Many thanks to our editorial and photographic contributors this month;Adrian Lee, Digby Stephenson and Andrea May. Editor’s LETTER

Copy DeadlineCopy deadline for any advertisement or editorial submission for the December issue of BN5 magazine is horribly early this month (sorry) - Friday 30 October. For editorial submissions email Emma Osman [email protected] or just call us for a chat on 01273 494002. You can catch up with the latest news and events at www.bn5magazine.co.uk

At the beginning of each month we send the new issue’s cover brief to Helen Boosey, the graphic designer who creates BN5 front covers for us. There’s always a certain amount of trepidation and excitement while we wait for the first proof. This month was no exception. The result was met with oohs and ahhs in the office - we voted the November 15 cover one of our very favourites.

It shows the brave and dashing WWI pilot FW Merriam, grandfather of Henfield resident Sylvia Macintosh, who kindly allowed us to select the image from the wonderful archive of photographs she owns. See Adrian Lee’s article on page 34, thank you Adrian for allowing us to publish.

November 15, issue number 112, is also a special one for me because I’ve been publishing BN5 for 10 years now. I started from my spare room with a small laptop and a crash-course (crash being the operative word) in publishing. It got me back to work after two children without the horrible commute to London. Those two boys are now 15 and 12 and there are six of us working on the two magazines in various capacities, part and full timers. We have a circulation of 7,500 and over 150 businesses advertising with us in the two publications.

So, a big thank you to the BN5 girls who are quite frankly, brilliant. They are funny, feisty, fabulous and fearless - and they need to be on deadline day! Zoe, Juthy, Sarah, Sue, Emily - thank you for your continued support. Here’s to another 10 years!?!

Best wishes

NEW HENFIELD NEIGHBOURHOOD PLAN CONSULTATIONFollowing the postponement of last month’s referendum due to concerns raised by some local residents, Henfield’s Neighbourhood Plan and supporting documents have now been published by Horsham District Council for a six-week consultation period from Friday 9 October until Friday 20 November 2015. The Neighbourhood Plan and supporting documents are published online at www.horsham.gov.uk/planningpolicy/planning-policy/neighbourhood-planning/current-neighbourhood-plan-consultations and reference copies are available in the Library and Parish Council Office. Changes to the documents published prior to the referendum have been highlighted in yellow. The key change is the movement of the SE Tyres site from Policy 2 (Housing Site Allocations) to Policy 3 (Mixed Use Site Allocations).Comments can be made by email to [email protected] or by post to: Neighbourhood Planning Officer, Horsham District Council, Parkside, Chart Way, Horsham RH12 1RL. You can also download a comments form from the above website. Following the consultation and consideration by the independent examiner, it is hoped to hold the referendum in February 2016. It is not thought that the postponement of the referendum will cause a significant delay to the adoption of the Plan. All postal votes for the postponed referendum will be confidentially destroyed. Everyone in Henfield Parish with a permanent postal vote will receive one automatically once the referendum is reorganised. Updates will be posted at www.horsham.gov.ukHenfield Parish Council

AIR CADETS MARK BATTLE OF BRITAIN 75TH ANNIVERSARY On Sunday 20 September the 1140 (Steyning) Air Cadets joined the Royal Air Forces Association, the British Legion, the Women’s Royal Voluntary Service and members of the public in commemorating 75 years since the Battle of Britain with a parade of the Squadron Banner through Steyning High Street followed by a Service at St Andrew’s Church. They also assisted RAFA members with collecting for the Wings Appeal in Steyning High Street on Saturday, collecting almost £250 in four hours!

This was just one of the busy weekends in September; the others were taken up with putting into practice camp craft skills learnt earlier in the year, a swimming competition and the Annual Wing Training Weekend held at Crowborough Camp. At the camp the cadets competed against the other Sussex Squadrons in events including: drill, band, first aid, aircraft recognition, target shooting, and raft building. They also took part in climbing, archery, clay pigeon shooting and orienteering. The Air Cadets parade on Tuesday and Thursday evenings at the Cadet Centre, Shooting Field from 7-9.30pm. All boys and girls from Years 8 upwards are welcome.

THANK YOU HENFIELDOnce again Henfield businesses excelled in their generosity at the recent memorial football match between Henfield and RSPCA teams. The raffle alone raised £411 and with the profit from the barbecue donated by Karen and Mia at the Plough, £581 was raised altogether. Our aim was £600 and the generosity of two of our friends who added to the fund meant we reached – and exceeded – this figure with £621 raised on the night. The money raised was split between the Henfield Football Club and the RSPCA. The RSPCA portion will go to the Lockwood Centre to provide equipment to rehabilitate rescued horses and donkeys. This was the 17th game played in our son’s memory and each year we continue to be amazed, delighted and very proud at how many people look forward to the evening and enjoy raising money to help these two good causes in the process. HENFIELD THEATRE COMPANY’S NEXT PRODUCTIONThe Henfield Theatre Company’s New Year Production will be Glyn Robbins’ play version of the C.S. Lewis classic ‘The Lion, the Witch and the Wardrobe’. The original story, published in 1950, records the adventures of four ordinary English children: Peter, Susan, Edmund, and Lucy Pevensie, who find themselves in the magical land of Narnia by way of a wardrobe that they stumble across in an old house. The play focuses on all of the most exciting and memorable parts of the book, with great dialogue that preserves the integrity of this magical tale. The production will thoroughly entertain all age groups and is certainly one not to be missed. ‘The Lion, the Witch and the Wardrobe’ will run from Thursday 7 to Saturday 9 January with evening performances each day and a matinee on the Saturday. The production is directed by Kevin Locke and sponsored by Miss Potts Pottery. Tickets will be on sale at Stevens Estate Agents from 1 December. More information will follow next month.Martin Love

If you would like to apply for funding, please do so in writing to Henfield Parish Council at the Henfield Hall, or email us at [email protected]. If possible, please include a copy of last year’s accounts and let us know what the grant will be used for. Council encourages local groups to apply. The closing date for applications is Friday 4 December.A further vacancy has arisen on Henfield Parish Council due to the resignation of Mr David Hodgkin. Our thanks go to David for his time spent working on Council and we hope that he will continue to let us have the benefit of his expertise as the village Tree Warden. The renovation of the football pitches on the Memorial Field has taken another step forward, as the topographical survey has now been carried out and the consultant will shortly submit his report to Sport England. It is anticipated that work will actually commence in spring 2016, but that the pitches will not then be available for football again

until the 2017/18 season, as the extent of the work being carried out will necessitate a long settling period. And finally a huge thank you to Tony Jackson for his efforts Chairing the Henfield Community Partnership (HCP) over the past 10 years, as he finally stepped down from the role in September. His accomplishments have been well documented elsewhere, but I will say that Henfield has benefitted greatly from his efforts! I know that we will continue to see Tony, as he concentrates his efforts now towards the development of the Henfield Haven. Welcome therefore to Carol Eastwood, who has taken over the role as Chair of the HCP. I look forward to working with Carol over the coming months.Kevin Wright

DEAR HENFIELD DOG OWNERS…This is a plea on behalf of Henfield Football Club to remind Henfield dog owners of the dangers of allowing your dog to foul on the sports pitches at The Kingsfield and The Rothery Field in particular. This has been an increasing problem over the last few months, with club coaches having to clear up before games can commence. There are adequate dog waste bins at both locations.A single gram of dog waste contains 23 million faecal bacteria and can cause blindness, kidney disorders and stomach disorders in humans, particularly children. Dog faeces can contain whipworms, hookworms, roundworms, tapeworms, parvo, salmonellosis and cryptosporidiosis to name but a few. So please bag it and bin it, don’t leave it to others or even worse, allow a child to become ill or permanently disabled.Simon Andrews.

WHY IS CHURCH LANE SO STEEP? Have you ever wondered why the gradient of Church Lane is so steep? Come to Church House on Church lane at 7.30pm on Wednesday 18 November and hear Bill Avenell, a specialist in Geography, give an informative, illustrated presentation. Commencing with a general appreciation of West Sussex, he will go on to cover farms, modern settlement, communication, housing and architectural styles and other issues concerning the environment. This event, promoted by The Friends of St Peter’s, comes at a fortuitous time, given the deferment of the Referendum on the Henfield Neighbourhood Plan when, before casting our vitally important votes, we will need to address such items of flooding, fracking, housing and planning. Tickets cost £8 (Members £7) and are available from Jasmines or from 01273 492294.Anthony Abbott

INTERNET FRAUD WARNINGWe received a call to the BN5 office from a local lady who was subject to a clever and complicated internet scam. She would like to warn others to be alert to the risks, and to highlight that the

scammers are getting more sophisticated and believable. The lady was sent an email with a link to update her computer to Windows 10. The email appeared to be genuine so she clicked on the link. It took her through a variety of options, and she requested ‘help and advice’ to download the update. The person she spoke to was confident, had prior knowledge of her details which gave credence to their story, and before too long they had gained access to her computer remotely. Before she knew it, her bank details appeared on the screen and she was being asked to pay a yearly ‘help-desk’ charge in dollars. Luckily no cash was removed from the account. If you have concerns about the validity of emails, do not download or click on links. You can get further help from members of the Henfield Computer Club, which takes place on a Wednesday, 10am-12 midday at Henfield Leisure Centre. Details can be found at www.bn5magazine.co.uk/clubs-and-groups/henfield-computer-club/ or by calling 01273 492620.Editor

One of the perks of having our office right in the centre of Henfield is that we are more involved in day-to-day village life. So when a truck emblazoned

with the St Barnabas House hospice logo drove into the Henfield Hall car park earlier this year and opened its doors, we immediately popped over to investigate. The truck opens up into a warm and welcoming display area and inside I found the wonderfully friendly Marcelle Palmer and Shaun Dicker from the St Barnabas House Hospice Outreach project. The principle aim of the project is to improve the way people access information and support related to end of life care. Marcelle, who is a fully qualified senior nurse, talked me through how it all works: “Basically our purpose is to take information and advice on life-limiting illnesses and end-of-life care out into communities. People can come and sit down in the warm and have a cup of tea and chat about anything that is worrying them.” The team are happy to talk about any aspect of life-limiting illnesses, from cancer to parkinsons, and dementia to heart disease, as well as end-of-life care and bereavement. Shaun, Project Support Worker, showed me the wealth of information they carry on-board about local and national support groups. For those who wish to talk in private, there is also a separate room that can be closed off. The specialist Outreach staff work closely with GPs and community health care teams to give advice and support in areas of symptom management as well as emotional, spiritual, psychological and bereavement support for patients, their families and significant others. “Our care professionals do fantastic work, but sometimes they assume

Reaching out to those in needthat someone else will tell a patient about relevant support groups and other sources of information” explained Marcelle: “People often come on-board a bit lost, overwhelmed and sometimes fearful. It’s very common for people dealing with life-limiting illnesses, including carers, to think that they should be able to manage on their own and they are often reluctant to ask for help. But after talking to us hopefully they leave feeling empowered and with a bit of hope.”The service launched 18 months ago and is still evolving: the team are still working out which locations work the best. As well as Henfield, the truck has regular visits to car parks outside libraries, hospitals, shopping centres, supermarkets and garden centres. “The St Barnabas House hospice is a well-known and trusted name across West

Sussex and the truck is very visible. People are inquisitive – they’ll often pop in just to find out what we’re all about.” said Marcelle. Another important part of the remit of the Outreach Service is to de-bunk the myths around dying and to encourage people to plan ahead: “We find that people find it really liberating to talk anonymously – they only have to share what they want to share” explained Shaun. “And there’s no time pressure, if people want to chat for an hour, they can chat for an hour.” There are many myths around hospice care and Marcelle, with her expertise in palliative care, is well qualified to talk about the reality: “Hospices are not just about the last few days of life, they can help both patients and their families throughout life-limiting illnesses. And we continue to help families after their loved one has died.”If people want to find out about how they can volunteer and help St Barnabas House hospice, then Marcelle and Shaun are more than happy to point them in the right direction. But as Marcelle explained, the Outreach service is not about fundraising: “We’re purely here to talk to people about their concerns and provide advice where we can and signpost people on to other organisations where appropriate. It’s fantastically satisfying to able to help people.”Sarah Butler

As the UK continues to commemorate the centenary of WWI, we were delighted when local resident Sylvia Macintosh contacted us to share her

grandfather’s memoirs and photographs with us: Frederick Warren Merriam, known simply as FW, was an aviation ace who played an crucial role in training British WWI pilots. The following is an edited version of an article written by Adrian Lee, which first appeared in The Express in July 2014.As the clock ticked down to the start of World War I the British air force was nothing short of a shambles. It was barely five years since the first aircraft flew across the Channel and aviation was still in its infancy. The latest bi-planes were cumbersome, desperately unreliable and prone to crashing. Although the Royal Flying Corps had been founded in 1912, military top brass doubted that aircraft would play any meaningful role in the looming conflict. The entire strength of our air force when war was declared was just 111 planes, along with a squadron of reconnaissance balloons, and the RFC was vastly outnumbered by its German equivalent. There was also a

shortage of skilled pilots because flying was considered a rather frivolous rich man’s hobby and few ordinary enthusiasts could afford the £75 licence fee.Into that background stepped a dashing aviator called Frederick Warren Merriam whose claim to fame was becoming the first pilot to fly through

FW Merriam - a magnificent man in his flying machine

the clouds. Merriam was a 34 year-old instructor at Brooklands Aerodrome in Surrey and was widely considered to be the nation’s finest aviator: in 1914 he was approached to lick novice fliers into shape. Ever since he was a very young boy Merriam’s ambition had been to fly. Before the war he’d competed in air races for prizes in a flimsy box-kite aircraft. On one occasion Merriam crash-landed upside down in a sewage farm and emerged unhurt but stinking from the wreckage. Many years later the incident would become an inspiration from a scene in the comedy film Those Magnificent Men in their Flying Machines. At the time flying was a perilous occupation. It was not uncommon for engines to become unattached and the pilots did not wear harnesses, so frequently fell from their aircraft. FW, clearly unimpressed by some of the aircraft in service, described one as “a flying death trap”.Merriam described how the pilots initially took to the skies carrying whatever weapons were to hand: “None of our machines were equipped with offensive weapons,” he wrote. “Everyone who could fly took off with a passenger armed with a rifle. I cannot resist a smile at the thought of our makeshift squadron with its rifles roaring into the air against the might of Germany.”By 1915 the government had no doubt about the important role of aircraft in the war and Merriam was receiving “shoals of pupils arriving weekly.” One of his students was Canadian Roy Brown who was credited with shooting down the Red Baron, Manfred von Richthofen.Despite his poor eyesight Merriam occasionally climbed into an aircraft to take on the ‘gas bags’ that were becoming a growing nighttime menace.

“We received instructions that if we were to encounter a Zeppelin and fail to destroy it with our rifles and hand grenades we were to ram it,” Merriam wrote. They were highly dangerous missions and, without any navigation devices, there were heavy British casualties.Eventually the warplanes were fitted with machine guns and that year one of his star pupils, flying in a tri-plane, encountered an entire German squadron and managed to bring down two enemies. Yet Merriam was always envious of the front-line pilots and was overjoyed when he was allowed to take part in anti-submarine patrols. In the autumn of 1917 he was flying over the North Sea when he spotted a U-Boat and dived in to attack, while priming his bombs by hand. Moments later FW was celebrating as his explosives hit the conning tower.Merriam took great pride in seeing the strides made by the young pilots. He wrote: “I experienced great satisfaction in seeing my fledglings soar and I could not help feeling that my work had been of some national importance.”

After the war Merriam continued to fly and opened his own gliding club on the Isle of Wight. He was working on his memoirs at the time of his death aged 76 in 1956 and his granddaughter, Sylvia, recently uncovered his notes. “In his retirement my grandfather spent a lot of time pottering round the garden, or working on his book, and never really spoke much about his war-time exploits” she explained. “I was more excited that he taught me to swim and it was only later when I became more interested in his background.”Adrian LeeMerriam’s memoirs and anecdotes from pilots he trained have been collated into a book ‘Echoes from Dawn Skies’ which will be published shortly.

Club chairman Digby Stephenson stated that Remembrance Day in Henfield has, over recent years, become an event that has drawn together

villagers and visitors from our surrounding area. Working closely with the Parish Council and three local Churches, the Club is proud of its contribution, and honoured to be the custodian of our War Memorials.Founded in 1919 as The Comrades of the Great War Club we are pleased to carry forward this tradition, and count the Royal British Legion as an integral part of our membership.Following the service at the War Memorial on November 8th the Club will be open to all attendees for light refreshments.

Friday 6th November at 11:306th Year children say a short eulogy and lay a poppy cross at each of the 11 service graves in the cemetery, followed by a single cross on the Memorial Wall to recognise all the fallen Henfield servicemen & women who are not buried in our cemetery. All welcome.Sunday 8th November09:15 Parade will rendezvous at the War Memorial outside ate Henfield Club and march to St Peter’s Church

Villagers are encouraged to come into the Henfield Club to view the newly created “Memorial Alcove”. This includes one of the 800,000 + poppy field that was so movingly created last year at the Tower of London. The Club’s most distant member, Squadron Leader Colin Rippey, RNZF (Retd) bought one of the poppies in memory of his grandfather.Sergeant Donald McLean, New Zealand 4th Auckland Regiment, who died 6th October 1917, Aged 23. He is buried in the New British Cemetery at Zonnebeke in Belgium. The poppy was sent to Colin’s home in Auckland, and last month it completed its world circumnavigation when he flew it back to the UK and presented it to Club Chairman Digby Stephenson.Digby Stephenson

In 2014 Henfield Birdwatch members started work on our 4th survey report . They recorded the birds in their gardens, made a note of other birds seen and

heard around the Parish (roving records) and our area surveyors completed their monthly survey walks in their various patches. During 2015 we have input the data and our area surveyors have written their reports. Members have provided their own photos, drawings and linoprints and the publication is ready to go. Our 2010 report won the Marsh Local Ornithology Award presented by The British Trust for Ornithology.

On 20th November we will publish the report and, to celebrate, we have a guest speaker at the Henfield Hall. He is Stephen Moss, a nationally acclaimed naturalist, writer and broadcaster who was the original producer of Springwatch. He is a great speaker and very entertaining. We’d love you to come along for a 7.30pm start. Admission is free for members and £3.00 for non-members.

Henfield Birdwatch 2015

In the huge willow tree next door, something large is flapping about and then cutting through the night air with a high-pitched, raucous squeak. A dark shape

swoops out gliding to rest on the neighbour’s roof. The creature is the tawny owl, its fat round shape silhouetted on the chimney like in a picture book. Autumn is here and the tawny owls will use their voices to the full to defend their territories. Quivering ‘hoo-hoos’ and rising ‘ker-wicks’ fill the dark garden and trees. The classic ‘Tu-whit’ ‘tu-whoo’ is female call and male response. The young owlets born in spring are now trying to take hold of their own patch. Their dappled fluffy bodies and round eyes, black as ebony, look almost cat-like. Sometimes the males fight over territories and can sound like a couple of brawling toms. The tawny owl is a nature success as there are around 50,000 breeding pairs in Britain. They make their homes in woodland, parks and towns in the holes of big trees and sometimes in old squirrel nests. Once a pair of owls has claimed their territory they may stay all their lives, catching

and eating frogs, small birds and mammals and worms. Tawny and little owls drop from trees, poles and roofs onto their prey, or like barn owls, glide low while hunting for rodents. The felling of large broad-leafed trees, rodent poison and cars are some of the dangers that our owls face. Now is a good chance to hear and see the nocturnal and vocal tawny owl. Take a walk down the rich wildlife corridor of the Downs Link, or onto the fields at dusk west of the village. I did going south of Hollands Lane and one flew silently, inches past my head, and perched low on a tree in front of me. It was thrilling to see the great round head turned easily 90-degrees left and how it settled itself on the branch rocking side-to-side. The bird looked west over fields, mixed hedges and trees down to the pastures around the River Adur and the Downs beyond. For small children frightened of the owl’s strange night sounds, read the gorgeously illustrated ‘Owl Babies’ by Martin Waddell and the eerie noises could become more familiar and friendly. As this is the November edition, the chances are when you are reading this that Christmas is only around seven

weeks away! If you’re like my wife, Annelise, you’ll probably have been thinking of and buying presents since Boxing Day last year. I on the other hand am confident I can sort everything out on the 23rd December – thank God for Amazon Prime! The old adage that “a puppy is for life, not just for Christmas” is as true as ever, however, there are still many 4 legged new additions to the family around the festive period. Even pet owners with the best intentions can get caught out, so I thought that it would be useful to put down a few words of advice if you are considering getting a new puppy. Unforeseen problems can occur with even the best bred dog, but making sure that your pup is as healthy as possible when he or she arrives will help avoid additional complications. I bought a second hand car last year, and on reflection, there are many parallels between buying a car and a pet. Granted, I’ve never come across a Labrador with a dipstick or heard of anyone test-driving a border terrier, but in terms of decision making prior to a purchase, there are definite similarities!

Do your research:Decide on what is the best breed for you! A 2-seater convertible may be great fun to drive, but isn’t much good for a family of four. Equally, don’t go buying a large breed dog if you don’t have the space outside or the time to walk it. Make sure that you have considered the requirements of your new addition and that you can accommodate them. It’s also advisable to research the breeder. If they are kennel Club registered, this provides a good degree of confidence that the

breeder is reputable. However, many respectable breeders are not Kennel Club Registered. If so, ask for a reference of someone else who has purchased a puppy from them – honest breeders will not have a problem with this.

Meet the vendor:Just as it is inadvisable to meet someone at some motorway services to test drive and buy a car, the same applies to purchasing a pet. Always make sure to go the breeder’s house and at least see the dam of the puppy. Even if the offer to “save you a journey” seems genuine, you should always endeavour to see the environment that your prospective pet has been brought up in.

Watch out for dealers:Unlike the world of cars, caution needs to be exercised when making a purchase from someone who buys puppies and sells them for a profit. Puppies can be born anywhere and sold more locally. Again, asking to see the dam of the puppy will confirm that the vendor did breed it. If the puppy has been vaccinated, it should have a vaccination card. Look at the address of the veterinary surgeon who administered the vaccines – if it is not local, the chances are that you are buying from a dealer.

Check the MOT certificate and service history: When buying a new set of wheels, you want to make that it has been well looked after and is running well. The same applies to a puppy! Ideally they will have been checked over by a veterinary surgeon and hopefully received a vaccination if they are old enough. Also check to see if they have been treated for fleas or worms and have documentation to support this. If your new pet has not been vet checked, then it is advisable to get them seen as soon as possible after you get them home to make sure there are no problems. In conclusion, the vast majority of dog breeders are genuine and take pride in producing healthy and lovable pups! The above advice is by no means exhaustive, but hopefully it will help to ensure that any prospective puppy owners can avoid additional pitfalls when they take on their new pet.

Pilates is a holistic exercise system designed to elongate, strengthen and restore the body balance; so much more than just building a ‘strong core’ or ‘perfect posture’. It uses whole body movement targeting specific muscle groups to re-educate movement patterns and rebalance the underlying muscular and structural systems in the body.

Pilates can facilitate profound changes in the body, when long-standing patterns shift, practitioners feel an increased sense of freedom in their bodies.Pilates apparatus utilises spring loaded resistance, gravity and movement to assist or challenge the body as required to perform the exercises.

Studio classes offer a high level of individual attention, working on your specific needs. Apparatus sessions are particularly helpful in rehabilitating injury, aiding with specialised conditions and reaching specific training goals. The support available from the apparatus facilitates the ability to target very specific muscle groups that can be difficult to identify without the apparatus feedback. Traditional studio apparatus are the Reformer, the Wunda Chair and the Ladder Barrel......” Since starting “one-to-one” Pilates with Bex in 2011 there has been a dramatic improvement in both strength and stability,

particularly in my areas of weakness, namely neck/shoulders and knees. I have been really surprised at the progress gradually made over the weeks, slowly building up resistance with very specifically targeted and subtle exercises which have proven to be amazingly effective. The results have far exceeded expectations and the constant neck and shoulder issues I was experiencing before have all but disappeared. I feel better than I have done for years, and there is still more we can work on. An added bonus is the greater u n d e r s t a n d i n g and awareness of my own body - a revelation!”

Christmas parties and giftsIf you are planning a Christmas party for your staff

– don’t let the taxman crush your festive spirits! Paul Samrah of Kingston Smith LLP advises how to

celebrate in style.A staff party, paid for by an employer, technically counts as a benefit in-kind on which employees are taxed. However there is an exemption that allows employers to host the event without it being treated as a taxable benefit – provided the cost per head is no more than £150. For the exemption to apply, the event must be generally open to all and not be exclusive to a particular group. However events based on separate working locations or departments of employees are allowed, if generally available to all employees within the location or department. Unless the principle of generality is achieved, then the full amount is taxable against the employees who attended. For example, an exclusively Directors event which excluded employees would not qualify for the exemption. Employers may organise more than one annual event and all such events may qualify for relief as long as the cost per head, in any one Tax Year, does not exceed £150 in aggregate. If say, two events are held, one costing £120 per head and the second £50 per head, in total you have breached the £150 limit. In this case, the whole of the first event will fall within the £150 exemption but none of the second. If only one event is held in the year and the sum spent is more than £150 per head, then the full amount spent will become liable to Income Tax and National Insurance (NI) for both staff and employer alike. It is taxed as a benefit, which could bring a nasty chill in the New Year. When planning your event and estimating the tax implications, remember that the price per head is calculated on the total number of attendees, that is all staff, their partners and any clients, and not just employees. Secondly, make sure you include all incidental costs. This means adding up not just the venue hire and catering costs but all the other things, such as entertainment fees, taxi fares, overnight accommodation and any VAT charged (regardless of whether or not

you are VAT registered). Divide the total cost of each function by the total number of people (including non-employees) who attend, in order to arrive at the cost per head. If an HMRC enquiry is launched, you will need to provide details of all the costs and attendees.Beware of trying to apply the HMRC’s concession to ordinary staff entertaining. You need to hold an event that is clearly a formally organised function. Some employers also make the mistake of charging the party to entertainment in the accounts, then forgetting that an event worth over £150 per head must be disclosed on the P11D. There are potentially harsh penalties for incorrect completion of the forms as well as Corporation Tax implications. It is worth remembering that although VAT on entertainment is not reclaimable, VAT on staff parties can be reclaimed, even if it exceeds £150 per head. This is an extra Christmas bonus not to be overlooked!Turning to gifts for staff from their employer – HMRC do accept nowadays that minor gifts may be provided tax-free for employees. There is no statutory de minimis limit, so care is needed. For instance an employer may provide employees with a seasonal gift, such as a turkey, a bottle of wine or a box of chocolates at Christmas. All of these gifts are considered to be trivial and are as such not taxable. Where there are a large number of employees, the total cost of providing a gift to each employee may be considerable, but where the gift to each employee is a trivial benefit, this principle applies regardless of the total cost to the employer and the number of employees concerned. If the gift extends beyond the trivial, for example from a bottle or two of wine to a case, from a turkey to a Christmas hamper, you should take advice as it is likely to be treated as a taxable benefit in kind. As a consequence, unless the cost is shown on the employee’s P11d (and the employee pays the tax accordingly) the employer will need to enter into a PAYE settlement agreement with HMRC. The employer will also have a Class 1A (or 1B) NI liability.

If the gift comprises non-cash vouchers, the Class 1A NI liability would transfer to a Class 1 NI liability, meaning both employees and employers would be liable. The cost to the employer of providing the vouchers would need to be added to the employee’s gross pay in the pay period that the vouchers were provided, to enable the calculation and deduction of Class 1 NI to be made.Cash presents, such as Christmas bonuses or vouchers redeemable for cash will require tax and NI contributions to be paid through the PAYE system. Finally, if you are considering making Christmas gifts to customers or clients, beware there is a £50 limit in any one Tax Year. The gift must be a business related gift, for example a calendar, clock or pen. It must clearly carry an advertisement for your business otherwise it will be classed as entertainment expenditure and will be disallowed.Enjoy the party!Paul Samrah
