"(dd) A Government servant shall have an

option to continue in Govt. service beyond the age

of superannuation I.e. 58 years till the attainment

of age of 59 years subject to the conditions as

mentioned below:-

(i) The extension in service shall be allowed onlyto those Government servants who exercise anoption on prescribed 'Proforma' annexed to thisNotification. The requisite option shall be submittedto the Head of Office or Head of Department, wellbefore six months of attaining the age ofsuperannuation I.e. 58 years. The option onceexercised will be treated as final and shall not beallowed to be withdrawn/ changed in anycircumstance,

Provided that the Government servants, inwhose cases the date of superannuation is before

the expiry of six month from the date ofcommencement of this notification, they mayexercise option at any time before the date of theirsuperannuation and after the issue of thisNotification.

(ii) During the extension, the Governmentservant shall continue to draw the same pay whichwas being drawn by him at the time of attainingthe age of superannuation i.e. 58 years.

Provided that increases in the dearnessallowance as may be sanctioned by. theGovernment from time to time shall be admissibleduring the extension.

Provided, further that the Government servantwill be considered for promotion in case ofavailability of promotional post during the extendedservice. In case of such promotion, pay will befixed from the date of promotion.

(iii) The Government servant will be entitled toreceive pensionary benefits on completion of hisextended service.

(iv) The extension in service will be subject tosatisfaction of the State Government and the StateGovernment may withdraw the extension given atany stage."

GOVERNEMNT OF HIMACHAL PRADESHANANCE(REGULATIONS) DEPARTMENT

NOTIFICATION

In exercise of the powers conferred by proviso to Article 309 of the

Constitution of India, the Governor, Himachal Pradesh is pleased to make

following rules to amend Rule-56 of the Fundamental Rules, in their application to

the State of Himachal Pradesh, namely:-

1. Short Title and 1. (i) These Rules may be called the Fundamental

Commencement. (in their application to the State of Himachal

Pradesh) Amendment Rules, 2014.

(ii) They shall come into force from the date of

publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Rule-56. 2. In Rule-56 of the Fundamental Rules;

(a) after clause (d), the following clause (dd) shall be inserted,

namely:-

"(dd) A Government servant shall have an option to continue in

Govt. service beyond the age of superannuation I.e. 58 years till

the attainment of age of 59 years subject to the conditions as

mentioned below:-

(i) The extension in service shall be allowed only to thoseGovernment servants who exercise an option onprescribed 'Proforma' annexed to this Notification. Therequisite option shall be submitted to the Head of Officeor Head of Department, well before six months ofattaining the age of superannuation I.e. 58 years. Theoption once exercised will be treated as final and shall notbe allowed to be withdrawn/ changed in anycircumstance.

Provided that the Government servants, inwhose cases the date of superannuation is before theexpiry of six month from the date of commencement ofthis notification, they may exercise option at any timebefore the date of their superannuation and after theissue of this Notification.

(ii) During the extension, the Government servant shallcontinue to draw the same pay which was being drawn byhim at the time of attaining the age of superannuation i.e.58 years.

Provided that increases in the dearnessallowance as may be sanctioned by the Government fromtime to time shall be admissible during the extension..

Provided, further that the Government servantwill be considered for promotion in case of availability ofpromotional post during the extended service. In case ofsuch promotion, pay will be fixed from the date ofpromotion.

(iii) The Government servant will be entitled to receivepensionary benefits on completion of his extended service.

(iv) The extension in service will be subject to satisfaction ofthe State Government and the State Government maywithdraw the extension given at any stage."
