Introduction
TheCaliforniaRegionalWaterQualityControlBoard,LahontanRegion(WaterBoard),asLeadAgencyundertheCaliforniaEnvironmentalQualityAct(CEQA)andStateCEQAGuidelines,haspreparedandcertifiedtheFinalEnvironmentalImpactReport(EIR)fortheComprehensiveGroundwaterCleanupStrategyforHistoricalChromiumDischargesfromPacificGas&ElectricCompany’s(PG&E’s)HinkleyCompressorStation(proposedproject)(SCH#2008011097).WhenaleadagencyapprovesaprojectandmakesfindingsonsignificanteffectsidentifiedinanEIR,itmustalsoadoptaprogramforreportingormonitoringmitigationmeasuresthatwereadoptedormadeconditionsofprojectapproval(PublicResourcesCode[PRC]Section21081.6[a];StateCEQAGuidelinesSections15091[d],15097).
CEQArequiresthemonitoringorreportingprogramtoensureimplementationofthemitigationmeasures,butCEQAdoesnotdefinetheterms“reporting”or“monitoring”anddoesnotspecifyhowthisshouldbedone,insteadleavingtheformat,contents,andcomplexityoftheprogramtotheinterpretationoftheleadagency.
Asleadagency,theWaterBoardhasdevelopedthisMitigationMonitoringandReportingProgram(MMRP)toensureimplementationofthemitigationmeasures.“Monitoring”istheongoingprocessofprojectoversighttoensurethemitigationmeasuresareimplemented,and“reporting”isthewrittenreviewofmitigationactivities.Tofacilitatemitigationmonitoringandreporting,thisMMRPincludesaworksheetforeachmitigationmeasurethatidentifies:1)Mitigationmeasure,2)Implementationtiming,3)Implementationresponsibility,4)Monitoringresponsibility,5)Monitoringrequirements,6)Frequencyofmonitoringorreporting,7)Standardsforcompletionorcompliance,and8)Agencyverificationofcompliance(“signoff”).AppendixAincludesaMonitoringandReportingRecordform,aswellasacompletedexample,wheremonitoringandreportingnotescanbedocumented.Somemitigationmeasuresrequireseparate,stand‐alonememorandaorreportsofverification,inwhichcasetheagency’sreceiptofthosereportscanbedocumented.
ThisMMRPincludesallmeasuresrequiredtoreducepotentiallysignificantenvironmentalimpactstoaless‐than‐significantlevel,aswellasmeasuresthatreduceimpactsbutnotnecessarilytoaless‐than‐significantlevel.

Mitigation Measure:
PG&Ewillimplementacomprehensiveprogramtodetermineresidencesandagriculturallandownerswhosewellsmaybeadverselyaffectedbyremedialactionsinrelationtochromiumplumeexpansion,remediationbyproducts,orgroundwaterdrawdown.
Implementationoftheprogramdescribedbelowisdesignedtoprovideadvancewarningbeforewatersupplywellimpairmentoccurs.Suchaprogramwillbedesignedtoeitherexpediteremediationbeforeawatersupplywellbecomesaffected,orprovidereliablewatersupplyfortheentiredurationofwellimpairmentduetoremedialactivities.ForthepurposesoftheprojectandthisEIR,watersupplywellsarethosethatprovidewaterforagricultural,domestic,orindustrialuses,andincludethosethatareusedforwatersupplyforfreshwaterinjections.WatersupplywellsdonotincludeIRZinjectionwellsormonitoringwells.
TheMitigationProgramwilldetermineall“actuallyaffected”andall“potentiallyaffected”wells(definedforeachsub‐mitigationmeasure,WTR‐MM‐2athrough2c,below).
Ifawatersupplywellisdeterminedtobean“actuallyaffected”well,thenPG&Ewillprovidealternativewatersupplymeetingtherequirementsdescribedbelow.
Ifawatersupplywellisdeterminedtobe“potentiallyaffected”well,thenPG&Ewilleither1)expediteremediationoftheconditionscausingthewelltobepotentiallyaffectedsuchthatactualimpactsdonotoccur;or2)providealternativewatersupply.IfPG&Echoosestoremediatethetriggeringcondition,itwillprovideafeasibilitystudyandplantotheWaterBoarddemonstratingfeasiblemeanstoavoidactuallyaffectinganydomesticoragriculturalwell.
Ifexpeditedremediationisnotfeasible,PG&Ewillprovidealternativewatersupplytoall“potentiallyaffected”wellspriortothewellsbeingactuallyaffectedbychromiumplumeexpansion,remedialbyproductsorsubstantialgroundwaterdrawdown.Becausethedefinitionofa“potentiallyaffected”wellincludesanywellthatisprojectedtobeaffectedinthenextyear,thisprovidesadequateadvancedwarningtofeasiblyprovidethealternativewatersupplybeforeimpactstosupplywellsoccur.

WaterQualityRequirementsforAlternativeWaterSupply
DomesticWells—Fordomesticwellsaffectedbyremedialactivities,thealternativewatersupplywillmeetthefollowingwaterqualityrequirementsforinteriorhouseholduses:
Forchromium,alternativewatersupplyshallbeequaltoorlessthanWaterBoardestablishedmaximumbackgroundlevels.
AlternativewatersupplywillmeetallprimaryandsecondaryMaximumContaminantLevelsforanyconstituent,otherthanchromium,thatisaffectedbyremedialactivitiesasdefinedinthismitigation.
Forconstituentsnotaffectedbyremedialactivities,thealternativewatersupplywillbeconsistentwithpre‐projectwaterquality.
Californiaandfederalrequirementsforpublicwatersystemswillapplyifthereplacementwatersupplyisdefinedasapublicwatersystem.Wheretherequirementsinthethreepriorbulletsareestricterthanpublicwatersystemrequirements,thenthemorerestrictiverequirementshallapply.1
DomesticWells—Fordomesticwellsaffectedbyremedialactivities,PG&Ewillprovidereplacementwaterforoutsidenon‐potablehouseholdusesinanamountandqualitysufficienttosupportexistingoutdoornon‐potablewateruses.Suchoutsidenon‐potableusesinclude,butarenotlimitedto,thefollowing:irrigationforlandscaping,gardening,provisionofwaterforpetsandlivestock,andwashing.
AgriculturalWells—PG&Ewillprovidereplacementwatersuitableforagriculturaluse(includinglivestock)toallpotentiallyaffectedagriculturalwells,asdefinedbelow,inanamountandqualitysufficienttosupportexistingagriculturaluse.
WaterSupplyOptions
InadvanceofimplementingtheprojectPG&Ewillprovideafeasibilitystudyandplantoprovidealternativewatersupplies.Provisionofalternativewatersuppliesmaybethroughoneormoreofthefollowingmethods:
DeeperWellOption—PG&Emayopttodrillsupplywellsdeeperifthedeeperwellisshowntohavesufficientwatersupplyyieldandtomeetthewaterqualityrequirements(definedabove)orbetreatabletosuchlevelsthroughon‐sitetreatmentprovidedbyPG&E.TheWaterBoardwillnotallowtheuseofdeeperwellsifthereisapotentialtospreadchromiumfromtheupperaquifertotheloweraquifer.AlthoughPG&EhasindicatedthatitisnolongerofferingthedeeperwelloptionaspartofthecurrentwholehousewaterreplacementprogramduetotheinabilitytomeettheWaterBoardorder’sstandardforCr[VI]of0.06ppb,theEIRmitigationstandardforCr[VI]isthemaximumbackgroundlevelofCr[VI](currently3.1ppb),thusthedeeperwelloptionremainsafeasibleoptionforEIRmitigation.
StorageTankandHauledWaterOption—PG&Emayopttoprovidewaterstoragetanksandhaulwatertotheaffectedlocationprovidedwatermeetsthewaterqualityrequirements(definedabove)

AlternativeSupplyOption—PG&Emayopttoprovideanalternativewatersupplythatdrawswaterfromasourceofwaterthatisnotaffectedbythechromiumplume,suchasacommunitywatersystem.Thisoptioncanonlybeprovidedsuchthatthewatersourceisnotprojectedtobeaffectedbyplumeexpansion,remedialbyproducts,orgroundwaterdrawdownforthelifetimeofremediationandcanmeetthewaterqualityrequirements.Thereareseveraldifferentoptionsforawatersupplysystemasfollows:
Useofwellsupgradientorotherwiseunaffectedbythechromiumplumeorremediation,combinedwithasystemofpipelinestowaterrecipients.Forexample,wellsneartheMojaveRiverareupgradientofthechromiumplume,areconsistentlyproductive,andcouldbepotentialcandidatesforawellsource.BasedonexperiencewithfreshwaterinjectionusingPG&E’swellssouthoftheCompressorStation,theremaybenaturally‐occurringconstituents,suchasarsenic,thatmightrequirepre‐treatmentbeforeprovidingasadrinkingwatersystem.
UseofaconnectiontoGoldenStateWaterCompanywhichcouldinvolveanestimated12‐milepipelinetotieintotheexistingwatertreatmentsystem.
UseofaconnectiontotheMWArechargepipelinelocatedalongCommunityBlvd.TheMWArechargepipelinederiveswaterfromtheCaliforniaaqueductandMWAwouldhavetoacquireadequaterightstowatertoprovideitaslocalwatersupply.Ifthiswaterisunabletomeetdrinkingwaterstandardsinitsoriginalstate,itmayrequiretreatmentbeforedistributionasawatersource.
AsdescribedbelowunderMitigationMeasureWTR‐MM‐5,asthespecificsofproposedwatersystemsaredeveloped,additionalproject‐levelCEQAanalysismaybenecessary.
BottledWaterOption—Ifrequestedbythehomeowner,PG&Emayprovidebottledwaterforconsumptiveuses.However,theprovisionofbottledwaterdoesnotmeetthefullintentofthismitigationbecausefullwellwaterreplacementwouldnotbeprovidedforallindoorandoutsidewateruses.Therefore,bottledwaterwouldneedtobesupplementedwithoneoftheotheroptionsdescribedabovetoprovidefullwellwaterreplacement.Ifthehomeowneronlywantsbottledwaterandnotfullwellwaterreplacementbytheproposedmethods,thenPG&EshalldocumentthistotheWaterBoard.
Regardingacommunitywatersystem,whiletechnicallyfeasible,theremaybechallengestoimplementingsuchasysteminHinkley.
AccordingtotheEPA,verysmallsystems(thoseserving25to500people)havethelargestnumberofviolations(mostlymonitoring/reportingviolations),andtheyexperienceonemaximumContaminantLevelViolationforevery80peopleserve,whichisthehighestratioofallsystem

TheCaliforniaDepartmentofPublicHealth(CDPH)hasregulatoryauthorityovercommunitywatersystems.UndertheprovisionsofSection116330oftheCaliforniaHealthandSafetyCode,CDPHhasdelegatedapprovalofsmallwatersystemswithlessthan200connectionstolocalprimaryagencies,whichinthiscasewouldbetheSanBernardinoCountyPublicHealthDepartment,DivisionofEnvironmentalHealthServices.Apermitapplicationforacommunitywatersystemwouldrequirecomprehensivetechnical,managerial,andfinancialassessmentstogainCDPH(ifmorethan200connections)orSanBernardinoCounty(iflessthan200connections)approval.Inordertobeapproved,smallwatersystemsmustdemonstratethattheycanbesustainableforthelongterm.
Anadditionalconcernisthelongleadtimetoimplementacommunitywatersystem,giventheapprovalandreviewprocess,andmoreextensiveconstructionactivitiesthanotheroptions,whichcouldtakeaslongas5years.
Hinkleyisdominatedbyruralresidences,manyofwhicharehighlydispersed,whichincreasestheamountofpiping,pumping,andassociatedcostandconstruction.
SomeindividualsinHinkleymaypreferacommunitywatersystem,butotherindividualsmayprefertheindependenceoftheirownwell,whichmaycomplicatetheimplementationofthisoption.
Monitoring
WaterQualityMonitoringandGroundwaterModeling
PG&EwillmonitorwaterqualityandmodelgroundwaterconditionsasrequiredbyMitigationMeasuresWTR‐MM‐2a,‐2b,and‐2cbelow.
Reporting
PG&EwillincorporatereportingonwatersupplyprogramimplementationintoannualreportingtotheWaterBoard.Reportingwillincludedescriptionsofallcompletedandplannedexpeditedremediationactionsandalternativewatersuppliesforthefollowingyear.

PG&Ewillconductaninitialmonitoringofdomesticandagriculturalwellswithinone‐miledowngradientorcross‐gradientofanyproposedin‐situremediationoragriculturaltreatmentunitcommencinguponapprovalofaneworderallowingexpandedremediation.Wherepossiblewithoutdelayingplannedremediationefforts,initialmonitoringwillbedonebeforeoperationofnewin‐situremediationareasandagriculturaltreatmentunitsforaminimumofoneyearonaquarterlybasis.Whereinitialmonitoringcannotbedoneforoneyearpriortooperationswithoutdelayingplannedremediationefforts,theninitialmonitoringcanbedoneconcurrentlywithcommencementofoperationsofnewin‐situremediationareasandagriculturaltreatmentunits.Constituentsanalyzedwillincludeallpotentialremedialactivitybyproductstoensurethatpre‐remediationwaterqualityisdefined,andthatdefinitionisapprovedbytheWaterBoard,foralldomesticandagriculturalwellsforwhichwellownersprovidepermissionforsampling.
PG&Ewillmonitorforremedialactivitybyproductsindomesticandagriculturalwells(wherevertheWaterBoarddeemsappropriate)withinone‐halfmiledowngradientandone‐quarter‐milecrossgradientofanyin‐situoragriculturaltreatmentunit,onatwice‐yearly(semi‐annual)basis.
Ifanydomesticoragriculturalwellsarefoundtobeactuallyaffectedbyremedialbyproducts(asdescribedabove),PG&EwillincreasemonitoringoftheaffectedwelltooncepermonthuntilalternatewatersupplyisprovidedtothesatisfactionoftheWaterBoard,afterwhichmonitoringcanbereducedtotwiceyearlyifnearbymonitoringwellsexist.

UntiltheWaterBoarddeterminesotherwise,PG&Ewilloperateandmaintaintheexistinggroundwaterextractionsystemtoachieveandmaintainhydrauliccapturewithintargetedareasonayear‐roundbasisconsistentwithCAOR6V‐2008‐0002A3,(LahontanRegionalWaterQualityControlBoard2012).TheWaterBoardmayperiodicallymodifyhydrauliccapturerequirementsasappropriatetoaddressremedialprioritiesovertime.
Agriculturaltreatmentunitsand/ortreatedwaterfromabove‐groundtreatmentfacilitiescanbeusedtoassistwithinwardhydraulicgradients,plumewaterbalance,andwaterqualityrestorationoftheaquifer.
PG&EwillimplementtheContingencyPlanforAUOperationsasdescribedintheFeasibilityStudyAddendumNo.3(PacificGasandElectricCompany2011c).

Everyyearfollowingpreparationoftheassessmentandapprovalofrestorationtimeframes,PG&Emustsubmitastatusreportofactionstorestoretheaquiferforbeneficialuses.Thestatusreportwilldescribeallactionstakenoverthecourseoftheyearandlistproposedactionsforimplementationduringthefollowingyear.Anupdatedschedulewillbeprovidedpredictingfulfillmentofaquiferrestoration.
Theassessmentdescribedabovecanincludeanalysisofthepotentialfornaturalattenuationtoreturnpre‐remedialreferenceconditionswithinanacceptabletimeframe,asdeterminedbytheWaterBoard.ThismeasureislimitedtoaddressingtheeffectsofPG&Eremedialactionsthatcausechangesabovepre‐remedialreferenceconditions.Itispossiblethatwaterqualityorgroundwaterbaselinelevelsmaybeaffectedbynon‐PG&Eactions(suchasotheragriculturalordairyactivitynotcontrolledbyPG&E)duringchromiumremediation.PG&Ewillonlyberesponsibletoremediatetheeffectsthatitcauses,notthosethatareduetotheactionsofotherthird‐parties.
Severaloptionsexistfortreatmentofagriculturaltreatmentbyproducts(TDS,nitrate,uraniumandotherradionuclides)ifnecessary:
AbovegroundTreatment:Treatmenttechnologies,includingreverseosmosis,electrochemicaltreatment(suchaselectrocoagulation),ionexchangeandpossiblyothermethodscanbeusedtoremoveTDS,nitrateanduraniumfromwater.
In‐SituRemediation:In‐situremediationusingcarbonamendment,likethatproposedinthehighconcentrationportionofthechromiumplume,hasbeenusedtoremediateelevateduraniumlevelsingroundwater.
Basin‐WideApproachtoTDSandNitrate:Abasin‐wideapproachtoreducingTDSandnitratecouldinvolvefallowingof,orchangesinfarmingpracticesatotheragriculturalfieldswithinthebasinthatarenotusedforagriculturalunittreatmentandatareadairies.Sincetheprojectwillincreaseagriculturalfieldsandproductionofanimalfeed,abasin‐wideapproachmayincludeanoptiontoimplementa“farmswap”toallowfallowingofotherlocalagriculturalfieldstoreduceTDSlevelsinthegroundwaterbasin.Theremayalsobeoptionstoimproveirrigationtechniquesbyusingdrag‐dripirrigationinsteadofbroadcastirrigationtechniques(thusloweringirrigationamountsandTDSloading),andcroprotation(whichmaylowerwaterdemand).TheremayalsobeoptionstoworkwithlocalHinkleydairiestolowerTDSandnitrateinputsthroughbettersitemanagementpracticesofmanureandrunoff.Participationbyowners/operatorsofotheragriculturallandanddairieswouldbevoluntaryandwouldbesubjecttoprivatenegotiationbetweenPG&Eandwillingparticipants.WhiletheseapproachescouldloweroverallloadingofTDSandnitrateintotheHinkleygroundwateraquifer,long‐termuseofagriculturaltreatmentunitsforchromiumtreatmentmaystillresultinlocalizedincreasesofTDSandnitrate.Ifabasin‐wideapproachisproposedbyPG&E,theWaterBoardshallrequirethefollowing:

Ifthebasin‐widebenefitaboveisdemonstratedtobeequaltoorgreaterthantheremedialimpairment,thentheWaterBoardwillrequiremaintenanceofthebasin‐wideactionsforthebenefitfortheHinkleyaquiferuntilallareassignificantlyimpairedbyTDSand/ornitrateduetoremedialactionsreturntopre‐remedialreferenceconditions.
Ifthebasin‐widebenefitaboveisdemonstratedtobeequaltoorgreaterthantheremedialimpairment,thentheWaterBoardmaydecidetonotrequirePG&EtospecificallyremediatelocalizedTDSand/ornitrateincreasesduetoremedialactionsprovidedthatallaffecteddomesticandagriculturalwellsareprovidedreplacementwater(perMitigationMeasureWTR‐MM‐2)untilpre‐remedialreferenceconditionsreturn.
Theimplementationofabasin‐wideapproachislimitedtotheprojectstudyareaforthisEIRatthistime.Ifinthefuture,PG&Eproposesbasin‐wideapproachesinvolvingfarmsoutsidetheprojectstudyarea,theWaterBoardwillneedtocomplywithCEQAandmayneedsupplementalCEQAevaluationpriortoinclusionofadditionalactionsoutsidethecurrentprojectstudyarea.

Agriculturaltreatmentwilllikelyreducenitratelevelsinthegroundwateraquiferoverall.However,ifgroundwaterisextractedfromanareaofhighernitrateconcentrationsandthentreatedinanareawithmuchlowernitrateconcentrations,itispossiblethatnitrateconcentrationscouldincreaseinthoselocalizedareas.TheWaterBoardwillincluderequirementsinthenewCAOand/orassociatedWDRsissuedfortheremediationasfollows:
GiventhatprioragriculturaltreatmentattheDesertViewDairyhasbeenshowntoreducenitratelevelssubstantially,itispossiblethatuseofirrigationwaterwithhighernitratelevelsmaynotresultinincreasednitratelevelsingroundwaterbeneathnewagriculturaltreatmentlocations.Inordertoconfirmifthisisoccurring,PG&Ewillmonitornitratelevelsforoneyearbeforecreatingnewagriculturaltreatmentunits(asfeasiblewithoutdelayingremediation),monitoratthestartofnewagriculturaltreatment,andcontinuemonitoringnitratelevelsduringimplementationofallnewagriculturaltreatmentunits.Ifnitratelevelsdonot:1)increaseabove10ppm(asN),or2)bymorethan10%(ifcurrentlevelsarealreadyabove10ppmasN),or3)bymorethan20%comparedtoexistinglevels(ifcurrentlevelsarelessthan10ppmasN)thennofurtheraction,otherthanmonitoring,willberequired.
Ifmonitoringindicatesthatnitratelevelsexceed10ppm(asN)orincreasingbymorethanthecriterianotedabove,thenPG&Ewillimplementacontingencyplanformanagingnitratelevelswhichmayincludesomecombinationofthefollowing:

PG&Ewillestimatethedurationofnitrateimpairmentofwaterqualityduetoremedialactivitiesandwillidentifyhowlongbeforeaffectedgroundwaternitratelevelswillreturntopre‐remedialreferenceconditions.Thedurationofnitrateimpairmentduetoremedialactivitiesmaypossiblyextendbeyondthetimenecessarytoremediatethechromiumplume;thegoalofremedialoperationinthelaterstagesofthecleanupshouldbetominimizethedurationofallimpacts.
TheWaterBoardwillretaintheauthoritytoapproveordenytemporaryimpairmentoftheaquiferduetonitratecontaminationandwillmakedeterminationsonacasebycasebasistakingintoaccountinformationonremedialprogress,theaffectedwellsandcommunity,thecertaintyofreturningaffectedgroundwatertopre‐remedialreferencewaterqualityconditionsovertimeandanyotherrelevantconsiderations.
Alternativelythismitigationmeasuremaybemetthroughbasin‐wideapproachesdescribedinMitigationMeasureWTR‐MM‐4.

Extractionwellsmaybeusedtointerceptelevatedconcentrationsofbyproductsandpreventdowngradientmigration.

Deserttortoisefoundwithintheconstructionareaswillbeeitherallowedtomovepassivelyawayorbephysicallyrelocatedbyanauthorizedhandlertoalocationoutofharm’sway,butwithintheirhomerange(definedbyUSFWS2009aslessthan1,000feet).Ifrelocatingdeserttortoise,atranslocationplanwillneedtobeapprovedbyCDFWandUSFWS.
