Terms & Conditions The Isfand Yar Bukhari District Hospital of Primary & Secondary Healthcare Department (hereinafter referred to as “The Procuring Agency” or Client”) invites sealed bids from eligible and experienced income tax & sales tax registered firms / companies (hereinafter referred to as “Firm”) for the specified goods/Supplies as per Annex-A (hereinafter referred to as “Goods/Supplies”).

1) General Instruction toBidders:

1.1 Any offer not received as per terms & conditions of the tender enquiry is liable to be ignored. No offer shall be consideredif:

a) Received without bid security. b) It is received after the time and date fixed for its receipt. c) Not signed & stamped by authorized person on each page of tender document. d) The offer is ambiguous. e) The offer is received by fax ore-mail. f) The offer is from a black listed firm. g) Offer received with shorter validity than required. h) The offer is not conforming to specifications/TORs indicated in the tender

documents. i) The offer/quoted rates are furnished other than the tender document. j) Any additional terms & conditions added by the Firm. k) Any conditional offer.

1.2 Only Income & Sales tax registered firms / companies are eligible to participate in the tender.

1.3 Bid will remain valid for a period of 90 days from the date of opening the tender. No change in price will be made in case of Pak rupees variation against US$ and any other case as maybe.

1.4 The cover envelop must indicate particulars of tender and date of opening. The envelopes must be properly sealed.

1.5 The Firm must indicate their National Income Tax No. / Sales Tax No. / circle of Income Tax Department.

1.6 Offered rates will be on DDP (IBD Hospital Attock), as detailed atAnnex- A and shall be inclusive of all taxes.

1.7 Tender will be awarded by The Procuring Agency after the approval of Competent Authority i.e. Medical Superintendent of this Hospital.

2. TimePeriod:

The Firm will have to supply the items within immediate/24hour from the receipt of the purchase order.

3. Extension of Delivery period:

3.1 In special circumstances, request for extension of supply of items may be considered by the Competent Authority on the written request of the Firm before the target date of supply, which will be authorized to either accept or reject the request of Firm without assigning any reason.

4. Cancellation / Penalty of Delay:

4.1 Incase, Firm fails to execute the purchase order or work order in a ccordance with the terms & conditions laid down in the tender document, bid security will been-cashed

and penalty @ 0.5% per day will be levied. The goods supplied to Hospital, will be inspected by The Procuring Agency through an authorized personnel (Drug Inspector) and will be

rejected, if not found according to the given specifications as mentioned at Annex – A, And The Procuring Agency will not be responsible for any costs or expenses incurred by the Firm in connection with the supply of goods.

5. Payment to the Contractors:

5.1 Payment will be made through crossed cheque to the Firm against invoice after100% completion of supplies on requirement basis.No payment will be made as advance.

6. Bid Security:

6.1 Bid security of Rs. 600,000/- will have to be attached along with Financial Proposal. It should be in the form of Pay Order / Bank Draft / CDR from a scheduled bank in favor of The Procuring Agency.(MEDICAL SUPERINTENDENT ISFAND YAR BUKHARI

DISTRICT HOSPITALATTOCK) 6.2 Bid security of unsuccessful Firms shall be refunded on the finalization of the Tender

whereas the bid security of successful Firm shall be refunded after successful completion of contract period.

6.3 The bid security shall be forfeited if: a. The offer is withdrawn, amended orrevised. b. TheFirm fails to execute the contract strictly in accordance with terms and

conditions of tender document.

7. Deduction of Taxes:

All taxes (if applicable) will be deducted while making paymentas per Government Rules / Instructions/Notifications.

8. Dispute:

In case of any dispute before or after the execution of contract, matter will be resolved as per PPRARules 2014 amended till date.

9. Evaluation Criteria:

9.1 The applicant must be the owner of the Company /Firm.

9.2 Company/Firm Certificate of Registration (name of relevant registration entity

where the firm is legally registered).

9.3 NTN & Sales Tax registration certificates. 9.4 Valid Drug Sale License issued on Form 9.(Wholesale License is not acceptable) 9.5 Undertaking on Legal valid attested Stamp paper (PKR 100) that Firm has not any

litigation by any of provincial or federal government department, agency, organization or autonomous body or private sector organization anywhere in Pakistan.

9.6 Separate Stamp Paper (100RS) stating that the supplier /firm has never been declared as blacklisted by the Government.

9.7 Company profile with financial statements and previous business details of same contracts if any.

9.8 Pharmacy within 2 kilometer radius of Hospital. 9.9 Latest two year financial statements of Firm. (Or Bank statements)

Note: Responsive Bidders as per abov ementioned Evaluation Criteria will be awarded the tender with highest discount

offered rates on MRP. In case of Surgical & Disposable items whre MRP not mentioned on packing, the Phamacist of

the hospital determine the market prices for subject items. And same discount will be applicable on market assessed

prices by Pharmacist of IBD Hospital Attock.

10. Bid / Tender opening procedure:

As per PPRA Rules 2014, single stage two envelopes bidding procedure will be used for procurement as the bid will be single package consisting of two separate envelopes, containing separately the financial and the technical proposals.

11. Other terms & conditions

11.1 The Firm shall provide rates inclusive of all governmental taxes and delivery of both services and goods will be the responsibility of the firm at Isfand Yar Bukhari District HospitalAttock.

12. Special terms & Conditions

12.1 Local Purchase Contractor will be entered through Open Competitive bidding as per PPRA Rule 2014 amended tilldate.

12.2 Reference trend list is attached in Annexure B for bidder’s information 12.3 Bid security in form of CDR worth of PKR 600,000/- must be attached with

financial bid while successful bidder have to submit performance security 8% of contract value separately.

12.4 The local Purchase contract will be non-transferable and no part of contract will be sublet by the successful bidder without the approval of competent authority.

12.5 Separate rates must be mentioned for drugs manufactured by, “National Firms”, “Multinational Firms” and “Surgical Disposable items (Either local or Multinational)” bidders with highest discount offered rates of eachcategory shall be contracted for duration of 1 financial year(I.e 2020-2021)

12.6 The Contractor shall supply all medicines as per drug Act 1976/DRAP Act 2012 and Rules frame there under.

12.7 Discount will be calculated on Maximum Retail Price fixed by DRAP (Drug Regulatory ofPakistan). If MRP is not mentioned on any surgical or disposable item, the market average price will be considered the MRP. ( The market average price will be taken by Hospital Pharmacist from three different pharmacies other than the contractor )

12.8 Purchase Order may be emailed to LP supplier through LP Portal.Contractor will submit the bill with supply on daily basis.

12.9 Local Purchase will be of two types. (I)Bulk Local Purchase.(II)Specific Patient Local Purchase.

12.10 Supplies will be received through In-charge Hospital Pharmacist / Medical Superintendent with same brand mentioned in Purchase Order with Batch Number and Expiry which will be mentioned in GRN (Good Receipt Number).

12.11 Contract may be signed with Pharmacy License Holder on Form 9 through tender advertisement and as per PPRA rule2014.

12.12 Supplier must have to supply the medicines approved by Punjab Medicines Formulary list attached in Annexure C, the supplies must be of the same brand mentioned in the Bill/Invoice as submitted by the supplier.

12.13 Supplies provided other than the approved list of PMF (Punjab Medicines Formulary) supplier will have to pay for the fee of DTL (Drug Testing Laboratory) of medicines, moreover any payment in-respect of these items (out- side Formulary) shall be made after clearance of DTL report.

12.14 In case the supplier/Contractor failed to supply the orders on same day of Purchase Orders, the competent authority may purchase the same ordered medicines from market on the risk and cost of thecontractor.

12.15 The Competent Authority reserves the right to reject / accept any or all tenders without assigning any reason and authority’s decision will be final in case of any

dispute as the case maybe.

12.16 All medicines being supplied must be defaced “GOVERNMENT PROPERTY NOT FOR SALE” by the suppliers.

12.17 In-case of LP bulk purchase shelf life of medicines must not be less than 85% of expiry date.

12.18 Pharmacy must be within 2 kilometers radius of IBD Hospital Attock.

Preface

In current era, Punjab Government paid huge attention for

development and upgradation of healthcare facilities in

Punjab, particularly, Drug Control has been revolutionized.

Chief Drug Controller (CDC) Punjab, Provincial Quality Control

Board (PQCB), Drug Testing Laboratories (DTLs) Punjab and

Hospitals under administrative control of Primary and

Secondary Healthcare Department (P&SHD), Govt. of the

Punjab has been enriched with human resource, capacity

building and infra-structure has been upgraded. Provincial

Drug Control Unit (PDCU) has been established to work as

lynchpin among various units and to effectively address

various vital components of drug control regimen and

pharmacy services in particular. PDCU is addressing Licensing

& Registration, current good manufacturing practices (cGMP)

and Pharmacy Services in Punjab. New and strict laws have

been introduced to curb the curse of spurious drugs from

province. Chief Minister Punjab adopted zero-tolerance policy

against menace of spurious drugs. In line with vision of CM

Punjab, Department took initiative to prepare Punjab

Medicine Formulary (PMF) including quality drugs/Brands to

ensure provision of high quality drugs in health facilities of

Punjab. PMF is the first initiative of its type in Punjab by

Provincial Drug Control Unit (PDCU) under the instructions of

Secretary Health. Secretary Health notified a committee for

development of rationale/inclusion-exclusion criteria.

Additional Secretary (Drug Control), Primary and Secondary

Healthcare Department (P&SHD), Govt. of the Punjab is the

Chairman of Punjab Medicine Formulary Committee (PMFC).

Preface

The idea of PMF was materialized by Pharmacy &

Pharmacovigilance Wing under the supervision of Additional

Secretary Drug Control. He personally contributed to design

and develop PMF out of his precious and busy schedule. The

information and data included is collected from reliable

national and international literature and database. All the

information included in PMF is vigilantly collected from official

and non-official literature, professional and regulatory bodies.

PMFC has reviewed and approved the drugs and relevant

Brands included in PMF. PMF aims to provide quick

information and guide for selection, prescribing, posology,

administration and monitoring of drugs specifically used in

P&SHD Health Facilities (HF) working under administrative

control of the Government of the Punjab. Core list of PMF is

primarily recommended for Local Purchase of drugs/Brands in

Primary & Secondary Healthcare Facilities in Punjab. Anyhow,

PMF may be equally useful for various healthcare providers

like; pharmacists, physicians and nurses. Healthcare providers

may use the information in PMF in their daily clinical practice.

Efforts are being continued to make it a useful manual.

However, suggestions/critics to improve the contents to make

PMF more beneficial are welcomed and may be shared at
