Before start of the Meeting, Brig Yashpal Singh, SEMO and Lt. Col Amit
Tiwari took oath to bear true faith and allegiance to the Constitution of India. President,
Cantonment Board Jabalpur, C.E.O, Vice President and other members have welcomed
them.
1. Multilevel Car Parking Schemes in Cantonment
Reference 1) CBR No. 01 dated 29-11-2019, 2) DGDE, Delhi Cantt letter No.
76/67/Expert Committee/C/DE/2018/Vol II dtd 07-11-2019 along with PDDE, CC,
Lucknow cantt forwarding letter No. 58006/MG/150th
BA/2 dtd. 14-11-2019.
3) DGDE, Delhi Cantt letter No. 76/67/Expert Committee/C/DE/2018/Vol II dtd 21-11-
2019 along with PDDE, CC, Lucknow /Cantt forwarding letter No. 58090/Gen/Car
Parking/Cantt/5 dtd. 25-11-2019.
To consider the report submitted by the Committee consisting of Vice President,
Cantt Engineer and Revenue Supdt on necessity of Multilevel Car parking in
cantonment area and the suitable sites available in cantonment area for the scheme.
Board is requested to consider the same.
Resolution No. 1
Considered in detail. CEO informed the Board that the Committee constituted
for exploring feasibility and suitability of land purpose for the Multilevel Car Parking
has submitted the interim report, without commenting on the need and feasibility. The
Committee has identified 03 locations in and around Sadar area of Jabalpur Cantonment
for Multilevel Car Parking and it is observed by the Board that the 03 locations which
were identified by the committee, for the scheme, are not suitable. Therefore it is
resolved that the Committee in next two weeks submits a detailed objective report
regarding requirement, feasibility and availability of land and financial implications on
the Board.
2. TA/DA Claims for Move on Permanent Transfer in respect of Group A
Officers
Reference PDDE, CC, Lucknow Cantt letter No. 57981/ADM/S.P./LCO Dtd 29-01-
2020 and 558044/ADM/S.J./LCO dtd 23-01-2020.
As per the directions of PDDE vide above referred letters, the following TA/DA claims
of officers are placed before the Board for consideration:-
1. TA/DA claim of Rs. 16420/- in respect of Shri Subrat Pal, CEO while he was
staying in Officers’ Mess in absence of not handing over the Govt.
accommodation, on permanent transfer of officer.

2. TA/DA Claim of Rs. 46,520/- in respect of Ms Shreya Jain, JCEO while she was
staying in Officers’ Mess in absence of non-availability of Govt.
accommodation, on permanent transfer of officer.
Relevant letters are placed before the Board for consideration.
Resolution No. 2
Considered in detail. It is resolved that the TA/DA claims of the officers be paid
through Cantonment Board Funds.
3. Amendment to the Cantonment (Payment of Allowances to Vice-President and
Elected Member) Rules, 2011 – Regarding
Reference DGDE, Delhi Cantt letter No. 76/38/Rules/Allowance to
member/C/DE/2016 dtd 03-02-2020.
Vide above referred letter DGDE office has forwarded the Gazette Notification
SRO No. 01(E) dated 27-01-2020 regarding Amendment to the Cantonment (Payments
of Allowances to Vice-President and Elected Members) Rules, 2011.
The same is placed before the table for noting.

Considered and noted.
4. Revision of Business Regulations in Cantonment Board Jabalpur
Reference DGDE, Delhi Cantt letter No. 76/67/Expert
Committee/C/DE/2018/Vol-IV dated 24-12-2019, PDDE, CC, Lucknow Cantt letter
No. 32670/VNS/BR/15 dated 30-12-2019 and letter No. 32670/VNS/BR/17 dated 14-
01-2020.
With reference to above this office has been directed to amend / revise old Business
Regulations of Cantonment Board Jabalpur, notified vide SRO 1607-1485-II dated 12-
08-1931 in accordance with various reforms provided vide MoD ID No. 14(12)/2018-
D(Q&C) dated 23-12-2019 including constitution of three more Committees viz The
Finance Committee, The Education Committee and The Health & Environment
Committee vide section 48(e) of the Cantonments Act, 2006. It is also suggested that in
the event of Boards having a Committee which has overlapping functions, the functions
& nomenclature of those committees may be suitably amended to align with the new
committees.

In compliance of abovementioned directions, the following points has been
incorporated in revised draft of Business Regulations for Cantonment Board Jabalpur.
I. Incorporation of relevant provision of law as per new Cantonments Act,
2006 in place of provision of old Cantonments Act, 1924.
II. Addition of process to pass any resolution by circulation of Agenda in such
circumstances where it is not possible to regular or special Board Meeting.
III. Old regulation regarding conduct of proceedings & deliberation of the Board
in English language is now amended and it is incorporated that all
proceedings and deliberations of the Board shall be conducted in two
languages i.e. English & Hindi, if possible.
IV. As per old Business Regulations, following Committees are working in
Cantonment Board Jabalpur
(i) Finance Committee
(ii) Building & Health Committee
(iii) Civil Area Committee
(iv) Education Committee
Whereas as per specific directions under reference, the nomenclature duties &
responsibilities of old committees is now been amended as follows in place of
old committees –
(i) Finance Committee
(ii) Health & Environment Committee
(iii) Civil Area Committee
(iv) Education Committee
(v) Building Committee
V. A prohibitory clause is introduced as per directions, regarding prohibition of
any elected member not to be member of more than two committees except
Vice-President.
Relevant file along with revised Draft Business Regulations is placed on the table.
Resolution No. 4
Considered and revised draft of Business Regulation approved. It is further resolved
that proper proposal be forwarded to the PDDE, CC, Lucknow Cantt as per instructions.
Any further modifications suggested/directed by higher authorities will be carried by the
CEO without referring it to the Board.

5. Payment of remaining outstanding amount in Arbitration Execution Case No.
549/2017 M/s Gayatri Construction v/s Cantonment Board Jabalpur (M.P.)
Reference CBR No. 11 dated 29-11-2019 and CBR No.
In compliance of Court order dated 19-11-2019, balance amount of Rs.
68,41,414/- was remaining to pay to the applicant M/s Gayatri Construction. The Court
has fixed the hearing on 21-01-2020 (adjourned for 22-01-2020 due to strike of
advocates) for balanced payment. The CEO, as authorized by the Board vide CBR No.
11 dated 29-11-2019 and on the basis of report submitted by Legal Advisor, ordered the
Accountant to prepare DD of balanced amount of Rs. 68,41,414/- and as per directions,
the Board paid the amount to M/s Gayatri Construction vide DD No. 645862 dtd 22-01-
2020 of Canara Bank on 22-01-2020. Subsequently on 04-02-2020, the subject
execution case been disposed off by the court on ground of complete and proper
compliance.
The matter is placed before the Board for apprising abovementioned
development of the case regarding payment of remaining amount.

6. Grant of Additional Increment-Family Planning
To consider application dated 01.03.2016 received from Rakesh Moolchand,
Safaiwala for grant of one increment w.e.f 01.01.2002 under the implementation of the
family welfare programmes in Cantonment Board as per M.P State Govt. Rules.
Relevant letter is placed on the table for consideration of the Board.

Considered and approved. However PCB advised the Board that as the matter is
of 2002 and the concerned employee is claiming it now, the same shall be verified for
correctness before implementation of the benefit.
7. Grant of 3rd
Stage Pay to Dr. (Mrs) Rupa Sarkar, RMO after completing 18
years of service
To consider grant of 3rd
Stage Pay to Dr. (Mrs.) Rupa Sarkar, RMO as per
instructions contained in MP State Govt. Health & Family Planning Order No. F.4-
1/2008/satrah/Medi-1, Bhopal dated 26-08-2008. The 3rd
Stage Pay of Dr. (Mrs.) Rupa

Considered. It is resolved that a suitable proposal be sent to PDDE, CC,
Lucknow for the same.
8. Medical Service Allowance to Medical Officer Jabalpur Cantt
To consider and approve the Chikitsa Sewa Bhatta/Medical Service Allowance
to Doctors of Cantonment Board Hospital according to the Pay Scale for the Doctors of
the MP State Govt. as approved by M.P State Govt. vide L.No. ,Q/04-01/2006/ l=g
dated 13.03.2013 w.e.f. 26.08.2008.
MP State Govt. has approved the medical service allowance for all doctors
whose Band Pay & Grade Pay is mentioned in the order. Shri Vedant Sarkar, Medical
Officer, Cantt General Hospital has in a Band Pay of Rs. 15600+39100 + 5400 Grade
Pay in that time. So, he is eligible for Medical Service Allowance as per M.P. State
Govt. order from the date of his joining i.e. 02.07.2018.
In this regard relevant order and report of Account Section is placed on the table
for consideration.

9. Reimbursement of Medical bill
Jabalpur Hospital & Research Centre, City Hospital & Research Centre, Jamdar
Hospital Pvt. Ltd and employees of Cantonment Board has submitted the medical bills.

the rates as per CSMA rules of Govt. of India with restrictions of admissibility.

11. Preparation of “Spatial Plan for Land Use” of Jabalpur Cantt. under
section 233 of the Cantonment Act,2006.
Ref : The DGDE letter No. T6/22/ Misc Policy/C/DE/2011/ Vol. II dated 29-10-2019;
even letter No dated 12-7-2013 and 21-11-2019 the PDDE letter No.
56443/LUP/ Cantt./37 dated 27-11-2019.
To consider for approval of “Spatial Plan for Land Use” prepared by Cantonment
Board Jabalpur. It is stated that the Consultant Architect Shri Sujeet Kalantare,
Jabalpur, hired by the Board for preparation of a Spatial Plan of Jabalpur Cant, in
accordance with the specific purpose of lands in accordance the terms of their tenure
and prescribed usage as recorded in the GLR and as per classification and transfer of
land under the CLAR, 1937.
The Spatial Plan of Jabalpur Cantt, as requires under section 233 of Cantonment
Act, 2006, has submitted the land use plan accordance with the guideline/ directions
issued by the DGDE, New Delhi as well as the PDDE, Central Command, Lucknow
vide above reference letter. As per the provision of Section 233 of Cantonment Act,
2006 is mentioned as under:-
“233. Preparation of land use plan-
(1) On the commencement of this Act, the Chief Executive Officer shall with the
approval of the Board, cause to be prepared a spatial plan for land use to be followed
in the Cantonment which shall include –
a) earmarking of zones for residential, institutional, commercial and other activities
and
b) improvement schemes for areas considered sub- standard on account of
narrowness of street, poor lighting, poor ventilation or irregular line of buildings in a
street.
2) The Board shall give publicity to the land use plan prepared under sub-section
(1) by publishing a gist of the plan in a local newspaper”.
As per provision of above mentioned section 233, of Cantonment Act,2006
preparation of a spatial plan for land use to be followed in the Cantonment. It is
requested to consider the same, shall be given publicity to the spatial plan for land use
prepared under sub section (1) and by publishing in sub section (2) a gist of the plan in a
local newspaper.
The gist of the “Spatial Plan for Land Use” of various GLR survey numbers of
Jabalpur Cantonment including notified civil area, is being mentioned as under:-
(a) All General Land Register (GLR) survey numbers (Sy.Nos) which are classified as
A-1, can be used for Army purpose as per GLR or as per the use of sanction of Ministry
of Defence. (b) All GLR survey numbers which are classified as A-2, are reserved for

future army use and can be used, as per GLR or as per the use of sanction of Ministry of
Defence. (c) All GLR survey numbers which are classified as B-1, can be used, as per
GLR or as per the use of sanction of by the Central Govt. (d) All GLR survey numbers
which are classified as B-2, can be used, as per GLR or as per the use of sanction of by
the State Govt. (e) All GLR survey numbers which are classified as B-3, can be used for
residential purpose, or as per the purpose defined in the respective GLR. (f) All GLR
survey numbers which are classified as B-4, can be used as per the purpose defined in
the respective GLR or as per the use of sanction of Govt. of India Ministry of Defence.
(g) All GLR survey numbers which are classified as C, can be used as per the purpose
defined in the respective GLR or as per the use of sanction of Govt. of India Ministry of
Defence. (h) All GLR survey numbers which are classified as “Private” or “Free Hold”,
can be used as per the purpose defined in the respective GLR.
Land use of following earmarked GLR Survey Numbers of Jabalpur Cant are
mentioned as under:-
a) Road/Transportation : Sy.No.441[C Land CB road] and
Sy.No.442[A-1 Land MES road]
b) Cantt Board Office : Sy.No.119
c) Public Garden/Park : Sy.No.127
d) Educational use : Sy.No.67-B, Sy.No.316, and
Sy.No.317 e) Use of army or LMA office : Sy.No.329
h) Sport /Recreation Activity : Sy.No.120, Sy.No.128, Sy.No.333
and Sy.No.334
The spatial plan for land use and all relevant documents/ papers/ letters are
placed on the table for consideration of the Board.
Resolution No. 11
Considered in detail. It is resolved to approve the spatial plan for land use and
gist of “Spatial Plan for Land Use plan” under section 233, sub section (1) & (2) of the
Cantonment Act, 2006 prepared by the approved Architect. It is further resolved to
publish the draft Spatial Plan in local newspaper and further necessary action be taken as per rules. After stipulated time of publication and considering the objections, if
received, the draft spatial plan be forwarded to the competent authority, as requires
under section 233 of Cantonment Act, 2006.
12. To consider a letter of Shri Rajit Yadav, Elected member of Ward No.7, regarding carrying out work on analogous B-2 land, Part of Khasra No.40,
main road Karondi Ranjhi Jabalpur Cantt

To consider the reference Letter of Shri Rajit Yadav, elected member of Ward No.7, regarding carrying out public work on analogaus B-2 land, Part of Khasra No.40,

main road Karondi Ranjhi Jabalpur Cantt. and provide basic civic amenities to cantonment citizens living in the ward.
As per under section 62 of the Cantonment Act, 2006, it is duty bound of the
Baord to provide basic civic amenities in the cantonment citizens living in the ward. It
is mandatory duty. The Board has already been collected and imposed tax since long
back.
In view of the above, the public works on analogaus B-2 land, are meant for
providing bare minimum civic amenities which are meant to cleanup and maintain all
the unhygienic localities in order to ensure the general public health and hygiene of the
Cantonment. It is requested to consider the same, shall be farward a letter to the
Collector/Nazul Adhikari,(Ranjhi) Jabalpur for requirment of “NOC” from land point of
view for providing bare minimum civic amenities that area of part of Khasra No.40,
main road Karondi Ranjhi Jabalpur Cantt.
The letter has placed on the table for consideration of the Board.
Resolution No. 12
Considered in detail. Shri Rajeev Yadav, Member of Ward No. 7 is of view that
the Board should have to forward a letter to Collector/Nazul Adhikari,(Ranjhi) Jabalpur
for seeking “NOC” from land point of view so that civic amenities on the part of Khasra
No.40, main road Karondi Ranjhi Jabalpur Cant. can be provided. But the PCB and all
the members have objected it and Vice President suggested that a combined proposal
from all the ward members be sent to competent authority /PDDE, CC regarding
providing NOC / permission to carry out basic civic works on B-3 or A-1 land.
13. Purchase of Steel Locker with Twelve Compartments through GeM
There are requirement to purchase 04 Nos of Steel Locker with Twelve
Compartments from Katanga School of Cantonment Board Jabalpur @ Rs. 29,500/-
each.
The comparative statement of GeM for the above mentioned item is attached with this report.
Board is requested to consider the matter. Relevant papers are placed on the
table.
Resolution No. 13
Considered and approved to purchase 04 numbers of Steel Locker with Twelve
compartments for Katanga School from the lowest supplier @ Rs. 29,500/- each, as per
comparative statement in GeM.
It was further resolved that if any requirement arise in future, the same shall also
be purchased through GeM at the same approved rate. CEO is authorized to incur the expenditure.

14. Purchase of Gym Fitness Equipment through GeM
There are requirement to purchase following gym fitness equipments for civil
public of Cantonment Board Jabalpur.
1. Back Extension Bench 02 Nos Rs. 19,200/- each 2. Viva Cable Cross Over It 01 No Rs. 89,950/- each
3. Recumbent Bike 01 No Rs. 97,000/- each
4. Multi Adjustable Bench 02 Nos Rs. 26,000/- each
5. Cosco Five Station Gym 07 Nos Rs. 55,000/- each
6. Multy Gym CHG 402 08 Nos Rs. 60,900/- each
7. Spin Bike 01 No Rs. 62,000/- each
8. Elliptical Cross Trainer 01 No Rs. 1,80,000/- each
The comparative statement of GeM for the above mentioned items are attached
with this report.
Board is requested to consider the matter. Relevant papers are placed on the table.
Resolution No. 14
Considered and approved to purchase required numbers of gym fitness
equipments as mentioned in Agenda side from the lowest suppliers at mentioned rates,
as per comparative statement in GeM.
It was further resolved that if any other requirement arise in future for the same,
the same shall also be purchased through GeM at the same approved rates. CEO is
authorized to incur the expenditure.
15. Purchasing of Dead Body Freezer Box
As per Member’s request, there is a requirement to procure Dead Body Freezer
Box. For which three quotations were called, out of which M/s Ashwika Enterprises,
Trimurti Nagar, Jabalpur has quoted the lowest rate of Rs. 92,460/- each (Tax extra).
Board is requested to consider purchase of 02 numbers of Dead Body Box from the
lowest firm.
In this regard certificate of Local Purchase Committee is placed before the table.
Resolution No. 15
Considered in detail. The Vice-President informed the Board that Jain Society of
Cantonment Board Jabalpur is ready to provide one Dead Body Freezer Box to
Cantonment Board Jabalpur, free of cost. Therefore it is resolved to purchase one
number of Dead Body Freezer Box from M/s Ashwika Enterprises, who has quoted the lowest rate of Rs. 92,460/- each (Tax extra). CEO is authorized to incur the
expenditure.

16. Supply of Water Supply Fittings

Fittings for Cantonment Board Jabalpur, published in Dainik Bhaskar, Nai Duniya,
Patrika and also uploaded on Central Public Procurement Portal as well as Board
website for wide publicity. Tender was opened on 01-02-2020 at 12.00 hrs, 04 tenders
were received and 03 were found eligible for opening of financial bid. Financial Bid
was opened on 04-02-2020 at 14:00 hrs.
Comparative statement along with report is placed on the table for consideration
of the Board. Resolution No. 16

water supply fittings items from the lowest tenderer at lowest rates as per comparative

22. Exemption of Poor Persons in paying property and other taxes
Ref. – Various representations received from elected Members, Vice-President
Cantonment Board Jabalpur, General Public and letter received from Shri Ashok
Ishwardas Rohani Member of State Legislative Assembly, Cantonment Jabalpur bearing
No. 5577 dated 23-01-2020.
Elected members, Vice President and Shri Ashok Ishwardas Rohani have submitted
letters under reference, for exemption; whole or part, in paying property and other taxes
to the Cantonment Board Jabalpur by poor persons, widow and any other suitable
category of general public.

It is specifically provided under section 113 of the Cantonment Act 2006 that the
Board may exempt poor persons in paying any portion of a tax. The verbatim of Section
113 of the Cantonment Act 2006 is as below-
“113- Exemption of Poor Persons- A Board may exempt, for a period not
exceeding one year at a time from the payment of any tax, or any portion of a
tax imposed under this Act, any person who in its opinion is by reason of
poverty unable to pay the same.”
The matter is placed before the Board for taking decision of issue of granting exemption
in view of abovementioned provision of law.
Resolution No. 22
Considered. It is resolved that exemption of property tax for one year 2019-
2020) only may be given to the poor persons on the condition that tax bill should be in
the name of the person and the person should have a BPL Card holder and should have
an authenticated ID proof. Revenue Supdt is authorized to process the cases for tax
exemption, after verifying the documents/correctness of claims.

Time Bound Advancement Scheme and Time Scale Pay to
Shri R.K. Patel, Compounder, Motilal Nehru Hospital, Jabalpur Cantt
To consider letter dated 19.11.2019 received from Shri. R.K. Patel, Compounder,
Motilal Nehru Hospital, Jabalpur Cantt regarding grant of revised Time Bound Advancement
Scheme and Time Scale Pay.
Earlier Shri R.K. Patel, Compounder was granted time bound of pay scale of Rs.
4000-100-6000 as per 5th Pay Commission after completing 24 years of service w.e.f.
28.10.2009. At that time, as per GO the time scale is as follow:-

Considered. PCB advised the Board that as the matter is very old and involves

24. Contract for Market Fees Collection (Teh Bazari).
Ref. E-Auction Tender Dated 09/01/2020.
Cantonment Board, Jabalpur invited E-auction for Transfer rights of collection of
Market fees (Teh Bazari) from different areas in Cantonment vide tender notice
no.6520/Tehbazari/RS/2020/1666 dated 09.01.2020 for the period of one year. E-
auction was published in daily newspapers ‘Patrika’ & ‘Haribhumi’ on 16.01.2020 and
uploaded on Cantonment Board website for wide publicity.
In response to the same only 03 tenders were received and on opening of this
financial bid on 05.02.2020 the comparative statement is as under:-

Considered and approved. It is resolved that the contract be given to Mother
Trading @ Rs. 9,58,500/- per annum for one year wef 06-02-2020 to 05-02-2021.
Further it is resolved that since the extension upto 31-01-2020 was given to Smt.
Shabnam Bano on the approved rate vide Circular Agenda No. 2 dated 30-11-2019 and
the new contract is awarded wef 06-02-2020, the collection for 05 days to be done from
the previous contractor i.e. Smt. Shabnam Banu.

25. Replacement of Ambassador Staff Car No. MP 20 CB 3324 and MP 20 CB
8867
One Ambassador Car having registration No. MP 20CB 3324 is attached with
PDDE, CC Office, Lucknow Cantt and one Ambassador Car having registration No.
MP 20 CB8867 is attached with Cantt Board Jabalpur. It is stated that since the
Hindustan Motors is wound up and problems of spares parts, timely servicing and
repairs of cars are being faced. Therefore Board is requested to consider to purchase 02
nos. of new Staff Cars from GeM to replace above referred two ambassador Cars.
Provision is made in 2019-20 (R) Budget.
The proforma invoice was taken from Maruti Suzuki India Ltd. for the model
Ciaz Delta SHVS (Petrol) (BS-VI) which is Rs. 7,98,199/- and the proforma invoice
was taken from Toyata Kirloskar Motor Pvt. Ltd. for the model Innova Crysta, Diesel
G Plus Package: 8 seater as per Govt. E-Marketplace (GeM) which is Rs. 14,24,809.98.

Resolution No. 25
Considered and recommended for sanction of PDDE, Central Command, out of
funds available with Board under A(4) head. It was further resolved that the Maruti
Suzuki Ciaz car will be replaced with Ambassador Car having registration No. MP
20CB 3324 attached with PDDE, CC Office, Lucknow Cantt and Innova Crysta will be
replaced with MP 20 CB8867 attached with Cantt Board Jabalpur.
26. Supply of Hygienic Chemicals on old approved tender rates
Due to urgency for the supply of Hygienic Chemicals Cantonment Board Office
had requested vide its letter No. 5/STRS/2020/1749 Dated 03/02/2020 to M/s Kanak
Caters and Event Organizer 188, Street No. 3/7 Sadar Bazar Jabalpur MP. to give his
consent to Supply Hygienic Chemicals on old approved tender rates.
Kanak Caters and Event Organizer vide its letter dated 05/02/2020 received on
same date gave his consent to supply Hygienic Chemicals on old approved tender rates.
The Board may consider to approve the same.

27. Considering Final Inquiry Report submitted by Inquiry Officer under Rule
12 (23) of the Cantonment Fund Servants Rules 1937 with respect to Mrs.
Charanpreet Khanna Revenue Superintendant

On ground of findings of detailed inquiry report submitted by the Inquiry
Committee constituted vide Reference No.1, the Cantonment Board Jabalpur being
Competent Authority under Rule 7 of the Cantonment Fund Servant Rules 1937
(hereinafter referred as CFSR) decided vide Reference No.2 to initiate departmental
disciplinary inquiry against Shri C K Kharate Cantonment Engineer Cantonment Board
Jabalpur and Mrs. Charanpreet Khanna Revenue Superintendant Cantonment Board
Jabalpur as well as appointed Col. Rajesh Kanojiya Adm. Commandant as Inquiry
Officer and Smt Saroj Vishvakarma Office Superintendant as Presenting Officer.
Subsequently the Board vide Reference No. 3 approved Charge sheets for both
employees and authorize the CEO to serve the Charge sheet to concerned charged
officials and after getting statement of defence, handover file containing Charge sheets
and statement of defence to Inquiry Officer for further inquiry.
In compliance of decision of the Board as mentioned above, the Inquiry Officer
concluded inquiry proceedings in accordance with procedure laid down under Rule 12
of the CFSR and thereafter vide letter dated 17-10-2019 intimated to serve copy of final
report (findings of the Inquiry Officer) to charged officials in compliance of Rule 12-A
(3) & (4) of the CFSR.
The Inquiry Officer, in its final report held both charged officials responsible for
committing serious errors on their own parts while discharging official duties as
mentioned in article of charges and recommended as follows-
“The Disciplinary Authority may choose to take suitable penalty and
corrective action against the abovementioned defaulters. The Board may issue
necessary directions to restrict these officials from performing
important/sensitive duties that may adversely affect the
financial/legal/administrative effectiveness of the Cantt Board.”
Mrs. Charanpreet Khanna has been served with final report of Inquiry officer on 7-
11-2019 in response of which Mrs. Charanpreet Khanna submitted her reply on 27-11-
2019.

The final report of inquiry office was placed before the Board in general meeting
held on 13-12-2019 for further considerations in respect of both charged officers as per
rule where the Board while passing resolution under reference 4 decided that reply of
Mrs. Charanpreet Khanna against findings of Inquiry Officer is under perusal hence the
matter for imposition of penalty against her will be placed in the next Board Meeting.
Complete Inquiry file with correspondence letters, final report of Inquiry Officer and
Reply of Mrs. Charanpreet Khanna is placed before the Board for consideration.
Resolution No. 27
Complete inquiry proceedings alongwith written statement of defence received
separately from each charged officials, documentary evidence and final report submitted
by Inquiry Officer in compliance of Rule 12(23) of the Cantonment Fund Servant Rules 1937 has been examined in detail and discussed the findings of Inquiry officer given
against Mrs. Charanpreet Khanna Revenue Supt.
The Inquiry Officer held in para 28 of the final report that Mrs. Charanpreet
Khanna committed act of negligence by not putting agenda regarding revision
(reduction) of amount of ‘Tehbazari’ (collection of damage charges on per day bases
from street venders) before the Board in any upcoming General meeting in compliance
of specific orders of the then CEO and also taking less amount of per day ‘Tehbazari’ in
place of approved rate of ‘Tehbazari’ while calculating base price for monthly rent of
each Gumtee.
Detailed reply submitted by Mrs. Charanpreet Khanna against findings of
Inquiry Officer (Final Report of Inquiry Officer) has been carefully examined by the
PCB and other members of the Board and discussed every aspect of reply. The Board is
agreed with the every finding of the Inquiry Officer against Mrs. Charanpreet Khanna
which is based on cogent documentary evidence and did not find any explanation of
Mrs. Charanpreet Khanna, substantive or well reasoned.
The inquiry officer in Appx ‘B’ of his fina0l report recommended the following
penalty and observations against Mrs. Charanpreet Khanna:-
(I) Mrs. Charanpreet Khanna, Jabalpur Cantonment Revenue Superintendant
is to be blamed for her failure to putup the agenda of reduced rent from
Rs.50/- per day to Rs. 30/- per day as directed by the CEO, for
consideration by the Board during the Cantt Board Meeting held on 08-
06-2017 and also in any subsequent Board Meetings thus leading to loss of enhanced revenue.
(II) The Disciplinary Authority may chose to take suitable penalty and
corrective actions against the defaulter (Mrs. Charanpreet Khanna). The
Board may issue necessary directions to restrict this official from
performing important/sensitive duties that may adversely affect the financial /legal/administrative effectiveness of the Cantt Board.

During the discussion regarding quantum of penalty against Mrs. Charanpreet Khanna, the CEO expressed his opinion that keeping in mind the past length of
unblemished services of Mrs. Charanpreet Khanna and non-imposition of any
departmental penalty specified under rule 11 of the CFSR 1937 during whole service
period.
After detailed discussion, the Board decided with majority to impose penalty of
reduction to a lower time scale on Smt Charanpreet Khanna, provided under Rule 11-
(2)(IV) of the CFSR 1937 with following directions;-
(I) Reduction to a lower stage in the time scale of pay shall remain
effective for further period of 01 year from today (II) During the effective period of penalty (effective for further period
of 01 year from today) the annual increment shall not be granted to
the employee but after expiry of penalty period (one year) the
employee shall be entitled to get benefit of current pay scale with
annual increment.
(III) The reduction in pay scale for period of 01 year will not have the
effect of postponing the future increment of her pay.
Looking into the second recommendation (clause (II) as above mentioned) of the
Inquiry Officer, Board further resolved that during the one year penalty period, the
Office Supdt shall supervise major financial decisions of Revenue Supdt Mrs
Charanpreet Khanna and shall also supervise all tender process of Revenue Dept.
It is also noted that the Hon’ble High Court of MP specifically ordered, vide final
order dated 05-09-2019 passed in WP 19212/18, to the Cantonment Board Jabalpur to
apprise frequent progress of the inquiry proceedings pending against Cantt Engineer and
Revenue Supdt to the Registrar, High Court of MP. Therefore, the CEO is advised
to apprise the decision of the Board to the Registrar, High Court of MP by filing
appropriate compliance report.
28. Noting of final order dated 10-01-2020 passed by the Hon’ble High Court of
MP in WP (PIL) No 10687/2019 involving issue of prohibiting uses of Shivaji
Ground for Non-Sport activities.

Surendra Yadav vs State of MP and others. In the subject PIL the Petitioner challenged uses of Shivaji Ground Sadar for
any non-sport activity by the Cantonment Board Jabalpur. The case was defended by Sr.
Standing Counsel of the Board Smt Indira Nair. After hearing detailed arguments from
both sides the Hon’ble High Court vide final order dated 10-01-2020 specifically
prohibited the Cantonment Board Jabalpur for using Shivaji Ground, Sadar for any non-
sport activity in future.
Complete case file along with Copy of final order dated 10-01-2020 is placed before the Board for noting.

Resolution No. 28 Considered and noted. It is further resolved that a legal opinion from Senior
Standing Counsel of the Board shall be obtained on issue whether it is suitable or not to
file a Review Petition with a request for seeking order regarding allotment of Shivaji
Ground for any non-sport activity for some limited period.
29. Noting of final order dated 30-01-2020 (common order) passed by the
Hon’ble High Court of MP in WP No 24192/2019, WP No 23659/2019 and
WP No 24012/2019 regarding issue of removal of shops from Pentinaka left
turn.
Ref. – Final Order dated 30-01-2020 passed in WP No 24192/2019, WP No
23659/2019 and WP No 24012/2019 . A WP (PIL) No 14855/2019 Satish Paroche Vs State of MP and other is
pending for seeking orders of removing encroachments from Left Turn towards YMCA
to Sadar Main Road at Pentinaka Squire. The Hon’ble High Court vide order dated 27-
09-2019 ordered to this office to take action for ensuring free flow of traffic from this
left turn and also to ensure vehicles will not be parked on Public Rod. In compliance of
court order the CEO issued notices to all shops situated at Pentinaka Left Turn under
section 257(2) of the Cantonment Act 2006 for removing shop (encroachment). Some of
the shop owners challenged the notice of removal of shop before the Hon’ble High
Court by filing Writ Petitions mentioned under references. All these case were defended
by Penal Advocate Vikram Singh on behalf of Board and the CEO. The Hon’ble Court
connected all these Writ Petitions due to involving common issue and on 30-01-2020
after hearing detailed arguments from both sides the Hon’ble High Court vide final
order dated 30-01-2020 disposed off all connected cases with common order.

31. Extension of Term of Office of Elected Members of Cantonment Boards-
Regarding
While ongoing proceedings of the Board, letter bearing No. 76/38/Ordinary
Election/C/DE/2019 dated 05-02-2020 regarding extension of Term of Office of Elected
Members of Cantonment Boards upto a period of six months beyond 10-02-2020 or till
the date of constitution of the Board, whichever is earlier, was received. The same is
put up before the Board for consideration.

32. At the end of the meeting, the following points have been raised by the
President and Member of Ward No. 7 Shri Rajeet Yadav respectively.
I. Drainage of Narmada Enclave, point raised by the PCB – CEO informed the
Board that the site be got inspected by the concerned Junior Engineer of Cantt Board
Jabalpur and one rep from the army unit and the report of the same shall be put up
before the Board on next meeting.
II. Repair of Kabristan Road, point raised by PCB – CEO informed the Board
that the concerned engineer shall be directed for inspecting the site and preparing
estimate for the same. The matter shall be put up before the Board in next meeting.
III. Repair of Cess Pool Emptier, point raised by Ward Member 7 – CEO
informed the Board that the cess pool emptier is very old and provision for purchasing
new Cess Pool Emptier shall be made in next Budget.
