Not paying taxes is a no, no and that’s the unfortunate answer required in our first Q&A. While reciprocity is a benefit for licensed CA contractors, there are still some ‘general’ rules that can’t be skipped. Another questioner is ‘floored’ by news that he will be required to have the appropriate contractor’s license and appropriate classification to ‘seal’ the deal…

Q: Our Corporation is currently suspended with the Secretary of State because we failed to pay taxes the last few years (we weren’t doing any business in California). We now have a big job opportunity in Southern California and need to get everything in order so that we can sign the contract. I looked up our contractor’s license and it shows a former employee still listed as our Qualifying individual. Can we work on replacing him on the license prior to dealing with the tax issues? I just wanted to hopefully get a head start on these items if possible. A:  No, no. The CSLB will not add the new Qualifier until your corporation is back in good standing with the Secretary of State.  You must meet all Suspension requirements before you can add a new Qualifying individual.

Q: You helped my company obtain a General Contractor’s License in California in 2012. I am the one who took the exams and I am listed as a Responsible Managing Officer (RMO) on the license. We now need to obtain our license in Nevada and Arizona. Can we do this with reciprocity and waive the exams?

A:  Thank you for contacting us again.  Nevada requires that you be actively licensed in one of the reciprocal States for five out of the last seven years.  Since you only obtained your license in 2012 you will not meet the reciprocal requirement in Nevada.  Arizona doesn’t have “reciprocity” any longer, however they allow for you to Waive the trade exam (the Construction Business Management exam is

still required) if you can show that you: a) passed the equivalent exam in another State, and b) your license has been active and in good standing at some point within the preceding five years.  It does sounds as if you qualify for a Waiver of the trade exam in Arizona.

Q: We are a flooring company and I need to know if I need a contractor’s license, and if so, what type of license would be required? The main type of work that we have always done is carpet and floor (tile, concrete, laminate) cleaning. But we have started to occasionally do more extensive cleaning such as coatings on the concrete and laminate floors as well as touch up caulking on tile floors. We have a potential job coming up for a large retail facility and I want to make sure that we are in compliance. Thank you for your advice.

A:  While you are not required to have a contractor’s license to do carpet/floor cleaning, you do need a license for the more extensive work that you mention such as seal coatings.  The appropriate classification for that type of work would be a “C-61”/”D-12” license.  There is no trade test for the “C-61” classifications, only the Law exam is required.  The “C-61”/”D-12” (Synthetic Products)

Changes to expect:

For plan years beginning on and after January 1, 2014, employers should carefully evaluate arrangements under which they reimburse employees for premiums, or are otherwise involved in the purchase of individual health insurance policies that provide non-excepted medical coverage (i.e., coverage that is subject to health care reform’s mandates) for employees. These arrangements create significant compliance concerns under health care reform. Furthermore, these individual policies should not be paid for or reimbursed on a pre-tax basis under an employer's cafeteria plan. As described in more detail (left).

Caution for Individual Policy Reimbursement

The IRS uses a FAQ on Employer Health Care Arrangements to highlight

the potential liability for employers that, rather than establishing a group

health plan, merely reimburse employees for the cost of their individual

health plan premium.

Q1. What are the consequences to the employer if the employer does

not establish a health insurance plan for its own employees, but

reimburses those employees for premiums they pay for health

insurance (either through a qualified health plan in the Marketplace

or outside the Marketplace)?

The IRS makes it clear that the consequence is that the employer may face a

penalty.

Specifically, as explained in Notice 2013-54, employer reimbursement plans

are considered to be group health plans and therefore subject to the market

reforms, including the prohibition on annual limits for essential health

benefits and the requirement to provide certain preventive care without cost

sharing. Notice 2013-54 clarifies, however, that employer reimbursement

plans cannot be integrated with individual policies to satisfy the market

reforms.

Consequently, the employer may be subject to a $100/day excise tax per

applicable employee (which is $36,500 per year, per employee) under Code

Sec. 4980 D.

Your choice of which daySynopsis: This course discusses the design and inspection of means of egress in commercial buildings. The course covers the requirements in the 2013 California Building and Fire Codes. This means of egress course covers determining occupant load, means of egress capacity, number of exits, the need for fire-resistance-rated construction, exit and exit access doors and door hardware, separation of exits and exit access doors, exit access travel distance, common path of egress, when can a person egress through adjoining spaces, exit signs, egress illumination, stairways and horizontal exits. Make sure to bring your 2013 California Building Code and your questions. This course is excellent for designers, architects, plan reviewers, building and fire code inspectors.

LUIHSW units are available as Learning Units for AIA. ICC CEUs will be provided.

INSTRUCTOR – KEVIN SCOTT - Kevin Scott is President of KH Scott & Associates LLC. He served the Kern County Fire Department, CA. for 30 years in several different capacities, retiring at the position of Deputy Chief. He has been actively involved in code development since 1988. He participated on the Drafting Committee of the International Fire Code, and served on the Code Development Committee for the International Fire Code from 1998 until 2004 when he was elected to the Board of Directors for the International Code Council. Mr. Scott has developed several training manuals and trainings programs for code enforcers and designers. Mr. Scott has developed and provided training for the CSFM, ICBO, IFCI, CALBO, CaFPOs, AIA and SFPE, and is a certified Preferred Provider for ICC. Safety Tip of the WeekBACK TO WORK & BACK TO SCHOOL

September begins with Labor Day, a day to honor those, like you and me, who work for a living; who are the backbone of this country. Labor Day also "officially" signifies that summer is over, and that means that in the next few weeks our children will be returning to school. Some of these boys and girls may be your own or perhaps your neighbors, but all of us need to be concerned about their safety. Remember when you went back to school after the long summer and your mind was focused on everything but school? In fact, you may have some of the same feelings coming back to work if you've just returned from vacation.

Knowing that the kids are probably not thinking much about safety, we have to watch out for them, especially in school zones and at bus stops! Big children, little children, and even adults will now be using the crosswalks, sidewalks and driveways around our schools. Watch for reduced speed limits in these zones in the morning and afternoon and obey them. Keep a sharp lookout for stopped school buses, flashing red lights, and the child that waits until the last second to catch the bus and darts from one side of the street to the other. Adjust your schedule to allow extra time to get to work in the morning, and use extra caution on rainy days.

If you're the one returning from vacation, make sure you reacquaint yourself with the safety rules at your workplace. To get up to speed, check with your supervisor to see what has changed while you were gone. Check your safety equipment, dust it off, and make sure it's working properly before using it. Think carefully about what you're doing and don't take any chances. Vacations are great. They take our minds off our work and it's a chance to relax. You deserved it and hopefully really enjoyed it, but now it's back to the old grind. Just remember, now that you're back on the job, don't relax when it comes to safety.

Whether ‘back to school' or 'back to work,' it's up to each of us to practice safety. Watch out for that child and watch out for yourself. If we all use just a little extra caution, we can significantly reduce 'back to school' accidents and keep ourselves from becoming an end of summer statistics
