairman (Dy. Speaker) presented the Report of the Committee to solve the dispute between ramponkars (traditional fishermen) and Mechanized Fishing Boat Operators. ,

VII. The Chairman (Dy. Speaker) presented the report of the committee on Privileges in the matter of breach of privilege arising out of a letter written by Mrs. Usha Sharad Vengurlenkar published in 'Navprabha'. The Chairman moved that the Report of the Privilege committee be taken into consideration. The motion was put to vote and carried. The Report was considered and adopted.

VIII. Hon. Speaker informed the House about the Report of the Business Advisory Committee. The Minister for Legislative Affairs moved for the adoption of the Report. The motion for adoption of the Report was put to vote and carried.

M. Minister for Legislative Affairs announced the business to be transacted during the week. -

X. ,(I) Shri V. D. Chodankar and H. Dourado called the attention of the Minister .

for Civil Supplies to the following matter of urgent public importance:

"Shortage of kerosene, maida, cement and high prices of sugar and steps Government had taken or intend to take in the matter to mitigate the hardship of the people".

The ~ i n i s t e r for Civil Supplies asked for time to reply the calling attention notice.

(2) S/Shri H. Dourado, A. N. Naik & R. D. Khalap, called the attention of the following matter of urgent public importance: -

"Fear and panic caused in the minds of public due to phenomenal increase in crimes specially murders like that of Tivim which have been going undetected and steps Government taken or intends to take in the matter".

The Chief Minister asked for time to reply the calling attention notice.

XI. Government Bills. b-A"

i) Bill No. 21 of 1980-The Goa, Daman and Diu Administrative Tribunal " (Amendment) Bill, 1980 was introduced, considered and read clause by clause.

ii) Bill No. 23 of 1980-The Goa, Daman and Diu (Authority for use of Eyes for therapeutic purposes) Bill, 1980 was introduced. The discussion on consideration of the Bill was postponed to 7th October, 1980.

Tuesday, the 7th October, 1980

I. (i) Eight starred questions were answered.

11. S/Shri Michael Fernandes and H. Dourado cailed the attention of the Minister for Fisheries to the following matter of urgent public importance: -

"Serious apprehecsions caused in the minds of the people of Caranzalem and sorrounding areas due to the proposed plan of the Government to build a fisheries harbour a t Caranzalem".

Minister for Fisheries asked for same time to reply the calling attention notice.

(2) Shri R. D. Khalap called the attention of the Minister for Education to the following matter of urgent public importance: -

"Continued boycotting of classes by the students of Government Primary School Virnora, Pernem since 1st October and Government's failure to take prompt action in the matter".

Minister for Education asked for time to reply, the calling attention notice.

(3) The Minister for Tourism made a statement in respect of calling attention notice by S/Shri V. D. Chodankar and H. Dourado regarding shortage of kerosene, maida, cement and high prices of sugar to u-hich his attention was called on 6th October, 1980. Few questions were also replied by way of clarification.

Minister for Fisheries then made a statement in respect of calling attention notice raised, by S/Shri Michael Fernandes and Herculano Dourado regarding plan of the Gcverdment to build a fisheries harbour a t Caranzalem. Few questions were also replied by way of clarification.

111. 1) Shri A. N. Naik called the attention of the Chief Minister to the following matter of urgent public impo-t L ance: -

"Reported threat of chain hunger strike unto death by some prominent social workers from Salcete if Government failed to stop the wanton sand extraction from the coastal beaches which is threatening human life, property and vegetation in those areas and in action on the part -of the Government."

The Chief Minister asked for time to reply the calling attention notice.

ii) Dr. Wilfred de Souza called the attention of the Chief Minister to the following matter of urgent public importance: -

"Harassment caused to commuters by the irregular bus services and the ovelrcrowding and overcharging in the buses operating in this territory and the steps Government intends to take to mitigate these hardships to the people".

The Chief Minister asked for time to reply the calling attention notice.

iii) The Chief Minister made a statement in respect of the calling attention notice raised by S/Shri Herculano Dourado, A. N. Naik and R. D. Khalap, regal-dlng increase in crimes specially murders like that of Tivim which have been going undetected to which his attention was called on 6th October, 1980. Few questions were also replied by way of clarification.

iv) The Minister for Education made a statement in respect of calling attention notice raised by Shri R. D. Khalap regarding boycotting of classes by the students of Government primary School, Virnora, Pernem to which his attention was called on 7th October, 1980.

consideration and spoke. Shri V. D. Chodankar moved that the Bill be referred to Select Committee. The consideration stage of the Bill was not concluded.

Thursday, the 9th October, 1980

I. (i) 6 Starred Questions were answered.

11. Breach of Privilege.

Shri H. Dourado raised a question of breach of privilege and contempt of the House against the Editor, & Publisher of 'West Coast Times' for having reported a news under caption 'and Herculano's comfort' in -its issue dated 9th October, -1980.

111. i) Shri H. Dourado, Dr. Witfred de Souza, S/Shri L. Faleiro, V. R. Naik, R. D. Khalap, S. Z. Nevagi and'D. F. Desai called the attention of the Minister for Labour to the following matter of urgent public importance: -

"Successive suspension, intiinidations and lock outs effected by Zuari Agro Chemicals IAd. resulting in hardship to over 1200 staff and workers and rea l - tant threats to industrial climate in the territory. What action has Government has taken to alleviate hardships of workers and obtain participation of Mana- gement in tripartite negotiations."

Minister for L a b c ; ~ asked for time to reply the calling attention notice.

ii) Shri R. 3. Khalap, called the attention of the Minister for Education to the follmvulg matter of urgent public importance:

"Grave conceni created in the minds of Government Primary teachers in Pernem Taluka on account of misappropriation CY£ thousands of rupees collected for depositing in the C. T. D. Scheme by an official of Education Deptt. and steps taken by Gcvernment in the matter."

Minister for Education asked for time to reply the calling attention notice.

IV. Government Bills:

Friday, the 10th October, 1980

( i ) Six Starred Questions were answered.

11. Hon. Speaker irxormed the House about the Report of Business Advisory Committee. Thu Minister for Legislative Affairs moved for adoption of the Report. Motion for adoption crf report was put to vote and carried.

III. Minister for Legislative Affairs announced the Business to be Transacted during the week.

IV. Shri R. B. Khalap called the attention of Minister for Public Health to the following matter of urgent public importance: -

"Reported letter in the daily 'Gomantak' dated 8-10-1980 regarding the death of one of the 3 children kept on a small ,table without any support due to the gross negiiiigerice on the part of the staff of the Gca MedicaJ College Hospital and action taken against the defaulters and the steps taken to avoid recurrences of such incidents.''

Minister for Health made a statement thereon. Few questions were also replied by way of clarification.

2) Shri J. M. Vaz, called the attention of the Minister for Public Health to the following mattes of urgent public importance: -

"Phenomenal increase of cases of rabbies in Cuncolim constituency and reported death at Curchorem due to rabbies and what steps the Government intends to take in the matter."

The Minister fcr Health asked for time to reply the calling attention Notice.

1) Resolution No. 8 by Shri F. M. Cruz.

"This Hcvse strongly recommends Government to repair the small bridge ,

linking Earnale with Gaunem so as to extend the existing road upto Maha- laxnli Temple Bandora Goa." - Resoluticn was not moved as the member concerned was absent.

"This Hcuse recommends Governrneilt to open a new police out-post within the jurisdiction of village Panchayat of Verem in Calangute consti- tuencv.

3) Resolution No. 18 by Shri D. F. Desai.

"Whereas many landless persons have been allotted the lands in Cotigaon for cultivation and settlement and the area being awarded a s Jayanti village;

And whereas the private lands in Cotigaon are b_eing cultivated with the aid of loans and subsidies granted by Govt., and over 3000 have already been settled permanently in this area;

Now, therefore this House strongly recommends Government to change the status of Cotigaon area from Wild Life Sanctuary to an ordinary forest".

Resolution proposed. Seven members took part in the debate. Resolution was withdrawn with 'the leave of ihe House.

Shri Luizinho Faleiro, moved the resolution No. 10 regarding police out post within the jurisdiction of Village Panchayat of Verem in Calangute Constituency with the permission of the Hoo'ble Speaker, as the said resolution was not moved by him as he was absent when the resolution was called upon earlier. The Resolution proposed. 3 members took part in the debate. The Resolution was withdrawn with the leave of the House.

4) Resolution No. 13 by Shri L. Faleiro:

"This House strongly recommends Government to exempt collection of entrance fees for the students picnic parties going for sight seeing a t Mayem Lake".

Resolution proposed. 7 members took part in the debate. The resolution was put to vote and carried.

Speaker that I am staying in the Circuit House and on that particular day due to paucity of staff I was served lunch only a t 2.20 p.m. and I had to attend Session a t 2.30 p.m. I suggested that members may be accommo- dated in Tourist Hostel as members are not provided with transport. The Tourist Hostel being near to the Assembly Hall, the members can walk down to attend the session. My suggestion was not for my personal comfort but to be punctual for attending this Assembly session in my capacity as M.L.A. i. e. as representative of the people.

The paper has reported that 1 complained that the food was not properly served, whereas my complaint was regarding delay ?n serving food.

It is my contention that the paper has distorted and suppressed my statement regarding delay in senring food with malice and has given a headline in order to mislead its readers that I spoke about my comfort. The paper did not make a mention about my anxiety to attenc; the Session in time.

The Editor and Fubiisher of the papsr is therafore guilty of Breach of FriWega srr;d Contempt of the House.

telegram received by them from Matany Saldanha, General Secretary, G.R:&% The Hon. Members were of the opinion that the telegram constitute Breach of Privilege and Contempt of the House and appropriate action should be taken against the author of the impugned telegram. Bug the Members did not give any complaint or notice in writing as required under t i e rules.

However, as the Hon. Members have appraised our Department about the matter by raising the issue on the floor of the House and han&ed over the telegrams a t the table, the point was exanlined by the Legislature Department. Subsequenfly on the same day I have also received a similar telegram. But since the impugned matter is in the form of telegram it was dii'ficult to confirm the author -of the same though it was sent in the n a r ~ e of Matany Saldanha. But now Hon Members Shri V. D. Chodankar and Shri Babuso Gaonkar have handed over the copies received by them by post which carried the signature of Shri Matany Saldanha, - General Secretary GRE. Having examined the matter the Secretary of the -4ssembly has given a report under Rule 73 of Rules of Procedure and conduct of Business which reads as under:

I was appraised. of the matter a t zero hour on 9th October, 1980 when the Hon. Members raised the issued on the floor of the House and many of them handed over the copies of the telegram received by them a t the Table. Subsequently -

It is my submission that the wording of the telegram under reference tends to intimidate the Hon. Members by threats with a view to influence them in their parliamentary conduct and as such amount to breach of privilege especially because, the motion for consideration of the Marine Fishing Regulation Bill, 1980 and the amendment to the said motion to refer the Bill to Select Committee are pending before the House.

By virtue of section 16 of Government of Union territories Act, 1963 read with article 105 of the Constitution the powers, privileges and immunities of the Legfxlative Assembly of a Union territory and of the members and the committees thereof shall be such as are enjoyed by the House of Commons a t the commence- ment of the constitution. In 1780 the House of Commons passed the following resolution :

"That it is a gross breach of privilege of this House for any person to obstruct and insult the members of this House in the coming to or the going from the House and to endeavour to compel member by force to declare themselves in favour or against any proposition then pending or expected to be brought before the House". , 4

*''Any attempt to influence the member otherwise than by way of argument, . . which has as its motive the intention to deter him from performing his duty,

constitute a breach of privilege. Thus an attempt to intimidate members by threats with a view to influence them in their Parliamentary conduct is a breach of privilege",

Therefore the point before us is whether the impugned telegram endeavour to compel members by force to declare themselves in favour or against any pro- position pending before or expected to be brought before the House.

The impugned telegrams were issued a t 23-40 hrs. on 8th October, 1980. I t may be recalled in this connection that the Goa, Daman and Diu Fishing Regulation, Bill, 1980 was moved for consideration on 8th October, 1980 and on the same day Hon. Member Shri V. D. Chodankar moved an amendment to the motion to refer the Bill to Select Committee. The debate on the original motion and the amendment to refer the Bill to Select Committee was not concluded on 8th Oct. 1980, and both the motions were pending before the House when the telegrams were issued. Eventhough the impugned telegram does not convey any definite threat, the wordings used. therein especially "Traditional Fisherman of Goa shall
