For an auto body shop, it may mean substituting an aftermarket part, even though the customer or insurer paid for an OEM part. For a general automotive repair shop, it can mean up-selling services or parts.

The consequences of improper and illegal actions have been well documented in this newsletter. BAR recently concluded a major consumer fraud case against a franchisee of Midas International. To some extent, the same principal applies to regulatory agencies like the Bureau of Automotive Repair (BAR). The success of BAR depends, in part, on having a licensing system that is relevant and responsive to the marketplace it is tasked with regulating.

With this in mind, BAR retained the services of two independent consultants to assess the regulatory structure for licensing individuals and stations in the Smog Check marketplace. The consultants’ evaluations built upon a formal assessment conducted by BAR and the Department of Consumer Affairs. Part of this evaluation involved soliciting input from more than 5,000 Smog Check station owners, technicians, and educators.

Smog Check Licensing Restructure (continued from cover)

The consultants completed their assessment in 2009. They found that the Smog Check Program’s licensing structure is outmoded and must be restructured to reflect today’s marketplace. One consultant even went so far as to say that BAR’s current licensing strategy might be best described as one size fits all, as it treats all technicians the same regardless of the job they perform or the level of knowledge, skill, and ability they already possess. In many cases, technicians are required to be licensed beyond the scope of the work that they are allowed to perform. Additionally, other highly skilled and proficient technicians are deterred from becoming licensed. These proficient technicians often work in shops that specialize in the repair of a particular brand of vehicle, including independents and new car dealers.

Under the proposed restructure, stations and technicians will be able to choose a license combination that best fits their business needs and career goals. For example, a Test-Only Smog Check station may opt to hire individuals who possess a license to test but not repair vehicles that fail an inspection. Conversely, an individual interested in testing and repairing vehicles that fail an inspection will have a specialized license to do just that.

Existing Test-Only and Test-and-Repair station licenses will not be affected by this proposal. All existing Test-and-

Repair licenses for technicians will remain unchanged, although the distinction between Basic and Enhanced program areas will be abolished. In addition, the Intern License will be eliminated.

Ultimately, this flexible licensing structure will help improve the effectiveness of the Smog Check Program. Stations will be able to choose the option that best meets their needs and the technician’s qualifications will be specific to the services for which they are licensed to provide. Licensing paths will be available for highly skilled and proficient technicians as well as for those with less experience. In both cases, qualifications, including training, will meet the needs of the job.

These are significant changes that will require a change to regulations. The regulatory update is being pursued in consultation with industry and the public. To date, BAR has conducted several public workshops and will conduct several more in the upcoming months. Stations, technicians, and educators are invited to share their views and ideas.

BAR makes every effort to ensure that licensees have the information necessary to comply with the law to avoid these situations. The Education First Program provides licensees an excellent one-on-one opportunity to learn about BAR and the law. Write It Right is essential reading for every licensee. The Smog Check Manual, which was recently revised, provides valuable information to technicians and stations.

Of course, even the most comprehensive educational effort means nothing to a licensee determined to break the law. That’s where BAR’s enforcement program comes in. On any given day, BAR has hundreds of highly-trained professionals investigating complaints, auditing shops, and inspecting facilities to ensure compliance with the law.

BAR also has world-class engineers who constantly review and analyze data to determine which stations and technicians may not be playing by the rules. They also employ the latest technology to help ensure the integrity of the industry.

BAR has been around for a long time. If there is one thing we’ve learned over the years, it is that unscrupulous operators will often work overtime to evade detection by BAR. BAR, in turn, must work even harder to stay one step ahead. Eventually, we will find licensees who fail to comply with the law and when we do, we take appropriate action as necessary.

Consumer Assistance Program Set to Expand

Off-cycle vehicles now eligible for retirement; vouchers to be offered to some consumersBig changes are coming to the Consumer Assistance Program (CAP). And those changes will benefit almost anyone who owns a car, truck, or SUV.

Beginning in early 2011, the Bureau of Automotive Repair (BAR), in conjunction with the California Air Resources Board (ARB), will expand the vehicle retirement option of CAP to include off-cycle vehicles. The owners of these vehicles will need to meet most of the same eligibility requirements as on-cycle vehicles, and consumers will receive $1,000 if they qualify. Unlike on-cycle vehicles, owners of off-cycle vehicles will not need to fail a Smog Check inspection in order to qualify.

In conjunction with the off-cycle vehicle retirement program, the ARB will be working with the San Joaquin Air Pollution Control District and the South Coast Air Quality Management District to implement a voucher program. The districts will be responsible for targeting owners who retire their off-cycle vehicles through CAP to participate in the voucher program.

Eligible consumers will receive either $2,000 or $2,500 toward the purchase of a newer vehicle. Consumers will be able to redeem their vouchers at participating car dealerships. Consumers can also use the vouchers to purchase transit passes from participating transportation districts.

“Expanding the vehicle retirement program is a really big deal,” notes Tonya Blood, Program Manager for CAP. “We at CAP receive many

applications from consumers who want to retire their vehicles but do not necessarily meet the eligibility requirements for CAP as things now stand.”

“This change in CAP to include off-cycle vehicles goes a long way to helping the State achieve its vehicle emissions reduction goals. It also gives consumers an avenue for disposing of their high polluting vehicles,” notes Chief Sherry Mehl.

Look for an expanded CAP and new application this December. Gold Shield and Test-Only stations will receive a

supply of the new applications shortly before implementation.

BAR Auto Body Inspection Program Going Strong

One of the most popular and useful services offered to consumers by the Bureau of Automotive Repair (BAR) is the Auto Body Inspection Program. This program is designed to help consumers who feel that the auto body repairs performed on their vehicle did not meet their expectations or were not what they paid for.

The consumer response to this service has been overwhelmingly positive. In 2009, BAR received 240 requests from consumers to inspect their vehicles. Of those requests, 194 inspections were completed. As a result of these inspections, 63 vehicles had issues with the work performed. Problems identified by BAR representatives ranged from minor quality and fit and finish issues to more significant problems.

“The Auto Body Inspection Program is a particularly valuable service to consumers,” notes BAR Chief Sherry Mehl. “I encourage shops that feel a customer may not have received the services they paid for from another shop to have the customer call BAR.”

Analyzer UpdateThe Bureau of Automotive Repair (BAR) continues to move forward in the development and procurement of a replacement for the BAR-97 analyzer. Green Station Recognition Program Continues to GrowProgram is particularly popular with consumersSince its inception, the Green Station Recognition Program has proven to

be quite popular with stations. The 27 shops that have signed on so far say that the program has been a great tool to distinguish themselves from their competitors and is a useful marketing tool.

The Green Station Recognition Program, which is administered by the Department of Toxic Substances Control, is designed to recognize businesses that engage in environmentally friendly practices as part of their normal business. Participation in the program is voluntary and there are no fees to participate.

The consumer response to the program has been extremely positive, as many make a point of selecting a shop based on its green certification.

Sean Leland patronizes Arreguin Performance in Ukiah not just because of the service he gets, but because it also happens to be a green station. “I absolutely support businesses that take care of the environment,” Leland says. “I never see oil or puddles of fluids on the ground when I visit Arreguin Performance, so I know they don’t seep into the ground and harm the environment,” he adds.

The green station certification also serves as an important marketing tool for shops.

Marvin-Donald Cruse says the green certification was a key fact that helped him to select The Dr. Independent Service as his primary repair shop. “There are many shops out there that can fix a car,” notes Cruse. “The Dr. Independent Service was the only shop in my area that had the designation, so it made my decision to go with them that much easier.”

Marc Kennedy, owner of The Dr. Independent Service, notes that doing little things, like replacing styrofoam cups with glass cups for coffee is just one of the things customers notice when they come into his shop. Other things, like using a car wash clarifier to separate oils and solids and working with a company to dispose of the empty aerosol cans are actions that may not be readily apparent to his customers, but they have a big impact on the environment.

Becoming Green Recognized is EasyIf you’re interested in your facility becoming a Green Station you can download an application from the BAR Web site at www.smogcheck.ca.gov and click on the “Green Station Program” link.

With your completed application, include the DTSC Model Shop Pollution Prevention Checklist, a copy of your most recent hazardous materials inspection report and air district inspection report, your DTSC “Summarize Your Environmental Benefits” form, the P2 Opportunities Checklist, and mail to the address on the application. If approved, DTSC will notify BAR and you will receive your Green Station certificate to post at your station.

Legislation Aims to Improve Smog Check ProgramThe California Air Resources Board (ARB) and the Bureau of Automotive Repair (BAR) are jointly sponsoring legislation that is projected to save consumers money, save time, and provide greater air quality benefits from the State’s Smog Check Program.

Addressing challenges raised by a recent analysis of the Smog Check Program, Assemblymember Mike Eng (D-Monterey Park) introduced AB 2289 that will improve service to more than 70 percent of vehicles in California subject to the program. The bill also directs older, high-emitting vehicles to the highest performing stations.

“The Smog Check Program is one of the most important air quality programs that we have to meet State and Federal air quality standards,” stated Assembly Member Mike Eng. “AB 2289 is designed to improve the program in reducing pollution through the use of new technologies that provide considerable time and cost savings to consumers while at the same time improving consumer protections by adopting more stringent fine structures to respond to stations and technicians that perform improper and incomplete inspections.”

“If signed, this bill will allow a major upgrade in the technologies used to test vehicle emissions,” said BAR Chief Sherry Mehl. “It will result in cleaner air and has the potential to reduce the cost of a Smog Check for many consumers, as well as reduce the time spent by consumers getting their vehicles inspected.”

“This new and improved program will have the same result as taking 800,000 old cars off the road, also resulting in a more cost effective program for California motorists,” said ARB Chairman Mary D. Nichols. “This bill will add additional improvements to one of our most effective programs in our fight for clean air, capturing up to 70 tons per day of smog-forming emissions.”

One way the program would reduce costs is by taking advantage of on-board diagnostic (OBD) technology installed in all new vehicles since 1996. The program will now take better advantage of OBD technology by eliminating tailpipe testing and instead using the vehicle’s own emissions monitoring system. This system has saved consumers time and money in 22 other states.

The recent review of the Smog Check Program revealed that 19 percent of vehicles that initially passed testing failed subsequent roadside tests within a short period of time. The audit can be found at www.arb.ca.gov/msprog/smogcheck/smogcheck.htm.

In response to these findings, Assemblymember Eng designed legislation that includes the following:

Authorize the use of On-Board Diagnostic II testing >to expedite the process;

Test vehicles known to release large amounts of >pollution at stations with the highest performance ratings;

Impose a stricter fines structure for improper >inspections;

Permit the State to contract with the private >sector to manage franchise-like networks of independently owned Smog Check stations;

Mandate an annual evaluation of station >performance using roadside tests; and

Encourage community colleges and other >training institutions to develop technician-training programs.

Report Unlicensed ActivityDo you suspect a shop or competitor engaged in repairing vehicles is not registered with the Bureau of Automotive Repair (BAR)? Then let us know!

It is against the law for individuals to engage in the repair of motor vehicles for compensation unless they have a valid registration. BAR takes this issue very seriously because unlicensed businesses create an unfair advantage and can harm the consumer.

If your ARD registration has expired, you must renew it or immediately cease performing automotive repairs.
