Several months ago I was asked to serve on a Green Space Committee charged with developing an ordinance to present to the Bismarck City Commission. The green space initiative is aimed at preventing the sometimes unattractive urban sprawl by requiring buffers such as parks, private recreation areas or even natural drainage sites and topography. The ordinance would mandate that developers set aside 7%

of all developable land for green space, but that the developer could pay the cash value of the land or some combination of both. The location of the land and/or the amount of cash would need to be agreed upon by the park board and the developer before annexation with the final arbiter of disagreements being the city commission. Any money collected by the park board is to be used in the general area where it is collected on new parks or the expansion of existing parks in the area.

It is hard to argue against the concept of green space. Parks are a great place for family activities and buffer areas add to the beautification of our city. However, I would advise our members to be cautious in supporting the ordinance because of the timing involved. Our city has never seen a period of more demand for residential lots, nor more rapid inflation of prices. It seems counterintuitive then to adopt an

ordinance which would take a good portion of those lots off the market and increase the prices of the lots that remain. There is no doubt that green space will add value to a development and most developers are already incorporating them, take the landscaped areas around Boulder Ridge, the coulees behind Eagle Crest or the lake down at Southbay for example.

At the public input meeting for the ordinance, the concern was raised by a local developer that his new residents would be taxed twice, once when they pay the extra expense on the lot, and again when they pay their property taxes of which a large portion goes to the parks. Bismarck is littered with park space that remains unused or at least underutilized. We should be encouraging the park board to take advantage of the space that they already own and to seek out developers to procure land where new parks are feasible. Otherwise, all we will do is add extra time and expense to land development when we can’t afford either.

As you drive around town, you’re sure to see yellow - yellow vans, yellow VW bugs, yellow trucks. And what does all that yellow make you think of? Shoot is August 23 The summer is far too quickly coming to an end,

but we’ve got one more bit of summer fun before fall hits. The Sporting Clay Shoot will be held August 23 at Capital City Sporting Clays Shooting Complex.

Players will shoot in teams of four, but you don’t need to sign up as a team. The shells and earplugs are provided, but shooters must bring their own shotguns and safety glasses (or sunglasses). The cost per shooter is $75 and includes a picnic following the shoot. Registration begins at 3:30 p.m. with start at 4 p.m.

Fall Parade of HomesSeptember 27-30

While the calendar still said July, our minds were already on fall. Contracts have been sent out to the interested builders for the Fall Parade of Homes already. However, we are still looking for more entries! The deadline for entry contracts is August 10. The entry fee is $500 for the first home, and $375 for each additional home. If you would like to enter a home, contact the BMHBA office at 222-2400 or email [email protected].

The Parade hours will be the same as last year: Thursday and Friday 6 p.m. - 8:30 p.m., Saturday 11 a.m. to 5 p.m., and Sunday noon to 5 p.m. All Parade homes must have a builder representative there during Parade hours.

The Parade of Homes magazine, containing the map of the house locations and photos of each home, will be available at local grocery stores the week of the Parade. If your business would like to advertise in the Parade publication, contact Deb Seminary from The Printers at 255-3422. The Printers will handle all ad sales in the magazine. The deadline to reserve a space in the magazine is August 24.

We encourage any builders with homes nearly completed to consider entering the Parade, and hope you’ll all mark your calendars to attend!

Permit numbers used were for only single family homes in Bismarck and Mandan. Up until this point, 2006 was the record high for year-end permits at 585. However, barring extreme circumstances, we are set to exceed that total this year as the YTD June total increased by 107 compared to 2006 and by 146 compared to last year at this time.

National News: What Are NAHB’s Priority Issues? Housing Production Credit, Foreclosures and Appraisals

(a series featuring different priorities in detail each month)As a member of the BMHBA, you are also a member of

the state (NDAB) and national (NAHB) associations. These branches of the HBA network are crucial when working on laws and industry regulations on the state and national levels. With the help of your PAC contributions and membership dues, NAHB is able to maintain their staff and garner support for the issues that can impact the building industry the most. This article is the beginning of a series of articles detailing the top seven legislative priorities of NAHB.

1. End the Housing Production Credit CrisisIt is absolutely vital to get credit flowing to the housing

sector again. In the current regulatory climate, many lenders have basically stopped making acquisition, development and construction (AD&C) loans that are necessary to allow builders to construct new homes. Credit is the lifeblood of housing.

Federal bank regulators maintain that they are not encouraging institutions to stop making loans or to indiscriminately liquidate outstanding loans. However, NAHB members who are dealing with banks all across the country suggest that bank examiners in the field are adopting a significantly more aggressive stance on AD&C loans out of fear of the regulators coming into the banks and targeting them.

NAHB is urging Congress to support bills pending in the Senate and House that would help restore the flow of credit for home building. Sen. Robert Menendez (D-N.J.) on Feb. 7 introduced S. 2078, the Home Building Lending Improvement Act of 2012, which offers a legislative solution aimed at ending the freeze in housing production credit that has forced countless home building firms across the nation to shut their doors. Similar legislation to resolve the ongoing credit problems for home builders was introduced in the House last year by Reps. Gary Miller (R-Calif.) and Brad Miller (D-N.C.). H.R. 1755, the Home Construction Lending Regulatory Improvement Act, has more than 85 cosponsors.

The Federal Reserve Chairman Ben Bernanke said that his message to regulators is for them to take a balanced approach and to approve loans for those who meet sound underwriting standards. “Do not turn away creditworthy borrowers, and that includes home builders,” said Bernanke.

2. Resolve Foreclosure and Appraisal ProblemsForeclosures: Record numbers of foreclosures

nationwide are driving down home values, destabilizing communities, costing jobs and preventing a full-fledged housing and economic recovery. The lower home values

caused by foreclosed homes are also forcing many home owners “underwater” or, in other words, to a situation where they owe more on their mortgage than their home’s current market value. Preventing foreclosures and keeping people in their homes is essential to stabilize home prices, strengthen communities across the land and get the recovery up to full speed.

Appraisals: The large numbers of foreclosures in most areas have inevitably led to numerous problems in the housing market, especially regarding appraisals. Flawed appraisals are a major problem for home buyers, owners and builders. Too often, appraisers are using distressed properties – many of which have been neglected and are in poor physical condition – as comparables in assessing the value of well-kept existing and brand new homes without accounting for major differences in condition and quality.

Low appraisals are affecting those trying to refinance, move-up buyers and prospective home buyers. It is telling that 60 percent of builders responding to an NAHB member survey in late 2011 reported receiving appraisals on new homes that were lower than the contract sales price, and more than half of the builders reporting that they had encountered this problem said the appraisal amount was less than the cost of construction.

Such appraisal practices are not only unfair and unreasonable, they perpetuate the cycle of declining home values, drive more home owners underwater and act as an obstacle to the recovery of the housing market. Moreover, the lower property values triggered by foreclosed homes are shrinking the local tax base of many communities. This is putting further pressure on already cash-strapped state and local governments to keep essential services at acceptable levels.

Major reforms in appraisal practices and oversight are needed to ensure that appraisals accurately reflect true market values and don’t contribute to price volatility, hold back the economic recovery or harm aspiring home owners and move-up buyers.

Builder Confidence Rises Six Points in July Builder confidence in the market for newly built, single-

family homes rose six points to 35 on the National Associa-tion of Home Builders/Wells Fargo Housing Market Index (HMI) for July. This is the largest one-month gain recorded by the index in nearly a decade, and brings the HMI to its highest point since March of 2007.

“Builder confidence increased by solid margins in every region of the country in July as views of current sales con-ditions, prospects for future sales and traffic of prospective buyers all improved,” said Barry Rutenberg, chairman of the National Association of Home Builders (NAHB) and a home builder from Gainesville, Fla. “This is greater evidence that the housing market has turned the corner as more buyers perceive the benefits of purchasing a newly built home while interest rates and prices are so favorable.”

“Combined with the upward movement we’ve seen in other key housing indicators over the past six months, this report adds to the growing acknowledgement that housing – though still in a fragile stage of recovery – is returning to its more traditional role of leading the economy out of reces-sion,” noted NAHB Chief Economist David Crowe. “This is particularly encouraging at a time when other parts of the economy have begun to show softness, and is all the more reason that the challenges constraining housing’s recovery – namely overly tight lending conditions, poor appraisals and the flow of distressed properties onto the market – need

to be resolved.” Derived from a monthly survey that NAHB has been con-

ducting for the past 25 years, the NAHB/Wells Fargo Hous-ing Market Index gauges builder perceptions of current sin-gle-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores from each com-ponent are then used to calculate a seasonally adjusted index where any number over 50 indicates that more build-ers view conditions as good than poor.

Every HMI component recorded gains in July. The com-ponents gauging current sales conditions and traffic of pro-spective buyers each rose six points, to 37 and 29, respec-tively, while the component gauging sales expectations for the next six months rose 11 points to 44.

Likewise, every region posted HMI gains in July. The Northeast registered an eight-point gain to 36, while the Midwest gained three points to 34, the South gained five points to 32 and the West gained 12 points to 44.
