Introduction
Application Item 1
In addition to any other applicable tariff, the prices, charges and rules of this Tariff apply, as amended from time to time, to or from
facilities served by Canadian Pacific (CP). Prices in this Tariff apply as published at the time the service was rendered or the event
occurs, in the currency of the country in which the service or event occurs, unless otherwise specified. The connecting railway is
responsible to collect switching fees and pay CP for switching provided under this Tariff. For notifications of updates to this Tariff,
subscribe using CP Customer Station.
Definitions Item 2
closed customer any CP-served customer or facility in the United States not listed in this Tariff
connecting railway the railway sending railcars to, or receiving railcars from CP for the purpose of switching
intermediate carrier a railway that physically facilitates the interchange of railcars between two other railways
interswitching the non-linehaul movement of a railcar in Canada between an applicable rail-served facility and a
switching interchange; regulated by the Canada Transportation Agency
linehaul movement on CP a revenue shipment for CP, with CP appearing in the route [e.g. CPRS-CHGO-XX]; ‘revenue’
refers to freight charges and does not include switching or accessorial amounts
reciprocal switching the non-linehaul movement of a railcar in the United States between an applicable rail-served
facility and the switching interchange
switching refers to both interswitching [Canada] and reciprocal switching [United States]
switching interchange the closest physical location to an applicable rail-served facility at which CP and the connecting
railway can exchange railcars, unless otherwise agreed
TIH/PIH commodities has the same meaning as defined in Tariff 8
What’s included Item 3
Switch fees in this Tariff include the core Rail Direct service elements described in Tariff 1 Item 25 (except linehaul movement from
origin to destination) and are based on the two-way movement of a loaded railcar in one direction and the same railcar empty in return
(or vice versa).
Switch movements are subject to the terms, conditions and rates published in Tariffs 1-10, with any applicable fees assessed to the
connecting railway. Some examples include:
Asset use under Tariff 2 Items 10-15
Intra-terminal switching under Tariff 2 Item 23 for railcars ordered but not used, which applies to empty railcars that are:
o received by CP under switching for loading and are returned by the customer to CP empty
o provided by CP to a connecting railway under switching for loading and are returned to CP empty

Interchange errors Item 10 Railcars received by CP at interchange must be safe to travel, properly loaded and ready to move. Full shipping instructions must have
been received by CP at or prior to the time of interchange delivery. Railcars must be delivered to the interchange indicated on the bill of
lading for linehaul movement, or to the switching interchange for interswitching or reciprocal switching.

Interchange error Item 11
This fee will be assessed to the connecting railway when a railcar is offered to CP:
that is unsafe or improperly loaded
that is an empty railcar unsuitable for loading
without full shipping instructions
at a location other than nearest interchange to the customer, unless otherwise agreed in advance
in error, requiring CP to forward the railcar to the correct railway
that is not completely ready to continue moving, accessible or not intended to move on CP
Interswitching in Canada Item 20 The rules and pricing for interswitching in Canada are regulated by the Canadian Transportation Agency [https://www.otc-
cta.gc.ca/eng/home] and found in the Canadian Transportation Act [https://laws-lois.justice.gc.ca/eng/regulations/sor-88-41/].
Interswitching does not apply to facilities owned by CP, except as noted below:

Reciprocal switching in the United States Item 30
Application
The customers and facilities listed in this tariff are open to reciprocal switching for railcars, subject to the noted restrictions. For
customers not listed, a linehaul movement on CP is required to access. Reciprocal switch fees are assessed to the connecting railway.
The prices and terms of reciprocal switching do not apply to the shipment types listed below. Such shipments require a full bill of lading
[EDI 404, EDI 417 or billing through CP Customer Station] showing CPRS in the linehaul route:
Dimensional loads [loads that exceed the length or width of the railcar and/or exceed 17’ 00” in height above top of rail]
TIH/PIH commodities [defined in Tariff 8 Item 2]
Reciprocal switching performed for CP
When CP delivers a railcar to a connecting railway for reciprocal switching, CP will pay the applicable tariff or contractually-agreed
switch fee to that railway. If the switch fee is higher than the amount provisioned in the freight publication under which the CP linehaul
was performed, CP may invoice the difference to the payer of freight for that shipment [e.g. the freight contract includes “switching up to
$300” and the actual switch fee is $500… therefore the difference is $200]. Where the freight publication is silent on the switch fee
amount included in the freight rate, CP will absorb the switch fee.
Non-absorption of intermediate carrier switch fee
Except as otherwise agreed, switch fees assessed by an intermediate carrier between CP and a connecting railway apply in addition to
CP reciprocal switch fees [e.g. switch fees for BRC and IHB as intermediate carriers between CP and connecting railways in Chicago].
