SUBJECT: Medal of Commendation

AGENDA ITEM:

Background: The department has a policy to recognize officers for actions beyond their normal routine.

The Medal of Commendation may be awarded to a member of the department for an outstanding police

act which brings credit to the department, and is highly recognized by other officers or citizens. This act

is characterized by obvious self-sacrifice while in the face of personal danger.

On January 12, 2020 at 6:53 p.m. Paramedic Officer Jason Rieber responded to the home of James and

Diane Williams for a structure fire. Upon his arrival Rieber learned that James was inside the residence.

The attached garage and part of the home were fully engulfed in flames. Officer Rieber entered the

smoke filled residence locating James and escorting him from the home. Officer Rieber and James were

treated on the scene by North Memorial Ambulance service for smoke inhalation but did not suffer

injury.

Requested Action:

Present the Medal of Commendation to Officer Rieber.

The meeting of the Breezy Point City Council was called to order by Mayor Tom Lillehei at 7:00 p.m. Councilmembers present were Gary Bakken, Rebecca Ball, and Michael Moroni. Gary Mitchell was absent. Staff present included Administrator Clerk Patrick Wussow, Chief Kevin Merschman, Public Works Supervisor Joe Zierden, Finance Specialist Kari Jacobson, and Deputy Clerk Deb Runksmeier. Also present was City Engineer Joe Dubel, WSN. All present stood for the pledge of allegiance. Consent Agenda A. Council Minutes 01/06/2020 regular meeting B. Open Forum – Diane Williams 32744 Northwoods Lane thanked Officer Jason Rieber for his service when her house fire happened. She also praised the fire department for their work. Mayor and Council Members Report A. The Mayor attended the follow up VRBO Ordinance meeting at the County. The County Board did not take any action at this time. He attended the Fire board meeting in Pequot Lakes on Wednesday with Administrator Wussow. Discussed the building permit totals from 2019 that shows how the city is growing. B. Councilmembers – No Reports Committee Reports Road Committee – Councilman Moroni spoke about the Buschmann Road joint Project with county assistance. Discussed county standards and state aid highway requirements as this project moves forward.

RESOLUTION 2020-07 A RESOLUTION PROVIDING FOR ANNUAL DELEGATION OF AUTHORITY TO MAKE

ELECTRONIC FUND TRANSFERS FOR 2020

WHEREAS, at appropriate times is it necessary for the City staff to transfer funds to conduct regular City Business; and WHEREAS, the transfer of funds is done electronically; and WHEREAS, Minnesota State Statue 471.38, Subd. 3 requires that cities make an annual delegation of authority to make electronic funds transfer to a Chief Financial Officer. NOW THEREFORE BE IT RESOLVED that the City Administrator/Clerk is designated with the authority to make electronic funds transfer. Memo to: Breezy Point Mayor and City Council From: Patrick Wussow, City Administrator/Clerk Date: February 6, 2020 Re: Liability Limits Each year with the renewal of the city insurance, LMCIT, asks the city to review whether or not we want to waive municipal tort liability limits. This decision is an annual election made by the city council. The city has not waived the monetary tort limits in the past. The city has liability coverage in the amount of $2,000,000. This is the standard amount provided by LMCIT. The city can carry additional excess liability coverage without waiving the statutory tort limits. As you may recall we had additional coverage beyond this for paramedic coverage as well. This additional coverage is now limited to the contract alone. The State of Minnesota has established tort limits for cities. Currently the limit established as a single claimant is $500,000. The total tort liability with multiple claimants for a single occurrence is $1,500,000. The league increased its minimum liability coverage for cities to $2,000,000. The minimum was increased in part to protect cities and also to provide additional coverage for those claims that are not covered by the statutory tort limit. If the city does not waive the statutory limit we have coverage up to that amount for a claim that is not subject to the tort limits. Assuming the council wants to maintain the current status, a motion that the city does not waive the monetary limits on municipal tort liability would be required. Given the city has never waived statutory tort limits this option is the council’s likely choice. If the council chooses to waive the limits the motion should include what amount of additional coverage should be purchased. Excess coverage can be purchased in increments of $1,000,000 up to $5,000,000. Underwriting would need to determine our additional costs. As a third option if the council wants to carry additional excess liability coverage without waiving the statutory tort limits a motion in that regard would need to define the amount of additional coverage. Excess coverage would come at an additional cost. Costs are determined by underwriting based on various factors. If the council wants to maintain past practices a motion to not waive statutory tort limits would be appreciated.

SUBJECT: 2020 CHIP SEALING

BACKGROUND:

The following roads: Pawnee Circle, Aztec Circle, Pima Circle, Navaho Trail, and Zuni Circle were

identified for chip sealing in 2020. These roads were paved a couple years ago and are the last

of the qualified roads to be chip sealed for the first time. For 2020 $60,000 was budgeted for

chip sealing, the estimated cost for these roads is around $34,000.00, and finalized costs will be

realized after the county puts chip sealing out to bid. I have attached the 2020 chip sealing

contract proposal with Crow Wing County to request authorization to sign the agreement.

RQUESTED ACTION:

A motion to sign the 2020 chip seal agreement with Crow Wing County would be appreciated.

CONSTRUCTION COST SHARE AGREEMENT WITH THE CITY OF BREEZY POINT (CP 18-200-99 & CP 18-300-20)

FOR THE BITUMINOUS SEAL COAT OF ROADWAYS UNDER THE JURISDICTION OF

CROW WING COUNTY, FIRST ASSESSMENT DISTRICT, CITY OF CROSBY, CITY OF BREEZY POINT, CITY OF CROSSLAKE, CITY OF FIFTY LAKES, CITY OF LAKESHORE,

DEERWOOD TOWNSHIP, JENKINS TOWNSHIP, AND ROSS LAKE TOWNSHIP.

This Agreement is made and entered into this day of __________, 2020, by and between the County of Crow Wing, State of Minnesota, a political subdivision of the State of Minnesota, 326 Laurel Street, Brainerd, Minnesota, 56401, hereinafter referred to as "County", and the City of Breezy Point, c/o Patrick Wussow – Administrator, City Hall, 8319 County Road 11, Breezy Point, MN 56472 hereinafter referred to as the "City".

WITNESSETH WHEREAS, the parties mutually agree that a bituminous seal coat desired by the City to be applied to the roadways listed in Attachment A has the potential to result in overall costs savings when combined with the County Project to provide a bituminous seal coat to County roadways and other local agency roadways, and, WHEREAS, the County has budgeted funds to complete the project; and, WHEREAS, the Crow Wing County Highway Department has prepared plans and specifications for the project entitled BITUMINOUS SEAL COAT, which plans and specifications are on file in the office of the County Engineer; NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED:

I. PURPOSE The parties have joined together for the purpose of constructing project CP 18-200-99 & CP 18-300-20. This agreement identifies funding responsibilities and also future responsibilities upon project completion. Attachment B (estimate) is considered a part of this agreement. II. Duties

A. Design and Construction

For this project, the County shall provide all design-engineering services unless otherwise stated in this agreement. The County shall provide all construction-engineering services, with the City being responsible for its share of design engineering/project development as identified in Attachment B. Attachment B is an estimate and final costs will be determined upon project completion. The County shall do the calling for all bids and the acceptance of all bid proposals and shall enter into a construction contract as the “owner” for purposes of the project.

B. Inspection and Approval

The County shall provide construction inspection and staking for the Project and approval for

acceptance of the work as it is completed. The County shall also be available to inspect said work and notify the City of any concerns that arise during or after the completion of the Project. Approval of the completed construction shall be completed by the County and the City.

III. COSTS A. Project Costs The project costs identified in this agreement are based upon current estimates. Attachment B identifies the agreed upon cost share quantities and estimated costs. Actual final costs for each agency will be determined by actual final quantities.

B. SUMMARY OF ESTIMATED COSTS - The estimated construction and engineering costs of the projects are shown in Attachment B and are summarized as follows:

Total Estimated Construction Costs $1,559,242.40 Estimated City Construction Costs $30,869.35 Estimated City Engineering Costs $3,086.94 Total Estimated City Costs $33,956.29

IV. TERM

This Agreement shall continue until terminated as provided hereinafter. V. DISBURSEMENT OF FUNDS All funds disbursed by the County or City pursuant to this Agreement shall be disbursed pursuant to law. Upon project completion, a final cost accounting will be performed totaling costs related to the Project. An invoice will be prepared by the County and submitted to the City. The City shall reimburse the County within 30 days of receipt of invoice. VI. CONTRACTS AND PURCHASES All contracts let and purchases made pursuant to this Agreement shall be made by the County in conformity with State law.

VII. ACCOUNTABILITY An accounting shall be made of all receipts and disbursements upon request by either party.

VIII. TERMINATION

This Agreement shall terminate upon completion of all obligations of the parties under this Agreement. This Agreement may be terminated prior to completion by either party only for breach of this Agreement or by mutual consent of the parties. X. NOTICE For purposes of deliver of any notices hereunder, the notice shall be effective if delivered to the Office of the Crow Wing County Highway Department, 16589 CR 142, Brainerd, MN 56401, on behalf of the County, and Breezy Point, 8319 County Road 11, Breezy Point, MN 56472, on behalf of the City.

XI. INDEMNIFICATION To the extent allowed by law, the County and the City mutually agree to indemnify and hold harmless each other from any claims, losses, costs, expenses or damages resulting from the acts or omissions of the respective officers, agents, or employees relating to activities conducted by either party under this Agreement.

XII. ENTIRE AGREEMENT It is understood and agreed that the entire agreement of the parties is contained herein and that this Agreement supersedes all oral agreements and all negotiations between the parties relating to the subject matter hereof, as well as any previous agreement presently in effect between the parties to the subject matter hereof. Any alterations, variations, or modifications of the provisions of this Agreement shall be valid only when they have been reduced to writing and duly signed by the parties. TO: The City of Breezy Point Mayor and City Council FROM: Patrick Wussow, City Administrator/Clerk DATE: February 25, 2020 RE: Legislative Policy Every year I attempt to visit our state Legislators at the Capital during the legislative session. This year I am planning to attend the March 19th Legislative day at the capital for MN cities. Meetings have already been set up with Representative Heintzman and Senator Ruud. Several other communities from Crow Wing County will be attending including Nisswa and Pequot Lakes. There may be more including Brainerd, Baxter, Jenkins, and Crosby. Our legislators have always been open and listened to our information. This visit I was hoping the City Council would authorize the attached letter or some revision of the attached letter. I have identified four bullet points, but I typically like to keep the bullet points to three. I would ask that the City Council prioritize their top three issues. Additionally, maybe I didn’t include an important issue that you would like included. That should be discussed prior to identifying your top three list. Included with this cover memo is a letter and attachments. Two of the attachments will be included with the letter to provide relative background information. The additional information provided is for City Council member to have specific to our Representative and Senator and bills they have authored in 2020. Please review my attached letter and share your thoughts and comments at the meeting.

Re: City of Breezy Point Legislative Action Issues

Senator Ruud:

At the March 2nd Breezy point City Council meeting, the City Council identified the

following issues as important to the City of Breezy Point. Please keep these issues and

the City Council concerns in mind while constructing legislation.

1. The City Council requests that mandates and associated costs be fully funded

so the City does not have to raise property taxes. Examples include: recent

Presidential Primary, Duty disability funding for Police and Fire 1997

legislation amended by 2003 legislation.

2. Appropriate Transportation funding – The Transportation Finance Advisory

Committee (TFAC) has identified unmet needs of at least $2.5 Billion per year

for the next twenty years. Local example: Bushman Road need of repair, this

is a potential project for Road of Regional Significance. Four gravel pits use

Bushman Road as a primary road (map identifies location, three outside of

the City of Breezy Point)

3. The Breezy Point City Council supports Bonding to address Minnesota

Workforce Housing Crisis. MN National Association of Housing and

Redevelopment Officials (MNNAHRO) seeks $200 million in housing

infrastructure bonds (HIB).

4. The Breezy Point City Council is opposed to legalizing the sale of Marijuana.

They specifically site two reports from the MN Police Chiefs Association –

Drug Policy Source Book and Marijuana Legalization the issues.

Point Aviation Days at the Airport Cliff Muller has authorized the City of Breezy Point to set up a “booth” during Breezy Point Aviation Days, to sell city golf cart permits. In 2019 the city issued 488 golf cart permits. Typically, we will issue golf cart permits into October of each year. One of the common comments we hear at City Hall is that some residents only come up on weekends when City Hall is not open. With that in mind, we have been considering options like visiting the camp grounds and local businesses during the weekends. Most of those ideas seems to only address a select group. By offering golf cart permits for sale during Aviation Days we hope that the community as a whole will benefit. There is the potential of drawing additional visitors to aviation days just for the purposes of obtaining a golf cart permit. Staff intends to create a flyer to post on the City’s website, City and Police Facebook pages, and hard copies for local businesses and at the campgrounds. To obtain the required golf cart permit, residents will still be required to provide the following:

1. Completed 2020 golf cart permit application (required every year) 2. Proof of Insurance for specific golf cart. (with current dates) 3. $10.00 (ten dollars) check or cash. Credit cards will not be accepted.

No action is necessary.

AGENDA ITEM:

Background: The city entered into an agreement with North Memorial whereby North provides medical

direction, equipment and medications that allow the certified officers of the police department to

provide advanced medical services to pre-hospital patients. Our current agreement has expired and it

took some time to get NMAS attorneys to sign off on the new agreement. Because of the issues with

having a two- year agreement they have changed the contract to an auto renewal so that we will no

longer need to go through this process. There are no other changes to the contract.

Requested Action:

Approve the agreement between the City and North Memorial for the continuation of the Police

Paramedic Program with auto renewal.
