Mary Louise is correct! The 1992 Agreement may be misleading to the uninitiated. Clearly, residential units can be built on the property.

However, I'm also reasonably certain that TM has already done their "GO", "NO-GO" preliminary land-use review. When a seasoned, knowledgeable, and profitable homebuilder is prepared to pay nearly $400K per acre (land, demolition, planning, engineering, etc included), it is more than likely that they are thinking about 30+ homes at a gross density of approx 3/ac .. A creatively "clustered" single family development, with some remaining open space (maybe a neighborhood park) would not be unreasonable. There are many examples of such developments existing throughout the County that have been approved (most of them, unanimously, by the Board of County Commissioners) within the last fifteen years. It will not negatively affect the value of our existing homes, and the Florida Statutes do not impose any restrictions that the new development must become members of an existing neighborhood HOA organization. They have the right to create their own. Our CC&Rs would likely be viewed as archaic and unfriendly.

The subject of taking advantage of the zoning ofthe 11.34 acres as a replacement of the sports center into a residential development of some sort isnot what the 1992 agreement covers - you would have to go back to the original and the revisedzoning development in 197 4 - and the subsequent revisions of the comprehensive plans of Sarasotacounty to really grasp what the potential is of the 11.34 acres if it were not a sports facility. soon so that any oral representations made at the upcoming meeting are not later construed as consent from the HOA to
