How Will New Tax Rules Affect You?

now that the tax relief, Unemployment insurance reauthorization, and Job Creation Act of 2010 is law, you’ll want to familiarize yourself with how this new legislation affects you — both as a wage earner and an investor.

Consider these key parts of the new tax laws:• Income tax rates remain the same. Under previous

legislation, tax rates were scheduled to rise in 2011, but the new laws will keep all tax brackets the same.

• Payroll taxes reduced by two percent. your share of the social security payroll tax will drop from 6.2 percent to 4.2 percent for 2011. Consequently, you should see more take-home pay. . you may want to consider investing at least part of this savings in another retirement account, such as an irA.

• Top capital gains and dividend tax rates stay at 15 percent. the question of what would happen to capital gains and dividend taxes has been of great interest to most investors. two years. you now still have a strong incentive to follow a “buy-and-hold” investment strategy, under which you’d earn the favorable 15 percent rate on capital gains from selling an appreciated asset, such as a stock, that you’ve held at least one year. And the 15 percent rate on dividend taxes will continue to provide you with good reason to seek out those stocks that regularly pay dividends; besides offering an advantageous tax rate, dividends, when reinvested can help build your ownership stake in the dividend-paying investments. (Keep in mind, though, that companies are not obligated to pay dividends and can reduce or discontinue them at any time.)

• Estate tax exemption set at $5 million per person. Under previous tax laws, the estate tax was scheduled to be repealed entirely for 2010 only, and then return in 2011, with an exclusion amount of $1 million and a top tax rate of 55 percent. Under the new legislation, the exclusion amount for 2011 and 2012 is $5 million per person ($10 million for married couples), with a top tax rate of 35 percent. the new law also includes a “portability” provision which can provide increased flexibility in estate planning between married couples to attain full use of the $10 million exemption. you’ll need to see your tax and legal advisors to determine what, if

Under previous tax laws, the gift tax exemption for lifetime gifts was $1 million. the new legislation increases the lifetime gift tax exemption to $5 million per person. you should work with your tax and legal professionals to determine whether the new exemption amount provides opportunities for you to consider during the next two years.

painting the exterior of your house is a major task, but one that helps retain both the aesthetic and real estate value of your home. if you are keeping the same color that is currently on your home, the process is shortened and easier. But, if you have decided it’s time for an update, choosing a new color can be a nerve-wracking experience.

Here are a few tips you may keep in mind: 1. take a look at your neighbors’ houses and note the colors you like. 2. Be sure to pick colors that will complement your neighborhood and the

surrounding houses, neutral or subtle colors are best. 3. Once you have narrowed your choice of colors for your exterior house walls,

trim, garage door, and front door, collect the manufacturer’s paint names and color numbers to make it easier for you to match when it’s time to buy the paint.

4. Any change in exterior appearance to your home requires approval from the Architectural & design review Committee before the work begins. you will need to fill out an ACC application with all information of your improvement. ACC applications can be found on the Avery ranch HOA website’s (www.averyranchhoa.com) front page. Applications may take up to 45 days to be approved or declined so be sure to give as much information as possible to insure a quicker judgment.

What a shame to live in one of the premier communities of Austin, only to find people’s trash at the pool areas. Our amenities exist for the enjoyment of responsible residents who take pride in our community. it seems that the Water’s edge Amenity Center has become the party spot of Avery ranch. it is unfortunate that management has altered the schedule of the porter in order to accommodate the dAily clean up of accumulations of glAss beer bottles and various other trash. not only is this littering irresponsible, it is also dangerous and expensive. imagine when swim season begins and people are dodging broken glass in the pool area. remember, it is your money that is paying for our porter services. He could be performing much more useful work other than picking up garbage that should have been placed in the appropriate bins. pleAse remember that glAss containers are nOt AllOWed in the pool areas. Above all, let’s at least ACt responsibly as adults and clean up after ourselves.

Holiday Hay Ride & santa Visit

On saturday, december 18th, the social Committee put on the Holiday Hayride event. two horse drawn and festively decorated carriages rode around the Morningside amenity center. santa and his helper were there from the north pole beside a beautiful, roaring fire. the music and decorations made the evening quite merry. Cookies, hot chocolate and coffee warmed up the revelers. the weather was seasonally perfect!

Over 500 residents came to participate. thanks to all the ArsC volunteers who helped organize and made this event happen. please consider being a part of your community by volunteering. A few hours of your time will go a long way to keeping Avery ranch a great social community. the social committee meets the first thursday of the month at the MAC at 7pm.

We look forward to Santa visiting us again next year!

Brookside residents were serenaded by about 40 carolers of all ages in december as neighbors joined with a group from st. Julian of norwich episcopal Church to carol and spread holiday cheer.

the group gathered at the Bindel’s home for build-your-own burritos and holiday drinks before bundling up on a festively chilly night to sing to neighbors whose porch lights were lit. Communication via the neighborhood message boards asked that those open to a visit from carolers leave on a porch light.

tracy perry, a Brookside resident, said the group was impressive. “such a big group!” she said. “And i loved that all of the little ones were there.”

the singers ranged in age from infants in strollers to kids running ahead to be the first to ring the bell on up to adults.

not all neighbors were expecting the carolers, but most seemed excited about their unexpected guests. “After we sang to one family, the dad stopped us to sing again so he could capture a video of us caroling,” one of the carolers said.

st. Julian of norwich is a new church that plans to build permanently in the Avery ranch area in the coming years, the rev. Miles Brandon said.

“it is our hope to eventually have a permanent home very convenient for those living in and around Avery ranch,” Brandon said. “We hope to continue to be a profound expression of god’s love for all who live in and around Avery ranch. thanks for opening your doors to us and letting us share with you some of the blessings of this season.”

iNGRedieNTs (foR 6 seRViNGs)1 small butternut squash (about 1 pound) , peeled, seeded, and cut into 1-inch cubes (about 3 cups)1 cup homemade or low-sodium canned chicken stock, skimmed of fat1 1/2 cups nonfat milkpinch of freshly grated nutmegpinch of cayenne pepper3/4 teaspoon coarse saltFreshly ground black pepper1 pound elbow macaroni4 ounces extra-sharp cheddar cheese, finely grated (about 1 cup)4 tablespoons parmesan cheese, finely grated (1 ounce)

diRecTioNs1. preheat oven to 375 degrees. Combine squash, stock, and milk

in a medium saucepan; bring to a boil over medium-high heat. reduce heat to medium; simmer until squash is tender when pierced with a fork, about 20 minutes. remove from heat. Mash contents of saucepan; stir in nutmeg, cayenne, and salt, and season with black pepper. stir to combine.

2. Meanwhile, bring a large pot of water to a boil. Add noodles; cook until al dente according to package instructions, about 8 minutes. drain, and transfer to a large bowl; stir in squash mixture, cheddar, ricotta, and 2 tablespoons parmesan.**

3. lightly coat a 9-inch square baking dish (4 inches deep) with cooking spray. transfer noodle mixture to dish.

4. in a small bowl, combine breadcrumbs, remaining 2 tablespoons parmesan, and oil; sprinkle evenly over noodle mixture.

5. Cover with foil, and bake 20 minutes. remove foil, and continue baking until lightly browned and crisp on top, 30 to 40 minutes more. serve immediately.

** you can stop at this point and your dish will be a creamy Mac & Cheese. Without the breadcrumb topping, you can cut about half a gram of fat and 11 calories a serving.

In this month’s editorial column, we’re addressing two matters concerning our community. seT YouR TRees fReeBarbara, our neighbor from Granite Shoals wrote to us:

“When i walk around my neighborhood in granite shoals, i see so many trees that were planted at the time most homes were constructed: 4-5 years ago. so many people have left the wire ties from the support stakes to the trees tied around the trunks. these trees are being so severely strangled they are dying in many cases. Other tree trunks have grown around the wires and are severely deformed. even if some people have cut the wires they have left the stakes which are an eyesore. i feel that Avery ranch HOA should insist that homeowners remove the wires And stakes which are no longer necessary. is there any hope of accomplishing this with an announcement in the newsletter perhaps?”

As a novice gardener, i felt that i could only respond to Barbara’s concerns aesthetically – yes, those tree stakes can be an eyesore, along with those pvC pipes from utility companies that stick up from the ground but aren’t used (why can’t they remove the latter if you’re not subscribing with them and you’re the homeowner?)

so i forwarded her note to travis County Master gardener and Avery ranch resident Bob Beyer, and this is what he had to say:

“i did some internet research to make sure this question is answered using reliable sources. texas A&M Agrilife extension service provides the following advice regarding the staking of a tree:

For most trees, staking is not recommended; however, if the tree trunk is not sturdy enough, use two stakes, one on either side of the tree, and give the trunk support for the first year only. http://aggie-horticulture.tamu.edu/extension/homelandscape/tree/planting.html

staking is usually a short term thing to allow weak trunks on very young or newly planted trees to gain the strength they will need to sustain the additional weight of the tree crown in later years. the duration of staking depends on the tree size, physical characteristics, and how it responds; again, remove the staking as soon as the tree can support itself. Almost all trees staked beyond two years, have greater probability of breakage than trees which are staked for shorter periods of time.

in addition, staking support lines create a tripping hazard which could cause a property owner a liability concern. Also, a tree is a major dollar investment, so why would any reasonable homeowner want to kill or misshapen their trees, only to have to bear the expensive cost to remove and replace them when and if they die? trees are a valuable ecological asset and are protected by City of Austin regulations. let’s protect our trees!”

there you have it. set your trees free, remove those ties and stakes from your trees by following the guidelines aforementioned.

MiscHief ANd PRANks oVeR THe HolidAY seAsoN

Our community looked so bright and sparkly during the holiday season with the holiday decorations many residents took time to set-up. Holiday cheer was intensified with carolers, a Holiday Hay ride and a santa Corner. there were over 300 residents who participated in the last two events that were held simultaneously and pumped up the winter holiday mood. thus it is disheartening to note that there were pranksters who marred this atmosphere. in one instance, a nativity scene put together by a resident had the babe in the manger figurine stolen, and the shepherd figurine went missing the following night. these pranks casted a shadow on the homeowner’s joyous holiday atmosphere.

you will also read an article in this issue how some people have ‘partied’ in our community facilities and left liquor glass bottles behind, even though there are rules posted that glass containers are not allowed in these community shared properties due to safety concerns.

let’s be mindful when using community shared properties and avoid pranks that violate a neighbor’s private property. With valentine’s day and Mardi gras just around the corner, let the good times roll responsibly!

As we look forward to spring, it is time to dream about improving our gardens and landscaping in 2011 and one of the best ways to get fresh ideas is to visit other gardens in Avery ranch, talk to the garden hosts, share experiences, get imaginative ideas, and as a pleasant fringe benefit – get to know your neighbors better.

Our annual garden tour in Avery ranch, a sponsored activity of your social Committee, will be saturday, May 21st beginning at 10 AM. this will be the tour’s fifth year. the tour is free and open to all Avery ranch residents and guests. this year ‘s theme will be “the Joy and diversity of Home gardening”, looking for gardens of all types, vegetable or ornamental. We can take up to ten gardens maximum. the garden tour is nOt a competition and all it takes to be on it is your willingness. We hope to get gardens

from as many different neighborhoods as possible on the tour.

All that is required is to open your yard and garden to your neighbors from 10 AM until 3 pM on tour day, be present to talk to them about it and your gardening experiences in Avery ranch, and be prepared to have a lot of fun doing it! it’s a toss-up as to who enjoys the tour most, the visitors or the hosts. We also could use a few volunteers to help with the operation of the tour, so if your yard isn’t part of it, you can still be. volunteers enjoy the
