On January 21, 2009, pursuant to the authority granted by Seetion 91.103 of the Los Angeles Municipal Code ("L.A.M.C"), theDepartment of Building and Safety (the "Department") investigated and identified code violations at: 1224 West FlorenceAvenue, Los Angeles, California, (the "Property"). A copy of the title report which includes a full legal description of theproperty is attached as Exhibit A.

Following the Department's investigation an order or orders to comply were issued to the property owner and all interested parties.Pursuant to Section 98.0411(a) the order warned that "a proposed noncompliance fee may be imposed for failure to comply with theorder within 15 days after the compliance date specified in the order or unless an appeal or slight modification is filed within 15days after the compliance date." The owners failed to comply within the time prescribed by ordinance,

In addition, on August 11, 2008, pursuant to Section 98.0402(e) of the L.A.M.C. the Department performed annual inspections onthe vehicle repair facility located at the same address, The property owner was given notice of the unpaid annual inspection fees onthe property. California Health & Safety Code, Section 33373, subparagraphs (a) and (b), requiresredevelopment agencies to record a statement with their county's recorder within 60days of the adoption of a redevelopment plan describing the land within the project areaand a statement that proceedings for the redevelopment of the project area have beeninitiated under this part. If the redevelopment plan authorizes the agency to acquireproperty by eminent domain, the statement shall contain a prominent heading inboldface type noting that the property that is the subject of the statement is locatedwithin a redevelopment project; a general description of the provisions of the plan thatauthorize the use of eminent domain by the agency, and a general description of anylimitations on the use of the power of eminent domain contained in the redevelopmentplan, including, without limitation, the time limit for the use of eminent domain asrequired by California Health & Safety Code, Section 33333.2

Section 33373(c) requires that for redevelopment plans adopted on or before December31, 2006, that authorize the acquisition of property by eminent domain, the agencyshall. on or before December 31. 2007, cause a revised statement to be recorded withthe county recorder containing all of the information revised statement containing therequirements of subparagraphs (a) and (b), noted above.
