Okay. Hi, everyone. Thanks for coming. I'm

Sue Pastor. I'm with the U.S. EPA. I'm the

Community Involvement Coordinator for the

Pines Project.

On my right you may see some familiar faces.

We have Jacob Hassan. He's the On-Scene

Coordinator; that's his title, and he's in charge

of overseeing the soil cleanup.

And next to him is Erik Hardin. He's a

familiar face to some of you. He is overseeing

the groundwater investigation that's going on

here.

Let's see -- Oh, Doug Petroff, from IDEM.

And he's our colleague and he works closely with

Erik on the groundwater project.

So, thanks for coming. I just wanted to

point out a couple of things to you, a couple

reminders. We're going to go over just briefly

what's going on with the soil and the groundwater.

So, some of you picked up the agenda, because

that's the plan that we're going to follow and try

to use our time wisely and get everybody out of

here in a decedent time. So, we're going to have

a couple of short presentations; Jacob first, Erik

next. So, please bear with us. And then we'll

have plenty of time to answer your questions. And

then hopefully we can wrap up and move our way out

of here somewhere near nine o'clock.

If we haven't answered all your questions or

you still wanted to talk to somebody, we can

probably hang around and chat with you one on one

if you need that.

Also, way in the back is Angie from NIPSCO.

And after you hear the presentations and have your

questions answered and you think you might need to

have your soil sampled, we can have Angie take

care of you on your way out. So, before we part

ways, do check in with her and she'll take your

information and have someone follow up with you on

the soil sampling.

pertaining to this project. So, if you really get

into this and you'd like to read up more, they're

court reporter. I just have a court reporter here

because I thought it would be a good idea to have

really good notes taken from tonight's meeting.

And she will do her best to make sure that we have

that. So, when you do come up and speak later on,

if you have a question, she would appreciate it if

in. That's just so that we can make sure that our

Okay. Lights. We will go right into the

slides. I have a couple, and then Jacob will

follow. Those are two of them. I don't think we

need it that dark. Somewhere -- All right.

So, Town of Pines Soil/Groundwater

Investigation. If you're just a guest at the

hotel, and you don't really belong here, now would

be a good time to exit. We did try to pull in a

few guests here and they said, we think you

weren't really here for us.

We are here tonight to give you an update on

EPA's residential property cleanup, as well as our

ongoing groundwater investigation, and also

provide you with an opportunity to ask questions.

Simple enough. So, we have a few ground rules.

If you would just please hold your questions until

the end of the presentations; bear with us. It's

going to be short. Jacob and Erik don't have a

whole lot of slides; they don't have a whole lot

to say; they're going to be brief, and then

they'll take the time they need to answer your

questions. And, at the point where we do have the

Q-and-A portion of the meeting, please only ask

one question. So, we will go around the room

again if we need to, and if we have time we'll

stay as long was we need to. But just to make

sure that everybody gets at least a chance to ask

one question, we will start with that and as time

permits we will go on.

So, we asked that you sign in and take a

number, just to keep some order to that. And if

you haven't done that, we can still add you to the

list. And, again, state and spell your name for

the court reporter, I think she would like that.

So, if we could all agree on that, then I will

turn it over to Jacob. Next slide.

MR. HASSAN: Thanks, Sue. Is this good for

everyone? Can you hear me well back there? Okay.

Like Sue said, my name is Jacob Hassan; I'm the

on-scene coordinator with U.S. EPA, and I will be

overseeing the residential soil removal, Town of

Pines. Just a few things I wanted to cover just

briefly, information, provide you a background

summary of how we got to where we are at today

with residential soil sampling and cleanup portion

of the ground -- ground -- Town of Pines

groundwater plume site; talk about the sampling

that's been ongoing over the last several months;

and then, for -- I guess give you a general

overview how the residential soil cleanup will

work, once those start to take action, and then

provide you some next steps that EPA will be doing

over the next several weeks to get this project

moving.

Next slide, please. So, a quick background.

November, 2014, NIPSCO and their contractor, at

the direction of the EPA and in consultation with

the Town of Pines, went out and did radiation

surveys on 48 properties. Taking that information

from those radiation surveys from those

properties, we were able to identify nine

properties that suspected of having large coal ash

deposits on them. EPA got the sample results from

those soil sampling efforts. They were evaluated

with our radiation expert from EPA, and with our

health experts from the Agency For Toxic

Substances Disease Registry. And evaluating that

data and determined that the radiation is not an

issue in the Town of Pines; however, those sample

results did indicate elevated arsenic and thallium

levels on seven of those nine properties, which

prompted the need for additional residential soil

sampling.

Next slide. So, over the last several months

there were two major sampling events that occurred

in the Town of Pines to sample residential

properties; one was in May, and one was in July.

And, as of today, there's been over 70 properties

have been investigated and sampled. But EPA would

like to sample more properties; so, if you're in

the Town of Pines, and we'd like to get your

information so that you can put that on -- and

hopefully get out there and sample the property,

relatively soon.

So, one thing that I did want to note to

everyone, that the sampling is not going to be at

any cost to the residents, the cleanup will not be

at the cost of the residents. NIPSCO will be

paying for the sampling, as well as the cleanup

portion of it.

So, for the residents that have had their

property sampled over the last several months, the

sample results have just recently come in, and

notifications will be going out to those residents

over the next couple weeks. And I believe some of

those notifications have already gone out this

week. So, you may have already received a letter

in the mail from NIPSCO with your sample results.

Next slide, please. So, this is an example

of what the soil sampling may look like. So, what

you have here in this picture is, this is what we

call geo-probe; the gentleman is pushing the tube

into the ground. And in the bottom of the tan

corner it pulled up a sleeve of soil. And what

happens is that soil from those sleeves are mixed

together; there's several samples taken on the

property. They're mixed together. And they're

sent to a lab for analysis, and the results of

those samples will come back and be evaluated by

EPA, and those results will tell us whether the

property needs a clean-up or not.

Next slide, please. So, if you have a

property that's been identified as needing

cleanup, this is the general outline of how this

process will work. So, NIPSCO will come to you,

and they will ask for access to the property, to

gain access so they can begin the work. Once they

have access, they will do a preconstruction

meeting with you; they'll do a walk-around the

property, and discuss the general processes as to

how the construction will work. They'll address

the questions and concerns you may have, as

associated with cleanup. And once the resident's

okay with the preconstruction meeting, they'll

begin the utility survey components. So, they

will survey your property for water lines, they

will survey them for electric, gas so that none of

those utilities are impacted during the cleanup.

And then they'll schedule the cleanup with you so

that you know when they'll -- when they're

planning on being out there at your property, and

you can plan for that.

So, once it's scheduled and that day shows

up, they'll move in a bunch of heavy equipment and

bring in some air monitors and they will start

removing soil.

Once the cleanup is completed, they will

backfill with clean material back to its original

grade and then they will landscape and restore the

property to its original condition, so it looks

like no work was ever done on the property. Or,

at least to the best of their ability that no work

has been done on that property.

Once the landscape restoration's completed,

they do a final walkthrough with you to make sure

that the restoration is done, has been completed.

Next slide. So, here's what the air sampling

may look like. I don't know if you can see it

very well. I'll point to it real quickly --

MS. PASTOR: You have got a pointer over

there.

MR. HASSAN: I'm sorry. So, as you can see,

this is a mini excavator; this is a picture from

another residential soil removal, back here in the

background is a tripod where the air monitors sit

along the perimeter of the property to make sure

that dust and metals associated with the coal ash

is not impacting the surrounding community. And

you get a closeup of what that looks like; this is

the air filter. This -- this is what gets sent in

for analytical -- to test for metals. And down

here is, what we call, all a -- a air monitor.

So, that monitors for dust on the perimeter of the

property.

Next slide. So, once the equipment's on

site, they'll clear the property; they'll -- or

actual excavation, and what will happen is, they

bring in most likely a mini excavator to start

filling back layers of the soil, and they will dig

until the property is clean, to about three feet.

And then, if there is material that happens to be

left behind, they will put it in a protective or a

demarcation barrier, and that barrier will be put

over that material, and then backfilled with clean

material.

Next slide -- Sorry. Backfilled with clean

material back to its original grade, as you can

see here, with clean soil. The next slide. And

then they will landscape it back to the property's

original condition.

Next slide. So, some things you may

experience over the next several months,

especially during this project, there may be some

road closure or detour due to heavy equipment in

the community. It's not planned to be a lot of

that, but there may be some occasions where they

may need to have a lane closed for the excavator

work or for other reasons. But it's not

anticipated to be a lot of those. Obviously,

there will be a lot of construction equipment and

air monitors on site. Right now the tentative

working schedule for the cleanups will be from

7:00 a.m. to 5:00 p.m., and that will be in

consultation, obviously, with the resident to make

sure that it is workable for them and their work

schedule.

And then, the long-term goal of this project

for cleanup all the properties may take up to a

year, but individual properties may take a couple

weeks up to a month to do the actual cleanup, and

repair the project of the properties -- Excuse me.

Next slide, please. So, over the next

several weeks this is what EPA will be working on.

We'd like to do more sampling for residents in the

Town of Pines, who would like to have their

property sampled. And the EPA will have a

presence to be on site to make sure that that's

sampling done properly. EPA is working to

finalize the legal agreement with NIPSCO, which is

being very close to being done. We're going to

work on that issue and make sure it is completed.

And once that is completed, a work plan will be

approved by EPA, which will outline the general

constructs of the work that will be done on these

properties. And once that work starts, EPA will

be on site or an EPA contractor will be on site to

make sure that NIPSCO is following the work plan,

and the property is being cleaned up accordingly.

And, throughout this process, EPA will be

providing progress reports. They will be

available on the EPA Web site so that you can, if

you're interesting in seeing the progress on how

the cleanup is going, you can go into the Web site

and access those reports.

So, here's my contact information, so if

concerns that you'd like to discuss that are

related to soil cleanup portion, please feel free

try to get back to you as soon as I can. And

travel here and there, but I will be responsive,

if possible, so . . . I'll hand it over to Erik

next.

MR. HARDIN: Thanks, Jacob. I'll try to

speak up and keep this away. That is, kind of

feedback is annoying.

My name is Erik Hardin; I am the project

manager. And I am overseeing the whole site. So,

the groundwater is a big part of it. The soil

portion, Jacob will be working on until the

removal is done. But then, once he goes away, I'm

still here. So, I'm going to give you a brief

rundown of what's going on with the groundwater

investigation. First, I want to make sure

everyone knows what groundwater is. This is the

water where you -- where you would get, where

someone would have a well. It's -- When it rains,

the water rains or snow water goes down into the

soil and keeps going down until it hits something

that stops it. And in this case, we have, you

know, a layer of topsoil and then it's pretty much

sand, and then it reaches a layer of clay,

depending on where you are, it's, you know, 25,

50 feet down, is that clay layer, and the water

just kind of sits on top of there, and sits on top

of there and pools, and we call that an aquifer

where that is pooled up.

So -- so, the investigation began, in the

early 2000s, some residents were complaining about

the taste of their well water, and IDEM got

involved; began investigating; they took some

samples of well water, and found some

contamination that they felt was related to the

coal ash in the Yard 520 Landfill. And that

landfill, I think most of you probably know, but

it's the landfill, if you -- just south of the

intersection there of short, little Highway 520

and Highway 20; looks like a grassy knoll now.

UNIDENTIFIED SPEAKER: Why are you telling us

this? We all know this.

MR. HARDIN: Because I'm giving a brief

summary and then we will open it up for questions.

I need to run down this real quick. It will just

take a couple of minutes here.

MR. HARDIN: Next. So, after finding those

contaminants, they requested our assistance. The

first -- first thing that EPA did, they came to a

legal agreement with the companies to extend

municipal water from Michigan City to most of the

town, and the other important thing that happened

with regard to groundwater -- And this actually

started before IDEM even got involved -- they

began closing the Yard 520 Landfill and that is

now -- That closure was completed in the

mid-2000s, and it's -- The closure is essentially

it's -- it's two and-a-half feet of compacted clay

on top of that. The clay is actually smashed down

to try and keep water from going down into it,

and, you know, going into the coal ash.

Next slide. So, then, the investigation has

been going on for a while now, and where things

stand right now: The range of, what we'd call,

impacted groundwater, the range of where we see

the coal ash-related contamination is very limited

now to an area near the landfill itself. And it's

not a place where there are any drinking water

wells.

Next slide, I'll show a little bit more. So,

we have the landfill. This is the portion of the

landfill. I don't want to block the view here.

This is the portion of the landfill that's of

concern here, and there's a couple -- there are a

couple wells up here, just over Highway 20, just

on the other side of 20. And then a well over

here in the wetland area, undeveloped wetland

area, that have levels we would consider unsafe of

coal ash-related contamination.

Next slide. So, the next steps, the final

report in the investigation is called a

Feasibility Study Report. I just submitted

comments, IDEM and I just considered -- or,

submitted comments, and we are hopeful that the

next version of this Feasibility Study Report will

be -- will be able to approve as final, and I will

use that Feasibility Study Report to develop a

cleanup plan; we call it a Proposed Plan. And

that goes out for public comment. And the

Feasibility Study Report, once it's final, will

also be a public document, available for review.

We review those comments; consider them, and

then from that issue a final cleanup decision --

it's in a document called a "Record of Decision",

or ROD. And then after the ROD is issued,

construction of the selected cleanup remedy will

be implemented.

And then, uhm -- So, one thing I want to say

about the remedy, of course, until the Feasibility

Study Report is completed, and the public -- or,

the proposed plan is out, I can't say for sure

what it is that we will select, but one thing that

I want to make sure I mention is, any remedy that

we select will involve monitoring. Continuous

monitoring. To make sure that the situation, that

the contamination isn't spreading.

There's my contact information. I also have

cards if anybody wants one. Okay. And then there

-- One other thing I wanted to mention.

Hopefully, soon we'll have somebody from the

county health here. She had a conflicting

meeting. But what we're finding -- What we're

seeing with these groundwater results is that coal

ash is not likely the only source of groundwater

problems in the area. And the only thing that I'm

tasked with, and also legally allowed to deal with

is the coal ash-related contamination. Now, that

being said, that's why I wanted to have county

health here; I want to have somebody here to talk

with you about your specific groundwater, if

indeed you still have a well, and see if any of

those other issues can -- that they can help you

with those other issues.

The next slide should be the county health.

The number for the Porter County Health

Department. And the person that's coming here is

Kelly Cadwell, she is the Director of

Environmental Health. Hopefully, she'll get here.

And with that, we will open the floor up for

questions. And Sue will moderate that.

wondering why it's elective or selective, how we

get our property tested. Because, as far as I

know, you've got the magic map, which goes maybe a

mile and-a-half to the east, a mile and-a-half to

the south, but I'm 3,000 yards to the west, and

I'm outside of your spectrum. And they refuse to

come in and test my property.

MR. HARDIN: Are you talking about soil or

groundwater?

MR. BOYCE: Take your choice. What can you

do for me?

MR. HASSAN: I can address the soil. So, I

can address the soil portion of that. Like I

said, if you're interested in having your soil --

I'm sorry -- If you're interested in having your

soil sampled, absolutely, we can put your name on

the list; we will. Angie, in the back, will be

glad to take your contact information, and put

your name on the list for sampling for the next

round.

MR. BOYCE: Sure, you know. As far as the

water goes, it's hard to find anybody in the

immediate area that can test the water properly.

And because you people have decided that you know

best how far this all goes, you know, we have no

choice. You know, on your sheets it says, "Town

of Pines," but it's selective Town of Pines, not

the elective.

MR. HASSAN: I'll let Erick answer that

portion.

MR. BOYCE: Erik can answer it.

MR. HARDIN: Yeah, the groundwater -- Do you

want to put the map up again.

MR. BOYCE: Yeah, put the map up.

MR. HARDIN: So, groundwater, you know, there

have been a number of -- a number of groundwater

sampling events, and each time they do that, they

do something where they measure -- actually

measuring of the head in the wells, and from that

they can determine the direction in which

groundwater flows. These arrows on here are

actually surface water flow, which are sometimes a

bit of an indicator of -- of groundwater flow, but

in this particular case, the -- what we're seeing

is the groundwater flows to the north, and there's

an easterly direction to it, as well. So, it's

kind of a, heading towards the Brown Ditch. So,

the folks that are outside of here, this red shape

here was decided very early on. Predated me, to

be honest. But it was to encompass an area that

would get all of the potential area where

groundwater was affected from the coal ash, both

in the landfill, and there's also some significant

coal ash deposits, you know, the stuff that

Jacob's dealing with, off to the east over -- over

here, so that's why you have this easterly leg to

it, as well.

MR. BOYCE: So, in other words, the

contaminated water actually is kicking the can

down the road, it goes to Indiana Dune National

Lakeshore Park.

MR. HARDIN: No, because the limitation is

here and that's -- At this point, we would focus

the -- we would focus the clean up on where we are

seeing the contamination.

MR. BOYCE: But where does the contaminated

water go, if it goes into the Brown Ditch?

MR. HARDIN: Eventually, it would -- it

would, in theory, go to the Brown Ditch. Now when

I say groundwater flows, it is more like an ooze.

It's a slow ooze. It's not -- So, uhm -- so, you

had some things that changed; that the extent of

the contamination used to be a little larger; you

had some things that changed with, groundwater and

so, we have a very limited area here. Where it

eventually goes, yeah, it would eventually go to

Brown Ditch. The surface water monitoring has

been an element of this, as well. And that has

not been shown to be an issue.

MR. BOYCE: Well, that's good because

Lake Michigan is a drinking water source.

MR. HARDIN: Right. Well, there would be a

tremendous amount of delusion, also, as soon as it

hit the lake.

MR. BOYCE: You're saying that the water

migrates north towards Lake Michigan, and I take

it you're saying, all your arrows point north;

right?

MR. HARDIN: The surface water, yes.

MR. BOYCE: Yeah. How come you went so far

south?

MR. HARDIN: That, I don't know the answer

to, other than perhaps there was a suspicion of

additional coal ash deposits down here when they

began the investigation.

MR. BOYCE: If you went that far east, which

I take to be almost a mile and-a-half, how come

you only went less than 3,000 yards west?

MR. HARDIN: Because over here there are

large deposits of coal ash, and that's why they

extended it all the way over here.

MR. BOYCE: Then I can just kind of figure,

just by what you're saying, that this is selective

on your part, not elective on our part.

MR. HARDIN: It's selective based on the

sites.

MR. BOYCE: On your map. Your magic map.

MR. HARDIN: Well, it's based on -- the

groundwater flow, it's based on the evidence

that's been gathered.

MR. BOYCE: So, you can actually tell me, in

all good conscience, I have no problem with my

property?

MR. HARDIN: With regard to coal ash?

MR. BOYCE: With regard to groundwater.

MR. HARDIN: With regard to the coal ash

affecting your groundwater.

MR. BOYCE: Yeah. Can you guarantee me that?

MR. HARDIN: The wells -- We have wells --

And I looked again after we spoke earlier today,

and none of the monitoring wells over here are

showing any coal ash impacts. So, if you have --

MR. BOYCE: I'm right where your little red

dot is; you're right outside the red line.

MR. HARDIN: Uh-huh. Okay.

MR. BOYCE: If you can guarantee that, hey,

I'm all for it. But if you don't know, don't tell

me you do.

MR. HARDIN: That I know that these wells are

clean, and I know that the groundwater is flowing

this direction.

MR. BOYCE: See, because they have refused to

put water on Brown Road, to the residents there.

We have to pay for it ourself. Although they run

the water all the way to Beverly Shores, and we've

got a lift station right at the corner of 12 and

Brown Road; two blocks from my residence.

MR. HARDIN: And I know there was significant

discussion of that earlier, and I -- The water

extension that was put in back in the early to

mid-2000s, covers a very large part of the town.

Right now the only place where we're seeing these

impacts, we've got monitoring wells scattered

throughout, we are only seeing a couple here and

over here.

UNIDENTIFIED SPEAKER: I can't see.

MR. HARDIN: Oh. We're just north of Yard

520, up here, and then in the wetland area to the

east of the landfill there. So, in order for me

or EPA to compel the companies, to force them, to

provide water for anyone else, I would have to

have evidence showing that there was an impact or

a threat of an impact. So, that's -- that's

where -- That's what I'm faced with.

MR. BOYCE: Well, I agree. But how can you

get evidence if you don't examine it?

MR. HARDIN: We have been examining it.

MR. BOYCE: No, you haven't. You haven't

examined my property. You haven't examined

Brown Road; if you moved that red line another

thousand yards, hey, I'm in good shape.

MR. HARDIN: But if the groundwater's not

flowing that direction from the landfill, then.

MR. BOYCE: Well, so you say. If you could

guarantee me my water's fine, hey, I'm -- I'm a

player.

MR. HARDIN: With regard to coal ash?

MR. BOYCE: Yeah. Can you guarantee me that?

MR. HARDIN: That it's fine with regard to

coal ash?

MR. BOYCE: Yeah.

MR. HARDIN: Of --

MR. BOYCE: Not assume; can you guarantee me?

MR. HARDIN: It's not assume. The science

would say no.

MR. BOYCE: Forget about science. You're the

guy that's running the show. Can you guarantee

me?

MR. HARDIN: Right. But all my decisions are

based on scientific evidence, which is what we're

seeing here, no impact.

MR. BOYCE: But, you haven't examined any

farther west. Water can migrate a long way. You

know that.

MR. HARDIN: Takes quite a bit of time.

MR. BOYCE: So, that means maybe next month

I'll have a problem.

MR. HARDIN: No. Takes years for water to

migrate.

MR. BOYCE: Maybe a couple years I'll have a

problem.

MR. HARDIN: Any significant distance.

Baptist Church, and the preceding fellow ahead of

me expressed my concern regarding the water, and

the fly ash on our property. We're on Route 20,

between the 520 Yard and the Brown Road on the

south side, and I've been troubled with this from

the very beginning. NIPSCO, from the start, said

they were doing us a favor by giving us water.

And yet, they only did a favor for part of the

town, not all of the town. And that pretty much

divided our town in some of that. And I was

wondering if, what the intent is; if there is any

intent of doing anything further, as far as

checking the water there on a regular basis for

the soil, and if there is a plan of extending the

city water to any of the areas that are not

covered in the Pines by that; and, by the way, our

church is on 20, but it is still in the Pines.

Erik, is that you?

MR. HARDIN: Yeah, it is. There are no plans

right now, because there's not a proposed plan.

So, but like I explained before, the -- I would

have to have evidence showing that there was an

impact or a threat of an impact before I could

compel or justify compelling, you know, forcing

the companies to extend municipal water lines.

So, there are no plans for municipal water

extension in terms of this process at this point,

but also, again, the proposed plan has not been

issued yet.

MR. GECKLER: Is there a test well within

that area that you're monitoring?

MR. HARDIN: Within your -- You're over here?

Is that where you're talking?

MR. GECKLER: Before Brown Road.

MR. HARDIN: Is Brown Road the county road,

also?

A. It is, yes.

MR. HARDIN: Okay. So, that's -- this is the

edge of it, so it's kind of out here. The map's

kind of blown up.

MR. BOYCE: It's probably closer to the red

line, right about there.

MR. HARDIN: Okay. So, you're in here.

MR. GECKLER: Yeah, right in there.

MR. HARDIN: Yeah, there's -- there's a

monitoring well somewhere in this area here. Do

you want to hold that up. I think maybe

results and show you what the numbers are. Where

the wells are and what the data are.

MR. GECKLER: I get asked many of the same

questions from my parishioners, "Is the water here

safe?" We do not drink the water, because we've

never been 100 percent sure that it is. And, of

course, the question is: Is it monitored, and

does EPA say it's safe? And I guess I feel like

the other fella, I'd like to have some kind of,

"yes, it is," to share, you know, the information

with the people.

MR. HARDIN: Right. And you're going -- That

is a county health question. Because the more

complete question, or the more complete answer,

"Is the water safe?" That's a county health

question. We're in here to address the issue of

the coal ash impacts.

MR. GECKLER: That's what I'm referring to.

MR. HARDIN: And, like I said, there are

other -- we think there are other issues going on

with the groundwater, too.

MR. GECKLER: It's -- it's tested quarterly

for anything else, as far as bacteria, or . . .

MR. HARDIN: Okay.

W-i-n-g-o. Back in the spring, you came to the

house and told us the importance of an urgency of

removing this fly ash before it thawed. And we

were under the impression that maybe May or before

the Fourth of July, and we're kind of hesitant

about having parties on our ground because we're

afraid the kids would stir something up. So, I

was just curious if it was so important back in

the spring before the thaw, why is it still not

done?

MR. HASSAN: I can answer that question.

The -- the delay, that -- it's the legal process.

It was the intent to get out there as soon as

possible, but working through the legal

process has -- has not been as quick as -- as we

would've liked, and that's been delayed. Until we

have a formal agreement with NIPSCO, there's -- we

have nothing to compel them to do the work, and to

have some sort of enforcement mechanism to say

that NIPSCO doesn't complete it to EPA

satisfaction that we can do something to totally

be in the situation. So, the hold up has been the

legal component of which is, hopefully, near end.

I think that we've a got -- a preliminary draft

has gone back and forth. I think that there's --

both parties were pretty close to agreeing on

something, and as soon as that agreement's

finalized and signed, and we have a finalized work

plan, then work will begin as soon as possible.

So, delay has been more on the -- the -- the legal

end of things, but in parallel to that, a lot of

work has been done in anticipation of starting

that work. So, a work plan has been started, and

has been developed, and EPA has reviewed drafts of

that to make sure as soon as that legal agreement

is in place, work can start almost as soon as

possible. So, it takes some time to get a

contractor.

MS. WINGO: Does the legal team know how

important this is supposed to be?

MR. HASSAN: They -- they --

something me, as a technical person, has been

emphasizing, and it's just that that process, that

takes a little bit longer than --

get your property sampled, or you want to talk to

someone from NIPSCO about your property, you can

see Angie in the back; they have been taking names

all these months, and they've been taking --

they've been following up with residents. So,

it's not like nothing's been going on, and they've

been busy with that.

so shocked, though, when the people testing the

is that not biased? How can we trust those people

to test the water, when they're the people on the

other side of the coin that the problem originated

MR. HARDIN: Yes, I can tell ya. This is a

very common thing. EPA, in the Superfund Program,

Don, you've had more history. Put you on the spot

here.

MR. DON BRUCE: Sure, that's all right.

MR. HARDIN: Percentage of sites that are led

by EPA compared to led by responsible parties.

MR. DON BRUCE: Yeah, the responsible party

sites in our Region Five of EPA, that's about

80 percent, and about 20 percent in our Fund

finance projects. And that being said, when it's

being led by the companies, we're overseeing it;

we have oversight contractors out. They're not,

you know -- They're using a third-party lab that

we've approved. So, they're simply taking the

samples, sending it in. You know, we're

evaluating the data.

MR. HARDIN: Yeah, they're following a very

specific work plan that we've approved, and we

have folks that just do that; that approve the lab

work plan and sampling work plan. So, it's --

every step of the way is, is being overseen.

MR. DON BRUCE: Like Erik said, at a

responsible-party site, the work is done by the

responsible parties, it's paid by them, but they

have to have it reviewed and approved by EPA, not

just Erik, but a lot of our lab people and

experts, the Quality Assurance Plan that will, you

know, give us all the technical details and the

quality assurance process and requirements, so for

that testing. So, that should be in the file,

right, Eric?

MR. HARDIN: What's that?

MR. DON BRUCE: The work plan and quality

MR. HASSAN: So, for the areas inside the

Town of Pines, EPA and NIPSCO agreed that any --

any area within Town of Pines, residential

property, one of their properties sampled, we are

in general agreement, we're in discussions right

now, as to the extent as to how far outside of

this -- outside of the town -- outside of the Town

of Pines, and outside the spread. So, we want to

get everyone's names on that list. So, everyone

in the circle, yes. And people that are on the

outer bounds, we're still in discussion with

NIPSCO to make sure that we have an agreement to

move forward, but, yes. We -- Everyone inside the

red is going to get sampled.

MR. HARDIN: To be clear, Kathy. It's

everybody in the red, and everybody in the town.

MR. HASSAN: In the town, yes.

MS. MURRAY: So, the entire remedial

investigation area.

MR. HARDIN: Yes.

MS. MURRAY: Have you contracted it out --

out the work out yet, who is going to do it?

MR. HASSAN: The contract hasn't been -- The

actual cleanup component?

the order is signed and NIPSCO can provide a scope

of work to the cleanup contractor, which is --

will be a part of that work plan that's been

tracking parallel to the order, so that when that

order is signed, the work plan can be signed, and

then they can send out that scope of work,

immediately, to send it out for bid with the quick

turnaround to get a contractor onboard. So,

things are happening rapid, so that work can

happen immediately, or as soon as possible.

MS. MURRAY: I know I have one last question.

My last question is: You -- And it's for Erik --

You had mentioned that you were going to be

testing the properties that do not have municipal

water that are being provided bottled water. Has

testing begun, and what is the status of that?

MR. HARDIN: Uhm, everyone that agreed to

have their well tested, has been tested, and those

results have been -- everyone should have those

results now. Their individual results.

MS. MURRAY: So, they had to agree to have

their well tested if they're being given bottled

water?

give -- they had to agree to give access to the

folks to come out and take the sample. You know,

otherwise they're trespassing.

MS. MURRAY: Okay. So, if they didn't agree

to have their well sampled, are you just going to

pull the water test then, regardless?

MR. HARDIN: Right. The monitoring well data

had -- The monitoring well data is showing that

folks that were getting bottled water are not in

an area impacted by coal ash-related

contamination.

MS. MURRAY: So, if you don't test, they --

MR. HARDIN: So, refusing --

MS. MURRAY: -- it doesn't matter. If you

don't -- their water is tested or not, if their

water is not tested you will --

MR. HARDIN: -- refuse --

MS. MURRAY: -- refuse bottled water from

them.

MR. HARDIN: Right. If they -- If they were

confused by that, then I certainly would want to

know who and see if we could get them to get

tested.

MS. MURRAY: How many attempts did you make

MR. HARDIN: They were -- I don't -- I don't

know. To be honest, I don't know. The letters

were sent out. The access agreement letters were

sent out from AE Com, and, in the letter, it did

say that it had no bearing -- whether you were

tested or not, had no bearing on -- on whether

bottled water service would continued. But please

do let me know if somebody was confused by that,

please give them my contact.

MS. MURRAY: So, you're not going to make any

other attempt? One attempt, that's it?

MR. HARDIN: Well, if folks didn't want their

water tested, yeah, I can't force it.

MS. MURRAY: Okay.

MR. QUEALY: Hi, my name is, Brian Quealy.

Q-u-e-a-l-y. And I own a business in the Pines,

Integrated Flavors; we are on Highway 12, between

the two motels. So, that's always our landmark.

And we are a food processing facility, and so, we

have to ensure, you know, that everything is safe

for us. We're on municipal water. So, we should

be fine with that. In fact, the water department

has been sampling our water every day, I don't

believe there's any relation to that. I think

they're just running their own tests. But we did

ask to have sampling done on our soil, the soil on

our property, and have signed the access agreement

last month. And so, I hadn't heard anything back

since then, and don't know, I thought we were

supposed to be notified before we come do any

sampling, or looking at the property. Most of our

property is, you know, the building and the

asphalt parking lot around it. There isn't a lot

of soil, but there is some. But really, if I

wanted one, you know, what's the time frame; when

should I expect to hear, as far as the sampling?

And, you know, I understand that there's some

delays, unfortunately, in the actual remediation.

But then also, are there any other, you know,

things that we, as a business and a food plant,

especially, should be concerned about, you know,

in the whole environmental scheme of, you know, of

what's happened in the town?

MS. PASTOR: You can handle the schedule and

maybe Mark could handle the food part.

MR. HASSAN: Yeah, so, there's not a set time

frame for the next big sampling event. My plan is

to get as many residents that are interested in

having their property sampled notify us today, or

as, you know, relatively soon after this meeting

so we can schedule a large amount of properties to

be sampled at once. So, this can be -- could be

within a week or two depending on how many

properties there are.

So, the plan's to have another sampling event

relatively soon after this, so you should be

notified pretty soon as to when that sampling

should occur.

And, for the health component, I don't know,

Mark, if you had anything you wanted to had for

environmental concerns for . . .

MR. JOHNSON: Mark Johnson, with ATSTR, which

is a federal health agency, and we are part of the

Center For Disease Control, and we provide support

to EPA and to county health departments in these

kind of assessments.

So, in terms of your question about impacts

on your food processing. We would not expect

there to be any concerns, certainly based on the

information we have, for your business. Certainly

having municipal water; it's being tested, is the

primary issue for you. It would be good to have

confirmation with the soil testing, but even that

wouldn't necessarily impact your process. We

don't really see any reason for there to be any

concern about that.

MS. PASTOR: Okay.

MR. HARDIN: That's specifically regarding

the coal ash. It's not --

MS. PASTOR: Okay. We've run through the

list. So, we wanted to give everyone a chance to

ask a question. Some -- Ma'am, could you grab the

mic, and for the court reporter, please.

MS. PROKUSKY: Hi, my name's Ann Prokusky

(phonetic), and I did get my water sample back.

Thank you very much.

I just got to talking to my neighbor. I just

heard about the contaminated soil. So, I've been

coming to these meetings for 14 years. I was

pregnant with my second child, and we were talking

about the water. And the water was in pretty bad

shape. Okay? And I was told, people would bring

jars of water in, and they would say, "Look at my

water." So, we had contaminated water in the

area. I'm the one percent that never got the

municipal water. So, I'm one of those people out

here that don't have that. So, we've moved on to

that. Now we are dealing with contaminated soil.

My question is: I kinda walked in late. I

apologize. But, I was seeing the part where

you're kind of taking off the soil in a person's

yard? Where are they supposed to live when this

is happening?

MR. HASSAN: All right. So, NIPSCO, on a

property-by-property basis, will offer temporary

relocation of property to property, while this

work is going, depending, you know, the length of

time, if it's going to be months.

MS. PROKUSKY: Did you mention that in --

because I didn't hear that.

MR. HASSAN: No, I did not.

MS. PROKUSKY: Okay.

MR. HASSAN: So, it will be a

property-by-property basis, and if it's one that's

going to be a prolonged cleanup, that they're

planning to offer a temporary relocation until

that work is completed.

MS. PROKUSKY: Because the equipment is loud;

my husband owns that equipment. And if you're

going to be ripping up the yard, and it's going to

be messy, it could rain, it could be a pretty bad

situation.

My other question is: Where is the

contamination? Where are the locations on the

map? What have you found out so far? Where's the

contaminated soil, and where are we at with that?

MR. HASSAN: Right. So, the contamination,

or the coal ash is -- is pretty much -- I don't

know how to describe this. So, the way the

material was used, so, I don't know if back in the

'70s it was used as fill material for some of the

lower-lying areas. So, my understanding is that

residents had the ability to say, "Yes, I would

like you to bring in some of the coal ash to bring

my property up to grade."

And so, using the records from, uhm, the

remedial process, uhm, from water line

installations and town -- town hall meetings from

the '70s and notes from the '70s, there was a

general idea of where these general coal ash

deposits were, and that kind of set the baseline

for properties that potentially had coal ash on

them.

So, the voluntary sampling component comes

from the unknown aspect. So, that's why we're

asking residents that are within this area to let

us know so that we can go out there and sample the

property to see if there are -- there is coal ash

on the property, and if there are elevated levels

of arsenic and thallium on the property. So,

that's kind of the general, general overview,

and . . .

MS. PROKUSKY: Okay. There are two parks in

our town. There was one that's over by the

restaurant on 12, it used to be Pumps On 12, and

then there's one by the 520 cutoff. Are those

parks contaminated, the soil, do you know?

MR. HASSAN: Which -- so, the -- I believe

both properties have been sampled, and the

results -- So the properties -- Are you talking

about the property by the town hall, is that one?

MS. PROKUSKY: There was one there, and then

there's another park that's by the 520 cutoff,

which is of off 20.

MR. HARDIN: Talking about the Pines Park.

MS. PROKUSKY: Yes.

MR. HASSAN: So, the town hall park did have

elevated levels of arsenic and thallium on it,

and, back in the spring, NIPSCO and their

contractors went out and moved the playground and

covered it with, uhm -- the exposed soil areas

with wood chips to prevent that exposure. And

that playground equipment was removed to prevent,

you know, children playing on it, and reduce the

interest on that property.

The other property, I'm not sure what the

results are on it. I don't have them off the top

of my head.

MS. PROKUSKY: Because, basically, the dump

is right across the street, so . . . chances are

pretty good, probably say that that soil is on

that park. I'm just speculating, but I could be

wrong.

And then my next question is: Okay, I'm one

of the people that don't have water. How is it

looking for me? Does -- Can anybody tell me if

I'm going to be getting municipal water? I have

been told, there's things circling around saying

that I'm not going to get bottled water anymore,

and . . . Does anybody know anything about that?

MR. HARDIN: Right. The bottled water was --

I'm sorry -- The bottled water was intended as a

temporary protective measure while the

investigation continued. And the discontinuation

of the bottled water will -- would happen as part

of a decision document. I can't say for sure

whether it's going to be discontinued or not. I

also can't say for sure whether additional

municipal water extension will occur or not. But

again, it goes back to, you know, can I force them

to do it, based on the evidence that I have in

front of me now. And I am really hoping she shows

up soon. But the county --

MS. MURRAY: The time frame?

MR. HARDIN: Yeah, in terms of -- oh, when

the decision will come out?

MS. MURRAY: Because I want to move. If I

can't get my free water anymore, I'm moving.

MS. PROKUSKY: (Overlapping speech) . . .

sell your house.

MS. MURRAY: Yeah, exactly.

MS. PROKUSKY: And since the --

MR. HARDIN: The decision document will --

Well, the proposed plan will likely come out

sometime early next year, and then the decision

document would be a few months after that. You

know, there are a lot of things that can,

obviously, that can change, schedule or delay,

there's a lot of moving -- or delay our process.

There's a lot of moving parts. But spring/summer

is where -- what I would estimate.

MS. PROKUSKY: I had some other problems,

too. Although we don't have the municipal water,

we still have the well water. It is shown that it

is drinkable. But now that the other 99 percent

of the town has the city water, the water has

moved, the water table. So, now my crawl space

floods when it didn't flood before. So, we had to

buy three pumps last year . . . And this is, if

we want to get out of our house, we have to tell,

you know, our realtor, that there's been flooding

down there; you know, we've got water problems,

and we don't have, you know, the municipal water,

and now there's this contaminated soil. Which I

don't know, will I get tested?

MR. HARDIN: Have you requested to have your

soil tested?

MS. PROKUSKY: I just found out about this a

couple days ago from my neighbor, so that's why

I'm here.

MR. HARDIN: So, if you want to have your

soil tested, please talk with Angie before you

leave, back in the back, and she'll get you on the

list.

MS. PROKUSKY: Well, I just want to

apologize, but I'm just frustrated. I've been

here for 14 years. I think there's a lot of empty

chairs because people have just given up. They've

just given up. And they don't feel like they're

heard. They don't feel like they're heard, and it

was -- it's hard for me to sit here and just, you

know.

MR. HARDIN: Right. A couple things I want

to mention. You said that the results showed that

your water was safe to drink. The test was

primarily for coal ash-related contamination.

And, like I said, coal ash isn't the only source

of groundwater problems in the area.

MS. PROKUSKY: But there's some questions. I

mean, reading it. I brought it with me, maybe you

can go over it with me; it's, like, reading

hieroglyphics or whatever, I don't know, or

whatever. But, there's some arsenic numbers in

there, which I do have concern about. And I don't

know where the cut off is for these numbers,

or . . . You know, but -- I'm thankful that I got

the water tested.

MR. HARDIN: And that's something that we

discussed earlier, and I think perhaps a second

mailing to the -- for the folks with the actual

comparison values be -- be sent out.

MR. JOHNSON: Yeah, if you have a copy of

another thing that's going on. I'm, like, what's

trying to raise a family, and it's not -- it's not

good. It's just not.

I'm on the town board at the Town of Pines. My

concern is, people selling their homes, and the

first question they get asked, "Do you have

documentation that your property is okay? Do you

have documentation that your water is okay?" Is

there something that can be put on your site that,

if I'm selling my property, I can go to your site,

and I can put in my address, and it will give me a

document, I can print a document, that says, I

have safe soil and I have safe water.

MR. HARDIN: So, it wouldn't be on our Web

site, because that is considered private

information. However, your test results -- You

had your soil sampled?

MR. PRAST: Yes.

MR. HARDIN: Everyone should be provided

their test results. There are some that haven't

gotten their results yet.

MR. PRAST: But, 20 years down the line, do I

have that piece of paper anymore?

MR. HARDIN: Well, I do.

MR. PRAST: And that question --

MR. HARDIN: I do. Honestly, I do. EPA has

those -- those all get saved.

MR. PRAST: So, we can have a document

supplied by you that says our soil is safe,

because right now mine isn't, but after this

removal, it will be, then I can request something

from you, with who I am and my address, that I can

show that everything is safe on my property, and I

can sell it.

MR. HARDIN: With regard to the coal ash

contamination.

If you've had your soil sampled, you will have

those results. And there will be something

generated after the cleanup is done, showing a

clean bill of health, so to speak.

MR. PRAST: So, as people ask us in the

Town of Pines, we can give them your name.

MR. HARDIN: Yes.

MR. PRAST: Okay.

MR. HARDIN: With regard to soil -- Well,

probably, my name is best, because Jacob's in here

for the cleanup, and then, when that's done, it's

me.

MR. PRAST: He's gone. He's gone.

MR. HARDIN: I'm here. And you know, there

was a point that I wanted to make at some point,

also. The way the Superfund process works is: We

do the clean up. We don't go away. Every five

years we go back and do what's called a five-year

review. And there's -- There will be monitoring

in place that will be ongoing. And then every

five years, we do a very detailed evaluation of

that. And that's after we've considered it

cleaned up and the cleanup done. But we go back

to make sure that conditions haven't worsened,

things aren't, you know -- things are still

proceeding as we planned, as we expected. So,

that's the way it works. So, there will be --

you know, there is somebody else that's assigned

to this site. There's always --

MR. PRAST: Yeah, because you're not the

Not a question, information. Talking to people in

the Town of Pines, such as the person who does our

street work, and other people on the Board, the

wood chips at the playground do not exist.

MS. MURRAY: Yeah. You didn't put them.

There was nothing put over after the playground

equipment.

MR. PRAST: The equipment was taken off and

that was it. There was a yellow tape put up

around it, and I think that's all that we had

done.

I went out and took a look at that, and I called

NIPSCO and they had someone come out and put

woodchips on top of it, whether those got

MR. PRAST: Were they just in bare spots, and

not the whole field?

MR. HASSAN: Right. It was the -- So, the

exposure was the playground equipment area. So,

where the areas where the swing to -- to avoid the

direct exposure to the soil is the whole point of

it.

MR. PRAST: Since my yard was contaminated, I

was told I couldn't even walk on it. I wasn't

allowed to let my dog walk on it. And that I

should stay out of that yard. But our whole park,

people still walk across it.

MR. HASSAN: And if that's an issue, then, I

will remedy that. I will fix that. I didn't --

It was my understanding that, from what I saw, it

was taken care of. But if it's not, I will take

care of that.

there's other contaminants that could possibly be

affecting the water, but we have not expanded on

what those contaminates are. And I'm wondering if

you can elaborate on that.

MR. HARDIN: Right. And part of that is

because, you know, I'm here investigating in

detail the coal ash contamination; and we just

have indicators that there could be other things.

MS. SMITH: Can you be quiet. I'm trying to

listen.

MR. HARDIN: One of the things that --

that -- As an example, one of the things that,

uhm, folks that had their private wells tested,

one of the things they tested for was something

called coliform, which is a class of bacteria.

It's a type of bacteria. And there were some

wells that had coliform hits, we would say. It's

really just a, yes or no, were they there? And

for those folks, from what -- I'll speak for

county health, since she's not here. The next

step would be to get a more specific test for

fecal coliform, which is an indicator of septic

impact. From a septic. Everyone in town is still

on septic systems. So, that is something in

particular that we're concerned that could be

potentially impacting the groundwater. It's not

something that we have investigated in detail;

again, because that's outside of our process. So,

that's -- some information we provided to the

county health, and we're encouraging folks to have

their wells tested, especially, if they have a

coliform hit; that they speak with county health,

and county health works with them to see if they

can remedy their problem. Or further investigate.

Coliform -- To speak a little bit more on this,

and this is something I've learned in the last few

weeks. Coliform, again, is a total class. It's a

type of bacteria. Mark can probably speak to it

more. But it's -- The only thing it indicates is

that they come from warm-blooded animals; right?

MR. JOHNSON: Yeah.

MR. HARDIN: So, the total coliform could be

an indicator, but they would more specifically

want to test for that specific type of coliform.

MR. JOHNSON: Yeah. And there are other

parameters that would be measured in that testing,

including nitrates and nitrites, which could be

another indicator of impact; it could be,

certainly around children. So, there's a whole

range of other tests that would be done on water

beyond what has been done with coal ash, and that

would be a more comprehensive evaluation of water

quality.

MS. PASTOR: Okay. Someone else who hasn't

I just have one question. For homes that were

built a long time ago, like in the '30s, like our

home was built in '38, would this pretty much

eliminate any possibility that any fill was used

in older homes like that?

MR. HASSAN: For purposes of the -- I'm

sorry -- for purposes of the home being built on

top of -- of the material, no. But, if there's a

possibility, and it's unknown without sampling,

with previous owners to your property had used

that fill materials, so it's just an unknown.

Unless you have -- Do you have visual -- Have you

seen it on your property?

MR. DRUFKE: I wouldn't know what it looked

like.

added in at some point, but it's mostly, like,

I've dug up a lot of broken glass, and so, I don't

know, if that's . . .

MR. HASSAN: Yeah, that -- that sounds like

it's similar to the bottom ash that I think that's

been used as a road base material. So, if --

MR. HARDIN: No. He should be tested.

MR. HASSAN: Yeah, I think still if you're

interested in having your property tested, I would

put your name on the list for that.

heard Mr. Prast talk about that he was told not to

walk on his grass or including that, and our soil

was sampled several months ago and we haven't

heard anything. And my husband is the town guy,

and he mows that grass and he digs that dirt, and

he does all that stuff. So, should he not be

doing that?

MR. HARDIN: That's a Mark question.

made to avoid direct contact with exposed soil, so

for those properties that were -- we met with

earlier on, as an interim measure, that we were

recommending that bare soils areas be avoided.

MRS. WATKINS: I signed every letter you guys

sent me, nothing said for me not to come in

contact with my soil. And no one ever talked to

me. I just got letters.

MR. JOHNSON: Right. Those were where we had

evidence of visible material that we made that

recommendation. So, I think we'll certainly need

to await the final results before I make any

recommendations to you specifically.

MRS. WATKINS: So, back to the question,

then. That they have him digging poles and

putting poles in the park, and doing stuff like

that; he shouldn't be doing that stuff, then.

MR. JOHNSON: We weren't aware that that kind

of activity was occurring, but something we should

probably talk to the Town about; so, that any

excavation or digging, there is no contamination,

be done in a way that it is safe.

MS. PASTOR: Who else hasn't had a chance to

ask a question yet, before we go around and take

MR. SMITH: Hi, my name is Brian Smith. You

just said to two things, in a way, that it's safe

excavating and mowing, whatever. I was just

wondering what parameters you would recommend

taking; say, if we need to cut our grass or

excavate. If there was any safety equipment that

you know of that would help with that.

MR. JOHNSON: And this is an area, you had

your property sampled already.

MS. SMITH: We are going to now because we

were told that glass and coal pieces were not an

indication of coal ash. So, when we called at the

very beginning, and they're, like, "Oh, no, you're

fine and you are far away." And now you're saying

that is. So, we're going to be getting tested

because that is not what we were told. When you

guys sent out the letters, the end of February,

March. I called the lady and she's, like, "Oh,

no, you're fine."

MR. HARDIN: I think perhaps what happened

there was, back in -- in -- It was the very end of

January, early February, when we found out first

about the elevated arsenic levels. And that was,

at that point, we were just talking about the nine

properties that had been sampled back in November,

and we hadn't moved on to that next phase of

sampling other properties. So, there could have

been some confusion there. And I apologize if you

got some conflicting information.

MS. SMITH: So, she was very certain. So,

should we stop mowing our yard? Wait. I mean,

honestly, should we stop doing that? People

aren't supposed to be in their yard, should we not

bother?

MR. HARDIN: I think what -- Well, I'll let

Mark speak, but I think it was -- Mark. Things

you can do as an extra measure of precaution.

MR. JOHNSON: Right. So, as a precautionary

measure, we made recommendations that people

avoid, until they have confirmation of their test

results, they avoid direct contact, you know,

with -- skin contact with areas of bare soil. So,

when there's a vegetative cover, grass cover, or

mulch, or some other barrier that prevents direct

contact with the soil, either through skin contact

or inhaling it, there's limited risk. So, it's

really precautionary until you have final results

to determine whether or not it's impacted or not.

MR. WINGO: My name's Dallas Wingo. I got a

question for Jacob and Erik. I cut my grass once

a week. It takes me about three hours to cut it.

It took me a lot of time to clean the property off

to make it accessible, and if I don't cut it once

a week, it becomes a jungle. Are you guys going

to come out and cut it for me? Because, if I let

it go, I'll tell you right now, with the moisture

from the lake and everything, it grows quick, and

if I do not cut it once a week, sometimes twice a

week, it grows so fast. If you guys are willing

to come out and cut for me, Praise the Lord.

MR. HASSAN: I think what we can do is, we

can talk to you about how you can safely do an

activity like that. And that would be in

consultation with Mark as to how best to

approach -- how to address an activity like that,

where you have to do it; that there are some

things that you probably can do that Mark can

recommend to do to reduce the potential exposure

from that, so . . .

MS. WINGO: I'm going to tell you a little

information. I bought the property in 2012.

Right after I bought, the property, I became

medication crazy. I got a bleeding problem, I

been to Billings, -- uh, Chicago hospital I don't

know how times. I just had a echo cardiogram,

which is $11,000, to make sure my heart was all

right. Praise the Lord, it's all right. But my

point is, my property has been tested, so, I don't

know how many times. I don't know how many times

they come out and said, "Well, we are going to be

there at ten o'clock tomorrow morning." I'd

follow up, just do this, do that. So, I'm just

curious to know, is it safe for me and my dog?

Which I paid $1,400 for. Is it safe for him to be

over there, drinking the water; running around the

grass; digging up moles. Is it safe? You guys

have been on my property; you know what I'm

talking about.

MR. HASSAN: Right. And probably may be the

best -- if we let Mark answer the health question.

MR. HARDIN: I'd discourage the mole

consumption, per se.

MR. JOHNSON: You shouldn't -- If it has a

grass cover, the soil is below that grass level

and the grass roots; so, in the areas where you've

mowed, the concern is if there's bare soil. If

your grass cutting activities results in a lot of

dust and soil, that may be an issue, especially if

you have concerns about or evidence of

contamination. If it has a thick grass cover,

then that's less of a concern in terms of it. And

now, there's no absolutes. We're trying to make

precautionary recommendations until -- so we have

information to actually -- the cleanup's been

completed.

MS. PASTOR: Someone else that has not had a

chance to ask a question. Going once, going

twice, otherwise we're going to ask a second

question. Kathy.

MS. MURRAY: Kathy Murray, Town of Pines. I

have to go back to our park by the Town Hall, that

has this high, high levels of arsenic. Now, when

all this came about, you fenced off the playground

area to keep kids off of that playground area; you

took the equipment down; and then you said you'd

covered some wood chips. But now, when I'm

listening to Mr. Johnson speak, I'm sitting here

super concerned that we still have people who have

access to that property; you know, it's public

property. Should we have fenced this off a long

time ago? Should you have fenced this off a long

time ago? I mean . . . ? It's public property.

MR. HASSAN: Right. So, in consultation with

Mark, we have reviewed NIPSCO's work plan, and the

work plan specified a protective barrier of wood

chips would be sufficient for a temporary time

period. It's a temporary barrier; right? So,

until that legal order can be in place, and that

NIPSCO can come in and clean up that material,

that the recommendation was that that temporary

barrier of the wood chips, and the grass should

have provided a temporary barrier until that

material could have, you know -- a temporary

thing, right? So . . .

MS. MURRAY: Right.

MR. HASSAN: That was what was recommended,

and approved in that work plan, as a protective

temporary measure. And so, obviously, the -- the

prolonged legal component of it, maybe it's worth

taking a second look at, as to next steps or

something maybe to mitigate that now.

MS. MURRAY: Yeah. We've had -- we've had

our -- a call 'em our "Pines Dude". You know, he

mows. He mows it at least once a week, you know.

And his -- Have we unintentionally put him in

danger by having him do this on . . . ? I mean,

because we're not -- we're not just talking a

small elevated level. Right? You know. You know

that; right? I mean, this is a very high level of

arsenic.

MR. HASSAN: Right. And to be honest with

you, I don't have an answer to that question.

So -- The -- the temporary -- the barrier was to

be temporary, and the -- As Mark said, if you're

cutting, you know, the grass at a certain level,

and it's not generating dust, it's not much of an

issue. If there's dust generated, that might be

something else.

MS. MURRAY: But I just -- I guess I just

have to say, because again, for 14 years, like she

said with the water.

MR. HASSAN: Sure.

MS. MURRAY: This is another case of where we

don't matter, the lawyers matter, NIPSCO's money

matters, and we don't.

MR. HASSAN: Well, I --

MS. MURRAY: Just got to put that out there.

MR. JOHNSON: Maybe to follow up on that. I

think this -- your description of the conditions

of the park are somewhat different than we thought

they were. So, we need to have a second follow-up

discussion with the Town about further

restrictions; as Jacob mentioned, we need to make

sure that there's a barrier that's sustained.

That also, people who were mowing or involved in

the site work, are aware of that contamination and

taking perfect precautions. So, we need to take a

second look to see if that's being maintained.

MS. PASTOR: Yes, ma'am.

MRS. WATKINS: So, I just have one quick

question. You said that the recommendation was

made to not have contact with bare soil. Who was

that recommendation made to? Because it wasn't

made to me, in any of the letters I got.

MR. HASSAN: All right.

MRS. WATKINS: I go out there and garden all

the time.

MR. HASSAN: I think there were a couple

locations; it was in the Town of Pines Newsletter,

where it was in that Q-and-A Section, in that

section; and then at a town council meeting, I

think back in April or May, when Mark was there;

that recommendation was made at that town council

meeting, as well.

MRS. WATKINS: Okay.

MR. HARDIN: With individual homeowners.

MR. HASSAN: What's that?

MR. HARDIN: With individual homeowners. And

there was also part of -- And I think in

Mr. Prast's situation, I think it was an

individual discussion with him. There have been

individual discussions with folks that had

elevated levels.

Back where the water, when you were saying that

somebody with Brown's was the one that's doing the

testing, but you had a third party. When you --

If you were the one, Erik, that was there, did you

label and seal those tubes that went into the

labs, so they were -- You knew that those samples

were --

MR. HARDIN: Were the same ones that went in.

MS. WINGO: -- were the samples that they

pulled? I was just curious. Because some of

these people really have bad water.

MR. HARDIN: Not me, personally, but, uhm,

for, I think, most of them, the -- my oversight

contract was observing that being done.

MS. WINGO: Observing or sealing?

MR. HARDIN: Observing being gone.

MS. PASTOR: Question? Or, you haven't asked

one yet, or someone who has a second or third

MR. WINGO: I got one more question for ya.

You said earlier about, you know, do everything,

replace what you take up. What if there's

something there that's irreplaceable? It takes

year to grow, takes year to come back. Like, I

got a chain-link fence and there's grapevines all

along this chain-link fence, and it's for privacy.

I didn't put them there; but they were there. I

want them kept there. So, what do we do in that

case?

MR. HASSAN: So, as part of the negotiated

access with NIPSCO, when they come to say, "We

want to come on your property to do cleanup,"

That's something that you would discuss with

NIPSCO and say, "I don't want these removed. We

need to save these." And that's something they

would be able to work around; if it's a prized

possession or something on your property that you

don't want disturbed; that there's options to work

around them. But, obviously, if there's material

and that the preferred would be to clean that --

that portion up. But that's something that you

would be able to discuss with NIPSCO when they

MS. WINGO: Well, the reason I brought this

up is because when you put city water down Second

Place, they went down eight feet; that's where

they found the fly ash, and that's why I'm saying,

that's where the grapevines are. So, I'm just

curious.

MR. HASSAN: Okay. Yeah. So, be sure when

that meeting with NIPSCO comes up, that that's

something that's mentioned so that they're aware

of it, and that it's something that you want to

keep.

MR. WINGO: Okay.

were talking about the playground and the fact

that the land was contaminated; you put wood chips

on top of it; you put grass on top of it; they

were going to cut the grass, everything was going

to be fine. But, earlier in the presentation, you

showed backhoes and taking stuff down three feet

and that; how come you never addressed the

playground like that where kids play?

MR. HASSAN: So, the playground will be

addressed like that. It's just -- So, the plan

is, is that legal -- like I had mentioned -- and

you guys are probably tired of hearing me say

this -- but that legal agreement is basically step

one.

Step two, is that work plan; and, step three

is to clean up all that stuff in the playground.

So, that property has been identified for

removal and it will get cleaned up as soon as our

work plan and NIPSCO can get their contractors out

there.

MR. BOYCE: Well, let me ask you this. It

will be two-part question.

MR. HASSAN: Go head.

MR. BOYCE: Is that area restricted right

now? Has it got restricted access, or can we just

go over there right now and roll around in the

dirt?

MR. HASSAN: You would be able to walk on

that property, yes, you would.

MR. BOYCE: In other words, you've done

nothing.

MR. HASSAN: Uh, I -- I would say that --

MR. BOYCE: You've done nothing.

MR. HASSAN: -- the playground equipment has

been removed, so the -- the -- There's no use of

that playground equipment anymore. There had been

a temporary barrier placed, as a temporary

measure, and at that point, the -- the fencing had

been removed in anticipation of a cleanup

happening on a much quicker time period. And it

has not happened yet, but it is anticipated. So,

things have happened, but those solutions need to

be re-evaluated.

MR. BOYCE: How long has it been since the

playground has been removed? Years?

MR. HASSAN: No.

MR. BOYCE: About six months?

MR. HASSAN: About six months, I think. Once

it was identified as a issue, that was one of the

first actions taken, was to remove that playground

equipment so that that potential risk was removed.

MR. BOYCE: Well, the playground equipment

really wasn't the problem; it's what the

playground equipment was sitting on.

MR. HASSAN: That's correct. But the

playground equipment is also a --

MR. BOYCE: What attract the kids.

MR. HASSAN: Attracts the kids; correct. So,

you --

heading for the Dunes Baptist Church.

MR. HARDIN: Right here. So, this is the

southern -- southern cell of the landfill; right?

MR. BOYCE: Yes.

MR. HARDIN: This one actually has the bottom

liner. We don't have concerns with contamination

leaving there. But, also the groundwater flows

towards it. This is, Brown Ditch flows here. So,

it's going -- This stuff right here, immediately

is going this way.

MR. BOYCE: I'm concerned about that arrow

down below. I am concerned by that one over there

headed west.

MR. HARDIN: Right down here.

MR. BOYCE: That little rascal there.

MR. HARDIN: That's because the landfill is

here.

MR. PETROFF: Surface water.

MR. HARDIN: The line area. This is the area

where -- This is the source of groundwater

contamination, going north. This is -- There's a

barrier -- a barrier wall that's in-between the

two wells, even, to prevent water going that way,

even.
