By stipulation of the parties through counsel, I was appointed to conduct a supplemental custody evaluation pursuant to Evidence :Code Section 730 in the above~referenced matter. The evaluation commence# on February 21. 1997 and conduded on May 6, 1997 when I met with the parties to inform them of my findings. conclusions and recommendations. During that conference, I discussed the data from the evaluation which forimed the basis for the condusions and recommendations. I subsequently met with the parties on JUlY 22, 1997 at which time Mrs. Baldares and Mr. Kidwell confirmed to me that th@'i were in acceptance of the specific terms and provisions. Subsequently, as you will recall, I contacted each counsel to discuss my findings and recommendations as well as the general status of the case. At that time, I understand I was requested by counsel to provide the recommendations to which the parties had agreed so that counsel could use the information to draft a stipulation. Since, at this time, it appears that the case is not going to continul2' to hearing. this document will contain the basis recommendations rather than a comprehensive report for the purposes of litigation. If, however, at any time &n the future, a litigation report is required or the Court requires my testimony ~~ further support the condusions and recommendations, I will provide either UP{H'u

BRIEF HISTORY AND PRESENTI~G ISSUES

employed as a part-time gardener who resides in his deceased mother's

residence in San Diego. Siboney Baldares is employed by a department store

chain in Orange: County as Security Manager. The child at issue is Donald,

born September 21, 1991, pursuant to the current Order resides with father

each Thursday at approximately lO:oo a.m. until Sunday at approximately

10:00 a.m.. The father picks up the child in Orange qAJunty to commence his

residential schedule. Mother picks up the child in San! Diego at the conclusion

of fathers resJdential schedule. I believe that the cum:mt schedule is, in part, a

result of mother's employment schedule which requires her to work on most

weekends. The additional factor has been the child's preschool age.

The primary precipitating change of circumstances in this matter has been that

Donald has reached an age to enroll in an elementary school. Both parties

wished to assume the deSignation as the primary custodial parent during the

school period.

PROTOCOL

Pursuant to the Court's Order, the purlX>se and scope of my retention was to

assess the matter as it related 10 the best interests of the child and render a

recommendation regarding a feasible child-focused developmental-related

custody plan. To that end. the following protocol was ~mployed.

The following variables and criteria were applied when assessing the family to

develop the basis for an appropriate custody recommendation.

BRIEF SUMMA RY

It was reported and confirmed that Donald is attached to and dependent upon

both parents. However, the primary dependen~tionship appear~ tG--b.....e __ ~ , .

with mother. As I discussed with counsel, there wer~ a number of factors and

c~at were considered in the formulation and basis for the

recommendations. Among those was the issue of father's history of alcohol

abuse. As counsel will recall, when conducting the initial evaluation, Dr. Mann

addressed this matter and made recommendations regarding alcohol

intervention, treatment and random alcohol screening. Subsequently, Mr.

Kidwell entered into an alcohol treatment program from September 1994

through September 1995, the goal of which was to faci·litate his abstinence. A~

the conclusion of the outpatient prQgram, he was referred to AA for continuing

support. During the process of the evaluation, Mr. Kidwell denied the use of

alcohol and then stated that he had resumed drinking, but, in his opinion, hi$

drinking habits did not present a risk.

As a result of conferring with Dr. Mann as well as other related mental healt"

professionals and the parties, it was conduded that there is a degree of risk with

father's present drinking pattern and the undersigned does not concur with Mr.

Kidwell's self·assessment. Presently, however, there have been no confirmed

incidences of Mr. Kidwell's drinking in the presence of the child.

CONCLUSIONS

Based upon the data considered in the evaluation, it was concluded that it

would be in the best interests 01 the child to reside in primary residence with his

mother during the school period and to commence elementary school [I",

mother's community.

RECOMMENDATIONS

Based upon the data collected in the evaluation and the conclUSions. thIS

following recommendations were rendered to the parties and accepted by Ms.

Saldares and Mr. Kiewell.

The following residential plan as it relates to father is contingent upon

abstinence from alcohol during any period that Donald is in his care. Rando!ll~

recommended random alcohol screens and for a myriad of reasons the process

was not utilized in the fashion that Dr. Mann expected and was not considered

to be effective or successful. I believe that, in order to preserve the best

interests of this child, the random alcohol screen is essential for at least a period

of one year. The necessity after ons year will be evaluated upon request of the

parties. However, during at least the first 12·rnonth period, father's custodial

access to the child is contingent upon his response to requests for random

alcohol screens which will be conducted by this office. Father has requested

that Smith Kline Laboratories, which is located in geographical proximity to his

residence, be utilized. I had an independent contact with the laboratory and my

office was infonned that it is necessary for father to respond as soon as possible

within one to six hours of request. Father states that he does not wear a pager

and is not always available. I have cautioned father that, if there appears to be

any pattern of non-response to the request, then it will be considered to be the

same as a positive alcohol screen and I will immediately recommend

modification of the custody plan. I request that counsel determine the financial

responsibility for payment of the drug screens and inform my office as to those

terms.

SCHOOL RESIDENTIAL PERIOD

It was recommended that Donald reside with mother commencing with the

1997/1998 school year.

Mother's employment schedule reaquires she work most weekends. It was

recommended that the child reside with father on weekends 1, 3, 4 and 5 at

which time f~t~er's residential period wjll commence on Friday at 2:00 p.m.

when he picks up the child from mothers residence. Mother will pick up the

child from father's residence at 4:00 p.m. on Sunday. The second weekend of

each month shall be designated to mother.

SUMMER PERIOD

The summer period will commence on the Friday that foHows the dismissal of

school at 2:00 p.m .. The summer period will conclude at 2:00 p.m. on the last

Friday prior to the commencement. of school. During the summer period. the

child will reside for two consecutive weeks with father then one week with

mother in an alternating fashion until the summer period concludes.

Regardless of the pattern of summer residential schedule, the summer period

will condude on the final Friday preceding the commencement of the schoo~

year. The summer will commence with father's two·week period and alternata

thereafter.

HOLIDAYS

All Court ordered holidays and special days will have priority over the regular

schedule. The regular schedule will resume for the other parent on the next

available scheduled time.

Thanksgiving: The Thanksgiving holiday will commence on Wednesday af

the dismissal of school until the following Sunday at 4:00 p.m.. I would

respectfully request counsel to determine the designation of the 1997 schedule

with the parties. If Donaid is designated to spend Thanksgiving in 1997 with his

mother, then he will spend all succeeding Thanksgiving holidays in odd~

numbered years with mother and all Thanksgiving holidays with father in eV611­

numbered years.

Chrl.tma.~ Since mother is in a retail business, her av~ilability through th<!?

school Christmas vacation holidays is limited. Therefore, the followin~

Christmas schedule has been recommended and accepted by the parties.

Each year, Donald will remain with mother from the dismissal of school ui1~H

will remain wi1h father for the balance of the Christmas school vacation period

until 4:00 p.m. the night before school reconvenes at which time mo1her will pick

up the child from father's residence or another mutually agreed upon location.

The parties agree that, in the event that mother's employment allows some days

off during this period, she will hav.e additional access 10 the child up to and

including half of the total school vacation period.

EaeteriSprlng Break: The EasterlSpring Break holiday will commence at

the dismissal of school on the last day of school and will conclude on Sunday

4:00 p.m. prior to the reconvening of school. This holiday will be observed il'1

two periods. The first period will commence at the dismissal of school and will

conclude on the following Wednesday at 2:00 p.m. at which time the second

period will commence. The second period will commence when the second

period parent picks up the child from the residence. The second period will

conclude on Sunday a1 4:00 p.m. prior to the day school reconvenes. In 1998

and all even-numbered years, Donald will be with father in the first period a!rld

mother in the second period. In 1997 and a/l odd-numbered years thereafter,

Donald will be with mother during the first period and father during the second

period.

Independence Day: The Fourth of July holiday will commence at 4:00 p.m.

on July 3rd and will conclude by 12:00 p.m. on July 5th. In 1998 and all even­

numbered years thereafter, the child will be with father and in 1999 and all odd­

numbered years thereafter. child will be with mother.

Mother's DaylFather's Day: The child will be with mother for the entire

Mothers Day weekend and father for the entire Father's Day weekend. Th~

weekend will commence on Friday afternoon at 2:00 p.m. and conclude on

Sunday at 4:00 p.m ..

Monday Holiday.: On all holidays celebrated on Monday, the child will

remain with the parent with whom he has spent the previous weekend. The

holiday will conclude on Monday at 4:00 p.m ..

There are no prOvisions for any other legal or religious holidays or any other

special days other than those specified above unless agreed to by the parents.

VACATIONS

During the summer period. each parent will have the opportunity to vacation

with the child during their regularly scheduled residential period. Th,®

vacationing parent will provide the other parent with written notice which wi!!

include a basic itinerary and/or destination information_

MEDtATION

If, at any time in the future, the parents have any concerns or disputes which

they are unable to resolve and they are at an impasse, or if either parent

believes it would be of benefit to consult the offices of the undersigned or any:

other appropriately trained and mutually agreed upon mental health

professional for the purpose of mediation to address and attempt to resolve thl)}

matter, then both parents will cooperative attend at least one consultation per

concern and share the cost equally unless otherwise agreed to.

12. Having had a spiritual awakening as the result of these steps, we tried to carry this message to alcoholics, and to practice these principles in all our affairs.

Many of us exclaimed, «What an order! I can't go through with it." Do not be discouraged. No one among us has been able to maintain anything like per­fect adherence to these prinCiples. We are not saints. The point is, that we are willing to grow along spiritual lines. The principles we have set down are guides to progress. We claim spiritual progress rather than spiritual perfection.

Our description of the alcoholic, the chapter to the agnostic, and our personal adventures before and after make clear three pertinent ideas:

(a) That we were alcoholic and could not manage our own lives.

(b) That probably no human power could have re­lieved our alcoholism.

(c) That Cod could and would if He were sought.

Being convinced, we were at Step Three, which is that we decided to turn our will and our life over to God as we understood Him. Just what do we mean by that, and just what do we do?

The first requirement is that we be convinced that any life run on self-will can hardly be a success. On that basis we aTe ahnost always in collision with some­thing or somebody, even though our motives are good. Most people try to live by self-propulsion. Each per­son is like an actor who wants to run the whole show; is forever trying to arrange the lights, the ballet, the scenery and the rest of the players in his own way. If

craving for liquor, and this often requires a definite hospital procedure, before psychological measures can be of maxi­mum benefit.

\Ve believe, and so suggested a few years ago, that the action of alcohol on these chronic alcoholics is a manifesta­tion of an allergy; that the phenomenon of craving is limited to this class and never occurs in the average temperate drinker. These allergic types can never safely use alcohol in any form at all; and once haVing formed the habit and found they cannot break it, once having lost their self­confidence, their reliance upon things human, their prob­leu.:; pile :1p G!! tte::!! a!:!d beC0:!!le ~stoni~hLl1gly oifficuIt to solve.

Frothy emotional appeal seldom suffices. The message which can interest and hold these alcoholic people must have depth and weight. In nearly all cases, their ideals must be grounded in a power greater than themselves, if they are to re-create their lives.

If any feel that as psychiatrists directing a hospital for alcoholics we appear somewhat sentimental, let them stand with us a while on the firing line, see the tragedies, the despairing wives, the little children; let the solving of these problems become a part of their daily work, and even of their sleeping moments, and the most cynical will not wouder that we have accepted and encouraged this move­ment. \Ve feel, after many years of experience, that we have found nothing which has contributed more to the rehabilitation of these men than the altruistic movement now growing up among them.

Men and women drink essentially because they like the effect produced by alcohol. The sensation is so elusive that, while they admit it is injurious, they cannot after a time differentiate the true from the false. To them, their alco­holic life seems the only normal one. They are restless, iuitable and discontented, unless they can again experience

if the rest of the world would only behave; the outlaw safe cracker who thinks society has wronged him; and the alcoholic who has lost all and is locked up. What­ever our protestations, are not most of us concerned with ourselves, our resentments, or our self-pity?

Sel£shness-self-centerednessl That, we think, is the root of our troubles. Driven by a hundred forms of fear, self-delusion, self-seeking, and self-pity, we step on the toes of our fellows and they retaliate. Some­times they hurt us, seemingly without provocation, but we invariably IiuJ ttiat at some time in the past we have made decisions based on self which later placed us in a position to be hurt.

So our troubles, we think, are basically of our own making. They arise out of ourselves, and the alcoholic is an extreme example of self-will run riot, though he usually doesn't think so. Above everything, we alco­holics must be rid of this sel£shness. We must, or it kills us! God makes that pOSSible. And there often seems no 'vay of entirely getting rid of self without His aid. Many of us had moral and philosophical con­victions galore, but we could not live up to them even though we would have liked to. Neither could we reduce our self-centeredness much by wishing or try­ing on our own power. We had to have God's help.

This is the how and why of it. First of all, we had to quit playing God. It didn't work. Next, we decided that hereafter in this drama of life, God was going to be our Director. He is the Principal; we are His agents. He is the Father, and we are His children. Most good ideas are simple, and this concept was the keystone of the new and triumphant arch through which we passed to freedom.

The physician who, at our request, gave us this let­ter, has been kind enough to enlarge upon his views in another statement which follows. In this statement he connrrrLS \vhat "~·vc 'llho h3.'./e suffered alcoholic torture must believe-that the body of the alcoholic is quite as abnormal as his mind. It did not satisfy us to be told that we could not control our drinking just because we were maladjusted to life, that we were in full Hight from reality, or were outright mental defectives. These things were true to some extent, in fact, to a consider­able extent with some of us. But we are sure that our bodies were sickened as well. In our belief, any pic­ture of the alcoholic which leaves out this physical factor is incomplete.

The doctor's theory that we have an allergy to al­cohol interests us. As laymen, our opinion as to its soundness may, of course, mean little. But as ex­problem drinkers, we can say that his explanation makes good sense. It explains many things for which we cannot otherwise account.

Half measures availed us nothing. We stood at the turning point. We asked His protection and care with complete abandon.

Here are the steps we took, which are suggested as a program of recovery:

1. We admitted we were powerless over alcohol­that our lives had become unmanageable.

2. Came to believe that a Power greater than our­selves could restore us to sanity.

3. Made a decision to turn our will and our lives over to the care of God as we understood Him.

4. Made a searching and fearless moral inventory of ourselves.

5. Admitted to God, to ourselves, and to another human being the exact nature o.f our wrongs.

6. Were entirely ready to have God remove all these defects of character.

7. Humbly asked Him to remove our shortcomings. 8. Made a list of all persons we had harmed, and

became willing to make amends to. them all. 9. Made direct amends to such people wherever

possible, except when to do so would injure them or others.

10. Continued to take personal inventory and when we were wro.ng promptly admitted it.

11. Sought through prayer and meditation to im­prove our conscious contact with God as we un­derstood Him, praying only for knowledge of His will for us and the power to carry thai out.
