3. Report, Discussion and Possible Action on Rules Committee Meeting Held on April 17, 2020:

Brandy Wells reported to the Board and stated that since our last meeting there has

not been any action or changes. There are a couple of items that the committee is looking at such as whether or not the Board actually has discretion over certain areas in the rules or statutes such as eyelash extension. The Committee has another meeting coming up soon where the committee will continue to review the rules and the last rule package the Board approved has not gone through the whole process.

4. Update Regarding Executive Order 2020-34 Building on COVID-19 Successes – Resuming Additional Business Operations for Barbers, Cosmetologists and Dine-in Restaurants.

Kim Scoplitte, Executive Director stated that this order allows salons to re-open on

May 8, 2020, following guidance from the Governor’s Office, CDC and Arizona Department of Health Services.

5. Update Regarding Executive Order 2020-36 Stay Healthy, Return Smarter, Return Stronger.

Kim Scoplitte, Executive Director stated that this order allows any business to re-open

on May 16, 2020, following guidance from the Governor’s Office, CDC and Arizona Department of Health Services.

6. Report and Discussion of Proposed 2020 Legislation relating to the Arizona State Board of Cosmetology.

Kim Scoplitte, Executive Director stated that from her understanding the Legislation

session is over. Jenna Bentley stated that she has heard that tentatively the house might resume next

week.

7. Discussion, Consideration and Possible Action regarding Waiver of School Renewal Fees.

Some schools had to close during this time and asked her to ask the Board to consider waiving the schools’ renewal fees. MOTION by Brandy Wells to include school renewal fees to be waived which are due on June 30, 2020, under Governor Ducey’s Executive Order in the original waiver of fees on Board Meeting April 17, 2020. 1. Report and Discussion on Agency Departments. • Financial Update • Personnel, Board Membership and Appointments Update • Licensing Update • Information Technology Update

2. Summary of Current Events that Affect the Arizona State Board of Cosmetology,

A.R.S. § 38-431.02 (K). This is the time for the Chair or Executive Director to give a brief summary on current events that affect the Board. It is informational only and no discussion may occur. Kim Scoplitte, Executive Director reported to the Board regarding the waiver of fees and that staff has done an enormous amount of work and has been awesome in making this happen and there is still more to do. Staff renewed 16,502 personal licenses, 4,356 salon licenses, total of renewal fees waived is between 1.2 – 3 million dollars and 610 Provisional

Staff is still working on refunds which have to be done one at a time due to PCI Federal guidance. Theresa Bunch, Deputy Director stated that there were many issues with GL Solutions and staff worked with GL to work through the issues. It has been a lot of late nights but it is cleaned up. Staff designed a Provisional license with the state seal, their photos are on the license and will expire within 6-months from the date it was issued or if the candidates fail any part of the exam there is an automatic email that will go out to expire the license and if they pass their exams the provisional license will expire and their first license will be mailed out and again the fee was waived for their license. Theresa Bunch, Deputy Director stated that she will be working with PCS and Prometric next week and that Prometric has re-opened some of their sites and PCS will be re-opening at the end of the month however it will be a slow process as they need to make sure candidates and staff are safe to resume testing. CONSENT AGENDA The Consent Agenda items may be considered for approval as a single action unless a Board Member or any other interested party wishes to remove the item for discussion. The Board may vote to go into Executive Session to discuss and consider records exempt by law from public inspection, including the receipt and discussion of information, or testimony that is confidential by State or Federal law on all agenda items under Steps 1, 2 & 3 pursuant to A.R.S. §38-431.03 (A) (2). Investigator Lisa Chavez testified that on November 18, 2019, the licensee came into the office and paid for 2021 personal license renewal and to change the social security number to her new one along with changing her name form Be Ba Thi Tran to Emily Be Ba Tran. Lisa Chavez stated that on December 18, 2019, licensee provided a copy of a letter from the Social Security Administration which indicated that her social security number had been retired.

On December 30, 2019, Lisa Chavez stated that she contacted the Social Security Office about the letter licensee had provided which indicates that the social security number had been retired. Staff from the social security office stated that in certain situations a new social security number is issued but the initial social security number is referenced to the new number and not retired.

On May 12, 2020, Lisa Chavez stated that she called the Social Security Office in Tucson and spoke to Lead Customer Service Representative Tom Payne regarding the issue and provided him with the BNC# from the letter and he was able to validate the numbers and both belong to the individual.

Irma Telles, Investigative Supervisor asked the Board if they would consider issuing licensee’s renewal with the new social security number.

Isabel Calleros requesting reinstatement of her cosmetology instructor license. Isabel Calleros licenses were revoked due to non-compliance on case no. 92162 and to come into compliance licensee would need to pay reinstatement fee, cost to deem, and any renewal/delinquents fees to bring license to current.

Isabel Calleros was sworn in and stated that after a series of strokes she left to Mexico to live with her aunt to get treatment and she did not have access to a phone while in Mexico. Isabel Calleros stated that in 2019 through the internet she found that her license was revoked and she has had a couple of schools asking her to come and work for them. Isabel Calleros stated that she has never had her license revoked.
