Incompatibility of Substance Abuse and Government Service

Alcohol and drug abuse are incompatible with military service (AR 600-85), and any use of illicit drugs is considered abuse. The irresponsible use of alcohol (i.e., drunk on duty or driving under the influence of alcohol) is considered abuse and is subject to judicial and/or nonjudicial action.

Drinking and Driving Punishment

The October 1998 ADAC and 12 October 1998, Stuttgarter Zeitung Nr. 235 magazines outlines. From .03 to .049 - BAC with suspect driving or involvement in an accident; Driver’s license taken away for at least 6 months:

7 points against your driver’s license: Fined from 30 to 45 times your daily salary.

From .05 to .079 - USAREUR driver’s license suspended 3 months. Stopped by a routine traffic stop 2 points against your driver’s license and 200 DM fine

From .08 to .109 - Driving banned for one month, 4 points against driver’s license: 500 DM Fine: Higher penalties for 2 nd and 3rd offenses. (BAC .08-.099 USAREUR driver’s license suspended for 6 months).

From .11 and above - You are considered absolutely unfit to drive a car. Driving privileges revoked for more than nine months if an accident 12 months. 7 Points against driving privileges. (BAC .10 and above USAREUR driver’s license suspended indefinitely. May request reinstatement after 1 year and successful completion of ADAPCP program).

From .16 and more - Punishment similar to .11 BAC and you may have to undergo a medical, psychological evaluation to determine whether you are fit to get a new driver’s license. At this BAC level you are also considered too inebriated to ride a bicycle.
