The Savannah District has recieived an application for a Department of the Army Permit, pursuant to Section 404 <>f the Clean Water Act (33 U.S.C. 1344), as follows:

Location of Proposed Work: The 249.84 acres project site is located west of U.S. Highway 301 and south of Broadlhurst Road West, 5.6 miles east of the town of Screven, Wayne County, Georgia (Latitude 31 .4518, Longitude -81. 924 7).
Description of Work Subject to the Jurisdiction of the U.S. Army Corps of Engineers: The applicant, Central Virginia Pr-operties, LLC (CVP), has proposed to discharge dredged or fill material into 24.68 acres of jurisdictional wetlands for the purpose of constructing a rail yard operation, including affiliated attendant features, such as unloading structures, rail car wash down stations, parking, dump truck turnarounds, and employee office. The rail yard W()Uld include: 1) a four track yard serviced by the adjoining CSX mainline railroad t1rack; 2) unloading infrastructure capable of servicing both train car gondolas and shipping containers; 3) a wash down/cleaning facility to clean unloaded cars prior to tranBferring back to CSX; and, 4) haul road infrastructure fr:om the CVP property to the adjoining Broadhurst Environmental Landfill (BEL). Work would be constructed with typical machinery such as backhoes, excavators, graders, dump trucks, etc. Work is planned to commence immediately upon successful issuance of all required permits.
No existing infrastructure curreintly exists within the existing CVP property. The applicant (CVP) currently has a valid Department of Army permit to discharge fill

material into 5.66 acres of wetland on the northern half of the existing property to construct a smaller rail yard which would be capable of receiving a much smaller volume of rail traffic. The applicant now indicates the volume has greatly increased to 100+ rail cars and the demand to process the increase in tonnage for transfer to the adjacent landfill (BEL) requires an increase in impacts to 24.68 acres of wetlands. Rail Yard Design Details:
1) Rail Yard: The CVP rail yard facility would consist of one lead track closest to the existing CSX mainline that is for storage of a full inbound 100-unit train, which is necessary to clear the entire train immediately off the mainline track. This clearance is necessary due to the use of this mainline by other freight trains and Amtrak passenger service trains. Inclusive of the lead track (rail that leads from the mainline switch to Track 1/Track 2 switch) the required length is 11, 737 linear feet of rail. Three service tracks (Tracks 2, 3 and 4) are required for train moving logistics, maintenance, and Municipal Solid Waste (MSW) unloading track. Specifically, the 9,009 foot long Track 2 is for storage of cleaned, outbound trains to be recollected by CSX. Track 3 is 6,456 linear feet long and is required as a rail car maintenance and storage track and MSW unloading track. Track 4 is 8,708 linear feet long and it would be the primary railcar unloading track which will be flanked by dump truck haul roads and staging areas, as well as a wash down/cleaning operation of the empty rail cars.
2) Unloading Facility: An unloading pad would be constructed around Tracks 3 and 4. The pad would be approximately 150 feet by 200 feet in size and would be large enough to accommodate at least two 65 foot long, gondola rail cars on each track and elevated unloading platform and equipment. Coal Combustion Residuals (CCR) material would be removed from the rail cars by excavators located above the rail cars on platforms and subsequently placed in dump trucks. MSW unloading would take place between tracks 2 and 3 where shipping containers would be removed from the train via a forklift and placed onto a specialized container carrier truck.
3) Cleaning Station: The CVP cleaning stations would consist of was water collection trays and pads under and next to the rail cars. These trays and pads would collect wash water and remaining waste residue, which would be treated as contact water. The contact water would be piped and pumped to three sequential settling tanks. Liquid from the settling tanks would be recycled to wash additional rail cars. Any water that cannot be reused would be transported to a publically owned treatment works facility.
The applicants stated purpose of the proposed project is to establish a rail yard complex that will accommodate CCR and other non-hazardous waste streams, including municipal solid waste that can be transported via rail to an approved lined (Subtitle D) landfill for proper disposal. The applicants stated need for the proposed

project is to provide a safe and economical method to transport any non-hazardous waste requiring proper disposal. The applicant did consider on-site and off-site alternatives. Applicant considered four off-site alternatives would require the purchase of property that was large enough to accommodate a four track ladder yard that measured 11,737 linear feet and was within 4-5 miles of BEL and direct main rail line access. Applicant indicates these alternatives would not be practicable because of logistical reasons and all had greater wetland impacts. The applicant considered four on-site alternatives that involved alternative build designs and layouts (as indicated on the enclosed maps/plans) in order to attempt avoiding and minimizing impacts to aquatic resources, as well as a “no action alternative”. These on-site alternative lay outs were all rejected for further consideration by the applicant because they had larger impacts to wetlands. In order to offset the unavoidable impacts to aquatic resources, the applicant proposes to purchase wetland mitigation credits from the Wilkinson-Oconee Wetland Mitigation Bank. The impact site is located within the primary service area of this bank.
BACKGROUND This Joint Public Notice announces a request for authorizations from both the U.S. Army Corps of Engineers and the State of Georgia. The applicant's proposed work may also require local governmental approval.
STATE OF GEORGIA Water Quality Certification: The Georgia Department of Natural Resources, Environmental Protection Division, intends to certify this project at the end of 30 days in accordance with the provisions of Section 401 of the Clean Water Act, which is required for a Federal Permit to conduct activity in, on, or adjacent to the waters of the State of Georgia. Copies of the application and supporting documents relative to a specific application will be available for review and copying at the office of the Georgia Department of Natural Resources, Environmental Protection Division, Watershed Protection Branch, 2 MLK Jr. Drive, Suite 418, Atlanta, Georgia 30334, during regular office hours. A copier machine is available for public use at a charge of 10 cents per page. All coastal projects are filed at our Brunswick office and will need to be requested from Mr. Bradley Smith at [email protected]. Any person who desires to comment, object, or request a public hearing relative to State Water Quality Certification must do so within 30 days of the State's receipt of application in writing and state the reasons or basis of objections or request for a hearing. The application can be

reviewed in the Savannah District, U.S. Army Corps of Engineers, Regulatory Division, 100 W. Oglethorpe Avenue, Savannah, Georgia 31401-3604. State-owned Property and Resources: The applicant may also require assent from the State of Georgia, which may be in the form of a license, easement, lease, permit or other appropriate instrument.
U.S. ARMY CORPS OF ENGINEERS The Savannah District must consider the purpose and the impacts of the applicant's proposed work, prior to a decision on issuance of a Department of the Army Permit. Cultural Resources Assessment: Review of the latest published version of the National Register of Historic Places indicates that no registered properties or properties listed as eligible for inclusion are located at the site or in the area affected by the proposed work. Presently unknown archaeological, scientific, prehistorical or historical data may be located at the site and could be affected by the proposed work. Endangered Species: Pursuant to Section 7(c) of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), we request information from the U.S. Department of the Interior, Fish and Wildlife Service, the U.S. Department of Commerce, National Oceanic and Atmospheric Administration, National Marine Fisheries Service; or, any other interested party, on whether any species listed or proposed for listing may be present in the area. Public Interest Review: The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. All factors, which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and in general, the needs and welfare of the people. Consideration of Public Comments: The U.S. Army Corps of Engineers is soliciting comments from the public; federal, state, and local agencies and officials; Native American Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the U.S. Army Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess

impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Application of Section 404(b)(1) Guidelines: The proposed activity involves the discharge of dredged or fill material into the waters of the United States. The Savannah District's evaluation of the impact of the activity on the public interest will include application of the guidelines promulgated by the Administrator, Environmental Protection Agency, under the authority of Section 404(b) of the Clean Water Act. Public Hearing: Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application for a Department of the Army permit. Requests for public hearings shall state, with particularity, the reasons for requesting a public hearing. The decision whether to hold a public hearing is at the discretion of the District Engineer, or his designated appointee, based on the need for additional substantial information necessary in evaluating the proposed project. Comment Period: Anyone wishing to comment on this application for a Department of the Army Permit should submit comments in writing to the Commander, U.S. Army Corps of Engineers, Savannah District, Attention: John W.
